PPAA nullifi es award made by education ministry due to irregularities

President John Magufuli has said selfi shness was at the heart of reasons why local contractors fail to

win tenders for big-value public works projects, TPJ has learnt.

The president, who was address-ing the concerns of a construction

sector stakeholder in Dar es Sa-laam recently that local contractors were being sidelined when it came to major public works projects, said local contractors needed to see value in forming joint ventures as a necessary fi rst step in win-ning big construction contracts.

Dr. Magufuli took issue with

what he called selfi sh tendecies among local contractors, saying it was time they learnt to fol-low the trend of construction business elsewhere in the world where a project could be tak-en up by a joint venture made up of even seventeen fi rms.

“The problem with local con-tractors is that they never want to work together as a group,” the President told the gather-ing of businessmen and wom-en at the State House adding that they awere always quick to shift blame on to the authori-ties when they did not succeed.

Dr. Magufuli said he had ex-pected the implementation of the Mbutu Bridge project, which was undertaken by a joint ven-ture of local contractors, would inspire more such undertakings, but noted with concern that by the time the next big project came up, only four or fi ve mem-bers of the ten-member group remained to form a joint bid.

The Public Procure-ment Appeals Author-ity (PPAA) has nulli-fi ed the proposal of

the Ministry of Education, Sci-ence and Technology to award contract to Realcom Equip-ment (T) Ltd, TPJ has learnt.

This came to light after Nelco-tech Engineering Ltd, successfully challenged the ministry’s decision, following what they deemed to

be an unsatisfactory answer for their application for administra-tive review regarding the enti-ty’s act of specifying the delivery point as Dar es Salaam instead of Arusha, contrary to the delivery schedule of the tender document.

The company argued that the proposal to award contract to a competitor was based on price difference while its bid was found to be non responsive for failure to comply with delivery schedule

provided in the tender document, whereas delivery to Dar es Sa-laam instead of Arusha Technical College, while cheaper, was con-trary to the tender requirement.

On its part, the ministry argued that it never awarded the contract as contended by the appellant, but rather it issued the offi cial commu-nication of intention to award con-tract, which elicited complaints to it.

Ministry added that apart from the complaints, the donor ad-

vised that the proposed winner and the complainant bidder be asked to clarify their bids regard-ing destination, since the ten-der clearly stipulated that it was intended for Arusha Technical College and not Dar es Salaam.

The president said local contrac-tors’ fortunes have somehow im-proved in recent years following the provision requiring all road proj-ects using funds from Road Fund to be undertaken by local contractors.

However, the President also said he was aware that local con-tractors were being hampered by the need for guarantees and con-ceded that some areas within the Government could be to blame for some of the local contractors’ woes.

marekebisho ya Sheria ya Un-unuzi wa Umma ya Mwaka 2011. Mabadiliko haya yalilenga kati-ka kupunguza pamoja na mam-bo mengine, muda mrefu wa mi-chakato ya manunuzi, kuweka viwango kwa bidhaa na huduma mbalimbali zinazotumiwa na ser-ikali ikiwemo samani, majengo, steshenari za ofi si na hata magari.

Mabadiliko haya yalilenga pia kupunguza bei za bidhaa au hudu-ma zinazonunuliwa na serikali, ku-weka upendeleo kwa watoa hudu-ma wa ndani sambamba na bidhaa zinazozalishwa kwa kutumia ma-lighafi za hapa nchini. Marekebisho haya yameweka pia takwa maalum kwa halmashauri zote nchini kutenga asilimia thelethini ya baje-ti zao za manunuzi ya mwaka kwa ajili ya makundi maalum ya wana-wake, vijana, walemavu na wazee ili waweze kushiriki katika uchumi wa nchi sambamba na kutengene-za ajira. Sheria hii ilianza kutumi-ka rasmi tarehe 8 Julai 2016, baa-da ya Rais kutia saini sheria hiyo na kuruhusu kuanza kutumika.

Licha ya mabadiliko haya, kwa kuwa kanuni za manunuzi ya umma ndiyo hutoa maelezo ya namna ya kutumia sheria, ilii-lazimu serikali kufanya mareke-bisho ya Kanuni za Ununuzi wa Umma, Tangazo la Serikali Na. 446 la Mwaka 2013 ili ziende-nane na sheria iliyorekebishwa

na pia malengo ya serikali. Seri-kali, kupitia kwa Waziri mwenye dhamana ya Fedha, ilirekebisha kanuni hizo mara baada ya sheria kurekebishwa na tarehe 30 Disem-ba, 2016 kanuni hizo zilichapishwa kwenye Gazeti la Serikali, Na. 333.

Makala haya yanaeleza kwa kina marekebisho hayo katika kila nyanja iliyoguswa, ili kuwa-pa fursa watumiaji kujua namna bora ya kufanya ili kufi kia malen-go yaliyokusudiwa na Serikali .Kupunguza bei ya bidhaa au huduma zinazonunuliwa na Serikali

Kulikuwa na sababu nyingi ziliz-oifanya Serikali kutafakari hoja hii. Mathalani, bei ya bidhaa au hudu-ma katika soko zilitofautiana kwa kiasi kikubwa na bei ya bidhaa hiyo hiyo pale ilipouzwa kwenye taasisi ya Serikali. Hali hii ilijenga imani hasi ya wananchi kwa serikali yao na hivyo kuona kuwa serikalini ni mahali pa ufujaji wa rasilimali za umma ikiwemo rasilimali fedha.

Kwa kuliona hili, kifungu cha 9 (1) cha sheria kimerekebishwa, ambapo Mamlaka ya Udhibiti ya Manunuzi ya Umma (PPRA) ime-ongezewa majukumu ya kukusan-ya taarifa za bei kutoka kwenye taasisi mahsusi zinazopanga bei za bidhaa au huduma na kuhakiki-sha kwamba bei hiyo inaendana na bei ya soko kwa bidhaa au hudu-ma tajwa. Kwa mantiki hii, itaku-wa ni ukiukwaji wa sheria iwapo taasisi yoyote itanunua huduma au bidhaa kwa bei ya juu zaidi ya bei ya soko. Nibainishe wazi kuwa hata kama PPRA haitakuwa na

bei husika katika tovuti yake, msingi wa ununuzi wa bidhaa au huduma husika ni bei ya soko.

Licha ya msingi wa bei ya soko nilioutaja, katika kudhibiti ununuzi wa bidhaa au huduma kwa bei ya juu, sheria katika kifungu 65B imeruhusu taasisi nunuzi kununua bidhaa moja kwa moja kutoka kwa wazalishaji wa bidhaa husika au mawakala wake iwapo tu bei zao ni za chini kuliko bei ya soko.

Kwa kuruhusu ununuzi huu, ta-asisi nunuzi inaweza kupunguza gharama zilizokuwa zinawekwa na mawakala au madalali. Hata hivyo, nieleze wazi kuwa kwa mu-jibu wa kanuni mpya 149A ya ka-nuni zilizorekebishwa, ununuzi wa bidhaa moja kwa moja kutoka kwa wazalishaji hautahusisha bidhaa moja moja. Kanuni zimebainisha kwamba ili taasisi nunuzi ifanye ununuzi huu, ni sharti uwe ume-bainishwa kwenye mpango wake wa mwaka wa manunuzi na ueleze ni aina gani ya bidhaa zitanunuli-wa kwa mfumo huu. Pia, mpango huo ni lazima uwe umepata idhini ya bodi ya zabuni ya taasisi husika.

Licha ya kuweka taratibu hizo, sheria pia imebainisha hat-ua nyingine zitakazowezesha kupungua kwa bei za bidhaa na gharama za manunuzi. Hatua hizo ni hizi zifuatazo; i. Kuondoa uwekaji wa bei kwa bidhaa na huduma mtambuka

contract to the proposed winner. In determining the grounds of

the appeal, the Appeals Authori-ty observed that the appellant was indeed compliant to the set criteria in the tender document and the de-livery point. Furthermore, it was considered to be the lowest eval-uated bidder; and was proposed for award of contract and that the donor granted its “No Objection”. This entails that the appellant’s bid was substantially responsive,

PPAA observed further that the revocation of the appellant’s pro-posed award was not proper in law and that the proposed winner’s bid was non-responsive at the begin-ning but was later on made respon-sive by the entity through a clarifi-cation it had sought contrary to its own tender document and the law.

The Appeals Authority conclud-ed that the proposed winner did not meet the criterion regarding delivery destination and that there-

fore their bid was non-responsive, and that the proposal to award the contract was not justified.

Serikali ilikuwa inatumia gha-rama kubwa kununua bidhaa kutoka nje ya nchi hata kwa vitu ambavyo vinapatikana hapa nchi-ni. Kwa marekebisho yaliyofany-wa, Serikali inasisitiza matumizi

ya bidhaa ambazo malighafi yake hupatikana nchini kwa wingi. Kwa kufanya hivi, bei ya bidhaa zitapungua kwa kuwa ghara-ma kama za usafiri, kodi na bima ambazo zilikuwa zinabebeshwa

kwa bidhaa husika zitapungua.Kwa kuzingatia mambo yaliy-

otajwa, ni imani ya Serikali kuwa kwa kiwango kikubwa, bei ya bidhaa au huduma zinazotole-wa kwa Serikali, zitapungua.
