DEAR ESOP MAN:

Is it possible for me to retire at 45? What would be the drawbacks of taking money out that early?

DEAR READY:

The ESOP does not provide an option to “retire” at age 45. The Plan’s retirement age is 62, with at least 5 years of service, to receive 100% of your account balance. After meeting those requirements, you will receive your total ESOP account balance the summer following your retirement. The only options to access your ESOP prior to retirement are the diversification options. If you have been in the ESOP for 10 years, there are partial account diversification options available at age 55, and again six years later, that allow you to access up to a total of 50% of the Garney stock balance in your account, less what you have previously diversified. If you decide to leave the company at 45, the Plan requires that your total vested ESOP account will be “segregated” and transferred into the Garney 401(k). Once the funds have been transferred, you will be able to self-direct how you want the money invested in any of the Vanguard funds that are currently available in our 401(k). After you have been gone from your Garney employment for five years, you will be able take a distribution of your Vanguard account in the sixth year after you left. Please be aware that if you do not roll this money over into an IRA, a Roth IRA, or another employers 401(k), you will be subject to both ordinary income taxes as well as a 10% penalty. ESOP Man cautions you that the decision to leave Garney as such a young age is not one to be taken lightly. If you are to consider leaving, it would be wise to consult with outside experts to ensure you are making a wise financial decision.

Win/Win has been one of our Philosophies for many years. Charles Garney instilled this in me when I was just a young ESOP Man back in the ‘80s. Win/Win is a mindset. Put simply, it means you want to develop solutions that are a “win” for you and a “win” for the person you are working with. This is the best long-term solution. REGIONAL PICNICS IN DENVER & KANSAS CITY

Garney held their Annual West and Midwest Area family picnics on Sept. 13 and 20, respectively. The picnics included fun family games, face painting, a dunk tank and great food. UMR was present at both picnics to discuss Garney’s benefits program and gave away raffle prizes to those who participated in the discussions. Looks like everyone had a great time!

We are proud of the fact that Garney is 100% owned by our employees. Employees become owners through our Employee Stock Ownership Plan (ESOP). The ESOP is one of Garney’s two retirement tools. The ESOP holds stock in Garney Holding Company and other cash investments. Garney’s other retirement option, the 401(k), is invested in the funds that you select. The 401(k) portion of the Garney retirement plan is a vehicle by which you can save your own income prior to the normal income taxes being held. In addition to your contributions, Garney will make matching stock contributions to your account.

WHAT IS A 401(k)? A “401(k)” is a qualified plan established by employers (Garney) to which eligible employee-owners can make salary deferral contributions on a pre-tax basis.

WHY SHOULD I CONTRIBUTE? Putting away money for retirement is a wise decision. With a 401(k), you can save for future financial needs through convenient payroll deductions. In addition, your contributions will be matched by company stock.

HOW DOES THE COMPANY MATCH MY CONTRIBUTIONS? To encourage you to contribute your own personal money to a 401(k) for retirement, Garney will match your contributions with company stock. The company will match the first 1% and then 0.5% (one-half percent) on the next 5% of your payroll deferral made to the 401(k) plan. To get the maximum company match, you must put in 6% (see table at right).

IS THERE A VESTING SCHEDULE FOR THE 401(k) LIKE THE ESOP? The vesting schedule for the employee matching stock is different than that for the ESOP. You are 100% vested in your matching stock shares after two years of service. You are always 100% vested in any contributions that you make to the plan.

WHEN AM I ELIGIBLE TO CONTRIBUTE TO A 401(k)? You are eligible to participate in the 401(k) plan after six months of service. At this time, you will receive an enrollment packet to fill out. You will have the option to select the funds you would like to invest in and the amount of your income you would like to invest. Garney offers investment options through Vanguard.

If you do not make a selection at this time, or opt out, you will be automatically enrolled in the plan at 3% of your income. You will be invested in the Target Date Retirement Funds that best match your age and normal retirement. If you do nothing, your contribution will automatically be increased by 1% each year until you reach 6%, at which point it will cap.

If you are like me, I don’t often get word of employees doing well. I only get complaints! The purpose of this email is to let you know how much we appreciate Tim, Lee and Don. Not just for helping us out when we have problems, but for the overall project. As you know, we know Tim and Lee very well and we are getting to know Don also.

These guys are very knowledgeable and perform their duties at the highest level. They are very competent and responsible employees and I would consider them an asset to the profession. What I appreciate the most is their ability to understand everything that is going on with the project and the City functions. I would recommend Garney to anyone.

EMPLOYEE-OWNER SPOTLIGHT: RICARDO LOPEZ

Ricardo (Ricky) Lopez has been with Garney Construction for the past 9 years, loyally working under Superintendent Steve Mertz out of the Atlanta office. Ricky has worked on several projects in Georgia, Florida, Virginia, and North Carolina. Steve Mertz describes Ricky as one of the most dedicated and hardworking employee-owners he has ever had the pleasure of working alongside – always pushing forward with a positive attitude, no matter the job site conditions. Originally from Mexico City, Mexico, Ricky has been a citizen of the United States for the past 18 years. Ricky left Mexico shortly after completing a full duty of three years in the Mexican Army, enlisted from the age of 15 to 18 years old. Ricky has been involved in the construction industry ever since, working on commercial construction before finding his Garney family in 2005. Ricky’s hard work and dedication to Garney is fueled by Garney’s ESOP and 401(k) plans that allow him to plan ahead for his future and better provide for his son, Michael’s, future. After work, Ricky enjoys ice cold Bud Light and country music. His favorite country musician is Conway Twitty.

GARNEY CREWS HELP BUILD NEW TRAINING VAULT

Essential Safety Products (ESP) specializes in distributing occupational safety, health, ergonomic, environmental equipment, and supplies, as well as assisting a wide variety of industries in achieving the goal of total worker safety. Their certified trainers provide courses designed to safeguard employees from the hazards they face every day including simulated situations. Due to their recent move to a new training facility, ESP needed a new confined space simulator. After discussions between Garney and ESP, the conclusion was made that the construction of two partially buried pre-cast vaults and a connecting pipeline were what ESP’s classes needed to simulate confined space safety and rescue tactics. Due to the tight quarters of the new facility, each piece of the four-piece vaults had to be placed by a 200-ton crane. The pieces were able to be offloaded next to the excavation with the largest piece of the vault coming in at 35,000 lbs. The project is now the only realistic training facility of its kind in Colorado. The following companies provided goods and services for this project: Garney provided over 180 hours including a crew of six, a project superintendent, and a regional safety manager; Duffy Crane and Hauling provided the services of the second largest 350-ton hydraulic Terex crane in Colorado that required over 200,000 lbs. of counterweights and volunteered a crew of three; Oldcastle Precast provided a 7 x 11 vault and a 8 x 8 vault, as well as 40 LF of 48” diameter reinforced concrete pipe (RCP); and Hockaday Trucking provided transportation services for Garney’s excavator and crew equipment to complete this project. ESP owner Ed Stephenson is thrilled with the outcome of this project that will tremendously help their training program with realistic confined space simulations. “We couldn’t turn down Garney’s offer to build this vault,” said Stephenson. “Having a real life vault simulator that is good enough for a contractor will definitely be beneficial for training municipalities and engineers. This project exceeded all my expectations.” All team members worked collaboratively together to complete a successful and above all else, safe project, in just over three days.

FAMILY CORNER

Bryan and Indira Muench welcomed their baby girl, Priya Carolina Muench, on August 16, 2014. Priya (above) weighed 7 lbs. 3 oz. and was 20” long.

Will Gulledge and his new wife, Lindsay Froggatt, were married on September 28, 2014, on Amelia Island. Will was a co-op on the Western Wake job site and in estimating as a co-op, then joined Garney full-time in estimating in January 2014. Will is now a Project Engineer on the Airport Water Reclamation Facility Improvements job in Brooksville, Florida.

Congratulations to Patrick and Lisa Vidonish on the birth of their daughter, Lily Marie, on September 4, 2014. Lily weighed 6 lbs. 8 oz. and was 20” long. Above, big sister Anna poses with Lily.

Garney is a contributing sponsor to the YMCA’s Challenger Program that has spearheaded construction of the Pryor Challenger Sports Complex in Kansas City. Project Engineer Tim Hockett and his children, Annie (8), Valerie (6) and Hayden (4), pictured at left, visited the park in early October. “It makes me proud to know that my company would contribute to something like this,” said Tim.

6th District Congressman Sam Graves visited the Ammonia Removal Improvements & Biosolids Dryer project in St. Joseph, Missouri, on August 26, 2014. There were about 20 people in attendance (including four Garney employee-owners) who toured the UV building, discussed regulations and funding, and held a Q&A session. Two local news outlets were there to film the event.

During the Q&A session, Project Manager Jeff Gorman shook Congressman Graves’ hand, introduced himself, and identified Garney as the general contractor constructing the project. Jeff explained that Garney is 100% employee owned and how the ESOP was extremely beneficial to all our families and futures. Congressman Graves signed on to the HR 4837 Bill last year and Jeff encouraged him to sign the Bill again this year.
