  • VIEW - PROPOSED VACATION OF AN EASMENT/RESERVE ON THE EAST SIDE OF

    LOWELL AVENUE, CONCORD TOWNSHIP, ROSS COUNTY, OHIO

    At 12: 30 p. m., this date, as advertised, the commissioners conducted a public view of and easement/ reserve on the east side of LowellAvenue, Concord Township, Ross County, Ohio.

    Accompanying the commissioners were Ross County Engineer, Charlie Ortman, and; resident Melissa Mitchell, 120 Lowell Avenue,Frankfort, Ohio.

    Mr. Ortman indicated his concurrence with the adjacent property owners including the Adena School District were all in agreement thatthe easement/ reserve be vacated.

    FINAL HEARING - PROPSED VACATION OF AN EASMENT/RESERVE ON THE EAST

    SIDE OF LOWELL AVENUE, CONCORD TOWNSHIP, ROSS COUNTY OHIO

    At 2: 30 p. m., this date, a final hearing was held, as advertised, on the matter of the proposed vacation of an easement/ reserve on the eastside of Lowell Avenue, Concord Township, Ross County, Ohio.

    Present for the hearing was county engineer, Charlie Ortman.

    Mr. Corcoran reported that the commissioners viewed the easement/reserve earlier in the day, in the company of the county engineer, atwhich time the county engineer indicated his recommendation that the easement/ reserve be vacated.

    The commissioners noted receipt of the Concord Township Trustees had passed a resolution determining to proceed with closure of theeasement/ reserve, and provided a copy of confirmed petition with thirteen ( 13) signatures from residents of Raygan; s Meadow

    Subdivision, Frankfort, Ohio, indicating that they are unopposed to abandonment of the easement between 120 and 150 Lowell Avenueshould not be developed into a road and should be release to the joined parcels.

    No other comments were offered, and the hearing was closed at 2: 36 p.m.

    Mr. Neal moved the adoption of the following resolution:

    RESOLUTION NO. 20- 112

    WHEREAS, the Ross County Board of Commissioners, by its Resolution No. 20- 110, adopted February 24, 2020, noted the receipt ofa resolution from the Concord Township Trustees, advising that the said Board of Township Trustees passed a resolution at its meetingon February 4, 2020, determining to proceed with the vacation of an easement/reserve on the east side of Lowell Avenue, and requestingthat this easement/ reserve be abandoned; and

    WHEREAS, by the same Resolution No. 20- 110, the said Board of Commissioners determined that it would be for the publicconvenience and welfare to vacate the roadway in question, and set a view and final hearing thereon; and

    WHEREAS, on this date, a public view and final hearing were held on the matted of the proposed improvement, at which times thepublic was afforded the opportunity to commend for or against proceeding with the proposed easement/reserve vacation; now, therefore,be it

    RESOLVED, that the Board of Commissioners of Ross County, Ohio, hereby affirms its earlier finding that the proposed improvementwould be for the public convenience and welfare, and orders that the said roadway, the general route and termini of which are as follows,be and hereby is vacated according to law:

    Located in Raygan' s Meadow Subdivision, ( O. R. Vol. 15, Page 140), Concord Township, Ross County, Ohio; just west of theVillage of Frankfort; and northerly off of County Road 550; thence northeasterly 701. 23 feet, per subdivision plat, with LowellAvenue ( T.R. 1340) to a point in the centerline of Lowell Avenue; thence southeasterly 25 feet to the easterly right of way ofLowell Avenue, this being the true point of beginning of the proposed vacation; thence southeasterly, between Lots 21 and 22 ofabove said Raygan' s Meadow, 117. 82 feet, per subdivision plat, to the property line of Adena Local Board of Education ( O. R.Vol. 170, Page 1235); the line of Adena being the end of the proposed vacation.

    and, be it further

    RESOLVED, that the said easement/ reserve so vacated shall pass, in fee, to the abutting landowners thereof, as provided by law; and,be it further

    RESOLVED, that the Clerk of this Board of County Commissioner be and she hereby is directed to forward a copy of this resolution tothe Ross County Recorder, to be entered forthwith in the proper road records of the county.

    SUBJECTS BROUGHT BEFORE THE BOARD

    Mandy Way and Tom Johnson, Chillicothe Farmers' Market vendors, met with the commissioners to discuss starting earlier for the 2020farmers market season.

    Mr. Johnson said now that we have the Coronavirus ( COVID- 19) Pandemic, may cause us to revisit this at a later date. Our plan was

    since the school' s closed, we no longer can continue the winter market. We were hoping to start earlier at the Service Center location.We will need to talk to the Health Department and following their guidance.

    Charlie Ortman, county engineer, met with the commissioners to discuss a road that was never entered into the county road system.

    Mr. Ortman said that in reviewing our records, Adrian Drive in Arlington Estates Subdivision, had never been accepted as a road withinthe subdivision. The road appears to be as good condition. John Berry, resident on Adrian Drive, indicated that his property could beused for a school bus turn around if needed. We are requesting the clerk to check the commissioner' s records, and then we can proceedwith the appropriate action in accepting the road.

    Sheriff Lavender met with the commissioners to discuss the precautions being taken due to the Coronavirus Pandemic and the precautionsthe Governor of Ohio, Mike Dewine, is enacting across the State of Ohio. We will, when possible, cite and release individuals as much

    as possible to try to keep the number of individuals coming into our facility down. Effective immediately, we will be enactingrecommendations by the Ohio Department of Corrections. We will follow Entry Screening Process for Prevention of COVID- 19Transmission and will continue those guidelines until further notice.

    Jeffrey Marks, county prosecutor, met with the commissioners to discuss opening up the conference room within his office for thosechildren who need to come to work with their parents. Since Governor Dewine has closed the schools, some of our employees have no

    day care or baby sitter arranged since short notice had been given about the school closings.

    Mr. Neal said is there a waiver that can be put into place to not hold the county liable. Or better yet, let' s discourage those children fromcoming to work with their parents. Can we not work something else out? We are also concern with those children entering a publicbuilding.

    Eric Braunlin, County Risk Sharing Authority ( CORSA) agent met with the commissioners to review the CORSA renewal for this year.

    Mr. Braunlin said that the renewal meeting of was cancelled due to the State of Emergency declared by the Governor, and CORSA willconduct its renewal meeting on March 20, 2020, by webinar at 10: 00 a.m. The special meeting of the membership will also be postponedand will reschedule at a later date and time. I have also furnished you with the Risk Control Service Bulletin outlining an EmployerChecklist during this pandemic and we strongly recommend that employment actions should only be implemented based on local needsafter consulting with legal counsel. Of course there is also the CORSA Human Resources Helpline available and free of charge if you

    would have any questions. The reappraisal of all county owned buildings will start next Monday, March 23, 2020.

  • Frank Hettinger, Yellowbud Road resident, met with the commissioners with concerns about his private property and the neighborscontinuing to disrupt the neighborhood. Charlie Ortman, county engineer was also in attendance.

    Mr. Hettinger said that he seems to think the alley had been abandon and now is private property. The highway runs in back of hisproperty. I have contacted the Township Trustees concerning the abandon alley because it appears the neighbors continue to party andhave said threading comments to myself and wife. We have had the sheriff out numerous times for the disturbance and Deputy Corcoranwill not cite them. I would like something done about this.

    Mr. Ortman said that we can check into the records to see if the alley in question has been properly abandon and get back with you.

    Mr. Corcoran said that they would also check with the sheriff.

    Tom Spetnagel, Jr., county auditor and Steve Neal Jr., county treasurer, met with the commissioners to discuss the State of Emergencycalled by the Governor.

    We are concerned with the public entering the building. Do you have a plan that we can follow?

    Mr. Corcoran said at this time we do not have a plan. We are going to consult with the Health Department to direct us in what shouldbe done. We are as lost in this as everyone else. This comes as a complete surprise to all of us. We are contacting the Health Departmentfor a meeting this afternoon and will let you know when that meeting will start. Hoping for guidance from them.

    OTHER BUSINESS

    The county commissioners hosted a teleconference with the Ross County Health District Administer Ben Avery and Director of Nursing,Michele Long, to discuss with all elected officials the current status of the State of Emergency announced by the Governor. Those inattendance were: Tom Spetnagel Jr., county auditor; Sheriff Lavender and Chief Deputy T. J. Hollis; Kathy Dunn, county recorder;Charlie Ortman, county engineer; Jeff Marks, county prosecutor; Ben Trotter, county coroner and Mike Ratcliff, deputy county coroner;Ty Hinton, county clerk of courts; Steve Neal Jr., county treasurer; Judge Matt Schmidt, Common Pleas Court 42; Judge Mike Ater,Common Pleas Court 41; Judge Jeff Benson, Juvenile Probate Court; and Paul Minney, EMA director. Diane Carnes, president of theRepublican Party was also in attendance.

    Mr. Avery said that we are looking towards an evaluation by division what we need to continue services here at the health department.Those employees will be on Administrative Leave with pay indefinitely for protection of our staff. We are looking to limit the trafficcoming in as well. We understand that the Mayor will shut down to the public. We are trying to discourage the public from coming intoour office. This will be effective first thing tomorrow. Are you considering opening an Emergency Operations Center?

    Judge Benson said that I have 29 employees. Ohio Revised Code Section 124. 388 reads an appointing authority may place and employeeon administrative leave with pay in circumstances where the health or safety of an employee could be affected. I have two (2) employeesthat I will be putting on administrative leave with pay immediately.

    Judge Ater said that the court system will meet later today to come up with a plan for the courts. We will let you know of our decision.

    The clerk advised the Board that the scheduled District Advisory Committee meeting ( DAC) has been cancelled for Thursday, March19, 2020 due to the COVID- 19. The meeting will be rescheduled at a later date.

    REGULAR MEETING SCHEDULED FOR MARCH 18, 2020

    Since the outbreak of the Coronavirus pandemic, the commissioners find it necessary to hold a regular meeting on March 18, 2020,convening at 3: 00 p. m., to discuss in further detail plans for the courthouse closure to the public and to hear from other elected officialsof their plans for office closures. No appointments have been scheduled at this time for any other outside business.
