School Board of Levy County Procedures for Florida Best and Brightest Internal Controls

Teacher, Principal, Educational Support Professionals 2019-20

Whereas, the School Board of Levy County, Florida acknowledges and seeks to comply with: - The definition of instructional employees within Section 1012.01(02)(a) through (e) –

Definitions, Florida Statutes; and - The requirements with Section 1012.731 – The Florida Best and Brightest Teacher

Program, Florida Statutes; Whereas, per state law, Levy County eligible charter schools shall receive their proportionate share of funds from the School District’s allocation for the Florida Best and Brightest Teacher Program prior to any awards of these funds to the School District’s eligible full-time Kindergarten through Grade 12 (K-12) or instructional employees within traditional public schools; Whereas, it is the intent of the Levy County School Board to reward as many high performing eligible full-time K-12 or instructional employees as possible with the funds within the School District’s allocation for the Florida Best and Brightest Teacher Program; Whereas, we understand that per state law, K-12 paraprofessional employees may be eligible for an award within the Recognition Award category only within the Florida Best and Brightest Teacher Program and shall be included in that determination; Therefore, the School Board of Levy County will adhere to the terms and conditions related to the School District’s implementation of the Florida Best and Brightest Teacher Program: 1. General Criteria that Apply Across All Award Categories

Pursuant to Section 1012.731 – The Florida Best and Brightest Teacher Program, Florida Statutes, all recruitment and retention awards shall be paid prior to any consideration of recognition awards. A. Any funds remaining after recruitment and retention awards shall be distributed as

recognition awards. B. The amount of the recognition award shall be based upon:

a. The amount of the School District’s final FEFP appropriation received from the Florida Department of Education (FLDOE) for the Florida Best and Brightest Teacher Program; and

b. The total number of eligible full-time K-12 instructional employee candidates. C. If the total number of eligible full-time K-12 instructional employee candidate

requires a total amount for recognition awards that exceeds the amount of the School District’s final FEFP appropriation received from FLDOE for the Florida Best and Brightest Teacher Program, the final award amount shall be prorated accordingly for all eligible full-time K-12 employee candidates.

D. All awards for eligible full-time K-12 instructional employee candidates shall by subject to appropriate employee payroll taxes as required by state and federal law

Schedule of Award Payments All Retention Awards for eligible full-time K-12 or instructional employee candidates shall be paid in one (1) installment no later than the second paycheck in March. All Recruitment Awards for eligible full-time K-12 instructional employee candidates shall be paid in one (1) installment no later than the second paycheck in March. All Recognition Awards for eligible full-time K-12 or instructional employee candidates shall be paid in one (1) installment no later than the second paycheck in May. Eligible full-time K-12 instructional employee candidates who are on approved Family Medical Leave Act (FMLA) leave on the scheduled date of an award payment shall still be eligible to receive the award payment.

Eligible full-time K-12 instructional employee candidates shall receive no more than one (1) type of award (e.g., recruitment, retention, or recognition). All awards are dependent upon the final number of eligible full-time K-12 instructional and paraprofessional employee candidates and final determinations of the funds available within the School District’s allocation received from FLDOE for the Florida Best and Brightest Teacher Program.

2. Retention Awards for Eligible Full-Time K-12 Instructional Employee Candidates within Section 1012.731 – The Florida Best and Brightest Teacher Program, Florida Statutes For the Retention Award, an eligible full-time K-12 instructional employee candidate shall meet the criteria established by the Florida Department of Education. Per state law, an eligible full-time K-12 instructional employee candidate must teach in an eligible school for two (2) consecutive years, including the current school year. Therefore, if an eligible full-time K-12 instructional employee candidate voluntarily transferred from an eligible school in 2018-19 school year to another school for the current 2019-20 school year, then the employee candidate shall no longer be eligible for the Retention Award. Involuntary transfers will be eligible if they meet the required criteria. The teacher must continuously be employed in a classroom teacher position through the payment date of the award or the last scheduled workday of the year in which the award is made, whichever occurs first. Pursuant to Section 1012.731 – The Florida Best and Brightest Teacher Program, Florida Statutes, the amount of the Retention Award for the 2019-20 school year shall be:

A. $2500 for an eligible full-time K-12 instructional employee candidate with a final summative evaluation rating of “Highly Effective” for the 2018-19 school year; and

B. $1000 for an eligible full-time K-12 instructional employee candidate with a final summative evaluation rating of “Effective” for the 2018-19 School year.

3. Recruitment Awards for Eligible Full-Time K-12 Instructional Employee Candidates within

Section 1012.731, Florida Statutes. For the Recruitment Award, an eligible full-time K-12 instructional employee candidate shall: A. Be a new employee employed by the School District for the first time in the 2019-20 school year, hired by the first FTE Date Certain, October 11, 2019, and only eligible for one recruitment award; B. Employed for the 2019-20 school year; C. Be certified and employed as a reading, mathematics, science, computer science, or civics classroom teacher; and D. Meet the requirements to be a “content expert” as defined within Florida State Board of Education Emergency Rule 6AER19-01, Content Expert for Best and Brightest Recruitment Award. E. The maximum amount of the recruitment award for the 2019-20 school year shall not exceed $4,000.

(2018-19) pursuant to Section 1012.34 – Personnel evaluation procedures and criteria, Florida Statutes.

D. Be employed continuously in a classroom teacher position through the payment

date of the award or the last scheduled workday of the year in which the award is paid, whichever occurs first.

E. The recognition award will be provided from the amount remaining after the

recruitment and retention awards have been distributed.

5. Recognition Awards for Eligible Full-Time k-12 Paraprofessional Employees within Section 1012.01(2)(e)- Definitions, Florida Statutes For the Recognition Award, an eligible full-time K-12 Paraprofessional employee candidate shall:

A. Have been hired on or before January 8, 2019. (99 days) B. Be currently employed with the School District in a K-12 Paraprofessional position

listed in Section 1012.01 (2)(e) - Definitions, Florida Statutes; and C. Have been evaluated for the preceding school year (2018-19) using the Educational

Staff Professional System Assessment System;

For the purpose of the Recognition Award, the over-all evaluation of “Outstanding” will equal “Highly Effective” and the over-all evaluation of “Above Satisfactory” will equal “Effective”. An eligible full-time paraprofessional employee candidate shall have a resulting average score on the Evaluation of Educational Staff Paraprofessional Rubric of “Highly Effective” or “Effective” for the 2018-19 school year.

All inquiries should be directed to the Director of Personnel. **Implementation of these procedures shall be under the supervision of the Director of Personnel with the assistance of the Personnel Specialist.

1012.01 Definitions. – As used in this chapter, the following terms have the following meanings:

(2) INSTRUCTIONAL PERSONNEL. – “Instructional personnel” means any K-12 member whose function includes the provision of direct instructional services to students. Instructional personnel also includes K-12 personnel whose functions provide direct support in the learning process of students. Included in the classification of instructional personnel are the following K-12 personnel: Classroom teachers – Classroom teachers are staff members assigned the professional activity of instructing student in courses in classroom situations, including basic instruction, exceptional student education, career education, or adult education. (This is for retention award) Student personnel services – Student personnel services include staff members responsible for: advising students with regard to their abilities and aptitudes, educational and occupational opportunities, and personal and social adjustments; providing placement services’ performing educational evaluations; and similar functions. Included in this classification are certified counselors, social workers, career specialists, and school psychologists. Librarians/media specialists – Librarians/media specialists are staff members responsible for providing school and library media services. These employees are responsible for evaluating, selecting, organizing, and managing media and technology resources, equipment, and related systems; facilitating access to information resourced beyond the school; working with teachers to make resources available in the instructional programs; assisting teachers and students in media productions; and instructing students in the location and use of information resources. Other instructional staff – Other instructional staff are staff members who are part of the instructional staff but are not classified in one of the categories specified in paragraphs (a)-(c). Included in this classification are primary specialists, learning resource specialists, instructional trainers, adjunct educators certified pursuant to s.1012.57, and similar positions. Education paraprofessionals – Education paraprofessionals are individuals who are under the direct supervision of an instructional staff member, aiding the instructional process. Included in this classification are classroom paraprofessionals in regular instruction, exceptional education paraprofessionals, career education paraprofessionals, adult education paraprofessionals, library paraprofessional, physical education and playground paraprofessionals, and other school-level paraprofessionals. 1012.731 The Florida Best and Brightest Teacher Program: The Legislature recognizes that, second only to parents, teacher play the most critical role within schools in preparing student to achieve a high level of academic performance. Therefore, it is the intent of the Legislature to recruit, retain, and recognize teachers who meet the needs of this state and have achieved success in the classroom. RECRUITMENT AWARD

The Florida Best and Brightest Teacher Program is created to provide recruitment and retention awards to classroom teachers, as defined in s. 1012.01(2)(a), and recognition awards to instructional personnel, as defined in s.1012.01(2), to be funded as provided in s. 1011.62(18) To be eligible for a one-time recruitment award as specified in the General Appropriation Act, a newly hired classroom teacher must be a content expert, based on criteria established by the department, in mathematics, science, computer science, reading, or civics. RETENTION AWARD To be eligible for a retention award as specified in the General Appropriation Act, a classroom teacher must have been rated as highly effective or effective the preceding year pursuant to s. 1012.34, and teach in a school for 2 consecutive school years, including the current year, which has improved an average of 3 percentage points or more in the percentage of total possible points achieved for determining school grades over the prior 3 years. RECOGNITION AWARD To be eligible for a recognition award, instructional personnel must be rated as highly effective or effective and be selected by his or her school principal, based on performance criteria and policies adopted by the district school board or charter school governing board. Recognition awards must be provided from funds remaining under the allocation provided in s. 1011.62(18) after the payment of all teacher recruitment and retention awards and principal awards authorized under this section and the General Appropriations Act. History – s. 25, ch. 2016-62; s.46, ch 2017-116; s. 39, ch. 2018-6; s. 19, ch. 2019-23. Note – Section 24, ch. 2019-23, provides that: The Department of Revenue is authorized, and all conditions are deemed to be met, to adopt emergency rules pursuant to s. 120.54(4), Florida Statutes, for the purpose of administering the provisions of this act relating to the Hope Scholarship Program and Florida Tax Credit Scholarship Program. Notwithstanding any other provisions of law, emergency rules adopted pursuant to subsection(1) are effective for 6 months after adoption and may be renewed during the pendency of procedures to adopt permanent rules addressing the subject of the emergency rules. This section shall take effect upon this act becoming a law and shall expire January 1, 2022. Note – Section 49, ch. 2019-23, provides that: The Department of Revenue is authorized, and all conditions are deemed to be met, to adopt emergency rules pursuant to s. 120.54(4), Florida Statutes, for the purpose of administering the provisions of this act.

Notwithstanding any other provision of law, emergency rules adopted pursuant to subsection (1) are effective for 6 months after adoption and may be renewed during the pendency of procedures to adopt permanent rules addressing the subject of the emergency rules. This section shall take effect upon this act becoming a law and shall expire January 1, 2022. Section 19, ch. 2019-23, substantially reworded paragraph (3)(b), which was subject to s. 49, ch. 2019-6. 6AER19-01 Content Expert for Best and Brightest Recruitment Award – In order to allow school districts to distribute recruitment awards in the 2019-20 school year, a content expert in mathematics, science computer science, reading, and civics means the following: For all areas, a person who has sufficient subject matter expertise as set forth in Rule 6A-1.0503(2)(a), Definition of Qualified Instructional Personnel, F.A.C. For the areas of mathematics, science, or computer science, a person who has either: Earned at least a master’s degree in the areas of mathematics, science, or computer science from an institution accredited by the Unites States Department of Education; or Earned at least a bachelor’s degree in the areas of mathematics, science or computer science from an institution accredited by the United States Department of Education and who has at least five (5) years teaching experience in the associated subject area or at least five (5) years work experience in the associated subject area. For the area of civics, a person who has either: Earned at least a master’s degree in political science, American history, social studies, or social science from an institution accredited by the United States Department of Education; or Earned at lease a bachelor’s degree in political science, American history, social studies, or social science from an institution accredited by the United States Department of Education and who as at least five (5) years teaching experience in the associated subject area or at least five (5) years work experience in the associated subject area. For the area of reading, a person who has either: Earned at least a master’s degree in English, English literature, reading, or literacy instruction from an institution accredited by the United States Department of Education; or

I. The Florida Best and Brightest Teacher and Principal Allocation is created to provide recruitment, retention and recognition awards to classroom teachers, instructional personnel, and principals based on criteria as defined in s. 1012.01(2), and is to be funded as provided in s. 1011.62(18).

Definitions For the purpose of this policy, the following definitions shall apply: A. Classroom Teacher – defined in Florida Statute 1012.01(2)(a) to include K-12

teachers that are assigned the professional activity of instructing students in courses in classroom situations, including basic instruction, exceptional student education, career education and adult education. By law it does not include teachers exclusively serving students in Pre-K or post-secondary programs. Teachers will be determined to be “classroom teachers” if they are assigned K-12 students in one or more courses for at least one period during each student day and also provide regular instruction to those assigned students.

B. Content Expert in Math, Science, Computer Science, Reading or Civics –

Defined by Florida State Board of Education Rule 6AER19-01 as a teacher who has earned at least a Master’s Degree in one or more of the associated subject areas, or who has earned a Bachelor’s Degree with at least 5 years of work experience in one or more of the associated subject areas.

C. Instructional Personnel – Defined in Florida Statute 1012.01(2)(a) – (e) The

School Board of Levy County will define qualifying instructional personnel as any K-12 staff member whose function includes the provision of direct instructional services to students or whose functions provide direct support in the learning process of students.

D. Newly Hired – Initial employment with the School Board of Levy County as staff member. This initial employment can be with either a District managed school or charter school; however, a teacher shall only be eligible for one recruitment award with the School Board of Levy County. Teachers previously employed in an instructional capacity in any Levy County school or department, District managed or charter, prior to July 1, 2019, shall not be eligible for an award from this category.

E. Performance Criteria and Policies Adopted by the Board – for the purpose of this award, this provision shall be defined as instructional personnel who received an overall summative evaluation rating of “Highly Effective” or “Effective” for the school year immediately preceding the award year.

F. Principal – defined in Florida Statute 1012.01(3)(c) as K-12 staff members performing the assigned activities as the administrative head of a school and to whom have been delegated responsibility for the coordination and

administrative direction of the instructional and non-instructional activities of the school. This does not include principals exclusively serving Pre-K or post-secondary programs.

G. Qualifying School – A school that has improved an average of 3 percentage points or more in the percentage of total possible points achieved for determining school grades over the past 3 years. Annually, a list of eligible schools will be identified by the Florida Department of Education and provided to the District. Schools that receive an improvement rating instead of a school grade have been determined to be ineligible by the Florida Department of Education Rule.

H. Rated as “Highly Effective” or “Effective” the preceding year – defined as

receiving an overall summative evaluation rating of “Highly Effective” or “Effective” for the school year immediately preceding the award year.

I. Recognition Award – must be rated Highly Effective or Effective the preceding year and selected by their principal.

J. Two Consecutive School Years – the current school year in which the awards are to be paid, and the school year immediately preceding the award year.

II. Award Categories

The following teacher and principal awards are to be provided by the District or applicable charter school governing board utilizing the annual appropriation identified by the State:

A. Recruitment Award: A one-time award for Section 1012.731(3)(a) provides for a newly hired classroom teacher determined to be a content expert based on criteria established under the Florida State Board of Education Rule 6AER19-01 in the areas of math, science, computer science, reading or civics.

1. Began working for the District on or after July 1, 2019 for the 2019/2020

school year, or began working for the District after the completion of the preceding February FTE survey window for all subsequent years;

2. Was employed continuously in a classroom teacher position through the payment date of the award or the last scheduled workday of the year in which the award is paid, whichever occurs first; and

3. Completed any District required application for the award and provided any supporting documentation requested by the District to verify eligibility for the award.

B. Retention Award (Classroom Teacher): Available to classroom teacher who: 1. Received a summative evaluation rating of “Highly Effective” or “Effective”

2. Was employed as a classroom teacher during 3 of the 4 October and February FTE survey windows at the same eligible school over the two-year eligibility period;

3. Are teaching at a qualifying school;

4. Employed in a classroom teacher position at the same qualifying school for two consecutive years through the payment dated of the award or the last scheduled workday of the year in which the award is paid, whichever occurs first; and

5. Completed any District required application for the award, and provided

any supporting documentation identified by the district to verify eligibility for an award.

C. Retention Award (School Principal) – Principal shall be eligible for an annual principal retention award provided he/she: 1. Was employed as a principal during 7 of the 8 October and February

FTE survey windows at the same eligible school over the four-year eligibility period;

2. Are currently serving as the school principal at the same qualifying school through the payment date of the award or the last scheduled workday of the year in which the award is paid, whichever occurs first;

3. Served as the school principal at that same school for 4 consecutive school years, including the current school year; and

4. Completed any District required application for the award, and provided any supporting documentation identified by the District to verify eligibility for an award.

D. Recognition Award: Available to instructional personnel who: 1. Were employed in an eligible instructional position through the payment

date of the award or the last scheduled workday of the year in which the award is paid, whichever occurs first;

2. Received a summative evaluation rating of “Highly Effective” or “Effective” the preceding year;

3. Selected by his/her school principal to receive the award, based on performance criteria and policies adopted by the District or charter school governing board; and

4. Completed any District required application for the award, and provided any supporting documentation identified by the District to verify eligibility

for an award.

III. As determined by the District, employees will only be eligible to receive one award, Recruitment, Retention, or Recognition, provided he/she meets all of the eligibility criteria for each award individually.

A. Eligibility Decisions

As stated above, the District my require an application and/or supporting documentation to be provided by an employee seeking payment of one or more of the awards associated with the Florida Best and Brightest teacher and Principal Allocation. Failure of an employee to provide timely or sufficient applications or supporting documentation, when requested, shall be considered a waiver of eligibility and the employee will not be entitled to an award. The sufficiency of an application and/or supporting documentation for any of the awards associated with the Florida Best and Brightest Teacher and Principal Allocation shall be determined by the Office for Human Resources, such decisions will be considered final.

B. Funding

The Florida Legislature annually establishes the total funding allocation for each school district. The District’s allocation is based on its proportional share of statewide FEFP base funding using weighted FTE. Each approved charter school operating within the District shall be provided its proportional share of the District’s allocation using the same FEFP base funding and weighted FTE formula employed by the state to determine the District’s allocation.

C. Award Amounts

The maximum amount of each award is established by the Florida Legislature through the annual General Appropriations Act. The District and charter school governing boards must pay the full award amounts specified in law for categories 1, 2 and 3 prior to paying any category 4 awards. The amount of individual category 4 awards shall be determined by dividing the number of eligible instructional personnel by the total amount of funding remaining after all category 1, 2 and 3 awards have been paid in full. Should the District’s or individual charter school governing board’s specific appropriation of funds be insufficient to pay the full award amounts specified in law for categories 1, 2, and 3; each award amount shall be pro-rated to match the District’s or charter school governing board’s specific appropriation and no category 4 awards will be paid. The award amounts identified in law, or, in the case of category 4 awards, by policy are considered to be gross award amounts. All applicable employer and

employee withholdings shall be deducted from these gross award amounts prior to payment of any award to an eligible instructional staff member or principal. Final eligibility for all award amounts shall be determined at the end of each academic year, and awards shall be paid prior to the end of the fiscal year.

D. Duration

Should the statutory framework or specific categorical funding appropriation related to the Florida Best and Brightest Teacher of Principal allocation be withdrawn or substantially amended by the Florida Legislature or a court of competent jurisdiction, this policy and the payments of any awards shall be immediately suspended until such time as a successor policy is developed and approved. Should any portion of this policy be determined to be inconsistent with state law or deemed otherwise invalid by a court of competent jurisdiction, this policy and the payment of awards shall be immediately suspended until such time as a successor policy is developed and approved.
