WORKSHOP OBJECTIVE

Islamic law promote Islamic property and land tenure conceptsas part of a sophisticated regulatory framework capable of beingimplemented concurrently with any other system of land tenures.

The Islamic property rights framework conceives of land as a sacred

trust but promotes individual ownership with a re-distributiveethos. Islamic perspectives of land administration can supportland rights initiatives in Muslim societies as well as provideuseful ideas for reforming any country’s land administration, landregistration, urban planning and environmental sustainability.

Principles of Islamic law (Shari’ah) are important and inuencesland rights and tenure systems in Muslim societies. Islamic lawcan be seen as an evolving, responsive and assimilating sphere ofcompeting ideologies and interests, though it is a site of strugglebetween conservatives and liberals. An appreciation of thedistinctive features and sources of Islamic law, its methodologiesand diversity in application and its dispute resolution mechanismswould contribute towards strategies aimed at enhancing security

of tenure.

Mohd Hairulazlan bin Ramlan holds a law degreeand Syariah degree from International IslamicUniversity Malaysia. His areas of study were IslamicLaw of Property, Probate and the Law of Succession,Islamic Legal System, Civil and Criminal Law,Public International Law, Transactions in IslamicLaw, Quranic Ayat and Hadith on Law, Usul al Fiqh

and Evidence and Procedure of Syariah Court. He has experienced inconducting Seminar on Faraid and Islamic Estate Planning. His job

experience includes preparing legal documentation of Islamic Willand Trust, administration of Muslim’s estate, and also conductingtraining for Islamic Estate Planner since 2006. His area of expertiseincludes Islamic Law of Inheritance, Hibah and Wakaf. His jobdescription also includes marketing and corporate relations. Hehas been dealing with several banks, nancial institutions, andgovernment agencies and conducting training to their employees.He is also involved in PERWARIS (Persatuan Perwarisan IslamMalaysia) in preparing paperwork for Faraid. He has also been aspeaker for radio talk show in IKIM.fm (91.5 MHz).

Dr Ainul Jaria Maidin  is an Associate Professor inlaw from the Ahmad Ibrahim Kulliyyah of Laws,International Islamic University Malaysia. She hasbeen teaching for the past 17 years. Prior to joiningthe University as a teaching staff, she has gainedexperience as an advocate and solicitor specialisingin property and corporate conveyancing. She has

carried out several consultancy projects for the Federal Departmentof Town and Country Planning, Malaysia, for the Ministry of Works

on the necessity of establishing a water commission for Malaysia. Atpresent she is a consultant for the Department of Land and Mines,Federal, Ministry of Natural Resources and Environment to reviewthe existing legal and institutional framework for improving theland administration delivery system. Her signicant publicationsare in areas relating land administration, land development andenvironmental aspects of land development. She has co-authoredtwo books, Principles of Malaysian Land Law and Strata Titles Lawand Procedure and her own book Malaysian Town and CountryPlanning Law is forthcoming by end of 2010.
