The 27th All India Conference of our

organisation held at Guntur has set a newdimension to our image, function and our future.

The manner the AIC itself was organised andconducted has no parallel in our history of All India

Conferences. The best atmosphere and ambiencemade available for the thousands of delegates and

visitors at Guntur enabled them to concentratemaximum with full attention over discussion on the

issues at hand. The leaders of various organisationswho were our special guests presented eloquent

and exemplary speeches that added newunderstanding to our strategy.

The issues that engaged our concentrationare the complex problems of Group C. Since we

met in the immediate background of implementationof 6th CPC recommendations, the issues involved

several aspects of pay commission. The justsubmitted Nataraja Murt i Committee

recommendations loaded with innumerablenegative recommendations was casting its dark

shadow. The serious issues of postal employeeslike Screening Committee, shortage of staff and

many other issues as well as the specific issuesof Postal Group C like Cadre Restructuring, TBOP,

System Administrators, Marketing Executives,PO&RMS Accountants etc have also making an

impact on the discussions in the AIC.

The battle lines should be drawn and proper

strategy shall have to be finalised if one has tosurmount the difficulties and succeed in all the

above issues. The AIC in the immediate backgroundof NFPE Convention held in the same venue has

drawn the policy and programme and strategy tounite all the postal employees behind a common

Sectional Charter of Demands of Postal Employeesincluding GDS as well as behind a common Charter

of Demands of all CG Employees.

The Conference debated at length and

arrived the understanding that a united struggle ofall sections of postal employees alone can ensure

further growth and progress. The Conferencewitnessed a special night session of System

Administrators that consolidated the demands ofthis section of employees. The AIC has paved way

INTO THE FUTURE WITH REPOSED CONFIDENCE

to explore the possibility of merging the cadre of

PO&RMS Accountants with the organisedaccounts to end the discrimination continuing over

decades and also for ensuring better promotionalavenues to them. The AIC endorsed the cadre

restructuring proposals of the CHQ to be takenforward to ensure better promotional aspects in

addition to 3 ACP. The exemption of ScreeningCommittee and filling up of all vacant posts will

continue to be our major issue to be tackled withtop most priority.

The AIC decided the strategy that we aspart of NFPE and Confederation will strive to forge

stronger links with the entirety of CG Employeesorganisations to carry forward the struggle for

improvement of recommendations of 6th CPC inthe immediate future. Our strategy also includes

that we establish larger unity of postal employeesunder the banner of Postal JCA for realising the

issues of Postal Employees and forge ahead inthe path of united action. The AIC also made it

clear that through these united action we have toensure that no adverse recommendations of

Nataraja Murti Committee could be implementedby the Government but the recommendations are

improved and modified.

Comrades! We the Postal Group C is the

largest organisation of NFPE and our role thereforeare paramount in playing the role of leadership in

uniting and leading the joint movement of Postaland CG Employees. The AIC has set the agenda

for building a stronger organisation to play thisdue role. The outcome of the AIC including the

over all appreciation of the delegates towards theeffective functioning of CHQ and the unanimous

adoption of all resolutions and Biennial Report andAccounts and the election of office bearers that

witnessed unanimous return of the outgoing teamonce again - all show the enormous confidence

reposed in the leadership of our organisation byour rank and file.

The elected team of office bearers of theCHQ will keep the stupendous task before us and

will continue its function best to keep theconfidence reposed on them.

General Secretary’s Desk

The historic 27th All India conference of ourunion was held from 30.11.08 to 3.12.08 at Guntur inAndhra Pradesh under the president ship of Com. M.Krishnan, President, CHQ. The reception committeeheaded by Com R. Sivannarayana, Asst GeneralSecretary and his team has made excellentarrangements for the conference, catering and theaccommodation for the delegates. This is the first timein the history of the All India conference that morethan 2000 visitors attended the conference besidesthe entitled delegates around 875.The wholeconference was held in a big auditorium which is fullyair-conditioned that provided very comfortableatmosphere to the delegates for the deliberations inthe conference. We have never seen in the past suchkind of arrangements for the AIC and the receptioncommittee deserves all appreciations.

The AIC commenced its proceedings with theFlag hoisting at 10.45 hours on 30.11.08. The nationalflag was hoisted by Com. B. G. Tamhankar, ExPresident, NFPE and CHQ. Com D. K. Rahate,President NFPE and Com M. Krishnan, President,CHQ hoisted the NFPE and the AIPEU Group C flagsrespectively amidst slogans renting the air. Floraltributes were paid to the martyr column beforecommencing the house. The cultural group performedprogrammes in an admirable way.

The inaugural session and the open sessionwas held at 1100 hours on 30.11.08 and Com M.Krishnan, president presided the meeting. Sri RaaviVenkataramana, MLA, Prathipadu and also theChairman of the Reception committee presented thewelcome address. Com Nilotpal Basu, Ex M.Pdelivered the inaugural address and dealt all the issuesconfronting the working class and role of the Postalworkers in the continuous fight against the onslaughtsof Globalization policies practiced by the Government.

Prof. Haragopal Reddy, Vice Chancellor of theAcharya Nagarjuna University delivered his oration ina magnificent manner detailing the problems of theworkers and their responsibilities. Com K. K. N. Kutty,Secretary General, Confederation of CentralGovernment employees and workers elaborated indetail about the denial of minimum wage by the SixthCPC and the need to launch serious programmesseeking the modification of the recommendations andensure better service condition to the CG employees.

Com K. Ragavendran, Secretary General,NFPE dealt all issues confronting the Postalemployees and explained the need for a united

indefinite strike from 6.1.2009 in order to safeguardthe interest of the GDS employees and also to achievethe Cadre review and three promotions. Com S. S.Mahadevaiah, General Secretary, AIPEDE union, ComP. Suresh, General Secretary, R4 addressed the opensession. Com R. Sivannarayana, General Secretary,Reception committee and AGS delivered vote ofthanks.

Rajanayagam, General Secretary, PostalAccounts, Com Asit Das, General Secretary, All IndiaSBCO employees association addressed during thesubject committee and greeted the conference.

Com K. Venugopal, General Secretary , AllIndia Insurance employees association orated on thesubject of THE CASCADING EFFECTS OF GLOBALFINANCIAL CRISIS on 1.12.08 evening which is themasterpiece of the deliberation in the conference. Hedealt in detail about the globalization, liberalization,privatization and the present serious global financialcrisis. His lecture is really exemplary and educativeone to budding unionists.

In the AIC, all Circle Secretaries and 46Delegates from all the circles participated in the livelydiscussions on the topic of Organizational Review.There was an all-round appreciation from the delegateson the functioning of the CHQ and assured theirunstinted cooperation for the future better functioningof the CHQ. The following resolutions printed in thebiennial report were placed and approved in the augustconference.1. Policy and Programme.2. Shortage of staff and allied problems like filling of

vacant posts, scrapping of screening committeeand augmentation of adequate posts for newservices.

3. Po & RMS Accountants.4. Promotional issues.5. Systems Administrators & problems.6. One time absorption of approved RRR candidates.7. Counting of past services as RTP for promotion.8. Monetary recovery and disciplinary action on

contributory negligence factors.9. Marketing Executives.10. Upward revision of MPCM allowance.11. Upward revision of Cash handling allowances to

Treasurers of post offices.

Unjust activities in the name of Business post.Apart from the above, several resolutions proposed bythe delegates were resolved on various issues. TheGeneral Secretary assured appropriate action on allthese resolutions. The redrafting of the Constitutionexercised by the committee was placed before thehouse and it was approved after some corrections andmodifications. The subscriptions from membershiphave been raised from Rs.10 to Rs.30 per month. Thedetails of the draft constitution will be printed on itsapproval by the department.

Comrade D. Sivagurunathan the victimizedformer P4 divisional secretary of Chennai City NorthDivision was felicitated by the CHQ President andGeneral Secretary in the Conference. He was donated1000/- by the P3 divisional union of Warangal.

The biennial report and audited accounts wereunanimously approved by the delegates and thereafterthe election of office bearers were held unanimously.The following office bearers were elected for the ensuingterm.

The AIC places its appreciations on recordsof the outgoing office bearers Com. Subhash Sharma,Com. Sumitra Goswami, Com. Pannerselvam & Com.L.P. Saikia.

We record our appreciations to the receptioncommittee of the 27th AIC headed by com R.Sivannarayana, AGS for the excellent arrangementsthat made the conference a historical and successfulone. Everyone admired the arrangements andhospitality of the reception committee and thisconference had its place in the milestone in the historyof our movement. We thank again all the comrades ofthe reception committee and record our sincere andabundant thanks.

The future is full of struggles for the bettermentof postal employees in general and the Postal GroupC in particular. The CHQ is fully confident that with the

total cooperation of all circles, divisions and branches,the huge task will be carried out to the satisfaction ofall members. We assure that we shall strive hard tolive up to the expectation s our comrades in the rankand file at grass root level and march ahead.

A SAD DEMISECOM. JASWANT, DELEGATE, SOLAN DIED WHILERETURNING FROM AIC

Com. Jaswant Sharma, Delegate from SolanDivision in Himachal Pradesh Circle died whilereturning from Guntur after attending the AIC due toheart attack. He was admitted at Nagpur but couldnot be saved. Himachal Comrades took much painto take the mortal to Solan from Nagpur. Com.Jaswant was only 25 years old. He was survived withhis parent and brothers. We pay our respectfulhomage to the departed Comrade. We dip our bannerin the memory of the young departed leader ofHimachal Circle.

INDEFINITE STRIKE CALL BY GDS UNION FROM17.12.08 EXTEND ALL SOLIDARITY ACTION BYPARTICIPATING STRIKE

The General Secretary, AIPEDE Union hasgiven notice to the Department for the indefinite striketo be commenced from 17.12.2008 on ten charters ofdemands particularly seeking modifications in theretrograde recommendations of the Natarajamurthycommittee report.

There is no second opinion about the needfor a united struggle against the GDS Committee'snegative and most in human recommendations. Boththe Federations and All India Unions including the GDSunions which met twice during the first week ofNovember'08 decided to launch indefinite actiondemanding the modification of retrograderecommendations of the GDS report, along with regulardepartmental employees demands like Exempting thePostal department from the purview of screeningcommittee, Cadre review, Grant of three ACP withoutrestrictions and other sectional demands.

Accordingly a convention was organized bythe NFPE inviting all the Circle Secretaries and CHQoffice bearers of all the affiliated unions and also theGDS union at Guntur on 29.11.08 and it was decidedunanimously to issue Strike notice on 19.12.08 forthe indefinite strike from 06.01.08 in case if thedemands are not settled through negotiations. It wasdecided to give utmost important in resolving the GDSdemands in the strike charter.

But to our shock and surprise, Com. S. S.Mahadevaiah during his oration informed the AIC ofour union held at Guntur from 30.11.08 to 03.12.08that he has decided to issue strike notice alone andseeking the cooperation of others for solidarity actions.Accordingly he issued strike notice on 02.12.08. All

the General Secretaries of other unions of NFPE whowere attending our AIC could not issue any strike noticesince every one decides to launch the indefinite strikeprogramme from 06.01.09 as decided in the NFPEconvention held on 29.11.08.

We do not want to say anything about thedecision of General Secretary AIPEDE Union. Beingthe General Secretary of that Union, he is having allprerogative rights to decide his own programme &action. We have no right to insist him to join theprogramme decided by all the unions under NFPEwhich is also assured to be endorsed by the FNPOand its affiliates.

The General Secretary, GDS union did nothear the requests of any one to postpone the strike toJan 08 for a united programme under the banner ofJCA with FNPO. He decided to carry out his programmeas he notified but requesting all the unions to extendsolidarity programme. Therefore the Federal secretariatmet on 9.12.08 has decided to extend solidarityprogramme with GDS union by direct participation inthe proposed strike from 17.12.08. The NFPE and allaffiliates exhibited their commitments towards theproblems of the GDS knowing very well that it will bevery difficult for them to focus the departmentalemployees' issues in the present juncture while

participating in the strike from 17.12.08 launched bythe GDS union without any strike notice and not placingtheir demands therein in the charter of demands.

As a responsible affiliate of NFPE and alsohaving close association and fraternity with GDS for along, we took this decision. When the GDS union isnot ready for postponement of strike for a united andgrand struggle up to 6.1.09 by organizing the rankand file for a strong action, We have no other alternateexcept to endorse the GDS struggle since we don'twant to remain as spectator or onlooker of thedevelopments.

Let us also jump into action extendingsolidarity action by participating the strike. We cannotallow the GDS employees are isolated on any accountand subjected for any victimization. The joint circularof NFPE and its affiliated unions and also the letteraddressed to department are enclosed along with thecircular .Even though the time before us is very short,We fervently appeal all Division/Branch secretaries torise up to the occasion and ensure full participation ofour comrades in the strike from 17.12.08 in theirbranches and extend solidarity support to the strikingGDS comrades.Dated : 9.1.2008 K.V. 1. The world capitalist economy is gripped in a

severe crisis. The allround recession that engulfed the

Americian economy has badly effected not only the

Americans but has spread across the world affecting

the employment and economic conditions of millions

of people. The US- sponsored and IMF-World Bank-

WTO dictated globalisation policies have proved to be

an utter failure through out the world. The gap between

the haves and have-nots, unemployment and poverty

has increased manifold and has reached an alarming

situation. Privatisation of the Government departments

and public sector undertakings, removal of all barriers

for facilitating free movement of finance capital and

deregulation of market, drastic cut in the subsidies

and other welfare measures has resulted in the

complete collapse of the industrial and agricultural

sectors. The life of the down-drodden, oppressed and

working class have become miserable.

The struggle against the imperialist

globalisation policies and the military aggression of

the US on the sovereign nations are intensifying day

by day not only in the third world countries but also in

the developed capitalist countries. Majority of the Latin

American countries have discarded the US-hegemony

and the imperialist globalisation policies. The socialist

countries are pursuing their own different path of

development. Socialism has emerged as the only

alternative to the imperialist globalisation. The

advocates of globalisation who has opposed the control

of Governments over the economy and finance capital

are now declaring bail-out packages by pumping more

and more government money to the financial sector to

save it from total collapse. Those who have preached

the thesis of "minimum government" now want "more

government' control over economy and are resorting

to nationalisation instead of privatisation.

This 27th AIC of AIPEU Grop-C strongly condemn,

the imperialialist globalisation policies and extend its

whole hearted support and solidarity to the working

class and the millions of people who are organising

militant struggle throughout the world against the US-

sponsored globalisation policies.

2. The former NDA Government and the present

UPA Government are vigourously pursuing the policy

of liberatisation, globalisation and privatisation. The

working class of India have put up strong resistance

against these policies. It is because of the intensive

struggle conducted by the Trade Unions and service

organisations in each sector and also jointly under

the banner of National platform of Mass organisations,

the Government could not push through its reforms in

the banking, insurance, pension and other sectors.

When compared to the developed capitalist countries,

the impact of worldwide recession that originated from

the US is less in India, only because of the fact that

struggle of the Indian working class has saved the

public sector undertakings including Finacial sector

by preventing the Government from whole-sale

privatisation. Instead of learning lessons from the

failure of the imperialist globalisation policies, UPA

Government is still pursuing the same policies. The

working class of India has to further intensify the

resitance against the anti-people and anti-working

class policies of the Government.

This AIC of AIPEU Group-C extends its full

support to the struggle of the working class and declare

that it shall join all the struggle programmes of the

National Platform of Mass organisations including

strike. This AIC further appreciates the alternative

policies pursued by the left front Governments of Kerala,

West Bengal and Tripura and extends its solidary with

these Governments in implementing the pro-people

and pro-working class policies.

3. The activities of the communal and divisive

forces have become a threat to the independence and

integrity of the country. The religious Fundamentalist

elements are resorting to terrorism and are engaging

in most cruel and heinous act to divide the people on

caste and communal lines. This AIC of the AIPEU

Group-C strongly condemn all the communal and

divisive acts and declare in one voice that the unity

and integrity of the country shall be preserved at any

cost.

4. The much awaited report of the Sixth Pay

Commission headed by Justice Sreekrishna was

submitted to the Government and the Government has

implemented its decisions on the recommendations

with slight modifications. The demand of the JCM staff

side and the Confederation of Central Government

Employees and workers regarding Minimum wage,

fitment formula, financial benifits on promotions,

increment rate, Pension Commutation, date of effect

to the revised allowances from 1-1-2006, has not been

accepted by the Government. Regarding

contractorisation of Group-D functions, Performance

Related Incentive Scheme, Outsourcing and

Resolution on policy and programmeAdopted In the 27th All India Conference

privatisation etc Government has accepted the

retrograde recommendations of the Commission. The

demand to scrap the Contributory Pension Scheme

is also rejected. Many departmental specific issues

remains unsettled. The Confederation of Central

Government Employees and Workers have decided

to conduct phased programme of action and campaign

for realisation of the just demands and also for rejection

of the retrograde recommendations. This 27th AIC of

AIPEU Group-C calls upon the Postal Employees

to continue its struggle for realisation of the

pending demands of the CG Employees and also

for rejection of the retrograde recommendation

of the Sixth CPC some of which are already

accepted by the Government and some still under

active consideration. This AIC feels that

prolonged campaign programme is to be

undertaken for rallying the entire CG Employees

before embarking upon an idefinite strike.

5. The GDS Committee headed by Retired

Postal Board Member Sri. Nataraja Murthy has

submitted its report on 29.10.08 . As expected the

bureaucratic committee has rejected all the major

demands of the Gramin Dak Sevaks. Civil Sevant

status, pro-rata wages and pension stands rejected.

The increase in the TRCA is megre varying from Rs.

640/- to 960/- monthly increase. Norms for calculation

of workload is tightened. Minimum TRCA is reduced

to 3 hours. The benefit of 5% increase in TRCA in lieu

of DA merger will be absorbed in future increments.

DA formula is to be changed. Bonus will be reduced

to half. House Rent Allowance, Transport Allowance,

counting of service for pension in the departmental

promotional Post, GPF, Assured Carrier Progression

(ACP) - all stands rejected. The proposed service

Discharge Benifit Scheme fails to meet the minimum

pension requirement. Retirement age will be reduced

to 62 from 65. No substitute for paid leave. Conditions

for compassionate appointment and Transfer tightened.

Thousands of Branch Post Offices are to be closed.

Trade Union rights curtailed. GDSSV, GDSMP and

GDSMM posts are to be abolished. Almost all the

recommendations are most retrograde and inhuman.

If Government is not ready to modify the

rcommendations in favour of the GDS, the only way

out is to fight it out. This AIC demand the Central

Government to modify the recommendations of the

GDS Committee and reject the retrograde

recommendations.

This AIC of AIPEU Group-C urge upon the

NEPE to take the lead to rally all the Postal

organisations under the banner of Joint Council of

Action (JCA) and organise a joint action programme

culminating in indefenite strike. Thus AIC further

resolves that AIPEU Group-C shall be in the forefront

of all the agitational programmes to be conducted for

realisation of the demands of the Gramin Dak Sevaks.

6. The Sixth CPC has not considered the

Departmental specific issues of the various cadres in

the Postal department. The Committee has left such

issues to be dealt with by the concerned departments

at the time of cadre restructuring. In Postal department

no cadre restructuring has taken place for the Group

C cadre so far.. The demands of the Accountants,

System Administrators, Business Executives, Public

Relations Inspectors, Postmasters who are in charge

of Post Offices, Supervisors, Treasurers etc remains

unsettled. However, the Department of Posts has now

agreed for cadre restructuring.

This AIC while appreciating the positive

approach of the Postal Board urges upon the authorities

to speed up the process of cadre restructuring and

come to a mutually agreed settlement on the issues

pertaining to each cadres.

7. The ban on creation of new posts imposed by

the Central Government from 1984 onwards is still

continuing. In 2000, the NDA Government has issued

an executive order for abolition of 2/3 direct recruitment

vacancies. Screening Committee constituted for this

purpose has recommended abolition of about 50,000

posts in the Postal Department. 2/3 posts upto 2005

has already been abolished. Abolition of posts for the

year 2006, 2007 and 2008 is pending. The

indiscriminate abolition of justified posts has resulted

in deterioration of the efficiency of the Postal services.

Due to shortage of PAs even counter duties are

combined. Postmen beats are also combined. RMS

sorting work is adversely affected and unsorted letters

are accumulated. Employees are striving hard to

This Federation is constrained to bring to yourkind notice that the All India Convention of all CircleSecretaries and CHQ Office Bearers of all affiliates ofthis Federation held at Guntur on 29.11.2008 hasresolved to submit the enclosed Charter of Demandsto the Department for settlement and to launch anIndefinite Strike in the event of non-negotiatedsettlement.

It can be seen that almost all the demandswere taken up with the department for long. Manyissues were submitted to the department throughunions wise Charter of Demands in the month ofFebruary 2008 [15.02.2008]. Unfortunately no attemptto convene any meaningful negotiation with the StaffSide is forthcoming causing grave concern anddisillusion amongst the entirety of postal employees.

It is in this background that the All IndiaConvention of NFPE unions and associations took thedecision to submit the enclosed Charter of Demandsand request for a negotiated settlement. It is also decidedby the above all India Convention that in the event of anon-negotiation by the department for a negotiatedsettlement before 18th December 2008, the entire postalemployees shall have to embark on an Indefinite Strikein the first week of January for which a formal Noticeshall have to be served on 19th December 2008.

This Federation is confident that you willpersonally intervene in this matter and cause seriousdiscussions with the Staff Side on the long pendingvital issues of the employees' to restore peace in theminds of the employees and to avert any unpleasantdevelopment that may disturb the tranquillity in ourservices.

Moreover, his transfer is nothing but an act ofvendetta for his trade union activities as DivisionalSecretary in GPO in complaining about the irregularitiesand non observation of by laws of the Society by Sri P.C.Bhatt, who is the ADPS (Staff & vig) and also the vicechairman of the Society. The provision of Rule 37 hasbeen misused in his case.

It is brought to our notice that the SPOs & ASPOsof Chhindwara Division are extending undue favoritismto the BPEU office bearers and denying the rights toordinary employees.The following are the few examples: -(i) One Sri D. K. Verma, LSG officials having PO &RMS Accounts Qualification has not been posted as APMAccounts. Whereas an unqualified LSG official Sri F. A.Ansari has been favoured with the posting of APMAccounts. Thereafter one Sri. M. S. Chandel, the BPEUCircle Secretary has been ordered to replace Sri F. A.Ansari and posted as APM Accounts who is neither a LSGofficial not possessing the requisite Accountsqualification.(ii) The SB Aptitude Qualified officials belonging tothat union are favored with posting in Divisional officeand Accounts branches. The unqualified officials areposted in SB branch.(iii) Despite clear orders that no BCR official shouldbe posted in Treasury branch, one BCR official has beenposted forcibly while several time scale PAs are awaitingfor their turns.

There are several complaints against the SPOsabout the undue favoritism extended to the unrecognizedunions and harassing the official belonging to otherunions. There are many transfers issued against theinterest of officials. The SPOs is functioning in anunbridled horse style.

However, the officiating pay for the period from01.025.07 to 21.11.07 in HSG I scale has not been paidso far due to want of orders from the Muzzafarpur (North)region. Similarly his whole officiating period should beconstrued as HSG I regular service for the purpose offuture increments etc.

Despite repeated representation, the issueremains unsettled. The delay causes unnecessarytension to the senior official.

The official has preferred an appeal seven monthsbefore and also retired from service on superannuation inAug 2008. However the appeal is still indisposed at theregional office. There are many such appeals are pendingin the Muzafferpur North region due to non posting of regularDPS to the region. This causes a concern.

lllll Grant of Tribal Area Allowance to theemployees serving in Tribal area of Igadpuri and otherplaces of Nasik District.

The payment of Tribal area allowance to theofficials working in Nashik District was stopped from31.03.02 due to the Maharashtra State Governments orderin replacing the allowance by a revised scheme by itsnotification dated 06.08.2002.

The state Government has declared that itsemployees working in such areas which are declared asNaxalite Threat areas and where the specialcompensatory allowance was paid earlier are entitled forthe new allowance which was fixed at the rate of 15% ofPay subject to the Minimum of Rs. 200/- and Maximum ofRs. 1500/-

The same allowance has not been extended tothe Postal employees working in the areas where theTribal area allowance was drawn earlier. Thenomenclature of the allowance has alone been revisedby the State Government but the areas are still coveredunder the Tribal areas as notified earlier by the StateGovernment.

The Chief PMG, Maharastra Circle vide his letterno. Estt/4-1 (2)/HRA -CCA/2008 dt. 12-09085 has soughtclarifications about extension of such allowances to ourpostal employees as per the state governmentnotifications changing the nomenclature of the allowanceand continue the payment of Tribal Area Allowance.

The office bearers elected in the General bodymeeting of AIPEU Group 'C' held on 21.08.08 at LudhianaCity Division have not been recognized so far by theDivisional administration for the reasons known to themonly and no monthly meeting is held so far with the electedrepresentatives.

The Circle Secretary has taken up the case withthe Circle administration and no action has been takenso far. The Circle administration do not care anyreferences received from the Directorate and even daredto cause orders derecognizing the circle Union eventhough the 27 months have not been lapsed since lastconference in spite of crystal clear instructions from theDirectorate on this issue and created a stalemate in thecircle. The Chief PMG is running amuck in denying thetrade union rights provided by the department and refusingthe legitimate right of the Trade Unions in the circle anddivisions. This causes a serious concern.

It is requested to intervene and cause appropriateorders to settle the present unpleasantness' prevailing inthe Circle by restoring the Trade Union facilities to theelected representatives of the Divisions/Circles.

RESOLUTION ON SHORTAGE & ALLIED PROBLEMSThis 27th All India Conference strongly feels that

the problems arising out of more than 30% vacancies on

all the divisions throughout the country has grown intomammoth proportions. This heavy shortage of staff istaking a heavy toll of the well being of the employees onone hand and the effective functioning of the departmenton the other. The camaraderie and cordial relationshipexisting between the head of the office and hissubordinates and even among colleagues is fastdisappearing and animosity is slowly creeping into itsplace owing to the unmanageable proportion of thismenace of shortage of hands. The administration ismaking tall claims about the need for effective functioningto tide over the blown-out-of-proportion crisis of financialloss by competing through business post in the marketwith others. But the basic necessity of providing sufficientman power for efficient implementation of new schemesintroduced in addition to the spiralling work-load isconveniently sidelined and forgotten. Hence, the effortsand claims for toning up our prestigious department willnot yield desired results. Before the citable of this strongfort of Dept-of posts starts crumbling without viablefoundation of manpower, needy and speedy action needsto be taken to strengthen the base and then to take effortsto go in for added strengthening of fort itself. This willensure longevity and viability of our department. Towardsmarching in this direction, the following efforts need to beaddressed at once.(i) FILLING UP OF VACANT POSTS EXISTING BEFOREFORMATION OF SCREENING COMMITTEE.

The Screening Committee has been formed in2001 and the posts to be filled up among the availablevacancies were identified after scrutiny since then. But toour dismay, it is shockingly noted that even the vacantposts of various cadres available prior to the formation ofthis committee are deliberately kept in the cold storagewithout being filled. This not only defies logic but alsodefeats the very purpose of such committees. The ironyis even after formation of screening committee 1/3rd ofthe vacancies is allowed to be filled up whereas the priorvacancies in its entirety are kept as vacant. Theconference requests the Department to evince all effortsto fill up the vacant posts existing prior to implementationof screening committee immediately.(ii) SCRAPPING OF SCREENING COMMITTEE & FILLINGUP ALL VACANT POSTS.

This conference wholeheartedly appreciate andthank our secretary, DOP for taking up with the Departmentof Per & Trg. Vide his letter No.25-35/2001-PE -1dt.4.4.2005 to exclude our DOP from the purview ofscreening committee as we have reached the saturationpoint of abolition of vacant posts. The DOP&T letter dt11.5.2001 envisaged an annual cut of 2% of vacanciesaiming for a total of 10% of vacancies abolished in 5years period. But our department has already reached9.5% of abolition of posts in the year 2003-04 itself. Further,it is pertinent to note that apart from 26.328 postsabolished under 2% annual cut since 2000, the workforce further dwindled by 19,000 posts owing to various

factors like non-filling of existing posts, matching savingsfor HSG II & HSG I (1622 posts), irregular combination ofduties etc.

Further, unlike in administrative offices the workcannot be kept pending in operative sector like postaldepartment. To rub salt in the wounds, new schemes,premium or otherwise, introduced in the name ofbusiness posts aggravate the situation by increasing thework-load to manifolds. It is pertinent to mention that theRailway was exempted from the purview of this committeefrom 2002 itself. The only operative department which isstill under this purview is the Department of Post. This isa sorry state of affairs.

The Sixth Pay Commission, in its Para 06.03.10,has recommended to revise the Annual DirectRecruitment Plan (ADRP) in terms of which only one thirdof the vacancies can be filled up. It further commented asinteralia: -

"This instruction (ADR) has resulted in agingbureaucracy, which does not easily adapt itself totechnology. An active and younger profile in Governmentemployment is the need of the hour. Further, strengtheningof the cutting edge for efficient delivery is required. Newguidelines, where reduction in manpower and levels offresh manpower intake would be assessed andprioritised by the individual Ministry or Departmentkeeping its work processes, service delivery andfunctional requirements and budgetary savings at centrestage should, therefore, be issued."

Accordingly, the Government should accept therecommendations and cause orders to leave the issueto the concerned Department/Ministry and lift the ban onrecruitment prevailing since 1983.

Under the circumstances, the 27th AIC of AIPEUGroup 'C' held at Guntur from 30.11.08 to 02.12.08 ferventlyappeals the Directorate to initiate action based on theSixth CPC recommendations. The AIC further appealsthe NFPE to exert pressure to Government throughpolicitical sources also and see the Department is grantedexemption from the purview of the screening Committeeand all the vacancies get filled up to ensure the survival ofthe department and to maintain efficiency of thedepartment in meeting requirement of customers.

The 27th AIC further appeals the NFPE that if theissue is not sorted out an All India agitation may beorganised under the banner of JCA culminating toindefinite strike during Feb' 2009.(iii) AUGMENTATION OF ADEQUATE POSTS FOR NEWSERVICES.

It is everyone's knowledge now the face of theDOP is fast changing with ever so many new servicesand schemes introduced on every day basis. Starting fromspeculation and sales of debentures, Gold coins, ICICbonds, UTI, Oriental insurance, shares etc. WesternUnion money transfer upto sales of weeklies, milkcoupons, X'mas cakes, books, prasadams of Templesetc, we are doing all-in-all business. The preparation of

electoral rolls, scrutiny of passport application, sellingrecharge cards for cell -phones, etc are being performed.Many new agency services are regularly introduced atselected offices without any respite. V-SAT MO, AMPClogistic mails are the ones introduced with fanfare butproved to be damp-squib heavily telling upon our financeswith losses.

The list of such new services is long andunending .If this being so, the clerical staff are put intomuch inconvenience without supplementing theresources of manpower. The work-load of all post officesin Savings Bank, Accounts Branch and other countersare already heavy owing to acute shortage of hands.These new services only prove to be the last straw on thecamel's back. Leaving out the traditional Postal work, forthe new services alone adequate number of employeesmay be provided by augmenting the establishment. Forthis purpose the qualified employees among GDS cadremay also be utilized by suitably compensating themfinancially. This requires very serious consideration andimmediate implementation.

We have already submitted a proposal for cadrerestructuring in Group C cadre and also submitted ourdemands on modification of Pay Commissionrecommendations. It was also assured in the formalmeeting held on 16.09.08 by the Member (P) to have afull-fledged meeting soon on the issue of cadre reviewwith the union.

However, no meeting was convened then. The27th AIC after discussing the issues threadbare hasresolved to request the Directorate to expedite theproposal and settle the issue at the earliest.

It is requested to consider the resolution andconvene a meeting for discussion on the subject.

Promotional avenues in PA Cadre are not asattractive as in the case of other Central Governmentdepartments like Railways, Central Excise & Customs,Income Tax etc. At the best, the P.A. who begins his careeris getting two financial up gradations in the name of TBOP& BCR which were declared as not regular promotions

during1999 even though it was achieved by surrendering20% supervisory & 6% operative posts. The Sixth PayCommission has also not considered the case of TBOP/BCR.

As such, we have no other alternate except toembrace the ACP promotions as if in the case of otherCentral Government employees. To off shoot thematching savings we offered earlier, a proposal for cadrereview has been submitted by the CHQ to the Department,which the conference approves. The proposal in Totoshould be implemented without any further matchingsavings. This 27th AIC resolves to demand:(i) The 1974 position in LSG (i.e) 20% postsupgraded for LSG should be revived and all singlehanded and double handed offices should be declaredas LSG posts.(ii) The 'A' Class & LSG offices should be declaredto the status equal to the present HSG II.(iii) All the HSG II & HSG I posts should beamalgamated and equated to the present status of HSGI.(iv) The nomenclature of LSG, HSG II & HSG I shouldbe revised as Supervisor, Senior Supervisor and ChiefSupervisor.(v) The Posts of Senior Postmasters & ChiefPostmasters should be allotted to General line anddeclared as hierarchical promotional posts.(vi) All Postmasters posts should be declared forGeneral line and there should be no share to inspectorcadres.(vii) The posts of Systems Administrators &Marketing Executives should be created and declared aspromotional cadres to the Postal Assts. The existingsystems Administrators should be observed in thepromotional posts by conducting a simple Trade Test intoken of recognising their effective and efficient role in thecomputerisation of postal services.(viii) The PO & RMS Accountants posts should bedeclared as an organised accounts cadre and it shouldbe declared as promotional cadre to the Postal Assistants.(ix) After creating more number of supervisory posts,20% can be allotted as promotional cadre for thoseappearing in competitive examination.(x) The other proposals contained in the CHQproposal on cadre review should also be considered.

This conference further resolves that the officialshaving 20 years of PA service should be allowed to appearthe PSS Group B Examination. Similarly the physicallychallenged candidates should also be allotted somereservation in the IPO Exam so that the aspirants mayhave a fair chance.

While granting higher pay scale to IPOs/ ASPOsone third of IP posts were earmarked for direct recruitmentwith educational qualification of graduate. This in effecttook away the existing promotional avenues available toPA cadre by 1/3rd. To compensate this loss, proposalslike increased quota in PSS Group B should be

considered and finalised by the Department. This shouldbe considered immediately.LSG Notional Promotion

This August Conference of AIPEU Group 'C' heldat Guntur from 30.11.08 to 02.12.08 further resolved torequest the Postal Administration to set right the followinganomalies arisen after scrapping the Fast TrackPromotion Scheme.(i) Prior to 1986, the LSG was the Circle Cadre andthe same position is revived in 2006. In between, it wascalled as divisional cadre. While granting notionalpromotional since 1986, several seniors could not gettheir due LSG promotion due to Rule 38 transfers andalso in dearth of LSG posts.(ii) In some circles, due to application of senioritybased on confirmation, several seniors were left out whilegranting notional promotions.

As per column 11 of the revised recruitmentrules 2006, the seniors can modify their LSG promotionat par with the date of promotion of their juniors.

RESOLUTION ON PO & RMS ACCOUNTANTSThe PO and RMS Accountants are discharging

the duties of higher responsibility and greater importance.The importance of accounts work has been recognizedin every establishment of Govt. But it is an unfortunatesituation in the Dept. of posts that the importance of theAccountants has not been recognized. This union hasbeen raising the demand to grant higher pay scale to thePO and RMS Accountants, which was partially acceptedand a scale lower than L.S.G was prescribed. However

the PO & RMS Accountants are being forced to opt back toPA cadre to avail the benefit of TBOP/BCR

After implementation of recommendation of thefifth pay commission , due to change of nomenclature ofspecial pay as special allowance, the quantum of specialallowance is not being counted towards fixation of pay onpromotion. The conditions prescribed for grant of specialpay in F.R has not been changed. Thus there is a greatinjustice to PO and RMS accountants in not counting thespecial allowance for pay fixation on promotion.

The posts of LSG and HSG in accountsbranches in Head Post offices have been manned byofficials having qualification of PO and RMS Accountants.On upgradation of 1622 posts into HSG-I, most of theposts of LSG Accountants have been upgraded to HSG IIresulting in dearth of LSG in feeder cadre.

Various changes in the rules & procedures hadtaken place in the case of LSG Accountants causing manyconfusions at field level. To overcome all these anomaliesthis 27th All India conference resolves to urge upon thepostal directorate to:1. The PO and RMS Accountants may be granted ahigher pay scale of LSG.2. The special allowance granted to PO and RMSaccountant may be counted towards fixation of pay onpromotion.3. As per the directorate instructions vide its letterNo.6/15/60- SPB II dt 16.7.60 read with letter No.6/1/59-SPB. dt 8.5.59, the option prematurely taken from officialsmay be withdrawn and the officials concerned may beallowed to exercise an option only when their turn forpromotion to either lines comes in future.4. Since the Dept. has declared the APM accountsas Circle cadre, divisional cadre & now as circle cadre,and also stated that the TBOP, BCR are only financialupgradations and not LSG & HSG II respectively, freshoption should be obtained from the PO & RMSaccountants qualified officials whether they continue toremain in General / or opt to Accounts line.5. Based on the 1972 Directorate orders, the dateof qualifying the PO & RMS Accountant Exam shall betaken as criteria for LSG APM accounts promotion andthe erstwhile Accountant gradation list be revived withupdated entries. The provisions laid down in Rule 276 ofPostal Volume IV should be adhered in right spirit.6. The LSG / APM Accountants may be allotted theshare of 20% as before which was in the recruitmentrules in the HSG II promotion.

The 27th AIC further resolves to declare the PO& RMS Accountant as Promotional Cadre to PostalAssistant with higher pay and a separate Channel ofPromotion to the Accounts line may be considered in orderto overcome the present anomalies in promotion.

The Sixth CPC has rejected higher pay scale toPO & RMS Accountants as if there is no functionaljustification exists for the same to treat them as organisedAccounts cadre. This is nothing but a farce since the 6th

RESOLUTION ON THE SYSTEMS ADMINISTRATORSThe responsibilities and the nature of work of

the Systems Administrators are higher than the PostalAssistants. They are working in many dimensions likehardware engineer, Data base administrators, net workadministrator, installation engineer etc. They are also incharge of imparting training in computers as well as inthe departmental software's. They have to clear all thedoubts of the officials then & there. They also need toengage themselves in the so called ergonomics of theworking environment such as installation of modularcounters, fixing UPS and other electrical points forcomputers etc.

The System Administrators need to accompanythe inspecting authorities and assist investigation offrauds and malfunctioning in the computerised offices tofetch the required data in the required format from theserver; they are in charge of maintaining security of thenetwork in the office. They are maintaining stock ofcomputers, history sheets etc. They are working withoutminding the working hours. They have to travel to attendproblems in the systems in other offices crisscrossingthe division.

However, the Postal department did notrecognise their service so far. The Sixth pay Commissionhas not dealt the issues in the proper perspective despite

we plead through our memorandum and in oral evidence.The cadre become the symbol of exploitation at thisjuncture and this AIC is seriously taking note for concern.

This All India Conference held at Guntur from20.11.08 to 02.12.08 after threadbare discussionsunanimously resolved to request the department toconsider: -(i) Augment a new establishment with anomenclature of 'System Engineer'.(ii) The newly created posts should be filled up withthe existing Systems Administrators by conducting a tradetest as a token of appreciation of their excellentperformance in the computer arena since the introductionwithout any extra remuneration of shouldering thisherculean task with heavy responsibilities.

Further, there are no uniform guidelines issuedso far on the role and responsibilities of the Systemsadministrators. Each Circle has prescribed the duties onits own contradicting with each others. This should befinalised.

Since the Systems Administrators have to attendfault then & there, they should be granted with Roadmileage allowance with out any ceiling. They should beprovided with cell phone with minimum talk value ofRs.500/- per month. They should be treated as out doorstaff like PRI (P) without insisting attendance or attachedwith any other operative work. Additional remuneration inthe shape of OTA/incentive may be granted for the excesswork or retention in the office beyond their office duty hours.

There is a need no keep panel of SystemsAdministrators and they should not be disturbed on flimsyreasons. Trainers Allowance may be granted to them incase of imparting training to others.

The letter No.P/4-1/Systems Administrators dt16.05.08 & 25.06.08 of the CHQ should be given propernote and the issues should be resolved at the earliest.

CANDIDATESThis All India Conference of AIPEU Group 'C' held

at Guntur from 30.11.08 to 02.12.08 wishes to draw thekind attention of the Hon'ble Minister for Communicationsto the fact of many candidates working as Postalassistants since 1994 on daily wages selected andrecruited under compassionate grounds in relaxation ofrecruitment rules (RRR). They are the wards of erstwhiledepartmental employees who either expired in harnessor retired on invalidation. Their applications were dulyprocessed, scrutinized in DPC and they were selectedfor the Postal Assistants. For want of vacancies, they wereasked to perform clerical duties as Reserved TrainedPool candidates (RTP) on daily wages subsequently inthe vacancies. But they could not be absorbed owing tothe axing of posts under screening committee. Thensuddenly the DOP had caused orders that the waiting listof such candidates maintained to regularize as and whenvacancies arise is untenable and to scrap the same. Theaggrieved candidate were forced to move court andobtained favourable verdict. Unfortunately the Departmentof Posts opted to go on appeal to Higher Court. But theabsorption still remains an elusive dream. The lives ofthese candidates who are working for more than 7 to 8years are delicately poised and over their heads theproverbial 'Damocles' sword is precariously hangingforever. The Department has filed a SLP in Supreme Courtagainst the favourable verdict pronounced in favour ofRRR Candidates approved earlier. This is nothing butblatant violation of agreement reached on 19.04.07 toabsorb all the approved candidates as one time measure.

This 27th All India Conference held at Gunturfrom 30.11.08 to 02.12.08 requests the Hon'ble Ministerof Communications to consider their case sympatheticallyand on humanitarian grounds and to accord absorptionas one time measure of all the approved candidatesforthwith.

The vacancies earmarked for RRR have notbeen filled up in many circles since 1999 due to courtcases on one plea or the other. The candidates could beabsorbed as one time measure in the residual vacancieswhich are kept unfilled is many all circles.

As per the recent orders of the DOP & T, thequota for compassionate appointment is raised to 5% ofthe total vacancies; and even if this provision is appliedand the waitlisted candidates approved againstvacancies since 1999, large number of waitlisted peoplewill get absorption and the remaining hands may beabsorbed as one time measure in other vacancies.

This 27th All India Conference fervently requests

the Hon'ble Minister of Communication to kindly showmercy on the wards of the postal staff by extending onetime absorption and withdrawing the SLP filed by the Deptfrom the Supreme Court against the favourable verdictdelivered by CAT also confirmed by High Court Chennai.

Further this AIC appeal the Government toremove the 5% ceiling fixed for the consideration toappointments under relaxation of recruitment rules andleft the discretion to the concerned ministries inconsidering such cases on humanitarian grounds.

The resolution adopted in the 27th All IndiaConference of this union on the subject of monetaryrecovery and disciplinary actions against innocent officialsunder contributory negligence factors is enclosedherewith for favour of kind consideration.

The resolution itself is self explanatory andexhaustive. Despite clear provisions in the volume III &Disciplinary rules, the innocents are being punishedunder contributory factors under one pretext or the other.In several cases, the proceedings are ordered withoutquoting any statutory rules or manual and just fixedresponsibilities on the shoulder of the innocent officialsunder the contributory factors and made them as scapegoats.

It is requested to cause detailed instructions toall concerned in order to protect the innocents from thecontributory factors and guard them from the clutches ofmisuse of the provisions by leaving the main offenderscat free.

RESOLUTION ON MONETARY RECOVERY ANDDISCIPLINARY ACTION ON CONTRIBUTORY

NEGLIGENCE FACTORSeveral courts of law in our country pronounced

various judgments opposing monetary recovery orderedfrom innocent officials for the SB fraud cases oncontributory negligence factor. The judgments quoted thatmonetary recovery should not be ordered for those whowere not directly responsible for the loss sustained tothe Department.

Similarly the Disc authorities are straight awayimposing punishments duly ordering for monetaryrecovery on the SPMs/Signallers in case of burglaries.Postal employees cannot be held responsible forburglary cases on any count. Police authorities should

apprehend the real culprits and recover the amount fromthem. If the local police authorities do not evince interest,the matter should be reported to the Police higherauthorities for further action by the Divisional Heads. Ifthe amount could not be recovered from the culprit, basedon police report the loss amount has to be written off withthe approval of the Government of India.

The Rule 58 (Appendix) of the P & T FHB Vol - Istipulates that in deciding the degree of an officerspecuniary liability, it will be necessary to look not only tothe circumstances of the case but also to the financialcircumstances of the officer, since it should be recognisedthat the penalty should not be such so as impair his futureefficiency'. However, the Postal Department has violatedits own statutory rules while ordering to recover theoverpayment due to fixation of pay to postmen during FifthCPC from the Accountants and officials forgetting eitherto note the circumstance of pay fixation or impairing theefficiency of the Postal officials due to that unwarrantedrecovery.

The Golden words in the FHB Rule 58 that "everyendeavour should be made to recover the whole amountlost from the guilty persons" is not being adhered to. Inmany cases, no effort is being taken to recover the amountfrom those the over payment was made. The innocentPostal Assistants and supervisors are being made asscapegoats and the entire amount is being recovered.The recovery on excess paid interest on TPF account inBhimavaram division is one of the testimony for the blatantviolation of the Statutory rules.

The Rules 11 A of CCS (CCA) Rules stating thatrecovery should made only if the official is directlyresponsible or the rules 107&108 of volume III about theconsideration of extenuating nature while imposingrecovery were merely on the books and volumes and notbeing applied in any case. Even the Rule 204 A (i) ofvolume III to condone the honest errors if the official hasacted in good faith and done his best up to the limits ofhis ability & experience become invisible to the jaundicedeyes of the many disciplinary authorities.

In General, the charges are usually framed thatthe employees did not adhere this rule or that and allthese are quoted only when a loss occurs. The otherrules like providing adequate man power as per thestandards or the basic working condition provided toobserve the rules etc do not come in their mind whileordering such in human recoveries.

Above all there is unwarranted delay indisposing the disciplinary cases, which causes tensionand mental agony to the charged officials who arecompletely helpless to fight out the delay. The disciplinaryauthority is fully armed to cut short any delay he wants.He is fully authorised to decide a case ex parte when thereply from the official is not received in time. They canmisuse the Rule 3 (i) to punish any one.

The Supreme Court in Historical judgment inthe C.A. No. 2168 of 2006 dt. 21.04.2006 that "When an

officer who exercised judicial or quasi judicial power actingnegligently or recklessly could be proceeded against byway of disciplinary action should be brought as a rule toarrest the menace and put check to the in human officersmisusing the disciplinary rules and punishing theinnocents on flimply reasons under the unbecoming ofthe Government servants and on contributory factor.

Under these circumstances the 27th All Indiaconference of AIPEU Group 'C' held at Guntur from30.11.08 to 02.12.08 resolves to oppose any actionagainst postal employees on contributory negligencefactor. Further this 27th AIC further appeal to thedepartment to halt such practices of resorting to Discaction/monetary recovery against innocent officials.

This conference further resolves that the primaryoffender shall alone be penalized and the defrauded /misappropriated amount should be recovered from himonly leaving the innocent officials from the contributoryfactors and resorting recovery on them.

This AIC further demands for necessary changesin the disciplinary rules providing the appointment ofappellate committee consisting of one or two membersfrom staff side in each circles to review the decisions ofthe disciplinary authority if appealed by the charged officialwhich will pave way to arrest the undue punishment nowawarded and uphold in appeals.

With a view to meeting the shortage of staff dueto absenteeism and other causes and also to managethe increased flow of traffic and also to curtail expenditureon overtime, the P&T Department has introduced the RTP(Reserved Trained Pool) scheme vide its No.60-36/80-SPB dt.30.10.1980.

"At the time of recruitment every time, after selectlist is drawn up, an additional list of candidates known asPart "B" or Part II is prepared for each Recruiting Units.The Part 'B' or Part II list is meant for filling the dropouts inthe main selection list". In addition, a further list ofcandidates up to 50% of the no. of candidates in the mainlist, is to be drawn up which is called Reserved Pool.Their permanent absorption could be made only in Jan'90due to TBOP promotion & Ban on recruitment.

In the meeting held with the Minister on 23.10.01,Member (P) informed that the demand for taking theirpast services could not be accepted since the RTPRecruitment was made outside the Recruitment Rules.

The Directorate in its letter No.10-7/2003/SR, Dt.4.11.03, while Communicating the stage of progress ofvarious demands, it is formed that the demand of theunion being contrary to the judgment of the Apex Court(S.C Judgment dt.1.8.97 in OA Nos. 80-123 of 1996) isnot acceptable and the case closed.

Again in the Periodical meeting of JCM(Departmental Council) held on 18.11.03, whilediscussing this issue under item No.9, the similar replyciting S.C. Judgment was given to the Staff side.

The Dept has closed its minds in this issuewithout minding various developments taken place afterthe issue of Supreme Court judgment on 1.8.97.

The Supreme Court judgment pertains mainlyto the absorption of all erstwhile RTPs and against variouspronouncements in CATs in favour to RTP Personnel.

In the said judgment the remark passed on thecounting of past services is restricted to appear in thedepartmental examination only. There was no mentionabout Promotion & Pension benefits. The extract portionis furnished interalia.

"In C.A. Nos. 127-130 of 1996, the RTPs whohave been regularly absorbed in the year 1988 have beengiven the benefit of counting their service as RTPs for thepurpose of their eligibility to appear for the departmentalexamination. The relevant rules provide that thecandidates must have put in at least 5 years continuoussatisfactory service in one or more eligible cadre beforethey can appear for the examination. The eligibility isrelated to five years service either cadre. Any service,which was, rendered prior to regular appointment in thecadre, cannot count for the purpose of this rule becauseit cannot consider as service in the eligible cadre. TheTribunal was therefore wrong in granting RTPs the benefitof service by them prior to their regular appointment, forthe purpose of their eligibility to appear for the

departmental promotion examination".Under Article 368 of CSRs (Rule 14 of CCS

(Pension) Rules 1972), periods of service paid fromcontingencies do not count as qualifying service forpension. In some cases, employees paid fromcontingencies are employed in types of work requiringservices of whole time worker and paid on monthly ratesof pay or daily rates computed and paid on monthly basisand on being found fit, brought on to regularestablishment. In pursuance of the recommendations ofthe council, it has been decided that half the service paidfrom contingencies will be allowed to count towardspension at the time of absorption in regular employment.

Such being the case for contingent staff, theRTPs utilized as 'SDC' performed all the duties andresponsibilities as PAs/ SAs, with their duty periodrestricted to 8 hours per day and wages on prorate to PAcadre for the period of duty computed and paid on monthlybasis, are therefore, on a much worse footing than thecontingent staff, and extending the benefit of the periodspent by them as 'SDC' to count for 'Qualifying Service'would be fair, reasonable and justified.On the analogy ofi. Rule 22 of CCS (Pen) Rules 1972 - Period spent on

Training - 3 monthsii. Rule 48-B of CCS (Pen) Rule 1972 -On voluntary

retirement -Up to 5 years.iii. Rule 21 of CCS (Pen) Rules 1972 -EOL on MC - Max.

at a time 5 Years.Applying the norms applied for learners in 1960 alsoRTPs would be benefited too. RTP service could beconsidered for retrial benefits.Various Supreme Court judgment pronounced insimilar cases confirm that the benefits should alsoto be extended to RTPs.

Further, the Government misinterpreted thejudgment of Supreme Court while disposing the SLP(Civil) 80-123Of 1996 filed by Government of India andrejected the entire demands of RTPs. This particularjudgment pertains to only the eligibility criteria fordepartment promotion and does not relate to counting ofpast RTP service for retirement benefits.

The services rendered in private establishmentsby the P&T Canteen employees are now being taken intoaccount for pensionary benefits as per DO P&T ordersbased on the Supreme Court pronouncement made in1999. Such being the case, there is every justification fortaking the past services of the RTP for promotionalaspects.

The Apex court has uphold the decision of theChennai High Court in granting service benefits of RTPsfor TBOP promotion to those deputed form the Post officesto Army Postal Service during their Period on RTP. Non-application of similar concession in treating the servicesof RTP as qualifying services for promotion is tantamountto denial of justice to the similarly situated persons.

While I witness the rising trend inmodernization and rapid computerization in theDepartment of Posts through LAN, WAN and MANand identification of more and more aam admi PostOffices day by day under Project Arrow incurring hugeexpenditure in the name of "Look and Feel Good"without any pre-check and proper assessment of itsown economic standard, ground realities of the PostOffices, shortage of man power due to ban on newcreation and imposition of the arbitrary ScreeningCommittee, the story of "Hare and Tortoise" strikes inmy mind in a different way. With a purpose of teachingus the central idea - "Slow and steady wins the race"- we have been told the story of "Hare and Tortoise"several times during our primary school education. Weall know that the Tortoise won the race due to hisconstant persistence and the Hare did not for hislaziness and overconfidence. Let me extend the storyto suit the present attitude of our Department to winthe race of computerization / modernization.

Being ashamed of his defeat, the Harechallenged the Tortoise. Realizing his fault of sleepingunder the banyan tree in the middle of the race, hebecame very cautious in the second round and rancontinuously without any break and finally won in thesecond round. But the cunning Tortoise invited the Harefor the third round race with condition of changing thepoint of destination. The tortoise suggested to touchthe peepal tree across the river. Being confident of hiswinning, the Hare agreed and the race started. Butwhen the river came, the Hare just stopped and theTortoise without facing any hurdle dived and swamacross to touch the point of destination. The hare wasagain defeated and felt ashamed for entering into theagreement without accessing his capability ofswimming with that of the Tortoise. Now hecompromised with the Tortoise and suggested to havean agreement that both would work in tandem withoutgiving any challenge to each other. On land, wherethe hare can run swiftly, the Tortoise will sit on thehare's back and on water where the Tortoise can swim,the position would be reverse. Thus, they agreed towork with a team spirit to conquer both land and water.And this is called the secrecy of success with teamspirit. Both proved "Union is strength". Comrades!Don't you think that if the Official Side works in tandemwith the Staff Side with proper understanding of eachothers capability, the Department can achieve anysuccess it desires? But Alas! if any such thinghappens at all !

Now let me continue the story. Days passed

The story of "Hare and Tortoise" and India PostBruhaspati Samal

Divisional Secretary, AIPEU, Gr.-Con. Subsequently, the next generation of the Hare inthe age of Information Technology considered the defeatof their ancestor from a mere Tortoise as a seriousoffence. Referring to Darwin's theory of evolution, theyopined that since there had been no change in thephysical structure of the hare and the Tortoise, thehare would certainly be the swiftly running animal andhistory had recorded it wrongly favouring the Tortoise.They demanded to change the earlier decision in favourof the Hare. The Tortoise now felt humiliated andconsidered such opinion of the hares of IT generationas an attack on his self-conceit, modesty, nobility andhumbleness. The Tortoise tired his best to make thesehares understand the reality about his earlier victoryand agreement with the Hare. But a group of hares ofthis IT generation accompanied with some sycophantschallenged the Tortoise to prove his efficiency onceagain. Due to their possession of IT tools, advancedtechnology and being imparted with various trainingsin the mean time, these hares of IT generation becamevery confident of their win. The overconfident haresalso extended the goal point beyond the peepal treewhich was fixed in the last round and re-fixed it to bethe horizon where the sky touches the earth. Now toretain his self respect and to struggle for existence,the Tortoise had no other alternative but to agree withsuch a proposal. The race started once again. TheHare ran and ran crossing the banyan tree, the riverbank, the peepal tree, the hills and forests across theriver without looking back with the only intention oftouching the horizon and to prove his efficiency better.But on the contrary, the Tortoise went slowly in hisnormal speed and rested under the banyan tree. Whenasked, the Tortoise simply replied that he might startwhen the hare would be nearer to the horizon. TheHare was running and running ahead. The spectatorsand judges waited for the Hare to come back with anew record. But he did not return. Where is the horizon?History repeated - "Too much cunningness undoes.The Hare is not only foolish but less intelligent thanthe Tortoise."

The narration of this old story in such a mannerkeeps quite relevance to the rising trend ofcomputerization and modernization in the Departmentof Posts. as if, the Department is trying to touch thehorizon. As we experience, it is entering into anyagreement anywhere with anybody and introducingseveral new products and services starting from e-Postto e-MO blindly without proper assessment of its ownfinancial viability, business strategies, income-costanalysis and similar other factors. Illustratively, the

PO-SHG-NABARD Linkage Scheme for disbursal ofmicro credit to women Self Help Groups, agreementwith Oriental Insurance Co. Ltd for sale of insuranceproducts, agreements with SBI, UTI, FranklinTempleton and others for mutual fund business,Memorandum of Understanding between theDepartment of Posts and the Ministry of Railways tobook railway reservation tickets through Post Offices,SBI's tie-up with India Post for sourcing the former'sassets, liability and investment products , introductionof Logistics Post Air , Instant Money Order (iMO)service , Electronic Money Order ( e-MO ) Service,launching of International Express Delivery Service inpartnership with Deutsche Post Worldnet (DPWN)etc. are worth mentioning here. In addition, with apurpose to create a faster response mechanism tomeet the emerging challenge of modern Informationand Communication Technology, the Department ofPosts has now launched "Project Arrow" as "windowsto the world for the common man" ( Aam Admi ). 500post offices have been identified for this pilot projectwith a view to cover 50 POs by 15th August, 2008 andrest 400 P Os by 31st December, 2008. To suit thenew design necessary construction / reconstructionwork of the identified PO buildings is rapidly going ondemolishing the existing counters / public places whichwere even built a few months ago. Crores of rupeesare being spent in this regard. Recently, another 4500POs have been identified under the project. Furtheranother pilot project effecting mobile payment systemutilizing ICT(Information Communication Technology)based on payment of wages through Mobile handsetsto be used by BPMs of selected Branch Post Officesis proposed to be implemented for NREGS wageearners. This apart, in the name of introducing acorporate logo, the Department, incurring hugeexpenditure beyond imagination changed ourprestigious logo which had been the pride and glory ofthe Department of Posts through out years occupyinga special space not only in the blood and soul of itsemployees but in the hearts of crores of Indian citizenscreating a separate status and identity of theDepartment. One can easily guess the probableexpenditure that would incur in changing the name /sign boards with repainting of the new logo on onehand and the type of gain the Department wouldachieve with such logo change on the other.

While we welcome any project that isaimed at improving the postal servicesaccompanied with technological advancement,we should not forget that we have already been warnedby the Planning Commission to attain self sufficiencyand at present we are striving for the same. In such aperiod, a layman can treat such unnecessary wastageof money as a blunder only. While the administration

fails to supply timely the daily requirements of lesscostly items like carbon papers and pins etc., whilethe administrations expresses its inability to cane /repair a torn/broken chair and staff are compelled towork in an unhealthy atmosphere, while the rates ofOTA / FSC / sweeping / gardening / water carryingallowance are not being revised for years together, suchextravagance is highly unappreciable and need to beprotested at any cost.

The Department is overconfident of its vastnetwork. But what is the human resource within? Thearbitrary Screening Committee has taken away morethan 50000 posts in the mean time. The ego of beingthe oldest and largest may not count. Who willimplement the policies? How a single handed SPMwith as many as 15 to 20 BOs will handle thousandsof NREGS Accounts? Without additional staff, withoutcreation of new posts even after justification, withoutsanction of justified OTA in the plea of paucity of funds,without proper scale of pay and even without grant ofofficiating pay, we are forced to work. Hanging thebanners of the oriental Insurance Company, we havebeen given to achieve the targets for Postal Lifeinsurance, distributing the leaflets of SBI, we have beenordered to open fixed numbers of S B and R DAccounts. How disgusting! We have experienced thefailure of VSAT. The required forms and pass booksare not available in the PSDs. Bar code stickers arenot being supplied to S Os for booking of Speed Postarticles. No AMC is being signed for timelymaintenance of computers. The Department fails toreplace a damaged pillar letter box due to want ofstock. How the policies will run effectively where thereis no vision? The Department is introducing suchproducts and services unilaterally without taking theStaff Side into confidence and trying to pluck where ithas not planted. To achieve their vested interest, thebureaucrats are making the innocent employees ofthe Department the cat's paw. Will such policies eversustain? Let's think deeply on these issues and guidethe Department properly for its existence?

A danger foreseen is half avoided. Can we beable to forecast, Comrades?

Therefore the 27th All India Conference of AIPEUGroup 'C' held of Guntur from 30.11.08 to 02.12.08unanimously resolvesi) To request the Govt once again to view sympathetically

INDEFINITE STRIKE

NFPE Federal Secretariat that met on 9.12.2008thoroughly discussed the entire developments taken placesince our earlier Federal Secretariat Meeting held on8.11.2008. The submission of Nataraja Murti Committeerecommendations; the need for united struggle to get thenegative recommendations rejected and necessarymodifications accepted by the Government; the decisionof the all India Convention of NFPE held at Guntur forlaunching a united Indefinite Strike from 6.1.2009 on acommon Postal Charter of Demands and on a commonCG Employees Charter of Demands; the submission ofIndefinite Strike notice for strike from 17.12.2008 by theGDS Union undermining the decisions of the NFPEUnions for a joint strike with preparations duringDecember etc have all been considered by the FederalSecretariat.

Though the NFPE Federal Secretariat was ofunanimous view that the GDS Union should have fallenin line with the decision of the NFPE for a joint IndefiniteStrike from 6.1.2009 for which Notice should be servedon 19.12.2008 and hectic strike tour from 21.12.2008 to4.1.2009 to ensure total participation of postal employeeson a Postal Charter of Demands of both GDS and regularemployees for ensuring better victorious results, theSecretariat has assessed that the GDS Union is not likelyto withdraw the strike notice served by it and therefore thesituation emerged is very crucial in the interests of threelakhs of GDS and to our movement.

The NFPE Secretariat was of the consideredopinion that irrespective of the stand taken by the GDSUnion, the movement cannot allow the GDS to be isolatedat the time of their struggle for modification of therecommendations of Nataraja Murti Committee that isloaded with many anti-GDS recommendations. TheSecretariat considered that any failure would result inlosing the gains registered by the NFPTE - NFPEmovement during the past four decades for GDS andtherefore the Federation and all the affiliated Unions /Associations cannot but take a firm stand to render totalsolidarity to the GDS by joining the Indefinite Strike from17.12.2008. It was in this background the followingresolution was unanimously adopted:

RESOLUTION OF FEDERAL SECRETARIAT

The Federal Secretariat of NFPE which met atthe office of the NFPE on the afternoon of 9.12.2008 onanalysing the entire development of events taken placeincluding the situation arising out of submission ofIndefinite Strike notice by the GDS Union, has unanimouslyresolved to call upon the entirety of postal regularemployees to extend total solidarity to the striking GDS byjoining the Indefinite Strike from 17.12.2008 and makethe strike programme of GDS a grand success.

This Secretariat also resolves unanimouslyto call upon the Postal Board to hold meaningfulnegotiations immediately with the Staff Side and rejectthe negative recommendations of the GDS Committeeas well as to modify them as demanded by the unions/ federations and avert the Indefinite Strike in the largerinterest of three lakhs of Gramin Dak Sewaks andalso to protect tranquillity and peace in Department ofPosts.

NFPE and all Affiliated Unions have submitteda joint letter dated 9.12.2008 to the Secretary [P]expressing the above decision of the FederalSecretariat and intimating that this letter may be treatedas a Strike Notice. The Department was requested toimmediately hold negotiations with the Staff Side formodifying the recommendations of Nataraja MurtiCommittee as demanded by the unions / federationsin order to avert a strike and to maintain peace. 2. The matter has been examined in consultationwith the Circle Office. The position is as indicatedbelow:

i&ii)No irregularity was noticed in transfer ordersissued by the SSPOs. No complaint/representation has been received from any of theofficial except Shri Kailash Yadav, DivisionalSecretary, AIPEU Group 'C' who is facing Rule-14Charge sheet on charges of payment of forgedcommission on RD deposits which was depositeddirectly at counter by the Account holder. It wasalso seen that no specific instance has beenreferred by the union.

iii) No favour in transfer/punishment was noticed. Thereviewing authority in Regional office reviews thepunishment awarded to the officials regularly.

iv) As no specific instance were given, no commentscan be offered.

v) No LSG official has been posted in single/doublehanded office after they were promoted in LSGcadre. The orders of transfer of Shri Sheesh PalSingh was issued by Regional office afterconsidering his representation vide RO letter No.RPB/STA/Rep-19/2007 dated 27.06.07

vi) Sardhana PO is LSG sub Post office and hence,there is no restriction to post an official again inthe same office if he had completed his tenure inany other office. The restrictions are applicable insingle/double handed offices only.

i) It is fact that the officer has worked as SPOsEtawah, Bulandshahar and as SSPOs Jhansi& Aligarh in Agra Region. The officer joinedas SPO Etawah after transfer from KheriDivision. He was transferred to the post ofSPOs Bulandshahar at his own request andcost, and as ADPS, RO Agra against vacantpost. Further, he was transferred to the postof Manager BD Lucknow GPO. Afterpromotion the officer was allotted to AgraRegion and posted as SSPOs Aligarh andsubsequently on request and cost he wasposted as SSPOs Jhansi. As far as transferof the officer from one Division to another inAgra Region is concerned, it was in publicinterest and not on administrative ground.

ii) The allegation that appointments of BPMSmade by Shri H.P. Singh while holding thecharge of SPOs Bulandshahar were cancelledis not correct. In fact, no appointment of BPMmade by Shri H.P. Singh in BulandshaharDivision was cancelled.

iii) The expenditure was made by Shri Singh afterseeking AA/ES from RO Agra.

iv) The allegation that the officer was involved inthe bogus cash conveyance and charged Rs1000/- per day for cash conveyance is

baseless. It is correct that Shri Singhdismissed Shri Pooran Lal Raikwar, the thenDivisional secretary. But it is not establishedthat the officer misused disciplinary powersas alleged.

v) No complaint about misbehaviour or usingunparliamentarily language by the officerhave been received. It is correct that certainFIRs were made against the officer inBulandshahar, Aligarh Division.

vi) It is correct that Shri Pooran Lal Raikwar, thethen Divisional Secretary, AIPEU, P-III JhansiDivision was dismissed on 28.10.2005 by ShriH.P. Singh on account of his involvement incase of misappropriation of Rs. 36,000/- atSippri Bazar SO Jhansi. As such theallegation that the officer took revenge anddismissed the Divisional Secretary due toreport about his corrupt activities is baseless.

vii) Shri H.P. Singh while working as SSPOsAzamgarh transferred Shri Ram ChandgraPrasad, AP to Mahul PO Azamgarh. Theofficial lodged FIR under Section 352/304, 506and 3(1)(10) SC ST Act at Kotwali Azamgarh.Police has submitted final report but the courthas not accepted and the case is pending.

We heard the learned Counsel Shri A.R. Holla,appearing for the applicant and Shri V.N. Holla,Additional Central Government Standing Counselappearing for the respondents.2. The above application has been filed undersection 19 of the Administrative Tribunals Act, 1985seeking for the following reliefs:

"(i) To quash the (a) Order No.BI/LSG/Dlgs dated@ Mysore 570020 the 03.04.2007, issued bythe respondent No.3, Annexure-A4, so far itrelates to the promotion of the respondentsNo.4 to 8 is concerned and (b) Order No. BI/LSG/Dlgs dated as Mysore-20 the23.08.2007, issued by the respondent No.3,Annexure-A6 in so far as the applicant isconcerned.

(ii) Direct the respondents No. 1 to 3 to considerthe applicant to the post of LSG in accordancewith the rules, Annexure A1 and extendconsequential benefits and

(iii) Grant such other relief deemed fit, having regardto the lacto and circumstances of the case"

We pursued the pleadings and considered thesubmission made by learned connil for therespondents.4 After service of notice on the respondents,have filed reply statement taking various groundsincluding Rule-39 of P&T manual Vol-4. The learnedCounsel for the applicant has relied on the judgmentof the Hon'ble Supreme Court in the case of ChiefCommissioner of Income Tax and Others vs. V.SubbaRao and Others reported in 2004 SCC (L&S) 201 inwhich while determining the seniority the date ofappointment has been considered. In the instant casethe respondents have considered the case of theapplicants from the date of confirmation in the service.The learned Counsel for the respondents has producedGovernment instructions dated 04.11.1992, theinstructions was referred by the Hon'ble Supreme Courtin the case of Direct Recruit Class II EngineeringOfficers Association vs. State of Maharashtra, para47 (a) of the said judgment, it was declared, theseniority of a person regularly appointed to a postaccording to rule would be determined by the order ofmerit indicated at the time of initial appointment andnot according to the date of his confirmation. Thelearned Counsel for the applicant submits that the O.M.dated 04.11.1992 has already been considered whiledeciding the case by the Hon'ble Supreme Court whichis reported in 2004 SCC L&S 201 in the case of ChiefCommissioner of Income Tax and Others vs. V. SubbaRao and others.5 We have carefully examined the submissionsmade from either side, without going to the merits ofthe case, since the respondents have not consideredthe case of the applicant as held by the Hon'bleSupreme Court supra, we direct the respondents toconsider the present OA as the representation and totake decision in accordance with Rules and thejudgment of the Hon'ble Supreme Court supra. If thedepartment of Post wants and clarification, they areat a liberty to obtain instructions from the DoP&T. Therespondents are directed to consider the case of theapplicant as mentioned above within a period of 3months from the date of receipt of the copy of thisOrder.6 O.A. is disposed of accordingly. No costs

l Uniform for Postmen and Group 'D'

As you are aware, India Post introduced BlueUniform for the Postmen and Group 'D' in the year2004 during the celebrations of 150 years of the PostOffice in India. Representations from the staff generalas well as some of the Staff Unions, in particular, havebeen received in the last four years about theirunhappiness over this decision. Some sections of ourstaff have demanded that India Post should revert tothe Khaki uniform with improved fabric which wouldmeet the requirements of creating a positive brandimage of the Department in the eyes of the public andalso make our officials comfortable while wearing thenew uniform. Secretary (P) has desired that this issueneeds broad consultations with the Heads of Circlesas well all the Staff Unions. Accordingly, I request youto kindly consult the Staff Unions in your Circle andoffer your valuable suggestions on this proposal.

2. There is also a demand about improving thequality of chappals/umbrellas or simply make cashpayment in lieu of chappals and umbrellas. I requestyour to kindly offer your valuable suggestions on thisproposal as well.

l Revision of Special Allowance and CashHandling Allowance-Recommendations of theSixth Central Pay Commission.

Consequent upon the decision taken by theGovernment on the recommendations made by theSixth Pay Commission and in supersession of thisDepartment's O.M. No. 4/4/97-Estt. (Pay II) dated22.4.98 and OM. No. 4/5/97-Estt. (Pay II) dated 5.5.98on the subject of Special Allowance and Cash HandlingAllowance respectively, the President is pleased todouble the existing rates of these Allowances. Therates of these allowances will be increased by 25%every time the Dearness Allowance payable on revisedpay scales goes up by 50%.

l Additional duties for Postman/DeliveryStaff.

On account of changes in work scenario of thePost Offices brought about due to the Induction oftechnology and primacy of business products, theduties and responsibilities of the postman haveundergone a vast change. In order to incorporate thesechanges, the following duties are prescribed in additionto the duties already prescribed for Postman/DeliveryStaff in the Postal Manual Volume VI/ Chapter III:-

Additional Duties of Postman/Delivery Staff

(i) Data entry in various modules (Postman,Speednet) of Meghdoot software of all mail articlesgiven to them for delivery. This duty will be performedduring the 80 minutes period (60 minutes before thehours of delivery and 20 minutes after return from thebeat) on each working day within the overall duty hours.

(ii) Assistance to Sorting Postman/HeadPostman in beat sorting, wherever available. Wherethere are no posts of Sorting Postman/Head Postman,the Postman will attend to beat sorting.

w Delivery of any pamphlets or Brochurespresented under Direct Post.

w Collection of surplus cash from sub Postoffices lying in the beat and remitting cash to the mainpost office to which they are attached, wheneverordered by the Postmaster.

w Assisting in Table sorting, Segregation ofmissent articles, misdirected articles and Beat sorting.

w Preparation of special delivery slips for bulkaddressees by data entry in the postman module.

w Sorting of accountable articles and Money

w Utilizing the services for data entry of RPLI/PLI proposals and generating acceptance momos forpolicies on payment of some Incentive.

l Child Care Leave in respect of CentralGovernment employees as a result Sixth CentralPay Commission - clarification retgarding-

The order regarding introduction of Child Careleave (CCL) in respect of Central Governmentemployees were issued vide this Department's O.M.of even number dated 11th September, 2008.Subsequently, clarification in this regard were alsoissued vide O.M. dated 29th september, 2008.

2. Consequent upon the implementation of ordersrelating to Child Care Leave, references has beenreceived from various sections regarding the procedurefor grant of this leave etc. In this connection, it is

mentioned that the intention of the Pay Commissionin recommending Child Care Leave for womenemployees was facilitate women employees to takecre of their childreen at the time of need. However,this does not mean that CCL should disrupt thefunctioning of Central Government offices. The natureof this leave was envisaged to be the same as that ofearned leave. Accordingly, while maintaining the spiritof Pay Commission's recommendations intact andalso harmonizing the smooth functioning of the offices,the following clarifications are issued in consultationwith the Department of Expenditure (ImplementationCell) with regard to Child Care Leave for CentralGovernment employees:-

i) CCL cannot be demanded as a matter of right.Uner no circumstances can any employeeproceed on CCL without prior proper approval ofthe leave by the leave sanctioning authority.

ii) The leave is to be treated like the Earned Leaveand sanctioned as ssuch.

iii) Consequently, Saturdays, Sundays, Gazettedholidays etc. falling during the period of leavewould also count for CCL, as in the case ofEarned Leave.

iv) CCL can be availed only if the employeeconcerned has no Earned Leave at her credit.

l Sixth Central Pay CommissionRecommendation-Special dispensation in theform of Special Casual Leave to CentralGovernment Employees with disabilities.

The undersigned os directed to say that theSixth Central Pay Commission had recommended thatthe number of Casual Leave available for employeeswith disabilities should be 12 days as against 8 daysfor other employees and it has been decided that theadditional benefit of 4 days leave shall be granted inthe form of Special Casual Leave. The undersigned isaccordingly directed to convey the sanction of theGovernment that Central Government employees withdisabilities as defmed in the Persons with

Disabilites (Equal Opportunities, Protection of Rightsand Full Participation) Act, 1995 may be granted SpecialCasual Leave for 4 (four) days in a calendar year forspecific requirements relating to the disabilitiy of theofficcial.

l Constitution of Project Management Unit

It has been dicided to establish a ProjectManagement Unit as an independent office for the

exclusive purpose of managing the implementation ofthe 11th Plan Scheme to modernize and computerizethe entire postal network. The responsibilities of theProject Management Unit (PMU) will include:

a. Conceptualization, planning, execution andmanagement of the Plan scheme on a projectmode from inception to end

b. Preparation of a comprehensive need based planfor induction IT in the department

c. Enablement of the selection of projectconsultants and other technology partners torealize the plan

d. Oversight of the project implementation, ChangeManagement and Human ResourceDevelopment

e. Coordinating different aspects of the project withconcerned divisions in the Directorate as wellas with the Circles

f. Maintaining liaison with all other interfacingagencies and stakeholders

g. Entering into contracts with partners/vendorsetc., as per specific authorization and managingthe same and

h. Carrying out all other project related functionsthat may be assigned to it from time to time

2. The Project Management Unit will becomprised of one SAG level officer, on JAG level officer,one STS level officer, one PSS group 'B' officer andsupport staff.

3. The following orders are issued after approvalof the competent authority:

i. Redesignation of the post of DDG (TechnologyPlanning) as DDG (Project Management Unit),Postal Directorate.

ii. Redesignation of post of Director (TechnologyOperations) as Director (PMU), PostalDirectorate.

iii. Temporary diversion of one post of ADG (SCT),which was earlier utilized as ADG, GDSCommittee as ADG (PMU)

iv. Temporary diversion of one post of PSS Group"B" SPG Section will identify a suitablesurplus/vacant post.

l Expenditure Management - EconomyMeasures and Rationalization of Expenditure-Guidelines related to LTC.

Referance is invited to the guidelines on

austerity measures issued vide O.M of even numberdated 5th June, 2008 and DoPT O.M. No. 31011/4/2008-Estt (A) dated 23th September, 2008 regardingacceptance of Sixth Pay Commission'srecommendations related to LTC. Vide the O.M. ofDoPT, it has been stipulated that travel entitlementsfor the purpose of official tour/transfer or LTC will bethe same but no daily allowance will be admissible fortravel on LTC. In order to meet the objective ofexpenditure management in view of the currentEconomy Measures, it is further stipulated that in sofaras travel on LTC is concerned for those entitled totravel by air, the cheapest economy fare ticket will bealowed irrespective of entitlement of such officers totravel while on tour.

These orders come into effect from the date ofissue.

l Expenditure Management - EconomyMeasures and Rationalization of Expenditure -Guidelines related to LTC- Clarifications - reg.

1.1 The undersigned is directed to refer to OM ofeven number dated 10 November 2008 regardingexpenditure management and guidelines for LTC. Inview of the references received in regard to thedifficulties in determination of 'cheapest' economy fare,it is clarified that officers and/or their families maychoose to travel on LTC by any airline provided thatthe fare does not exceed the fares offered by NACIL(Air India) under their LTC 80 scheme effective from 1December, 2008 for sectors covered under the scheme,details of which are available on the website http://w w w . i n d i a n a i r l i n e s . i n / s c r i p t /leavetravelconcession.aspx. For sectors not coveredby the LTC 80 scheme of NACIL, officers shouldensure that cheapest economy tickets are purchasedby their booking through internet/airlines directly/authorized travel agents.

1.2 It may also be certified by each officer whilesubmitting his/her LTC claim that no other benefit, otherthan air travel, has been availed of as a part of anypackage offered by any airline.

2. These orders will be applicable in the case oftickets booked on or after the date of issue. In respectof tickets booked between 10 November 2008 and thedate of issue of these orders, LTC claims may beprocessed for clearance provided full fare economytickets have not been purchased and no other benefits,except air travel, have been availed of.

l Financial assistance in cases of death.

The existing instructions dealing with grant offinancial assistance in cases of death are containedin the Department's letter No. 1-3/99-Wel & Sportsdated 1.06.2000.

2. An item enhancement of financial assistancein such cases was placed before the Postal ServicesStaff Welfare Board in its meeting held on 14.05.08 andthe Board desired detailed examination of the matter.

3. The matter has been examined and as a resultthereof it has been decided to enhance the limit offinancial assistance in cases of death due to riots,attack by the robbers and terrorists while not on dutyfrom the existing Rs. 10,000/- to Rs. 12,000/-. Thelimits of financial assistance in all other categories ofdeath remain unchanged.

4. It is clarified that the financial relief grantedas per the decision of the board would be effectivefrom 2008-2009 and no past case will be re-opened.

l Financial assistance to the Postal Welfareorganizations for running Crèches and tailoringSchools.

As per existing instructions issued vide letterNo. 19-4/99-Wel & Sports dated 01.06.2000, the Deptt.grants financial assistance to Central Postal LadiesOrganization and Circle Postal Ladies Organizationto the tune of Rs. 25,000/- per annum and Rs,. 15,000/- per annum respectively.

2. An item to increase the above limit was placedbefore the Postal Services Staff Welfare Board in itsmeeting held on 14.05.2008 and the Board desired detailedexamination of the matter before taking a final view.

3. The matter was further examined and it hasbeen decided to enhance the grant of financialassistance to Central Postal Ladies Organization fromexisting Rs. 25,000/- to Rs. 35,000/- and in regard toCircle Postal Ladies Organization from existing Rs.15,000/- to 25,000/-

l Financial assistance to T.B. Patients.

As per existing instructions of the Department

issued vide letter No. 15-43/92-WL & Sports dated02.09.1992, financial assistance is payable to the TBpatients who remain on E.O.L. and HPL due to ailment@ Rs.1500/- per month and Rs.750/- per monthrespectively.

2. An item-proposing enhancement to the limitswas placed before the Postal Services Staff WelfareBoard in its meeting held on 14.05.08. However, theBoard desired detailed examination of the matter.

3. In the process of examination and on scrutinyof the information received from all the Circles, it hasbeen noticed hat there are negligible number of casesfalling in this category. Therefore, it has been decidedto do away with this category of financial assistancewith immediate effect.

l Enhancing the grant-in-aid to PostalRecreation Clubs.

The recreation clubs in the Department ofPosts are being given additional grant-in-aid @ Rs.5/- per head per year in accordance with the instructionsof DOP&T issued vide No. 1-4/86-Welfare dated01.09.87. Subsequently the DOP&T had revised itsinstructions vide their letter No. 1-3/98-Wefare dated14.10.1999 enhancing the additional grant -in-aid fromRs. 5/- to 15/-, but these instruction were not to theknowledge of the Department of Posts.

An item to enhance the rate of additionalgrant-in-aid was placed before the Postal Services StaffWelfare Board in its meeting held on 14.05.08. TheBoard desired detailed examination of the matter,before taking a final view in this regard.

The matter was examined particularly in the lightof the instructions dated 14.10.1999 issued by theDOP&T and it has been decided to increase theadditional grant-in-aid from the existing Rs.5/- per headto Rs. 15/- per head, with the matching funding from themembers of the club. Suitable instructions to this effectmay be issued to all concerned under intimation to thisoffice. The provision of matching funding must be ensured.

RESOLUTION ADOPTED UNANIMOUSLY IN THE FEDERAL SECRETARIATMEETING HELD ON 09.12.2008.

The Federal Secretariat of NFPE which met at theoffice of the NFPE on the afternoon of 9.12.2008 onanalysing the entire development of events takenplace including the situation arising out of submissionof Indefinite Strike notice by the GDS Union, hasunanimously resolved to call upon the entirety of postalregular employees to extend total solidarity to thestriking GDS by joining the Indefinite Strike from17.12.2008 and make the strike programme of GDS

a grand success.This Secretariat also resolves unanimously to

call upon the Postal Board to hold meaningfulnegotiations immediately with the Staff Side and rejectthe negative recommendations of the GDS Committeeas well as to modify them as demanded by the unions/ federations and avert the Indefinite Strike in the largerinterest of three lakhs of Gramin Dak Sewaks and alsoto protect tranquillity and peace in Department of Posts.

BUILD UNITY FOR STRUGGLE

NFPE will take every effort to unite the entireorganizations for the struggles in line. We are discussingwith FNPO leaders for forging struggle unity. We arediscussing with the leaders of Confederation forsynchronizing the struggle of all in a comprehensivemanner to ensure total unity during struggle. NFPESecretariat is aware of time constraint on all of us in

general and on the rank and file leadership in particular inorganizing struggles. Let us take things on its priority. Letus first concentrate on our first task of winning the GDSdemands through 17.12.2008 Indefinite Strike or throughnegotiations prior to that. The other struggles shall take itsimportance after the first phase is over. The task isstupendous and the decision of GDS Union to go aheadwithout waiting for others has made the task more complexand complicated. Still we have our historical responsibilityand role to play in the larger interest of three lakhs of GDSand the whole movement itself. Let us play our united role.Let us commence the preparations with war footing.

SHORT OF FUNDS, GOVT FOR PENSION-PF MERGERThe finance ministry has sought comments of thePension Funds Regulatory & Development Authority(PFRDA) to merge its employees ContributoryProvident Funds (CPF) with the New Pension System(NPS) to unburden its underfunded or, in some cases,unfunded liability. The move is seen as an importantstep where the government is gradually delinking itselffrom various pension and provident fund schemes andletting employees opt for best income opportunitiesavailable in the market by investing with a choice offunds managers. The NPS is currently available forgovernment employees, both state and central, whojoined after January 1, 2004. In this new scheme,employees and employers contribution is depositedin the New Pension System fund and the regulator

invests the money in debts and equities through itsselected fund managers. At the time ofsuperannuation, an employee receives 60% of thetotal amount earned through investments and the rest40% is deposited with an insurance fund manager ofthe beneficiary's choice from where he receives amonthly pension.

The NPS fund already has Rs. 4,000 crorewhile the government's decision to merge the CPFwith it will bring in an additional Rs. 10,000 to Rs.12,000 crore. The merger of CPF with NPS mayhappen in the next two months with the PFRDAsupporting the government's proposal, financeministry sources said.

u The National convention on Global Financialcrisis and the need to protect the Banking,Insurance and pension sectors was held at NewDelhi on 12.12.85. The convention wasCosponsored by All India State GovernmentEmployees Federation, Bank EmployeesFederation of India, All India Insurance EmployeesAssociation and the Confederation of CentralGovernment Employees and Workers. SecretaryGeneral NFPE and all other General Secretariesattended the convention. The convention hasresolved to canalize all efforts to educate themasses and co ordinate the working class toregister protest against the proposed reforms inBanking, Insurance and Pension sectors by theUPA Government.

u The All India Convention comprising of all CircleSecretaries and CHQ office bearers of all affiliatedunions of NFPE was held at Guntur on 29.11.08. Itwas unanimously decided to go on indefinite strikefrom 06.01.2009 on postal charter of demands andalso decided to request the Confederation tosynchronize its indefinite strike on all Pay Commissiondemands.

u The National Executive of the Confederation

met on 13.12.08 at New Delhi and took decision toorganize an indefinite strike on 20 point Charter ofDemands from 20.01.2009 and conduct State levelconvention between 06.01.09 to 09.01.09 in whichNational level leaders will participate.

u A grand meeting was organized at AjmerGPO by the Divisional Union and Com. K. V.Sridharan, General Secretary orated. More than 200comrades participated. Com. H. P. Diwakar OGS &Divisional Secretary had made elaboratearrangements for the special meeting. The CHQappreciates his commitment and well conduct of themeeting.

u Based on the approach of the Department innot taking any decision on GDS committee report without consulting the Staff side and the positive approachof the Senior Officers Committee headed by Sri P. K.Gopinath, Chief PMG, Delhi Circle and also the letterof the Department, the NFPE Federal Secretariatdecided to call off the indefinite strike from 19.12.08(after 2 days) and extend solidarity support to strikingGDS union. The GDS union has called off the strikeon 19.12.08 evening after meeting the secretary,Department of posts. Our Red salutes to all thecomrades who participated in the Strike. Lal Salam

8. This 27th AIC of AIPEU Group-C views

with grave concern the decision of the

Government to open about 20,000 franchise

outlets (Private Post offices) during the current

five year plan. The GDS Committee has

recommended opening of more and more

Panchayath Sanchar Seva Kendra (PSSK).

Further there is a move to grant Licence to

Private Couriers by amending the Indian Post

Office Act. This AIC urges upon the Government

to drop the move to open franchise outlets and

PSSKs. This AIC further resolves that any move

to Privatise Postal services by outsourcing its

functions will be opposed tooth and nail by the

entireity of Postal Employees.

9. The prices of essential commodities are sky-

rocketting day by day. The Government of India is not

taking any effective measures to bring down the prices

or to prevent the price rise. The life of common man

has become miserable. The rise in prices of essential

commodities is mainly due to the liberalisation and

privatisation policies pursued by the UPA Government.

The subsidies to the farmers are either curtailed or

stopped. The Government has withdrawn from the

procurement of foodgrains and the floor-price fixed is

far below the expected level. The FCI godowns are

leased out to private agencies such as Reliance etc.

The fair price shops, ration shops and Public

distribution systems have been demolished to favour

multi-national companies to have a free play in the

market. The poor and the middle class employees

and workers are worst-affected by the price rise which

results in erosion of their real wages. Inspite of the

fall in prices of petroleum products in the global

market the UPA Government is not ready to reduce

its prices to give some relief to farmers and other

industrial sectors.

This 27th AIC of AIPEU Group-C strongly

protest aganist the indifferent attitude of the

Government in preventing the rise in prices of

the essential commodities and calls upon the

Postal employees to join the working class

movement in the fight aganist the price rise which

is the aftermath of the wrong policies pursued by

the Government.

The All India Postal Extra DepartmentalEmployees Union has served a Notice for IndefiniteStrike from 17.12.2008. In this background the FederalSecretariat after a thorough discussion on 9.12.2008has resolved to request the Postal Board to commencemeaningful negotiations with the Staff Side to modifythe Nataraja Murti Committee recommendations andsettle the demands to avert the Indefinite Strike forpreservation of tranquillity and peace in the services.

recommendations of the sixth pay conmmission-

Revision of pension of Pre-2006 pensioners/family

pensioners etc.

Kindly refer to the office memorandum F.No.

38/37/08-P&PW(A) of GOI Dated September 1st, 2008

on the subject cited above.

As per paragraph no. 4.1 of the said

resolution, the pension/family pension will be

consolidated w.e.f. 01.01.2006 by adding together:-

i. The existing pension (Basic pension only)

ii. Dearness pension

iii. Dearness relief upto AICPI(IW) average index 536

i.e. @ 24% of pension.

iv. Fitment weightage @ 40% of the existing pension

i.e. Basic pension only.

As per sub paragraph iv above the fitment

weightage @ 40% of existing pension has only been

granted. The DA admissible on 01.01.2006 has been

reduced from 30% to 16% under the revised DA

formula.

In the case of regular employees, the fixation

of pay in the revised pay bands will be calculated by

multiplying the basic pay drawn as on 01.01.2006 on

the existing V CPC pay scales by a factor of 1.86. In

Addition to it annual increment @3% of pay bands,

plus DA thereon will also be payable. As such the

reduction of DA from 30% to 16% will be compensated

to some extent in their cases. In addition to it, their

transport allowance and HRA have also been

increased.

But the Basic Pension of the pensioners will

remain un-changed till the commencement of VII Central

Pay Ccommission.(If any) Accordingly the benefit of

40% fitment weightage on basic pension will lose after

07 years due to the reduction of DA. The below detailed

illustration is self explanatory in this regard.

Total benefit on Pension per month = 13108-11550=Rs. 1558/-Assumed DA as per pre-revised formula:-After 7 year @ 12% per year i.e. 84%On pre-revised pension Rs. 7500/- Rs. 6300/-Calculation of DA (assumed) as per revisedformula:-After 7 year @ 6% per year i.e. 42%(half of 84%) on revised pension Rs. 11300/- Rs.4746/Loss of DA per month (6300-4746) Rs.1554/-

It is very much clear from the above illustrationthat the benefit of fitment weightage @ 40% amountingto Rs.1558/- will lose with in a period of 07 years due

to the loss of Rs.1554/- being reduction in DA. In view of the preceding paragraph, the benefitof revised pension will be ZERO after a laps of a periodof 07 years.II. The increase in the quantum granted by thegovernment vide paragraph no. 4.5 from 80,85,90,95and 100 years of pensioners age is appreciable but itshould start from 70 years of age because in the currentscenario it shall not be viable due to increased cost ofmedical attendance. The proposed increase inquantum of pension needs to be doubled at the age of85 years because the grant of said privilege at the ageof 100 years is a cheap joke with the pensioners.

III. The medical allowance of Rs.100/- per month beingpaid to the pensioners was very meager and has beenwithrawn. It should be restored and increased toRs.650/- per month as in the case of BSNL employeesdue to ever increasing cost of medical attendance.Moreover free indoor treatment in Hospitals should beallowed to the pensioners keeping in view their limitedre-sources.

The LTC facility/encashment should also be allowedto the pensioners as in the case of pensioners of state Govt.

It is worth mentioning here that the Hon'ble

Defence Minister Sh. A.K.Antony has alsorecommended to the Hon'ble Prime Minister of Indiato revise the pension formula of VI CPC in respect ofpensioners of Defence services immediately.

The National Executive of the Confederationmet today as per the notice issued. The meeting waspresided over by Com. S.K.Vyas. The meetingreviewed the implementation of the decision taken atthe meeting held at New Delhi on 26th August, 2008.Taking into account that most of the affiliates haveendorsed the decision taken to organize an indefinitestrike action in pursuance of the 20 point charter ofdemands. The meeting took the following decision.

a) To delete point No. 10 (in part I of the charter ofdemands) i.e. SDA to employees in NE Region.

b) To amend point No.4 in part II of the charter ofdemands as under:

"Replace adhoc bonus with PLB and removethe 60 days ceiling. Implement the decision ofraising the Bonus computation ceiling (Rs3500) to all persons employed by Govt. of India.

c) To serve the strike notice on 2.1.2009 by allaffiliates and the Confederation CHQ at Delhito the respective Heads of Department andCabinet Secretary respectively. by holding amassive demonstration on that day. Comradesfrom Delhi, Rajasthan, Punjab, Haryana, UPand selected comrades from all other stateswill participate in the rally. The number ofComrades each state should deploy toparticipate will be intimated in our next circularletter. The meeting desired that atleast tenthousand comrades should assemble at JantarMantar for the rally in order to manifest our unityand determination in organizing the indefinitestrike.

d) Such Demonstrations will be held on 6th Jan.2009 in all State capitals with massivemobilization of members and will serve the copyof the strike notice on each heads of Offices.

e) The indefinite strike will commence from 20thJanuary, 2009.

f) Besides the 20 point common charter ofdemands the affiliates may add the sectionaldemands as is decided upon by the respectiveorganizational fora.

g) The State COCs will hold state level conventions
