Greetings ... from behind the mask! For me, it's somewhat hard to comprehend that 2 months after the end of the 'normal' 2020 filing season, here we are. Still drudging through the maze and confusion of new tax laws, coupled with new tax law interpretations, all playing together in the longest tax filing season of all time! And did I fail to mention, those masks? The white ones, the blue ones, the ones with stripes, all of which make conversation somewhat inaudible at best and client recognition nearly impossible. Issue Number: IRS Tax Tip 2020-69 June 11, 2020

Taxpayers will soon be able to file amended tax returns electronically

Later this summer, for the first time taxpayers will be able to file their Form 1040-X, Amended U.S Individual Income Tax Return electronically. Making this form electronically fileable has been a long-time goal for the IRS. It will greatly benefit the tax professional community and taxpayers. The new electronic option will allow the IRS to receive amended returns faster while minimizing errors normally associated with manually completing the form. It will also provide the IRS with more complete and accurate data to help customer service representatives answer taxpayer questions. When the electronic filing option becomes available, taxpayers will only be able to amend tax year 2019 Forms 1040 and 1040-SR returns electronically. In general, taxpayers will still have the option to submit a paper version of the Form 1040-X and should follow the instructions for preparing and submitting the paper form. Whether an amended return is filed electronically or manually, taxpayers can still use the "Where's My Amended Return?" online tool to check the status of their amended return. The New Business Workshop presented by NM Taxation & Revenue is a comprehensive look at the Combined Reporting System (CRS) for Gross Receipts, Withholding and Compensating Tax programs. We will discuss Non-Taxable Transaction Certificates, Estimated income tax payments for business owners, deductions and exemptions from Gross Receipts, special tax programs and audits. We also present e-file training. NMTRD Form ACD-31015 Business Tax Registration Application and Update Form

Revised April 23, 2020

I have been working with a client to try to get them in the NM Managed Audit program. I was surprised when the NM auditor sent me the subject form. He said that it is meant to be the replacement for the Forms ACD-31015 (Application for Business Tax Identification Number) and ACD-31075 (Business Tax Registration Update). They have taken two 1-page forms and replaced them with a 4-page form plus instructions. The link to this form should be in the newsletter. NMSEA Member

Practitioner Liaison, NMTRD 4) NMSEA Happenings newsletters 5) First Friday IRS Liaison Conference Call notes plus any other important information that should be distributed to NMSEA members as soon as possible. If an NMSEA member is not receiving the Constant Contact distributions, please contact Richard Wright, NMSEA Newsletter Editor at [email protected]. According to Constant Contact, the average Open/Download rate for our Constant Contact distributions is about 40% (about 50 of 120 NMSEA members). Some members’ Internet Email Providers have problems with mass mailers. The easiest way to solve that problem is to provide Richard Wright at [email protected] with an alternate email address.

NMSEA May Monthly Meeting May 15, 2020

NMSEA’s first, virtual, monthly meeting on Zoom had 15 attendees. Membership Committee obtained a list of NM EAs (about 130) who are not members of NMSEA. Letters with NMSEA mousepads are being sent to invite them to join NMSEA. Sandy Weidner gave an excellent presentation on “The CARES Act and the SECURE Act.” During the presentation, three polling questions were presented to attendees to validate the one hour of free CPE credit.

NMSEA’s June Monthly Meeting 6/19/2020

Virtually presented through Zoom

Ideally you should use a computer with camera and microphone capabilities. However, any device should work (I pad, Surface, cell phone, etc) but the quality might not be as good. You can also call into the meeting using a regular phone. To enter the meeting, you can either:

1. Click on the Zoom link that has been provided (cut & paste would also work) or

2. Go to Zoom.us and click on the “Join a Meeting”. You will then be asked for the meeting number and the meeting password.

If you have never attended a Zoom meeting, you will be asked if you want to download the Zoom application. This app is free and should only take a few moments to install. Follow the prompts to enter your name and leave your audio and video on. While you are waiting for the meeting to start, you can test your microphone to make sure that the audio is functioning correctly. The meeting will open up at 11:45 AM and all of the attendees will be allowed to enter. You can use this time to wave & chat and smile at each other. Any questions that you have about the Zoom application can be answered. The President will call the meeting to order at Noon and all of the attendees will be muted at that time. Not to worry though as there will be opportunity to ask questions or add to the discussion. After the business portion has been concluded, Troy Scott, EA will make a presentation on The SECURE Act. A FREE 1hr CPE credit will be available to those who choose to stay and watch the presentation. Yes, thanks for asking...there will be a couple of polling questions ….. per IRS requirements. There is absolutely no charge for the education credit. Unfortunately, you will not be able to earn the CPE credit if you are using a regular phone and only have the ability to listen to the presentation. So plan to join and to bring a beverage and/or your lunch and hang out virtually with NMSEA. This is a new adventure for your Education Team so please be patient. It might not go as smoothly as we would like it to. We will welcome your suggestions & criticisms. Paycheck Protection Program (PPP) Loan Forgiveness Changed

In a rare bipartisan effort with only one no vote by Rep. Chip Roy (R-Texas), Congress made changes to the Paycheck Protection Program (PPP) Loan Forgiveness. The Paycheck Protection Program Flexibility Act of 2020 (HR 7010) modifies several provisions of the Paycheck Protection Program (PPP) and amends the Small Business Act and the CARES Act related to:

“Covered period” period for loans Payroll spending requirements Deferral of employer payroll taxes FTEs and salary reduction Loan payoff due date

NAEA E@lert June 5, 2020 Changes to Paycheck Protection Program

E@lert, who discovered an empty 2020 CE bucket recently, yesterday attended the first of a half dozen scheduled June NAEA webinars. Jason Dinesen, EA, led a 1 CE course entitled "COVID-19 Tax Issues Update: The latest news, changes, and guidance." E@lert, who is a bit of a geek, decided to share with Facebook the class in progress. The point today is Jason covered a piece of breaking news: Both the House and Senate had passed a bill (HR 7010) https://www.congress.gov/bill/116th-congress/house-bill/7010 making significant changes to Paycheck Protection Program (PPP) requirements: Covered period: Changes from eight weeks to 24 weeks from loan origination date or December 31, 2020, whichever is later. Payroll cap for non-payroll costs: In order for the PPP proceeds to be forgiven, the CARES Act stipulated no more than 25 percent of expenses could be non-payroll. HR 7010 raises the cap to 40 percent. PROBLEM: the bill also states the loan recipient needs to use at least 60 percent of the covered loan for payroll costs, and implies a cliff. Staff replacement: As long as number of staff or salary/hourly wage are restored to February 15, 2020, levels any time before the end of the calendar year, loan recipients will not need to take a haircut on forgiveness. Tony Nitti (https://tinyurl.com/Tony-Nitti-Article), who is one of E@lert's favorite tax writers, takes a masterful run at both the bill and at framing the PPP issue more broadly: The program includes many missteps and much to irritate many observers, including those who were eligible but did not apply, and those who made decisions weeks ago and cannot, at this late date, take advantage of the HR 7010 language.
