At 4:00 p.m., Deputy Speaker Bai Sandra Sin-

suat A. Sema called the session to order.

Pursuant to Section 73, Rule XI of the amended

Provisional Rules of the House, the Members sang

the National Anthem and thereafter, Rep. Jose Car-

Third Reading House Bill No. 6908. EXPLANATIONS OF VOTE

The following Members explained their votes:

1. Representative Brosas, speaking in Fili-

pino, voted against the measure because it

will not end contractualization but will only

legalize the principal-contractor-employer

scheme. She added that the Bill also in-

tends to remove the recognition of so-called

“necessary and desirable” workers which

allows capitalists to avoid regularizing

them. She added that the token provisions

on giving more workers benefits, banning

discontinuous employment, and shortening

probationary periods cannot address the is-

sue of widespread layoffs and tortuous ab-

sence of job security.

2. Representative Casilao voted against the

measure because first, it falls short of ad-

dressing contractualization despite placing

requirements for the registration and ac-

creditation of job contractors. Second, the

removal of the provision on the regulariza-

tion of necessary and desirable workers, is

a step backward for the achievements of the

labor sector on the issue of work regulari-

zation. He added that the Bill’s require-

ments and penalties for labor-only contract-

ing are also inutile because majority of big

businesses, who are prone to go around the

law in order to make profit, are behind such

a practice.

3. Representative Lagman voted for the meas-

ure as he stressed that stamping out irregu-

lar contractualization and the pernicious

practice of end-of-contract (“endo”) is long

overdue. He however asked that a Bicam-

eral Conference Committee address the fol-

lowing:1) the plugging or deletion of the

Bill’s loopholes; 2) inclusion of provisions

to protect workers from illegal dismissal,

such as constructive dismissal; 3) regulari-

zation of repeatedly rehired project em-

ployees; 4) the jurisdiction to award moral

and other damages to illegally-dismissed

workers, by the National Labor Relations

Commission and competent regular courts;

and 5) imprisonment of, in addition to im-

position of fines to erring employers in ac-

cordance with the principle of malum pro-

hibitum.

4. Representative Zarate voted in the negative

as he stressed that the instant measure will

not end labor contractualization. He

pointed out that it contained many provi-

sions that businessmen—who have been vi-

olating workers’ rights and bleeding them

dry for profits—could easily circumvent.

He added that the Bill’s removal of the term

“necessary and desirable” in the classifica-

tion of workers will only encourage further

labor contractualization.

5. Voting in the affirmative, Representative

Atienza said that the Bill will be the first

step in protecting the labor force from

abuse and will give the government more

control over contractualization. Neverthe-

less, he expressed hope about the Sponsors’

promise that the measure was a response to

the over-all problem of casual employment

not only in the private but also the public

sector. He stressed that it was time for the

government to give permanent status to its

employees who have been working as cas-

uals for decades and that he intends to fol-

low it through with a law that will attend to

civil servants who are also being taken ad-

vantage of by the government.

It being a Monday, on motion of Representative

Defensor, there being no objection, the Chair de-

clared a Privilege Hour and thereafter recognized

Rep. Arnolfo "Arnie" A. Teves Jr. for his privilege

speech. PRIVILEGE SPEECH OF

REPRESENTATIVE TEVES

Representative Teves spoke about temporary

restraining orders (TROs) that were allegedly being

traded in the courts and explained how such kind of

corruption often led to further corruption. In partic-

ular, he questioned the past and future issuance of

TROs by several justices of the Court of Appeals in

certain cases including a case that he filed against

the incumbent governor of Negros Oriental. As he

denounced such acts, he challenged the media to be

vigilant and the Supreme Court to be responsive, as

well as reminded President Rodrigo Roa Duterte

about his continued fight to end corruption in gov-

ernment.

At this juncture, Deputy Speaker Cayetano re-

linquished the Chair to Deputy Speaker Linabelle

Ruth R. Villarica.

On motion of Representative Defensor, the

Chair recognized Rep. Anthony M. Bravo, Ph.D. for

his privilege speech.

PRIVILEGE SPEECH OF

REPRESENTATIVE BRAVO (A.)

Representative Bravo pointed out that it was

difficult to secure on-line appointment schedules

for passport application/renewal in the Department

of Foreign Affairs (DFA) allegedly due to the

hoarding and selling of such schedules by several

syndicates. He said that DFA Secretary Alan Peter

S. Cayetano has denied the allegation and explained

that the DFA only opens slots for passport applica-

tions every three months to ensure the security of its

website.

Citing past problems such as the printing of de-

fective passports and illegal subcontracting of e-

passports, Representative Bravo enumerated the

recommendations of the House after it had con-

ducted a probe on the persistent delay in the issu-

ance of passports. He asked what security issues

are triggered if it opens application schedules for six

months instead of three months; and whether the

three-month limitation in passport application was

due to the activities of fixers who had contacts in-

side the DFA.

At this juncture, Deputy Speaker Villarica relin-

quished the Chair to Deputy Speaker Cayetano.

After showing a video presentation of the long

lines of passport applicants in the DFA office in Pa-

say City, Representative Bravo urged the DFA to fix

the problem as soon as possible.

MANIFESTATION OF

DEPUTY SPEAKER CAYETANO

Whereupon, Deputy Speaker Cayetano mani-

fested that inasmuch as her brother is the Secretary

of the DFA, she would personally deliver to him a

copy of Representative Bravo’s (A.) speech. She

commented that in the aforecited video, the passport

applicants were not pre-cleared and exceeded the

day’s limit of 500 clients. She added that the DFA

website has posted information on the status of the

passport problem and the Secretary gave his assur-

ance about immediately solving the matter.

PRIVILEGE SPEECH OF

REPRESENTATIVE CASILAO

Representative Casilao first said that the Ki-

lusang Magbubukid ng Pilipinas (KMP) recently

joined the commemoration of the 31st anniversary

of the Mendiola massacre, which tragedy occurred

on the same day that Republic Act (R. A.) No. 6657

or the Comprehensive Agrarian Reform Program

(CARP) was approved in response to the clamor of

the farmers for genuine agrarian reform. He then

stressed that since the expiration of CARP in June

2014, the government was unable to fulfill its prom-

ise to provide farmers with their own land and to

uplift their living conditions. He said that farmers

from Eastern Visayas will march to Manila next

month to launch a campaign for higher prices for

abaca, palay, and coconut; and to seek help about

pest problems and military operations in their re-

gion.

Thereupon, Representative Casilao stressed

that the peasant sector continued to suffer from the

primary problem of land ownership; and that this

was exacerbated by landlord-tenant relationships,

usurious practices, low prices of agricultural prod-

ucts, and the high cost of farm machineries.

He likewise condemned the extra-judicial kill-

ings of farmers under the Duterte Administration by

members of the Armed Forces of the Philippines

(AFP) as he stressed their (1) opposition to such

killings, the all-out war policy, and labor contractu-

alization, and (2) support for the resumption of

peace talks with the National Democratic Front of

the Philippines.

Representative Casilao subsequently asked

Congress to enact House Bill No. 555 or the Genu-

ine Agrarian Reform Bill (GARB), otherwise

known as the Free Land Distribution Bill, and to

conduct an inquiry into resolutions he filed on hu-

man rights violations in the peasant sector.

PRIVILEGE SPEECH OF

REPRESENTATIVE CASTRO (F.L.)

Representative Castro decried the political har-

assment of Alliance of Concerned Teachers (ACT)

NCR Union President Jocelyn “Ma’am Joy” Mar-

tinez by three policemen in civilian clothes, while

she was holding a class in Imelda Elementary

School in Malabon City. She said that such actions

could also be considered as attacks against the other

members of the union.

Representative Castro then stressed that said

harassment of a known critic of anti-teacher poli-

cies will not stop ACT-NCR Union from fighting

for the rights, welfare, and benefits of the teaching

sector. She called on all teachers and unionists to

remain vigilant, stand on their ground, and continue

to advance their legitimate demands.

Representative Elago spoke about how the

youth could contribute for a wider discourse on the

Administration’s push for charter change. She cited

the heroes and revolutionaries of the nation who

taught the essence of liberty and freedom and their

struggle for democracy and development; and said

that there can be no more fitting way for the youth

to honor the former than to pledge their commit-

ment to genuine social change.

She then said the youth have remained brave,

resilient, and active in the face of many issues such

as labor contractualization, underemployment, and

hazardous working conditions as well as lack of ac-

cess to education, high tuition fees, and repression

in the campus. She called on them to intensify their

awareness and organization as well as their assis-

tance of marginalized and oppressed sectors; and

support the forthcoming national days of action for

free education, human rights, justice, national sov-

ereignty, territorial integrity, and peace.

Finally, she called on the House Committee on

Higher and Technical Education to investigate re-

ports on the implementation and use of funds for the

current academic year’s free tuition policy; noted

ELAGO’S PRIVILEGE SPEECH

On motion of Representative Defensor, there

being no objection, the Body referred Representa-

tive Elago’s privilege speech to the Committee on

Rules for its appropriate action.

TERMINATION OF THE PRIVILEGE HOUR

On motion of Representative Defensor, there

being no objection, the Body terminated the Privi-

lege Hour.

TRANSMITTAL TO THE

On motion of Representative Defensor, there

being no objection, the Chair directed the Secretary

General to immediately transmit to the Senate, cop-

ies of the House Bills that had been approved on

Third Reading.

ADJOURNMENT OF SESSION

On motion of Representative Defensor, there

being no objection, the Chair declared the session

adjourned until four o’clock in the afternoon of
