Official Plan:
The subject lands are designated “Low Density Residential” by OPA #210 (Thornhill Community Plan). The subject lands are also designated “Low Rise Residential” and “Natural Area” by the City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the Official Plan.
Comments:
Consent Applications B039/11 and B040/11 were adjourned “Sine Die” at the Committee of Adjustment meeting of December 8, 2011, as the Owners were required to submit a Zoning By-law Amendment application to rezone a portion(s) of the subject lands. On October 30, 2012, City of Vaughan Council approved Zoning By-law Amendment File Z.12.013, to rezone the subject lands from R1V Old Village Residential Zone and OS1 Open Space Conservation Zone to R1 Residential Zone and OS1 Open Space Conservation Zone. The lands subject to consent applications B039/11 and B040/11 were rezoned to R1 Residential Zone. The implementing Zoning By-law has not been enacted. A condition of approval to Zoning By-law Amendment File Z.12.013 states that prior to the enactment of the implementing Zoning By-law, the Owner shall carry out an Archaeological Assessment of the entire property to the

satisfaction of the Vaughan Cultural Services Division. The Vaughan Cultural Services Division recently commented that there are no further concerns for impacts to archaeological resources for the subject property. This clears the condition stated above, and the Development Planning Department is currently preparing the implementing Zoning By-law for enactment. Further, the Development Planning Department has been advised by the Cultural Services Division that the ongoing Archaeological Assessment does not affect the consent applications and that they have no objection to the above-noted consent applications. Therefore, considering that the current applications are to facilitate a land exchange only, and not to create new residential lots, the Development Planning Department has no objection to supporting Consent Application B039/11 and B040/11, subject to the condition below.

The Development Planning Department supports Consent Applications B039/11 and B040/11, subject to the following condition:
