Alan Peter Zaggy, M. D. , Chapel Hill, North Carolina The Board adopted a motion that Dr. Zaggy's application for licensure not be approved. C. Clement Lucas, Jr. , M. D. , Tuxedo Park, New York The Board reviewed a report indicating that Dr. Lucas surrendered his license to practice medicine in the state of North Carolina on September 10, 1982. The Board adopted a motion that Dr. Zaggy's application for licensurenot be approved.

The Board reviewed a report indicating that Dr. Lucas surrendered his licenseto practice medicine in the state of North Carolina on September 10, 1982.The Board adopted a motion that this report be accepted as information.

The Board reviewed a report indicating that Mr. Clement surrendered his ap-proval to perform medical acts as a physician assistant on September 24,1982. The Board adopted a motion that this report be accepted as information,that the North Carolina Academy of Physician Assistants be informed of Mr.Clement's surrender of his approval to perform medical acts as a physicianassistant, that the state organization be requested to inform the NationalAcademy of Physician Assistants of this action on the part of Mr. Clement,and that, in the future, formal actions regarding physician assistants beincluded in the Board's report to national and state organizations.

The Board reviewed information indicating Dr. Webb has requested reinstate-ment of his DEA privileges, The Board also reviewed a report indicatingDr. Webb is out of North Carolina at the present time. The Board adopteda motion that this report be accepted as information, that Dr. Webb be thankedfor corresponding with the Board, and that Dr. Webb be informed, when hereturns to the state, the Board will consider his request for reinstate-ment of DEA pri vi leges.

Richard Dallas Hamer, M. D. , Charlotte, North Carolina

The Board adopted a mot ion that Dr. Hamer be i ssued a temporary ! i censefor a period not to exceed twelve months and that the conditions ofprobation placed upon Dr,. Hamer's licensure in Cal i forni a be imposed onthis temporary license:

(1) Dr. Hamer shal 1 not apply to the Drug Enforcement Administrationfor a certificate of registration for controlled substance prescri-bing privileges without prior written approval of the Board.

(2) Dr. Hamer shal 1 not prescribe, admini ster„di spense, order, or possessany controlled substance as defined by the Federal Controlled SubstanceAct and shal 1 refrain from consuming any drugs or medi cations whichare not prescribed for him by another physician.

(3) Dr. Hamer shall violate no law of the United States or of the stateof North Carol ina.

(4) Dr. Hamer shal 1 cooperate wi th representatives of the Board inthe moni toring of these condi tions.

(5) Dr. Hamer shal 1 appear before the Board at such time as the Board deemsnecessary, at which time the Board wi 1 1 consider the renewal of histemporary 1 i cense.

The Board adopted a further motion that Dr. Hamer appear before the Boardannual ly, at which time the Board wi 1 1 consider renewal of this temporarylicense. The Board adopted an additional motion that this temporary be re-stri cted to the practi ce of Dermatology and that i t be noted the letterfrom Dr. Lorentz serves as evidence Dr. Hamer has updated hi s therapeuticknowledge.

Joseph Everett Swanton, M. D. , Mountain City, Tennessee

The Board adopted a motion that the charges preferred against Dr. Swantonbe dismissed and that he be so informed.

Hellfried Erwin Sartori, M. D. , Washington, DC

The Board reviewed a request from Dr. Sartori that his North Carolina licensebe registered. The Board adopted a motion that Dr. Sartori be informed theBoard is postponing consideration of his request until a Finding of Facthas been received from the Maryland Board of Medical Examiners.

Rehabilitation of Physicians

Dr. Blackmon reported to the Board that $10,000 seed money for establishinga continuing medical educati on program for impaired physicians wi 11 probablychange hands within a few days as Slade Crumpton of J. L. and J. Slade Crumpton,Incorporated, has indicated he wishes to contribute this amount towardscontinuing medical education in North Carolina. Dr. Blackmon also discussedthe possibility of increasing registration fees to provide money for thisprogram. He told the Board that tax deductible contributions may be made tothe Foundation of the North Carolina Medical Society for the purpose offurthering this program. Dr. Blackmon volunteered to continue working asliaison between the Board and William S. Wood, M. D. , but stated he believeda current Board member might serve more effectively in this capacity.The President thanked Dr. Blackmon for all his efforts in the area ofcontinuing medical education programs for impaired physicians.

Ann Weisler, Application for Resident's Training License

The Board reviewed a request from Ann Weisler that the ECFMG requirementfor licensure be waived. The Board also reviewed information concerningher medical education in England. The Board adopted a motion that theECFMG requirement for a resident's training license be waived but that,if this applicant cannot satisfy the Board she has earned an M. D. degree,her application for a resident's training license not be approved.

Merle June Slifkin Oz, M. D. , Ramat Gan, 52326, Israel

The Board reviewed a report indicating Dr. Oz's postgraduate medicaleducation in Israel is not AMA or AOA approved. The Board adopted a motionthat Dr. Oz not be approved for full medical licensure in the state ofNorth Carolina.

Recent United States Graduates with Indefinite Practice Plans

The Board adopted a motion that, if these applicants have North Carolinapractice sites at the time they apply for licensure, they be consideredeligible to obtain full North Carolina medical licenses; however, ifthese applicants do not have North Carolina practice sites, they be consideredeligible to receive letters of intent.

Ronald M. Ovetsky, M. D. , Roanoke, Virginia

The Board reviewed information indicating this physician who graduatedfrom St. George's University has contacted the Board regarding licensure.The Board adopted a motion that it respond to this inquiry as the Board hasresponded to similar inquiries in the past.

Bee Sting Certificates

The Board adopted a motion that physicians' certifying applicants as havingcompleted the required training procedures to qualify for certificates mustsign, not stamp, these applications for approval.

Board Meetings Rescheduled in Raleigh - October and December, 1983, Meetings

The Board adopted a motion that the October, 1983, Board meeting be heldat the Radisson in Raleigh. The Board adopted a further motion that theDecember, 1983, Board meeting be held at the Sheraton Highwoods.

Biennial Registration Reinstatement

The Board suspended the licenses of the following physicians for failure toregister. As these physicians have now registered, the Board, in accordancewith statutory authority, adopted a motion that the reinstatement of thesephysicians' licenses be approved:

Budget 1982-1983

The Board adopted a motion that the Budget be approved.

Meeting with Dr. Weinerth

The Executive Secretary reported on this meeting. Dr. Weinerth informed Mr.Paris that the physician who issued a letter authorizing contro!led substancesfor a patient is now instructing younger residents under this physician's super-vision regarding the pitfalls of authorizing prescriptions for controlled sub-stances and instructing them in the proper utilization of these drugs. TheExecutive Secretary also reported to the Board that he discussed with MaryFent the fact that the Board of Medical Examiners has rescinded its actionallowing residents to obtain DEA registrations and that„ the Drug EnforcementAdministration, therefore, no longer permits residents at Duke UniversityMedical Center to obtain individual DEA registrations.

Liability Insurance for Board Members

The Executive Secretary reported to the Board that the North Carolina Boardof Medical Examiners does not now carry liability insurance for its members.He stated that Board carried this coverage for a few years but dropped itbecause of expense. Dr. Sullivan expressed concerns regarding the possibilityof malpractice insurance premium increases as a result of a recent suit andalso the fact that, if he applied for licensure in another state, he would beobligated to answer "yes'' to the question, "Have you ever been sued"? Dr.Sullivan requested a full explanation regarding these matters. Dr. Kermonstated the physician Board members' insurance companies covered them inthis action and had been notified of this suit. Dr. Kermon also stated thatMrs. Walston, the public member, and Mr. Paris, the Executive Secretary willbe covered by the Board.

Ewing vonSchmittou

The Board reviewed a letter from this individual inquiring whether he shouldregister with the North Carolina Board of Medical Examiners. The Board adopteda motion that Mr. vonSchmittou be informed that the functions mentioned in hisletter do not constitute medical acts requiring him to be approved by theNorth Carolina Board of Medical Examiners; however, he cannot call himself aphysician assistant or a PA.

Proposed Meeting with the Board of Nursing

The Executive Secretary reported to the Board that Anna Kuba, Executive Di rec-tor of the Board of Nursing, has requested a meeting between Dr. Kermon,Dr. Pagter, Bryant Paris, Anna Kuba, Gene Tranbarger„ and the attorneys forboth Boards to discuss the function of the Joint Subcommittee. The Boardadopted a motion that the Board of Nursing be notified the Board requestsmore information about this proposed meeting to discuss the function of theJoint Subcommittee, specifically, a list of agenda items to be discussed.

James Glendon Trenner, PA, Raleigh, North Carolina

The Board adopted a motion that a letter be wri tten to Mr. Trenner's primarysupervising physician informing him that Mr. Trenner has applied for approvalto perform medical acts in another practice setting. The Board adopteda further motion that this letter also state, if it is the primary super-vising physician's wish that Mr. Trenner accept this additional employ-ment, he may do so, provided the primary supervising physician assumesresponsibility for all medical acts performed by Mr. Trenner in both prac-tice settings and provided there is only one set of standing orders.The Board also adopted a motion that a copy of this letter be sent toMr. Trenner.

Percy E. Golson, PA, Durham North Carol ina

The Board adopted a motion that a letter be written to Mr. Golson's primarysupervising physician informing him that Mr. Gol son has applied for approvalto perform medical acts in another practice setting. The Board adopted afurther motion that this letter also state, if i t is the primary super-vising physician's wish that Mr. Gol son accept this additional employment,he may do so, provided the primary supervising physician assumes responsibilityfor al 1 medical acts performed by Mr. Gol son in both practice settingsand provided there is only one set of standing orders. The Board alsoadopted a motion that a copy of this letter be sent to Mr. Golson.

Proposed Endorsement Regulation Regarding Minimum Acceptable FLEX Scores

The Board adopted a motion that the new regulation regarding minimum accep-toble FLEX scores apply only to applicants who take the FLEX examinationafter January 1, 1983.

License by Endorsement Applicants Who Fail to Appear for Scheduled Interviews

The Board adopted a motion that, unless there are extenuating circumstances,applicants who do not appear for interviews before the full Board afterbeing granted temporary licenses must repeat the entire endorsement process.

Robert A. Muilenberg, M. D. , Arden„ North Carolina

The Board adopted a motion that Dr. Muilenberg be considered eligible fortemporary, limited licensure. The Board adopted a further motion that,if Dr. Muilenberg secures a position working under medical supervision atthe Alcoholic Rehabilitation Center in Black Mountain or in a similar con-

The Board adopted a motion that this matter not be considered at this time,Ihat information on this fee be sent to Board members prior to the December,1982, meeting and that Reconsideration of the Fee for Approval of Changesin Primary Supervising Physicians for Nurse Practitioners be placed on theagenda for discussion at the December, 1982, Board meeting.

Interim Approval of Nurse Practitioner Applications

The Board re-aff i rmed i ts approval of the mechani sm for interim approval ofnurse practitioner applications which may be reviewed and approved by theNurs ing Board, forwarded to the Chai rman of the Joint Subcommi ttee for recom-mendations, and presented to the Board for its consideration.
