3. (S/NF) JTF GTMO Assessment:

a. (S) Recommendation: JTF GTMO recommends detainee be Transferred to theControl of Another Country for Continued Detention (TRCD).

b. (S) Summary: JTF GTMO assesses that detainee is not member of Al-Qaida and/or itsglobal terrorist network, but is an admitted retired HIG commander who turned his commandover to his sons. Detainee's son Hizatullah Nasrat Yar (ISN US9AF-000977DP (AF-977)) isbeing held at JTF GTMO and his other son, Abdul Wahid, is still at large. Detainee's sonswere involved in the planning and support of attacks on US personnel in the Konar Provinceand it is assessed that detainee was also involved with the activities of his sons. It is assessedthat even after retiring, detainee still had influence among the HIG leadership through hissons and if released, he will still have the ability to plan, support or facilitate acts of terrorismagainst the US and its allies. It has been determined that detainee poses a medium risk to USforces in Afghanistan, and due to his medical condition, he is recommended for Transfer tothe Control of Another Country for Continued Detention (TRCD).

4. (S/NF) Detainee Background Summary: Unless otherwise noted, the followingparagraphs are based solely on detainee's statements.

a. Prior History: Detainee served in the Afghanistan Army in the late 1950's to early1960's for two years as an infantry soldier receiving small arms training. Detainee claims tohave no experience with grenades, explosives, mines or artillery. During the Sovietoccupation, detainee moved his family to Khatako Poal (near Peshawar), Pakistan (PK). In1981, detainee became a commander in Sebghatulla Mohadadi's Hezbi Nejati Mili (NationalRescue Party). During this time period, Gulbuddin Hekmatyer's Hezbe-e-Islami Gulbuddin(HIG) party was the most powerful resistance organization fighting the Soviet occupationdue to US support. Hekmatyer told Mohadadi that his people should join the HIG against theSoviets since he had the support of the US. As soon as Hekmatyer took control of the HeziNejati Mili, he had all of the party's leadership killed and forced the remaining members ofthe Hezi Nejati Mili to join the HIG. As soon as detainee aligned himself with the HIG, hewas told he was not going to be allowed to fight anymore and Muwlavi Bismullah,General/Commander of the HIG, sent him back to his village to be the local HIG militiacommander. (Analyst Note: Hezb-e-Islami (HIG) is a Tier 1 target. Tier 1 targets aredefined as terrorist groups, especially those with state support, that have demonstrated theintent and the capability to attack US persons or interests.)

b. Training and Activities: Detainee was a local HIG commander until his health beganto deteriorate fourteen years ago and he tumed over his command to a Lal Pasha, until Pashafled Afghanistan to Iran following the fall of the communist government in 1991. Detainee's

son, AF-977, was voted the new HIG village commander. AF-977 was the commanderunder theKarzai government under General Engineer Wasil and was instructed to collect allof the weapons from the villagers and store them until further notice. Detainee's son (AF-977) was arrested by US and Afghan forces on 1 March 2003, in Sorobi, AF after he wasreported to be a HIG commander involved in rocket attacks against US forces.

c. Capture Informatioh: On 26March2003, US forces were conducting a buildingsearch for hidden weapons near the Sarobi Dam, AF, based off of a HUMINT sourceclaiming a large number of weapons were being stored in the detainee's house. Detainee didnot resist capture and was asked if any weapons were stored in the home, which he replied"there were no weapons stored in the house." Once weapons were found, detainee stated hehad been directed to collect weapons from the local people for storage by General Wasil andWasil had established a military/police post in his home with him in charge. Weaponsrecovered included 107 mm rockets, multi-tube 107 mm rocket launcher, PKM (crew servedmachine gun), AK-47, and uniforms.

d. (S) Transferred to JTF GTMO: 9 May 2003

e. (S//NF) Reasons for Transfer to JTF GTMO: To provide information on thefollowing: Current operations and leadership personalities of the HIG.

5. (S) Detainee Threat:

a. Assessment: It has been determined that detainee poses a MEDIUM risk, as he islikely to pose atbreat to the US, its interests and allies.

b. Reasons for Continued Detention:

o Detainee's son, Abdul Wahid, replaced his brother AF-000977 upon capture as HIGcommander and is linked to the plot to kidnap US personnel. Abdul Wahid was thegovernor of Laghman Province when the Islamic Transitional Govemment ofAfghanistan came to power, but was replaced due to his known connections withGulbuddin Hekmatyar and the HIG.o Mid-March2}}3, Abdul Wahid was planning to attack US convoys and kidnap USpersonnel on the Kabul to Jalalabad, AF road between Sorobi and Jalalabad. Wahid wasplanning to exchange hostages for a recently captured HIG commander named (FNU)Ezat. Ezat is assessed to be AF-977, detainee's son.o HIG forces commanded by AF-977 were reported to be conducting surveillance onUS forces, coalition forces and Afghan government offrcials for potential rocket attacks

to be conducted in early April of 2003. Two potential targets identified were the KabulHotel and the Presidential Palace in Kabul, AF.o Several documents were recovered from detainee's home. Field exploitation showedthe documents to be: a HIG membership card for one of his sons (AF-977), severalpictures of detainee, which included one of him sitting beside a man signing into HIG,and other various HIG paperwork.o Detainee was captured with a letter discussing an Abdul Azizand Mulam Anifrecruiting Afghan National Army (ANA) members from Sangar, AF to fight against USand coalition forces.o In November 2002, Gulbuddin Hekmatyar reportedly stayed at detainee's compoundin Sorobi, AF.o Detainee claims to be a poor and uneducated man, but detainee has shown inintenogations that he is more educated than he pretends to be. During initialinterrogations in Bagram, AF, dated 28 March 2003 detainee was asked in Pashtu, "What

is your name?" he responded in English, ooWhat's your name?" Detainee also claims hecannot read and write, but letters were found during his capture that were addresseddirectly from him to other individuals such as his son, AF-977.o Detainee is very deceptive and is most likely withholding information regarding hisand his son's involvement with the HIG as well as HIG activities and intentions inAfghanistan. During a debriefing held on 21 June 2004, detainee did not recognize anyphotos of prominent HIG members to include two photos of his son (AF-977).o Detainee has continued to communicate directives concerning weapons and numbersto personnel in the Sarobi District, AF through letters home. The phrasing of the lettersseems to influence the personnel receiving the letters to cooperate with US forces. It isunknown at this time if detainee is being deceptive with the letters or his actual intent isfor the receiver to cooperate with the US forces.

c. Detainee's Conduct: Detainee has a past history of passive behavior. Detainee hasno recorded discipline history and no violent behavior.

6. (S//NF) Detainee Intelligence Value Assessment:

a. Assessment: JTF GTMO has determined that detainee is of MEDIUM intelligencevalue.

o Detainee is a retired HIG commander who was active with the HIG since the Sovietoccupation and would be able to provide historical information on HIG leadership torecent HIG Anti-Coalition operations in the Konar Province, AF, to include theoperations perpetrated by his sons. During the capture of detainee , alarge weapons cache

7. (S) EC Status: Detainee's enemy combatant status was reassessed on 27 June 2004, andhe remains an enemy combatant.
