LYON COUNTY SHERIFF’S OFFICE ACTIVITY REPORT 1. On Sunday, October 3, 2021, around 5:30pm, Deputy Joe Witherspoon and Sheriff Brent White responded to a disturbance complaint on Cinder Lane, South of Suwanee. Upon arrival, they located a male subject outside of a residence who had been pepper-sprayed. A female was barricaded in the residence and eventually came out to speak with police. Following an investigation, it was determined the female subject had engaged in an argument with the male subject regarding another woman and subsequently assaulted him by way of pepper-spray. At the time of this incident, the male subject was out of custody on multiple bond conditions from previous incidents. One of the bond conditions was that he have no contact nor communication with the female subject. Both the male and female were arrested by Deputy Witherspoon and charged as follows: - Elisha D. Armstrong (40) of Kuttawa Charged with Assault-4 th Degree (minor injury) - Jacob H. Armstrong (37) of Kuttawa Charged with Contempt of Court/Resistance to Order J. Armstrong

LYON COUNTY SHERIFF’S OFFICE ACTIVITY REPORT

1. On Sunday, October 3, 2021, around 5:30pm, Deputy Joe Witherspoon and Sheriff Brent White responded to a disturbance complaint on Cinder Lane, South of Suwanee. Upon arrival, they located a male subject outside of a residence who had been pepper-sprayed. A female was barricaded in the residence and eventually came out to speak with police. Following an investigation, it was determined the female subject had engaged in an argument with the male subject regarding another woman and subsequently assaulted him by way of pepper-spray.

At the time of this incident, the male subject was out of custody on multiple bond conditions from previous incidents. One of the bond conditions was that he have no contact nor communication with the female subject. Both the male and female were arrested by Deputy Witherspoon and charged as follows:

- Elisha D. Armstrong (40) of KuttawaCharged with Assault-4th Degree (minor injury)

- Jacob H. Armstrong (37) of KuttawaCharged with Contempt of Court/Resistance to Order

Both subjects were lodged in the Crittenden County Detention Center.

2. On Tuesday, October 5, 2021, around 12:30pm, Sheriff White received a complaint from a victim who owned a vehicle which was parked at a residence in Lyon County. When the victim returned to her vehicle, she found it had a slashed tire, damage to the paint, and blunt force damage to the hood area.

On the same date around 4pm, Deputy Sam Adams and Sheriff White located and interviewed Michael J. McClanahan (29) of Kuttawa regarding this investigation. McClanahan was subsequently charged by Sheriff White with Criminal Mischief-1st Degree for the damage to the vehicle. The investigation is continuing.

3. On Wednesday, October 6, 2021, around 11am, Deputy Seth P’Pool charged Beverly A. Dukes (54) of Calvert City with a Lyon District Court bench warrant for Failure to Appear on a theft case from 2019. Dukes was lodged in the Crittenden County Detention Center.

4. On Thursday, October 7, 2021, around 4pm, Eddyville Police Officer Shannon Oliver observed a vehicle at an Eddyville business which had been the subject of a police BOLO on September 29, 2021, following a hit/run collision in Suwanee. Sheriff Brent White went to the local business and detained the driver who was confirmed to be the same one involved in the earlier collision. In addition, the vehicle was also confirmed to be the same one in the collision. The vehicle was impounded and the driver, identified as Garland E. Springs (63) of Eddyville, was detained and subsequently charged by Deputy Seth P’Pool with the following offenses:

- Leaving the Scene of an Accident/Failure to Render Aid or Assistance- Failure of Owner to Maintain Required Insurance-2nd Offense- Operating Vehicle with Expired Operator’s License- No Registration Receipt- No Registration Plate (canceled registration)

5. On Friday, October 8, 2021, around 2:15pm, Sheriff Brent White pulled up to the courthouse parking lot and observed a female subject approach a male subject with her car after the male exited his vehicle. The female subject was known by Sheriff White to be the subject of a court order restraining her from having any contact and communication with the male subject and she was also previously ordered to be at all times no closer than 500 feet away from the male.

Sheriff White confirmed the court order in the NCIC database and subsequently detained the female. Season L. Day (53) of Kuttawa was later arrested and charged with Violation of a Kentucky EPO/DVO. She was lodged in the Crittenden County Detention Center.

6. On Saturday, October 9, 2021, just after 12:30pm, the Lyon County Sheriff’s Office and Lyon County EMS were summoned to a residence on KY 295 North of Kuttawa where they located an elderly victim who was injured and found to be malnourished, dehydrated, and septic. The female victim had life-threatening injuries and was transported to Mercy Health – Lourdes Hospital in Paducah for treatment.

Deputies detained a male caregiver at the home and transported him to the Sheriff’s Office for further investigation. A search warrant affidavit was subsequently petitioned to District Court with the assistance of the Commonwealth Attorney’s Office. The search warrant was granted for the home and deputies later executed the warrant and seized multiple items of evidence. In addition, deputies documented numerous items by way of video and photographs related to the investigation.

Deputies identified William D. Hammonds (50) of Kuttawa as the victim’s only caregiver. Hammonds was arrested and charged with Wantonly Abusing or Neglecting an Adult. He was lodged in the Crittenden County Detention Center.

Unfortunately, on Sunday, October 10, 2021, just after 10am, the victim in this case succumbed to her injuries and died at Mercy Health hospital in Paducah. Her name is being withheld until next-of-kin can be properly notified.

A forensic autopsy of the victim is pending at the Western KY Regional Medical Examiner’s Office in Madisonville later this week. Charges pertaining to this incident and Mr. Hammonds will potentially be upgraded in the coming days/weeks. Hammonds remains lodged under a $50,000 cash bond in Marion.

Deputy Sam Adams is the lead investigator. He was assisted in this investigation by multiple deputies from the Sheriff’s Office, Lyon County EMS, KY Department for Community Based Services/Adult Protective Services Division, 56th Circuit Commonwealth Attorney’s Office, and the McCracken County Coroner’s Office.

7. On Saturday, October 9, 2021, Lyon County Sheriff’s Deputies were notified of a vehicular pursuit coming into Lyon County from Caldwell County on US 641. As Caldwell County law enforcement personnel pursued the vehicle into Lyon County, Deputies Seth P’Pool and Joe Witherspoon set up tire deflation devices on US 641. The vehicle being pursued, a 2012 Chevrolet Impala, impacted the devices and turned toward two on-coming vehicles as if he was going to intentionally collide with them. The driver then turned onto Depot Road, just North of Eddyville. The driver continued to flee on Depot Road before getting the vehicle stuck at the end of the dead-end road. Deputies quickly detained the male driver and a female passenger.

Further investigation revealed the male driver was a wanted fugitive and was the same person who was pursued by Sheriff White into Caldwell County on September 28th before the pursuit was turned over to Caldwell and Princeton law enforcement. He was identified as Jason A. McGregor (28) of Princeton. He was charged with multiple arrest warrants by Caldwell County law enforcement, and by Deputy Witherspoon with Fleeing/Evading Police-1st Degree, Wanton Endangerment-1st Degree (2 counts), Criminal Mischief-3rd Degree, Operating on a Suspended/Revoked License, and Possession of Marijuana. He was lodged in the Crittenden County Detention Center.

McGregor’s passenger identified as Kaitlyn B. Prowell (23) of Salem, was also arrested by Deputy Witherspoon after it was determined she was assisting the driver (McGregor) by way of utilizing a police scanner on her phone in order to evade law enforcement during the pursuit. Prowell was charged with Fleeing/Evading Police-1st Degree by Complicity, Possession of Marijuana, Possession of Drug Paraphernalia, Wanton Endangerment-1st Degree by Complicity (2 counts), and Wanton Endangerment-1st Degree (of a Police Officer / 4 counts). Prowell was lodged in the Crittenden County Detention Center.

8. On Sunday, October 10, 2021, at 1:15am, Deputies responded to a disturbance complaint on Magnolia Street in Kuttawa. Upon arrival, they located an injured victim who claimed a male subject had assaulted her. Deputy Joe Witherspoon located Gary E. Hopper (62) of Kuttawa. Hopper was arrested and charged with Assault-4th Degree (minor injury). He was lodged in the Crittenden County Detention Center.
