REPORT OF SALE FOR 470 SECURITY BOULEVARD, GREEN BAY, WI 54313

Deborah J. Caruso, the chapter 7 trustee in this case (the “Trustee”), by counsel, pursuant

to Rule 6004(f)(1) of the Federal Rules of Bankruptcy Procedure (the “Bankruptcy Rules”),

reports as follows:

1. On December 21, 2016, the Court entered its Order Granting Trustee’s Motion to

Sell Real Estate Located in Green Bay, Wisconsin, Free and Clear of All Liens, Encumbrances,

Claims and Interests with a Prospective Purchaser Identified But Bids Considered (the “Sale

Order”) [Doc 804], authorizing the Trustee to sell real estate located at 470 Security Boulevard,

Green Bay, WI 54313 (the “Real Estate”) to Northeast Communications, Inc. for the total

purchase price of $1,141,000.00, free and clear of all liens, encumbrances, claims and interests.

2. On December 28, 2016, the sale of the Real Estate was completed, realizing gross

sale proceeds of $1,141,000.00. Attached and incorporated herein as Exhibit 1 is the Final ALTA

Settlement Statement – Combined (the “Closing Statement”).

3. As reflected in the Closing Statement, in addition to the purchase price of

$1,141,000.00, the Trustee received credits for the following: (a) $4,000.00 in relation to the

sale of the furniture located at the Real Estate;2 and (b) $338.79 for the proration of 2016 real

estate taxes. As reflected in the Closing Statement, the following was paid at closing:

(a) $41,219.96 to the Brown County (Wisconsin) Treasurer for 2016 real

estate taxes;

(b) $22,249.50 to A&G Realty Partners, LLC for commissions; and

(c) The remaining balance of $1,081,869.33 to Cerberus Business Finance,

LLC (“Cerberus”), in partial satisfaction of its prepetition and postpetition

secured claims.

4. After application of the $1,081,869.33 to Cerberus’ prepetition and postpetition

secured claims, the total outstanding balance owed to Cerberus as of December 28, 2016 is

approximately $22,030,278.24, excluding accrued and unpaid interest, fees, expenses or other

costs.

5. Pursuant to the Notice, Case Management and Administrative Procedures (the

“Case Management Procedures”) approved by this Court on October 4, 2016 [Doc 220], the

Trustee will serve a copy of this report on the following (as defined in the Case Management

Procedures): (a) the Core Group; (b) the Request for Notice List; and (c) the Appearance List.

6. The Trustee requests that this report be exempt from the notice and hearing

requirements under the Case Management Procedures and the requested relief be granted without

further notice or hearing.

WHEREFORE, the Trustee respectfully requests entry of an order approving this report,

approving the payments set forth herein, and granting the Trustee all other just and proper relief.

2 Tiger Capital Group, LLC, the Trustee’s Court-approved auctioneer with respect to tangible personal property, is

entitled to a 13.0% commission in connection with the sale of the furniture located at the Real Estate, or $520.00.
