FROM:

Grant Uyeyama, Director of Development Planning Development Planning Department

MEETING DATE:

May 9, 2013

OWNER: Marie Halpern FILE(S): A093/13 Location:

160 Theodore Place, Thornhill Ward 5, Vicinity of Yonge Street and Steeles Avenue West

Proposal:

The Owner is requesting permission to maintain an unenclosed deck with the following variances:

Variance Proposed Required 1 Minimum rear yard setback to deck 5.0m 5.7m 2 Minimum rear yard setback to deck

stairs 4.4m 5.7m

Official Plan:

The subject lands are designated “Low Density Residential” by in-effect OPA #210 (Thornhill Community Plan). The subject lands are also designated “Low-Rise Residential” by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan.

Comments:

The Development Planning Department has no objections to the proposed variance. The deck, as-built, has little to no impact on adjacent properties, as the rear yard of the subject lands abut Hilda Avenue. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Recommendation:

The Development Planning Department supports Minor Variance Application A093/13.

Condition(s):

None.
