Ningaloo Marine Park (Classified Waters) Amendment Notice 2008

Made by the Minister for the Environment under section 62(1a) of the Act.

1. Citation

This notice is the Ningaloo Marine Park (Classified Waters) Amendment Notice 2008.

2. Commencement

This notice come into operation as follows: (a) clauses 1 and 2 — on the day on which this notice is

published in the Gazette; (b) the rest of the notice — on the day after that day.

3. The notice amended

The amendments in this notice are to the Ningaloo Marine Park (Classified Waters) Notice 2005.

4. Clause 4 amended

Clause 4 is amended by deleting “sanctuary zones” and inserting instead —

“ special purpose zones ”.

5. Clause 5 amended

(1) Clause 5 is amended as follows: (a) by deleting “recreational areas” and inserting instead — “ recreation areas ”; (b) by deleting “sanctuary areas” and inserting instead — “ recreation zones ”.

6. Clause 6A inserted

After clause 6 the following clause is inserted —

“ 6A. Declaration of activities incompatible with

conservation purposes of special purpose areas

For the purposes of section 13B(5)(c), (6)(c), (7)(c), (8)(c) and (9)(c) of the Act, the relevant activities referred to in Table 4 of the approved management plan which are designated as activities which are not permitted in a special purpose area are declared to be incompatible with the conservation purposes described in the approved management plan for the special purpose area classified as a special purpose area under clause 4 and referred to in Schedule 2 item 1.

”.

7. Schedule 1 amended

(1) Schedule 1 item 6(e) is deleted and the following paragraphs are inserted instead —

“ (e) from there extending east along latitude 21º58.4′S

to the high water mark; and (f) from there extending north along the high water

mark to the point described in paragraph (a). ”.

(2) Schedule 1 item 16 is amended in the heading by deleting “Gnaraloo” and inserting instead —

“ Gnarraloo ”.

8. Schedule 2 amended

(1) Schedule 2 item 1 is amended by inserting before “All” the subitem designation “(1)”.

(2) At the end of Schedule 2 item 1 the following subitem is inserted —

“ (2) The purpose of this special purpose area is conservation of

benthic habitats. ”.

(3) Schedule 2 item 2 is amended by inserting before “All” the subitem designation “(1)”.

State Superannuation Act 2000

State Superannuation Amendment Regulations (No. 3) 2008

Made by the Governor in Executive Council.

1. Citation

These regulations are the State Superannuation Amendment Regulations (No. 3) 2008.

2. Commencement

These regulations come into operation as follows: (a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette; (b) the rest of the regulations — on the day after that day.

3. The regulations amended

The amendments in these regulations are to the State Superannuation Regulations 2001.

4. Regulation 3 amended

Regulation 3(1) is amended as follows: (a) by inserting in the appropriate alphabetical positions —

“ “GESB Super (Retirement Access) Member” means

a member of the GESB Super (Retirement Access) Scheme;

“GESB Super (Retirement Access) Scheme” means the superannuation scheme established by regulation 200;

”; (b) by deleting the definitions of “Retirement Access

Member” and “Retirement Access Scheme”.

5. Regulation 93 amended Regulation 93(2) is repealed and the following subregulation is

inserted instead — “ (2) A Commonwealth payment cannot be accepted under

this regulation for a person who is a West State Super Member and not already a GESB Super Member.

”.

6. Regulation 200A inserted After regulation 200 the following regulation is inserted — “

200A. Scheme renamed as GESB Super (Retirement Access) Scheme

When this regulation comes into operation the superannuation scheme established by regulation 200 is renamed as the GESB Super (Retirement Access) Scheme.

”.

7. Regulation 204 repealed Regulation 204 is repealed.

8. Regulation 205 amended Regulation 205 is amended as follows: (a) by inserting before “A” the subregulation

designation “(1)”; (b) at the end of the regulation by inserting —

“ (2) The Board must not accept a contribution for a person

who is over 65 years of age if a regulated superannuation fund would be prevented by regulation 7.04 of the SIS Regulations from accepting the contribution.

”.

9. Regulation 208 amended Regulation 208(1)(a) is deleted.

10. Regulation 212 amended After regulation 212(2) the following subregulation is

inserted — “ (2A) The Board must ensure that for each readymade

investment plan established under regulation 106(1) there is a corresponding readymade investment plan established under this regulation with the same asset allocation.

”.

11. Regulation 214A inserted

After regulation 214 the following regulation is inserted — “

214A. Member who is also a GESB Super Member

(1) This regulation applies — (a) in relation to each GESB Super (Retirement

Access) Member who is also a GESB Super Member; and

(b) despite anything in regulation 214.

(2) If the Member’s selection under regulation 108 is a readymade investment plan (as defined in regulation 105), then the Member is taken to have selected under regulation 214(1) the readymade investment plan (as defined in regulation 211) with the same asset allocation as that of the plan selected under regulation 108.

(3) If the Member’s selection under regulation 108 is a personalised investment plan (as defined in regulation 105), then the Member is taken to have selected —

(a) under regulation 214(1), a personalised investment plan (as defined in regulation 211); and

(b) under regulation 214(1a), the same asset allocation as the Member has selected under regulation 108(2).

”.

12. Regulation 217 amended

After regulation 217(1) the following subregulations are inserted —

“ (1A) A request under subregulation (1)(a) may be made —

(a) in relation to so much of the Member’s account balance as constitutes an unrestricted non-preserved benefit, at any time; or

(b) in relation to so much of the Member’s account balance as constitutes a restricted non-preserved benefit, at any time after the Member has ceased to be a worker; or

(c) in relation to an eligible termination payment transferred to the GESB Super (Retirement Access) Scheme from a source other than a superannuation fund, at any time.

(1B) A request under subregulation (1)(b) may be made at any time.

”.

13. Regulation 219 amended Regulation 219(3) and (4) are repealed and the following

subregulations are inserted instead —

“ (3) If the Board —

(a) has been unable, after making reasonable enquires, to find an administrator or executor of the Member’s estate; or

(b) considers it desirable to do so in order to relieve or avoid hardship,

the Board may pay up to $25 000 of the benefit — (c) to one or more of the Member’s dependants in

proportions determined by the Board; or (d) if, after making reasonable enquiries, the Board

has been unable to find any dependant of the Member, to one or more other individuals in proportions determined by the Board.

(4) In this regulation — “dependant” has the same meaning as it has in

section 10 of the SIS Act. ”.

14. Regulation 219AA inserted After regulation 219 the following regulation is inserted in

Part 5 — “

219AA. Transfer to eligible rollover fund The Board may transfer the balance of a Member’s

retirement access account to an eligible rollover fund if that fund is permitted by the SIS Act to accept the benefit, whether or not the Member has requested the transfer.

”.

15. Various references to Scheme and Members amended (1) Each provision listed in the Table to this subregulation is

amended by deleting “Retirement Access Scheme” and inserting instead —

“ GESB Super (Retirement Access) Scheme ”.

GUIDELINES 2005 To amend the Director of Public Prosecutions Prosecution Policy and Guidelines 2005 accordance with the Director’s power to issue guidelines under section 24 of the Director of Public Prosecutions Act 1991 (WA) by:

Decision to Charge 1. By amending clause 5 by replacing “Western Australian Police Service (WAPS) with “Western Australia Police (WAP)” and by deleting all references in the guidelines to “WAPS” and replacing with “WAP”.

Other Relevant Public Interest Factors 2. By inserting after paragraph 32(d)—

“(da) securing appropriate convictions, so far as it is practicable, to compliment the operation of the Community Protection (Offender Reporting) Act 2004 and the Working with Children (Criminal Record Checking) Act 2004.”

Shire of Plantagenet LOCAL GOVERNMENT PROPERTY LOCAL LAW 2008

Under the powers conferred by the Local Government Act 1995 and under all other powers enabling it, the Council of the Shire of Plantagenet resolved on the 25 March 2008 to make the Shire of Plantagenet Local Government Property Local Law 2008. The Shire of York Local Government Property Local Law as published in the Government Gazette of 17 January 2001 is adopted as a local law of the Shire of Plantagenet, with the modifications as are here set out.

1. Preliminary (a) Wherever the “Shire of York” is mentioned in the local law substitute “Shire of Plantagenet”. (b) Wherever the “Liquor Licensing Act 1988” is mentioned substitute the “Liquor Control Act 1988”.

2. Definitions In Clause 1.2— (a) Delete the definition of “boat”. (b) In the definition of “building’— (i) after “;” in paragraph (a) add “and”. (ii) in paragraph (b) delete “; and” and substitute “.”. (iii) delete paragraph (c). (c) In the definition of “vehicle”— (i) after “;” in paragraph (c) add “and”. (ii) in paragraph (d) delete “; and” and substitute a “.”. (iii) delete paragraph (e).

3. Repeal In subclause (1) of clause 1.5, delete—

“The following local laws are repealed— Local Laws relating to—

York Memorial Swimming Pool published in the Government Gazette of 21 December 1966 as amended in Government Gazettes of 2 July 1982 and 5 May 1989; The Speed of Vehicles Driven on Land which is Vested in or under the Care, Control or Management of the Council of the Shire of York, published in the Government Gazette of 10 May 1974, as amended in the Government Gazette of 29 September 1989”

and substitute— “The Shire of Plantagenet (Local Government Act) Local Laws published in the Government Gazette on 15 July 1997 are repealed.”

4. Activities which may be pursued on specified local government property (a) In subclause (1) of clause 2.7— (i) delete paragraphs (e) and (f); and (ii) renumber paragraphs (g) to (j) inclusive as (e) to (h) respectively. (b) In paragraph (d) of subclause 2.7(2), delete “boats,” in the two places in which it occurs.

5. Activities which may be prohibited on specified local government property (a) In subclause (1) of clause 2.8— (i) delete paragraph (e); and (ii) renumber paragraphs (f) to (h) inclusive as (e) to (g) respectively. (b) In paragraph (c) of subclause 2.8(2), delete “boats,” in the two places in which it occurs.

6. Cancellation of permit In subclause (1) of clause 3.12, delete “clause 9.1” and substitute “clause 8.1”.

7. Activities needing a permit (a) In paragraph (a) of subclause 3.13(1), delete “subclause 3” and substitute “subclause (3)”. (b) In subparagraph (ii) of paragraph (g) of subclause 3.13(1), delete “stand” and substitute “stop”.

“Dogs to be kept under control 7.13 An authorised person may require the owner, or person in charge of a dog, to remove the dog from the saleyard if the authorised person considers that the dog is causing a nuisance or disrupting the sale.”

WATER AGENCIES (POWERS) ACT 1984 Shire of Nannup

WATER SUPPLY IMPROVEMENTS To improve the reliability of the Nannup—Bridgetown water supply scheme, the Water Corporation proposes to construct the following works— • 27km of 300mm diameter PVC pipe from the new Nannup bore site to the existing

Millstream Dam, complete with all fittings and connections. • Three transfer pump stations, one at the Nannup bore site and two at locations along the pipe

route. Each pump station will be a steel building approximately 8m x 5m x 5m high and having an environmental green finish.

• One 500kL balancing tank on the Nannup bore site and three 400kL balancing tanks at locations along the pipe route. Each tank will be of steel construction, approximately 12m-13m diameter and 4.5m high and having an environmental green finish. The tanks will be complete with access facilities, pipework, valves and fittings.

The location of the proposed works is in the Shire of Nannup as shown on the plan. The proposed works are scheduled to commence in May 2008 and will continue for a duration of approximately 8 months. The pipeline will be below ground PVC pipe and generally constructed using open trench excavation which will be backfilled and restored. Major road and river crossings will be constructed using trenchless technology.
