Other Planning Act Applications The land which is the subject in this application was also the subject of another application under the Planning Act: Minor Variance Application - A184/12 was approved June 28, 2012 as follows: 1. To permit a minimum southerly interior side yard setback of 1.82 m. 2. To permit a minimum northerly exterior side yard setback of 5.30 m. 3. To permit a maximum building height of 11.0 m to the top of the roof surface (flat roof).

A sketch is attached illustrating the request. This application will be heard by the Committee of Adjustment on the date and time shown below.

The Owner is requesting permission to construct a 2-storey single detached dwelling with the following variances:

Official Plan:

The subject lands are designated “Low Density Residential” by in-effect OPA #210 (Thornhill Community Plan), as amended by OPA #589. The subject lands are also designated “Low Rise Residential” by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board.

Comments:

On June 28, 2012, the Committee of Adjustment approved Minor Variance Application A184/12, on the subject lands, to permit the construction of a 2-storey single detached dwelling with the following variances:

1.82m 2.5m for a two-storey dwelling

2 Minimum northerly exterior side yard setback

5.30m 9.0m

3 Maximum building height

11.0m (to top of flat roof)

The current application also proposes to construct a 2-storey single detached dwelling at 29 Riverside Boulevard; however, the current application proposes a different layout of the subject lands and design of the proposed dwelling. The Owner is required to apply for Variances #1 and #2 again, as the attached sketch associated with the previous approval has changed, due to the change of the layout and design of the proposed dwelling. As was previously stated in Minor Variance Application

A184/12, the Development Planning Department has no concerns with Variances #1 and #2. The reduction of the southerly interior side yard setback (Variance #1) maintains sufficient space between the proposed dwelling and the existing dwelling to the south and maintains the intent of the Zoning By-law. The reduction of the northerly exterior side yard setback (Variance #2) is consistent with the location of the existing dwelling to be demolished. Also, the Development Planning Department has previously supported 11.0m maximum building heights to flat roofs in the R1V Old Village Residential Zone, and specifically did so for Minor Variance Application A184/12. The Department has no concerns with an increase in maximum building height to 11.10m, as this is a minor increase and meets the intent of the Zoning By-law. Further, Minor Variance Application A184/12 originally requested a Variance to permit a driveway width of 14.53m. The Development Planning Department had no concerns with this request; however, it was removed from the application at the meeting of the Committee of Adjustment on June 28, 2012. For the current application (A366/12), the increase in maximum driveway width (Variance #4) is only for a small portion of the proposed driveway, while the remainder of the proposed driveway is approximately 8.0 at a maximum. Based on the size of the lot and the total amount of soft landscaping being provided, the Development Planning Department has no objection to Variance #4. The Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Recommendation:

The Development Planning Department supports Minor Variance Application A366/12.

calculation. Comments: The Development/Transportation Engineering Department has no

objection to the proposal to permit a maximum driveway width of 13.40 metres within the subject property at the entry of the garage access point. The proposed widened driveway appears to be in conformity with the City’s grading criteria and does not appear to have any significant impact on the existing drainage pattern.

The Development/Transportation Engineering Department has no further comments and no objection to Minor Variance Application A366/12.
