Parjana® Distribution, LLC (the “Company”) and _________________ (the “Installer”) warrant the EGRP® system installed at your location will perform in accordance with the standard of performance quoted to you by the Company for a period of ten (10) years (the “Installation Warranty Period”). Only the standard of performance quoted directly by the Company may be used for purposes of this Warranty.

In the event you desire to make a claim on this warranty, you agree to grant the Company and/or the Installer, and such persons as the Company may designate, the right to access your property at times convenient to you for the purpose of assessing the performance of the EGRP® system installed at your location. If, during the Installation Warranty Period, the Company agrees that the EGRP® system installed at your location is not performing in accordance with the standard of performance quoted to you by the Company, the Company and/or the Installer will take the necessary steps to recon�gure the installation so that it will perform in accordance with the standard of performance originally quoted to you by the Company. You agree that this remedy may include the Company and/or the Installer installing additional EGRP® and Caps at your location and you agree to provide access to your property at times convenient to you for this purpose. Such additional installation would be at no additional cost to you. This Installation Warranty is transferable to new owners of the property where the EGRP® system is installed provided said owners are in compliance with the terms hereof.

This Installation Warranty will be void and of no further force or e�ect if any of the EGRP® system installed at your location has been damaged or removed or there has been a material change to the area where EGRP® system was installed including without limitation signi�cant construction, landscaping, or alteration in ground water �ow, sewer backups, or �ooding conditions outside of original parameters established for this installation.

The foregoing is the sole warranty provided by the Company and/or the Installer regarding the EGRP® system installed at your location. THE COMPANY AND/OR THE INSTALLER MAKE NO OTHER WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO OR IN ANY WAY RELATING TO THE INSTALLATION OR PERFORMANCE OF THE EGRP® SYSTEM, WHETHER BASED ON BREACH OF WARRANTY OR CONTRACT, NEGLI-GENCE, STRICT LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

THE COMPANY AND/OR THE INSTALLER DISCLAIM ANY LIABILITY OR RESPONSIBILITY FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY OTHER EXPENSE CAUSED BY THE INSTALLATION OF USE OF EGRP® OR CAPS WHETHER SAID PRODUCT OR INSTALLATION THEREOF WAS DEFECTIVE OR NOT.

Notwithstanding any other provisions to the contrary, the Company’s and the Installer’s maximum liability pursuant to this warranty shall not exceed the amount received by the Company and/or the Installer in conjunction with this installation. Nevertheless, in the event the Company should at any time o�er or otherwise be obligated to provide, a refund, the Company shall also be entitled to a return of all EGRP® and Caps installed, which the Company must be allowed to obtain upon its own election and at its own expense.

This Installation Warranty is only valid if endorsed by an authorized representative of the Company after the Company veri�es the Installer’s compliance with the applicable policies and procedures.

This Installation Warranty is separate and distinct from the Product Warranty issued solely by the Company warranting the EGRP® system components to be free from manufacturing defects for twenty �ve (25) years.
