THE QUALIFIED BIDDER :1. Juristic Person of either local or foreign nationality.2. Person who is 18 years of age and above.

THE AUCTION EVENT :1. The Auctioneer will designate the place for bidding.2. The Auctioneer will designate the time for bidding.3. The Auctioneer will designate the machines for bidding.

REGISTRATION REQUIREMENTS :1. All local bidders must submit the following documents upon registration :-

1.1 copies of registration form, personal identity card or passport and house registration of the company hereby represented.1.2 copies of company affidavit that is issued by the Ministry of Commerce, complete with any one senior management personnel signature and company’s stamp endorsement. The document is only deemed

valid if the issuing date falls within 3 calendar months from the date of submission.2. All foreign bidders must submit their registration form and passport for copies upon registration.3. All foreign bidders are required to pay a sum of 400,000 Thai Baht or its equivalent of USD$10,000 as collateral cash deposit to the Auctioneer upon registration. All deposit should be made in cash or by T/T

remittance. For locals, cashier cheque and bank drafts are acceptable.4. The Auctioneer will then issue the bidding card to the bidder who has completed all the registration formalities.

HOW TO REGISTERRegistration could be done at the site office either before auction day from 24 JANUARY 2012 onwards or on auction day itself by producing all the above required documents as well as placing a deposit in cashor T/T remittance for foreign bidders and cashier cheque by local bidders.

HOW TO AVOID THE CROWD FOR REGISTRATION !!For Foreign Bidders ONLY

1. Registration form must be completed and returned by fax together with the bank receipt on application for remittance of cash deposit to JSSR’s head office.2. The bidder will then be issued and subsequently informed of their bidding number through fax.3. With the bidding number, the bidder would only need to call at the registration counter on auction day to collect their bidding card and present their passport for copies.

COLLATERAL CASH DEPOSIT1. All unsuccessful bidders are given a full refund on their collateral cash deposit no later than 3 working days after the auction event.2. All successful bidders will have their collateral cash deposit retained by the Auctioneer who will use this cash in part payment towards settlement.

BIDDING PROCEDURE :1. The Auctioneer hereby grants any participant in possession of a bidding card issued by the Auctioneer the right to bid at the auction. This right can be revoked at any point of time upon the sole discretion of the

Auctioneer.Note : Upon misplacement or loss of the bidding card, the registered bidder of the lost card MUST PAY for all items being purchased under the bidding number of his card.

2. The bid will be called in Thai and translated to English concurrently by the Auctioneer.3. The Auctioneer will give the final signal to confirm the sale to the successful bidder.4. The bidder who bids the highest bid for any particular lot accepted by the Auctioneer will be the SUCCESSFUL BIDDER. This agreement to purchase is irrevocable under any circumstances.

INSPECTION : Bidders are free to inspect all the equipment put up for sale from the 24 JANUARY 2012 until the 26 JANUARY 2012, 8:00a.m .–6:00p.m. daily at the auction site. The Auctioneer does not warrant orguarantee the accuracy in the description of the equipment imprinted on the bidding card or catalogue list.TERMS OF PAYMENT : Successful bidders must make full payment for their bids either in cash or by T/T remittance to the Auctioneer on or before 8 FEBRUARY 2012. Successful bidders who fail to pay within the

specified period will be considered as abandoning their purchase. As such, the Auctioneer is entitled to forfeit the collateral cash deposit made by the successful bidder and render the auctionpurchase agreement null and void. The Auctioneer also reserved all rights to take legal action against all successful bidders who abandon their purchase.

VAT 7% : Equipment purchased must be exported from Thailand within 60 days after the Auction. Otherwise, all items will be VAT taxable.NOTE : For foreign bidders who sell their auction purchased items locally (within Thailand) are also LIABLE to pay VAT.

EQUIPMENT REMOVAL PROCEDURE :1. The Auctioneer will hand the equipment and all other necessary supporting documents to the successful bidder when the full payment is made on or before 8 FEBRUARY 20122. All fully paid equipment must be removed from the auction site by 16 FEBRUARY 2012. Otherwise, the successful bidder will be liable to pay the Auctioneer a storage fee of 500 Thai Baht per day per unit of

equipment left in the Auctioneer’s premise for each day exceeding the deadline.3. All transportation costs, dismantling costs and any other related expenses incurred for equipment removal will be charged to the account of the successful bidder.4. In instances where successful bidders authorized any other party besides themselves or the company they represent to remove their equipment, the authorized party upon removal must produce :

- an authorization letter issued by the successful bidder’s company for the removal, endorsed with the company’s stamp and undersigned by a senior management personnel. (Please fill out the authorizationletter enclosed within the biding card.)

- ID card or passport copies of the successful bidder and the authorized party executing the removal.- House Registration document of both the successful bidder’s company and the company of which the removal party epresents.

5. The Successful bidder must provide their own mode of transportation in removing the equipment out of the Auction site The Auctioneer will assist in removing all equipment on to the transportation of thesuccessful bidder. However, the Auctioneer will NOT be responsible for any accidents or damages that may occur during the removal.

6. The Auctioneer will provide all documents the Auctioneer holds to the bidder within 30 days after the auction day. The auctioneer only guarantee that all documents will be valid for 30 days after the successfulbidder receive the documents. The auctioneer will not be responsible for validity of equipment documentation after 60 days from the auction date.

1.1 กรณบคคลธรรมดา ใหแสดงบตรประจำตวประชาชน พรอมสำเนาทะเบยนบานและ เซนชอรบรองสำเนา

1.2 กรณนตบคคล ใหแสดงหนงสอรบรองบรษทฯ ซงผมสทธตามกฎหมายเปนผออกให และภ.พ.20สำเนาบตรประชาชนและสำเนาทะเบยนบานของผมอำนาจ ภายในกำหนดไมเกน 3 เดอนนบตงแตวนทออกจนถงวนททำการประมล (เซนชอและประทบตราบรษท)

2. ผเขาประมล ตองวางเงนประกนกอนทำการประมล 2.1 ลานประมล กม.32

- เงนประกนจำนวน 200,000 บาท (สองแสนบาทถวน) บคคลภายในประเทศ - เงนประกนสกลดอลลารสหรฐจำนวน 10,000 เหรยญ (หนงหมนเหรยญ) บคคลจากตางประเทศ

2.2 ลานประมล กม.35 - เงนประกนจำนวน 200,000 บาท (สองแสนบาทถวน) บคคลภายในประเทศ - เงนประกนสกลดอลลารสหรฐจำนวน 10,000 เหรยญ (หนงหมนเหรยญ) บคคลจากตางประเทศ

3. ผชนะการประมลไมสามารถยกเลกรายการสนคาทประมลไดไมวากรณใด ๆ ทงสน4. ผเขารวมการประมล สามารถลงทะเบยนไดตงแต 24 มกราคม 2555 จนถง 26 มกราคม 2555 และตรวจ

สอบสภาพสนคาทกรายการไดกอนการประมล ตงแต 24 มกราคม 55 จนถง 26 มกราคม 55 และใหยดถอคณสมบตของ สนคาตามสภาพทเปนจรง โดยไมคำนงถงขอความใด ๆ ในเอกสารการประมล

5. ผชนะการประมล ตองชำระเงนคาสนคาครบถวนเตมจำนวนของราคาทประมลภายในวนท 8 ก.พ. 55หากพนกำหนดวนดงกลาวไปแลว จะถกยดเงนประกน และเสยดอกเบยอตรา 15 % ตอปการออกใบเสรจรบเงน / ใบกำกบภาษ

บรษทฯ จะดำเนนการเปดใบเสรจ / ใบกำกบภาษ ตามชอและทอยของผทลงทะเบยนเขารวมประมลเทานน จะไมมการแกไขใบเสรจ / ใบกำกบภาษในภายหลง

การสงมอบ/ การขนยาย1. เมอผทำการประมลไดรบการชำระเงนครบถวนแลว ชำระเปนสกลเงนบาทเทานนหากตอง การชำระ

เปนสกลเงนอนจะตองดำเนนการแลกเปลยนเงนตราเปนสกลเงนบาทในอตราทเทยบเทากบมลคาสนคาทประมลได ผทำการประมลจะสงมอบเอกสารทเกยวของให ผชนะการประมล ณ สำนกงานใหญ กม.35แตจะตองไปรบสนคา ณ ลานประมลททำการขายสนคาตวนนๆ

2. หากตองมการขนยายไปเกบ ณ สถานทอน ผชนะการประมลจะตองเสยคาใชจายในการ ขนยายสนคานน ๆ ในกรณทมความจำเปนตองถอดชนสวนเครองจกรเพอการขนสงผทชนะการ ประมลจะตองรบผดชอบคาใชจายรวมทงดำเนนการเองทงหมดหากตองการวาจางใหผทำการ ประมลดำเนนการใหผทำการประมลจะแจงคาใชจายใหผชนะการประมลทราบ

3. เมอผชนะการประมลไดรบมอบสนคาแลวจะตองขนยายออกจากลานประมลกม.32 อยางชาภายในวนท 16 ก.พ. 55 หากลวงเลยกวาวนทกำหนด ผทำการประมลจะคดคาทจอดเกบเครองจกร วนละ 500 บาท(หารอยบาท) ตอหนงรายการ

4. ในกรณ ผชนะการประมล และ ผรบสนคา ไมไดเปนบคคล หรอ นตบคคลเดยวกน จะตองทำหนงสอมอบอำนาจและเอกสารประกอบตามทผทำการประมลระบไวในทายเลมของหมายเลข บตรประมลเพอใชเปนหลกฐานในการรบสนคาแทน

5. ผทำการประมลจะอำนวยความสะดวกแกผชนะการประมล โดยจดเจาหนาทและเครองมอเพอนำเครองจกรและรายการสนคาตาง ๆ ทประมลไดขนรถบรรทกใหโดยไมคดคาใชจายใด ๆ แตทงนผทำการประมลจะไมรบผดชอบตอความเสยใด ๆ ทงสนอนเกดขนระหวางการดำเนนการให

6.ผทำการประมลจะสงมอบเอกสารประกอบทงหมดทเกยวของกบสนคาใหแกผชนะการ ประมลภาย ใน30 วน หลงจากวนประมล โดยเอกสารดงกลาวสามารถจะนำไปจดทะเบยน หรอ แจงยายไดทนท หากแตผชนะการ ประมลไมไปดำเนนการกบทางราชการภายใน 30 วนหลงจากไดรบเอกสารจากผทำการประมลผชนะการประมลจะตองเสยคาใชจายในการเตรยมเอกสารอน ๆ (ถาม) และทางผทำการประมลไมขอรบผดชอบตอการตดตามเอกสารดงกลาวหลงจากระยะ เวลา เกนกวา 60 วน นบจากวนประมล
