a couuaanicuon from F L Hoffmanresiding on East Gadsden street whichbrwgkt ap a flue question regardingthe settlement of paving bills and thematter was referred to the city attor-ney

and finance committee for adjust ¬

ment and recommendation Mr Hoff ¬

man wrote the council that two daysafter date of a special assessment no-tice

which he bad received he hadtendered the partial payment due tothe bond trustees and they had refusedto receive it on the ground that the i

time given for taking advantage of the i

payments had passed and the bondtrustees had no discretion in the matter but to deny the partial assessmentplan to the assessed party because I

payment was not made within thespecified time Mr Hoffman showedthat timing the notice he had receivedby the postmark of letter he waswithin the time for payment as gov-erning

called upon the council for reliefChairman Byshnell of the ond trus-tees informed the council that MrHoffman had stated facts In his com-munication

but that the bond trusteeshad no discretion in the matter but torefuse the partial payment plan whenpayments were past due as in this

I case even for a day The chairmansaid the city attorney had been eonsuited in the matter and he had givenan opinion to the effect that the coun ¬
