The Agencies/Contractors should fulfill the following requirements, (Part-I)

The Agency/Contractor should have valid license issued by the competent authority i.e. Labour Commissioner to carry out the above contract (Copy to be enclosed along with the request for tender form.)

The Agency/Contractor should have sufficient experience at least THREE YEARS in carrying out similar contracts, with at least ONE YEAR in providing services at Central/State Government, reputed private organizations. Copies of experience certificates to be enclosed.

EPF, ESI, Income Tax (latest), Service Tax Registration certificate copies to be enclosed.

Establishment Certificate issued by the concerned authority.

Tenders will be issued only to those who show proof of their Registrations mentioned above.

Only those tenders will be considered of Agencies/Contractor who fulfill the above requirements. Preference will be given to those who have provided/ are providing satisfactory services in Central/State Government organizations.

The tender should be on the specified form (non transferable) which may be obtained from the Gen Section, CSIR-NIO, Regional Centre, Lokhandwala Road, Four Bungalows, Andheri (W), Mumbai-400 053 between 9.30 am to 1.00pm on all working days from Monday to Friday except on holidays on payment of Rs.

GENERAL TERMS AND CONDITIONS

The tenderer submitting tender would be deemed to have inspected the premises, considered and accepted all the terms and conditions of contract. The areas of sweeping and cleaning indicated in the ANNEXURE “A” are purely approximate and likely to vary on either side up to any limit. NIO through Scientist-in-Charge, Mumbai reserves the right of altering the specifications of work of adding to or omitting any items of work or of having portions of the same carried out in the institute by others and such alterations and variations shall not violate this contract.

No verbal or written enquiries will be entertained in respect of acceptance or rejection of the tender. Any action on the part of the tenderer to influence any officer of the NIO or canvassing in any form shall make the tender liable for rejection. The NIO reserves the right to cancel or reject in full or part any or all tenders received, without assigning any reasons.

The contract will initially be for a period of ONE YEAR which can be extended for further period of one year based on the satisfactory performance of the initial period of the contract. The NIO may renew/extend the contract to such further period(s) as it may deem proper, having regard to the quality and manner of the contractor’s performance. The extension of the contract will be based on written request from the contractor.

The Contractor is required to have a valid Labour License issued by the Regional Labour Commissioner, Mumbai and comply with the provisions of the Contract Labour (Regulation and Abolition) Act 1970 and rules made there under.

Time is the essence of this contract. In case the contractor fails in fulfilling the obligations fully and in time, the NIO shall have the absolute right to take up the work at the Contractor’s cost and risk and recover any and all such expenses from the amounts due to him including Security Deposit. NIO shall have right to impose penalty commensurate with the fault and amount towards damages, if any, shall be recovered from the bill. In the event of the contractor failing to execute the annual housekeeping contract awarded to him for NIO premises in whole or in part, an alternative arrangement will be made by the NIO totally at the cost & risk of contractor besides suitable penalty.

The contractor should note that under no circumstances the contract is transferable i.e. on award of contract, he shall not transfer, assign or sublet the

contract. In the event of non compliance the contract will be immediately terminated entailing forfeiture of EMD.

The contractor/his representative should be available all the time at the work site during the course of time. He should report daily and take instructions on the register to be maintained by him from the officer appointed by Scientist-in-Charge, Mumbai . Schedule of work carried out in the areas of work as well as daily checks for housekeeping should be prepared and maintained and produced as and when required/asked by the office.

The contractor must have a well established office at Mumbai and the details such as complete address, telephone number, fax number, e-mail ID, Mob numbers, furnished to NIO, to enable the office to contact during emergency and as when required the authorized person . Further the contractor may note that all the correspondence posted to him at the address furnished to the office will be considered to have been delivered in time.

The contractor on award of contract should maintain a register furnishing the Name, Address, Character Certificate, Latest Photograph, Telephone Number of the contract personnel engaged by him and posted at NIO. This register completed in all respects should be handed over to the officer appointed by Scientist-in-Charge, Mumbai within 15 days from the date of award of contract. Any change in respect of the above details should be informed immediately to office.

The contractor should maintain duty register furnishing the details of attendance which is required to be signed by the workers deployed at NIO in the morning while reporting for duty and in the evening at the time of departing from office on all working days. The register should be made available for inspection to the authorized representative of the Scientist-in-Charge, Mumbai whenever called for.

The rates as quoted by the contractor in the tender based on which the

contract has been awarded will be applicable for entire period of the contract and the contractor will not make any claim for additional charges under any circumstances unless any revision is notified by the appropriate Government Authority in the Minimum rates of wages and other related statutory benefits.

The contractor shall declare in writing if he is related to any of the officer/employee of the institute with details of relationship thereof.

The contractor should see that the housekeeping staff will be present in the premises and carry out duty for entire eight hours excluding meals/tea hours in shifts to attend to the duties assigned by the office. They should maintain

highest discipline and behave politely in proper manner with the office staff and guests..

On award of contract, the contractor is required to execute all works as per detailed specifications, requirements and as directed by Scientist-in-Charge, Mumbai. He is required to guide the workers for proper execution of the work as per the directions of SIC, Mumbai. He is required to post authorized representative at the site who should be available on all days during the office hours to receive the instructions from SIC, Mumbai from time to time. Cleaning of rooms and bathrooms has to be ensured during the morning shift taking into account the convenience of the occupants. All such instructions both verbal/written given/received by the authorized representative on behalf of the contractor shall be deemed to have been received by the contractor within the scope of work order.

On award of contract the contractor will have to provide the required manpower with sound health within the age group of 18 years to 60 years. The personnel engaged and posted at NIO should have minimum literacy level i.e. VIII standard pass. They should be able to read/ talk/ understand Hindi and Marathi.

Verification report from the concerned police station in respect of all the workers deployed at NIO by the contractor should be submitted within a period of one month to the SIC, NIO, Mumbai from the day of award of contract. Similarly fitness certificate from RMO should be obtained and submitted to office.

The contractor is required to provide 2 (TWO) sets of uniform to the workers deployed at NIO (both male and female) which should be approved by NIO along with one pair of Safety Shoes and Gloves . Each worker should be issued I.D. Card which must be displayed by the worker while performing duty at the institute.

On award of contract if it is observed that the quality of work is not satisfactory , the contract may be terminated and security deposit forfeited. Also if the work undertaken is of inferior quality and proper action is not taken at the time of execution of work, the contractor shall remain liable to pay compensation to the institute for the inferior work as determined by NIO and in the event all payments have been released to the contractor for the work already undertaken, the amount towards compensation will be deducted from any sum due/security deposit/EMD to the contractor.

The contractor should ensure payment of wages to the workers deployed at NIO, strictly as per the provisions of the “Minimum Wages Act” – 1948 and adhere to the provisions of contract labour (Regulation & Abolition)_ Act 1970, contract labour (Regulation & Abolition) Rules 1971. The wages of the workers

should be credited to the respective individuals bank account/ or paid in cash in the presence of the representative from maintenence Committee, NIO nominated by the Scientist-in-Charge, R.C., NIO, Mumbai, on or before 7th of every month. In

the event of 7th is holiday, the wages should be disbursed on the previous day. Any worker remains absent on day of the wages are disbursed, the wages should be disbursed to the said worker on the day he/she reports for duty in the presence of the officer appointed by the office.

The monthly pre-receipted bill in duplicate drawn in favor of the Scientist-

in-Charge, NIO, Mumbai towards the labour provided should be submitted to office by 5th of every month for reimbursement along with EPF, ESI remittance challens specifying the names and number allotted to the labourers deputed at NIO by the concerned authorities commencing the second month of award of contract.

Service Tax and TDS and other statutory levies as applicable from time to time will be deducted from the monthly bills of the contractor.

In case of any delay in the part of the office in processing the monthly reimbursement bill, the contractor is required to ensure the payment of wages to his workers deployed at NIO by 7th of every month and there should be no linkage between the disbursement of wages and settlement of the bill submitted to the office.

The contractor shall furnish an Indemnity bond at his own cost to indemnify NIO against any claim arising out of or connected with this contract.

The contractor shall indemnify the institute against all claims out of action under the Employees State Insurance Act, Employees Provident Fund & Miscellaneous Provision Act, or the Workmen’s Compensation Act or any other Civil or Criminal Law in force in so far or they related to the contract personnel employed by him or claims arising out of such employment.

The contractor shall be solely responsible for all the accidents or injuries to the contract personnel employed by him and deployed at NIO. The NIO shall not be liable for any disability claims/compensation due to such accident/injury, death etc.

During the period of the agreement the contract may be terminated by the

Director, NIO if it is found that continuation of the contract is not in Public Interest by giving one calendar month’s notice and the contractor is not eligible for any compensation or claim in the event of such cancellation. Also if at any later date it is found that the documents submitted by the contractor at the time

of award of contract are manipulated/forged, the work order issued will be cancelled and security deposit will be forfeited without any claim whatsoever on NIO and the contractor is liable for action as appropriate under the extent laws.

In case the contractor is not interested in carrying on with the contract he is required to give a written notice to the office.

The contractor should note that during the tenure of the contract, water and electricity charges will be borne by NIO.

The contractor should note that the members of the contract personnel provided by him shall be the employees of the contractor and not of the NIO to any extent under any circumstances. He shall make payment to his labourers as per the Minimum Wages Act. In case of any default in this regard it shall be sole responsibility of the contractor to meet the obligations under the Act.

The contractor shall execute an agreement on stamp paper of required value for due performance of the contract which should be as per the approved format issued by CSIR and the same will be handed over on award of contract.

The contractor should be aware that the agreement executed by him shall not confer any tenancy right upon him at all times. He should be aware that the NIO premises along with all the other items is the sole property of the NIO/CSIR.

Contractor will be fully responsible for any accident or mishaps involving workers engaged by him and it is his responsibility for settlement/ pay claims made by these victims. The contractor shall indemnify the NIO from any claims arising out of accidents, disabilities of any nature, death arising out of provisions under law or any other nature in respect of all workers engaged by the contractor. The contractor will fully indemnify NIO against all claims in this regard.

It shall be the sole responsibility of the contractor to ensure security and safety of all the property and assets movable/ immovable of the institute while performing the jobs in the office premises. He should report promptly to the institute any theft or pilferage that takes place or any attempt is made to that effect. He is required to identify the workers to be deployed exclusively for the cleaning of all the toilets in the area mentioned. It is his responsibility for cleaning the toilets, as well as security of the fixtures/fittings handed over at the time of commencement of the contract. In the event of the fixtures/fittings are stolen/broken due to the manhandling by the contract workers , the contractor should report immediately in writing to the office. The NIO will be at liberty to recover the cost of the said item from the contractor or ask the contractor to replace the damaged item which should be of the same quality , under approval from the Scientist-in-Charge, NIO, Mumbai.

8 If there is any loss to the institute on account of dishonesty, connivance,

negligence on the part of his workers or due to any cause, the contractor shall make good on demand the loss to the institute.

The contractor shall abide by all laws and regulations and statutory obligations in force from time to time including labour laws and shall indemnify the NIO from any claims in this regard. It will be the sole responsibility of the contractor to abide by the provisions of Employment of Children Act, Worker’s Compensation Act, Employment and Labour / Contract Labour Act, Industrial Employment Act, Contract Labour (Regulations and Abolition Act) 1970, Minimum Wages Act, 1948, Employees Provident Fund, ESI Fund, any other act or legislation, which may govern the nature of the contract.

The personnel of contractor should observe only three closed holidays in a calendar year irrespective of number of the holidays observed by the in state. The 3 National closed holidays normally cover Republic Day, Independence Day and Mahatma Gandhi’s Birthday. The services of workers deployed by the contractor should be made available on all days i.e. six days in a week basis i.e. 26/27 days in a month irrespective of holidays except on Sundays. The contractor shall be fully responsible for providing leave benefits, weekly off, festival holidays etc., to the personnel deployed. When any of the worker deployed at NIO comes late or proceeds on leave or absents himself/herself it is the responsibility of the contractor to provide a suitable substitute.

The contractor shall be personally responsible for the conduct of his workers deployed in the institute and in case of any complaint against the workers the contractor will be under an obligation to change the worker concerned when instructed by SIC,NIO, Mumbai. The contractor & his staff shall follow the rules and regulations of the NIO in force and instructions issued from time –to-time. The NIO will be free to take action against the contractor for violating the same.

The Contractor is required to commence the work of Annual House Keeping (Scheduled employment of sweeping and cleaning) work of NIO premises with effect from the date of acceptance of award letter. In case it is found that the work has not commenced on the said date the NIO at its sole discretion may cancel the work order and the EMD/Security Deposit shall be forfeited without any further reference to the Contractor.

The contractor will have to furnish a Bank Guarantee from a Nationalized Bank for an amount equivalent to 10% of the annual contract value as security

which should be valid for a period of eighteen (18) months with effect from the date of award of contract The validity of the bank guarantee will be revalidated to the extended period of contract + 6 months and released to the contractor only

after satisfactory completion of the contract and after deducting the amount towards damages/missing items etc as reported to the office and submitting a proof that he has met with all the statutory obligations of the laborers deployed by him to the satisfaction of NIO Authorities.

Any compensation of disengagement on account of death, disability of any worker/s engaged by the contractor at NIO even though such disability manifests after the termination of the contract shall be contractor’s exclusive liability.

Except where otherwise provided, any dispute arising out of any terms and conditions of this agreement, the parties shall strive to find mutually acceptable solutions failing which all questions, disputes or differences arising under or in connection with this agreement shall be referred to the sole Arbitrator of a person to be nominated by the Director General, Council of Scientific & Industrial Research, New Delhi, whose decision shall be final and binding on both the parties. The venue of the arbitration shall be at New Delhi or such other place as may be decided by the arbitrator and arbitration shall be under the Arbitration Conciliation Act, 1996. The Arbitrator may from time to time enlarge the time for making and publishing the award.

The decision of the Director, NIO, regarding any disputes whatsoever arising out of the contract will be final and binding on the Contractor.

UNDERTAKING BY THE CONTRACTOR

I/We state that the site visit has been made in order to evaluate the level of service to be rendered, noted the minimum requirement of workers as per the estimate and quoted accordingly. Full manpower as detailed in NIT on daily basis for housekeeping, sweeping and cleaning the entire institute premises on rotation as per the given schedule or as per the instructions from Scientist-in-Charge, NIO, Mumbai. Substitute(s) will be provided as and when required. Extra labour if required /instructed by office will be provided during conference/meetings etc. Labour will be provided for shifting of furniture and equipment as and when required at no extra cost. I/we ensure complete supervision over the work and the workers deployed at NIO

I have obtained LABOUR LICENCE from the Labour Commissioner, Mumbai and comply with the statutory conditions on award of contract.

I/We state that the rate quoted by me/us only for LABOUR Charges as per the requirement of NIT

I/We know that no supply of any material consumable/non-consumable is involved from my/our side, and the same will be maintained/supplied by SIC, NIO, Mumbai. I/we will ensure filling of liquid soap in soap dispenser, providing odonil air purifier , toilet tissue paper in toilets, naphthalene balls in wash basins, urinal pots and other places as required. Emptying of dust bins, garbage and other waste material etc will be collected in polyethylene bags/substitute as approved by state government which will be disposed in the designated waste bins. Disposal of biomedical and non-biomedical waste at the required places and as per the instructions from the SIC, NIO, Mumbai will be undertaken.

I/we agree to effect the payment to the laborers deployed at NIO for housekeeping work on or before 7th of every month, as per the minimum wages act 1948 as notified by the Ministry of Labour, Government of India. I/we agree for the monthly bills payment on pro-rata reimbursement basis with remittance challans. I /we will discharge the obligations towards statutory remittances i.e. EPF, ESI, Bonus etc under the relevant acts/rules.

I/we agree that the laborers deputed at NIO will be entitled to three paid National Holidays i.e. Republic Day, Independence Day, and Mahatma Gandhi Jayanti

I/we agree to abide by General terms and conditions enclosed in the tender form.

SCOPE OF WORK

The institute is of international repute and is being visited by dignitaries both local and international in connection with the seminars and meeting organized at NIO. As such the aesthetic looks of the institute/laboratory and surrounding areas is to be maintained .

Keeping this in mind the contractor is required to clean the building premises and the surrounding areas and maintain hygienic and sanitary conditions. Cleaning of rooms and bathrooms has to be ensured during the morning shift taking into account the convenience of the occupants/users. Unoccupied rooms /premises should be cleaned everyday.

The workers deployed by the contractor should be highly disciplined and behave with the guests and staff members. The contractor should instruct them not to indulge in arguments with the staff members and guest.

The contractor should note that the laborers deployed for the housekeeping work should be present in the NIO premises for eight hours on all working days excluding meals/tea to carry out the duties assigned by the SIC, NIO, Mumbai

Housekeeping work to be attended daily.

The contractor /workers are required to undertake twice daily the sweeping and mopping of all the institute floors inclusive the lifts. Cleaning, removal of stains, cob webs etc from the walls, railings, corridors and lifts should be attended daily.

Cleaning of waste paper baskets, sanitation bin & spittoon set & disposing of garbage/refuse as directed. Cleaning glasses of windows, doors and partitions. Dusting of furniture, cupboards, phones, partition walls, doors, windows, notice boards, flower vases and pieces of decoration and other materials available in the institute.

Cleaning the common toilets and urinals regularly every two hours throughout the day with phenyl and other disinfectants. Suitable number of female cleaners should be deployed for cleaning the ladies toilets and gents toilets should be cleaned only by male cleaners. Porcelain fixtures are to cleaned with vim or other approved cleaner. Cleaning of vertical marble and mosaic surfaces. The rooms should be thoroughly cleaned with dettol and other approved disinfectant and the rooms should be sprayed with room fresheners/perfume to maintain pleasant odor.

Drains, sanitary fixtures, manholes and sewer lines should be attended/cleaned whenever required for smooth functioning. Bleaching powder,

hit, should be sprayed on regular basis to prevent breeding of flies, mosquitoes, lizards etc.

The contractor will provide heavy duty bags for collection and disposal of classified garbage from the institute premises as per the instruction of SIC, NIO, Mumbai.. The infectious and non infectious waste should be collected and disposed as directed by the SIC, NIO, Mumbai.

Note:

1. The rates should be quoted both in words and figures to avoid ambiguity. The amount in words to be written just below the respective amounts in figures under each item.

2. The rates should be quoted only for the items mentioned above i.e. for Sr. No. 1 to 4 and 6 & 8. No other rates to be quoted for any other item.

3. The % of Service charges as at Sr. No. 6 above may be quoted considering the fact that all the statutory liabilities and other benefits etc. will have to be provided by the contractor at his cost. It may please be noted that the cleaning material – consumables and non-consumable like equipments, implements, tools, and other day to day cleaning materials will be provided by the institute.

4. Where both Central and State Government have fixed the minimum rates of wages, the rates of the wages whichever are higher will be applicable. In that case the %of Service Charge as quoted by the Contractor as at Sr. No.6 above will remain the same and only the rates of Minimum Wages and other linked Statutory Liabilities as at Sr. No. 1 to 4 will undergo change and accordingly his service charge will be equivalent to same% at Sr. No. 6 However the tenderer is required to quote the rate fixed by the Central Government / State Government whichever is higher in the above format. Current notification of both Central Government / State Government may invariably be enclosed with price Bid.

5. If the Price Bid is not strictly as per the above format it is liable to be rejected.

Payment against item no 2,3 and 4 will be made to the contractor as at actual and on reimbursable basis as per the supporting receipts / challans, documents.
