    A regular session of Troy City Council was held Monday, June 1, 2015, at 7:00p.m. in Council Chambers.

    Members Present: Clark, Heath, Kendall, Oda, Schweser, Snee, Tremblay and Twiss. Upon motion of Mr. Kendall, seconded by Mr. Clark, Mr. Phillips was excused from this meeting by unanimous roll call vote.

    INVOCATION: The meeting began with the Pledge of Allegiance, followed by an invocation given by Council Member Kendall.

    MINUTES: The Clerk gave a summary of the minutes of the May 18, 2015, meeting of Troy City Council. There were no corrections or additions to these minutes. A motion was made by Mr. Clark, seconded by Mr. Twiss, to approve these minutes. Motion passed by unanimous roll call vote.

    COMMITTEE REPORTS: Community & Economic Development Committee: Mr. Twiss, Chairman, reported that Committee recommends approval of the rezoning covered by Ordinance No. 0-12-2015. Report signed by Kendall, Schweser and Twiss.

    Law & Ordinance Committee: Mr. Schweser, Chairman, reported that because of safety issues related to some substances that have recently been placed on sidewalks, the Law Director has recommended that legislation be considered to prohibit anyone from placing on a sidewalk any substance that cannot readily be removed with non-pressurized water and a broom and without damaging the sidewalk. Committee noted that the Law Director has also recommended that the City consider legislation that would support the continuation of the painting of strawberries on certain City streets due to the identity of the City of Troy with the Troy Strawberry Festival. Committee recommended that legislation be prepared to:

    1. Amend Section 521.04 of the Ordinances regarding sidewalk obstructions; damages or injury to prohibit the use of any substance on sidewalks that cannot be readily removed with non-pressurized water and a broom and without damaging the sidewalk. Committee supported emergency legislation so that there is no delay in addressing the safety issues.

    2. Authorize the painting of strawberries on City streets around the square area to the same area where the Strawberries have been painted. As the Strawberry Festival will be held soon, Committee supports emergency legislation.

    Report signed by Snee and Schweser. Discussion. Mrs. Oda stated her objections to the legislation amending Section 521.04 and noted three points: 1) She does not feel there is documentation to support the safety and/or damage concerns with superhydrophobic materials used on sidewalks, and believes this is really a way to stop certain messages; 2) She does not believe there is a justification for emergency legislation as the City had been aware of the product being used on sidewalks; and 3) The City should not exempt itself to allow the strawberries to be painted on the streets, especially without documentation that such paint is not slippery. Motion. Mrs. Oda made a motion to return the proposed recommendation to the City and ask the City to give Council a solution within the law that addresses the application of any messaging on public property with any substance, and under any circumstances. Motion failed for lack of second. Discussion. Mr. Schweser commented that he supports people being able to do messaging on sidewalks but he also supports the property owners' rights to remove messaging, so he supports the legislation that limits the material used to that which can be easily removed. -Mrs. Snee commented that there is a concern that certain materials cannot be easily removed and those substances can also create a safety factor. -Mrs. Oda commented that she has an email from a company that the substance can be removed with soap and a broom. -Mr. Titterington advised that when the substance was applied to sidewalks in front of City Hall, it could not be removed with soap and a broom and could not easily be removed with chemical removers, and it took a few applications for removal with the result being the sidewalk was scarred. Addressing Mrs.Oda's points, he commented : 1) Regarding safety, the substance is used to waterproof shoes and to wick away water and reduce the co-efficiency of friction on items such as boats and water skis, and this is supported by academic data; 2) The timing of emergency legislation is due to the combined approaching Strawberry Festival and the

    fact that this item needed to be thoroughly reviewed by the City's Law Director and also by other legal counsel and the City's Insurance Pool; 3) The strawberries are painted by the Strawberry Festival Committee and not the City so the City is not exempting itself. The proposed legislation is not regarding any message as the City is aware of Constitutionally protected free speech messaging. -Mrs. Oda suggested this be addressed as a graffiti issue. -Mr. Clark commented that he supports the right to message but also the right for a property owner to remove a message if he wishes and is concerned about the City's liability should someone be injured from a fall on a slippery surface. -Mr. Twiss asked who is responsible to remove a message; with Mr. Titterington responding that if the property owner chooses to remove a message, that is the responsibility of the property owner. -In response to Mr. Heath, Mr. Livingston confirmed that people may place messages on sidewalk as long as it can be removed as stated in the legislation. -Mr. Schweser noted that, as part of the Strawberry Festival, organizations that have painted strawberries on sidewalks as a fund raiser, but may no longer paint them on the sidewalk or touch up ones previously painted on the sidewalk. It was noted that the berries can be painted on driveways or walkways between the sidewalk and residence.

    CITIZEN COMMENTS: -Brian Kemper, 4012 W. Canal Street, stated he did not believe the amendment to Section 521.04 was about safety as the City had not put up a sign regarding the message on the sidewalk outside City Hall warning that the surface was slippery when wet; rather he believes the objection is to the message applied to the surface. He further commented that if safety is the issue, the City would not allow people to walk on painted strawberries in the street. -Lester Conard, 1210 S. Clay Street, stated he applauded Mrs. Oda for her comments, and said the rest of Council are just "following sheep". He said he feels the issue is not safety, it is about abortion, and the City is using available means to get what it wants. He commented that he wanted to put a sealer on new sidewalk at his residence to protect it, but now cannot.

    COMMENTS OF THE MAYOR: Mayor Beamish commented as follows: -He and other officials recently returned from a good trip to Japan for economic development and a visit to the sister city, Takahashi City. -Troy has achieved bronze status recognition as a bicycle friendly community.

    COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY: Mr. Titterington provided a reminder that the new recycling contract will result in some positive changes. Rather than bins, the containers will be 65 gallon containers on wheels, and this should help curb appeal as material will not blow out of the new containers. Residents can request a second container at no cost. The City and vendor will work together to help provide information to citizens regarding the new recycling containers. In addition the City will be providing information to citizens where the alley collections must be changed to street collections due to size and/or configuration of alleys. Mr. Schweser asked how the new collection may impact areas where there are no drives and cars may be parked in front of the containers. Mr. Titterington commented that is one of the issues that will have to be addressed.

    COMMENTS OF PRESIDENT OF COUNCIL. Mrs. Baker asked if 0-13-2015 means sealants cannot be used on sidewalks, with Mr. Titterington responding "no".

    COMMENTS OF COUNCIL: Mr. Clark stated his wishes for a safe and profitable Strawberry Festival. He also stated he would like to have some information about the criteria to go from bronze to silver status as a Bicycle Friendly Community.

    CITIZEN COMMENT Brian Kemper, 4012 W. Canal Street, accused Mr. Titterington of lying to Council that it is permissible to apply a sealant to a sidewalk as the sealant cannot be removed with soap, water and a brush. Mr. Kemper said that the action of Council is about his messaging and asked if there will be a sign at City Hall next time it rains and stated the City would be hearing from his attorney. Lester Conard, 1210 S. Clay Street, said he now knows he can use the sealer, and that he has used it before and it is slippery.

    SUBJECT: ESTABLISH POSITION OF CONCESSIONS/FOOD & BEVERAGE MANAGER

    SUMMARY REPORT: (To be read at Council meeting) This Committee met on June 10 to consider the recommendation from the Troy Recreation Board to establish the FLSA exempt position of Concessions/Food & Beverage Manager to oversee all concession operations at both the Hobart Arena and the Troy Aquatic Park {TAP). Financial data indicates that bringing this function in-house would make concession purchases more convenient for the customer and should positively impact concession revenues, with an estimated $21,000 per year increase in net revenues once renovations are complete.

    RECOMMENDATION: (To be read at Council meeting) This Committee supports the recommendation of the Troy Recreation Board that all food/beverage concession operations at the Hobart Arena be performed by City staff and we recommend that legislation be prepared to amend the salary ordinance to establish the position of Concessions/Food & Beverage Manager at the pay grade of MGT -1 (range of $47,994.95- $56,233.02).

    This Committee met on June 10, 2015, to consider the recommendation from the Troy Recreation Board to establish the FLSA exempt position of Concessions/Food & Beverage Manager to oversee the concession operations at both the Hobart Arena and the Troy Aquatic Park (TAP). This meeting was also attended by Mayor Beamish, Council President Baker, Council Members Snee and Tremblay, the City Auditor, the Director of Public Service and Safety, the President of the Troy Recreation Board, and members of the City staff.

    Currently the City contracts for a vendor to operate the food and non-alcoholic beverage concession operation at the Hobart Arena and City staff operates the alcoholic beverage concession at the Hobart Arena and the food and beverage (non-alcoholic) concession at the TAP. The current agreement for the concession vendor at the Hobart Arena expires at the end of June. As a part of the plan for the renovation of the Hobart Arena (including expanded concession areas in both size and number) the consultant, Bigelow Companies, has recommended that all concession operations at the Arena be handled by staff. This would make concession purchases more convenient for the customer and should positively impact concession revenues. Customers now have to get into one line/location to purchase alcoholic beverages and an entirely separate line/location for other concession purchases. The recommendation from the consultant further included that a staff person be dedicated as Concession/Food & Beverage Manager to oversee the concession operations. Financial information provided by the Recreation Director indicated an estimated $21,000 per year increase in net revenues once renovations are complete. Those figures are supported by the City Auditor.

    The Recreation Director advised of the plan to eventually partner with non-profit organizations within the Troy community to work concession operations, thereby supporting the fund raising efforts of the non-profit organizations. This would be modeled off the arrangements other venues have established with the non-profit community.

The project was authorized at not to exceed $780,300. The project was recently completed, with total billings from the contractor in the amount of $806,422.20. We were advised that the overage was due to less than favorable soil conditions that resulted in instability and the need for significantly higher quantities of fill material.

    RECOMMENDATION: (To be read at Council meeting) It is the recommendation of this Committee that legislation be prepared increasing the authorization for the North Market Street/Piqua-Troy Road/Troy-Urbana Road realignment project from $780,300 to the amount of $806,422.20. So that final payment can be made to the contractor, we support emergency legislation.

    This Committee met on June 10, 2015, to consider authorizing additional funding for the North Market Street/Piqua-Troy Road/Troy-Urbana Road Intersection Realignment Proje.ct. This meeting was also attended by Mayor Beamish, Council President Baker, Council Members Clark, Kendall and Tremblay, the City Auditor, the Director of Public Service and Safety, and members of the City staff.

    This project was authorized for bidding in 2014, at an amount not to exceed $780,300. $350,000 of the project cost is funded by a grant from the Ohio Public Works Commission (OPWC). The project included a safer intersection with roadway work, extending water and sewer lines through the intersection, and improved storm water. A contract was awarded in the amount of $761,361.59. The project was recently completed, with total billings from the contractor in the amount of $806,422.20. We were advised that the overage was due to less than favorable soil conditions that resulted in instability and the need for significantly higher quantities of fill materials, with this recognized by the City and the contractor.

    The budget breakdown for the project is shown below. The City Auditor advised that fund balances are sufficient to fund any additional costs.

    RECOMMENDATION: It is the recommendation of this Committee that legislation be prepared increasing the authorization for the North Market Street/Piqua-Troy Road/Troy-Urbana Road realignment project from $780,300 to the amount of $806,422.20. So that final payment can be made to the contractor, we support emergency legislation.

    Mrs. Baker, President of Council Utilities Committee NEGOTIATING FOR STREET LIGHTING CONTRACT

    SUMMARY REPORT: (To be read at Council meeting)

    DATE: June 10, 2015

    This Committee met on June 10 to consider if Troy should negotiate jointly with other cities in the region for one price schedule for the next street lighting contract. Recent negotiations have been conducted by the Miami Valley Communications Council (MVCC). MVCC is willing to negotiate the next contract on behalf of the participating communities, and has requested that the communities that intend to be part of the joint negotiations indicate that by July 15.

    RECOMMENDATION: (To be read at Council meeting) It is the recommendation of this Committee that legislation be prepared expressing the intent of the City of Troy to negotiate jointly with other cities in the region on one price schedule under which street lighting services shall be provided. Due to the time frame in which the intent is to be transmitted, Committee supports emergency legislation.

    This Committee met on June 10, 2015, to consider if Troy should negotiate jointly with other cities in the region for one price schedule for the next street lighting contract. This meeting was also attended by Mayor Beamish, Council Member Snee, the City Auditor, the Director of Public Service and Safety, and members of the City staff.

    Troy's current agreement for street lighting expires at the end of this year. For the most recent contract, Troy has been one of approximately 17 area communities negotiating the street lighting contract through the Miami Valley Communications Council (MVCC). For the current three-year contract, Troy's savings in street lighting costs has been estimated to be about $220,000, or about a 19/o savings. MVCC is willing to negotiate the next contract on behalf of the participating communities, and has requested that the communities that intend to be part of the joint negotiations indicate that by July 15.

    RECOMMENDATION: It is the recommendation of this Committee that legislation be prepared expressing the intent of the City of Troy to negotiate jointly with other cities in the region on one price schedule under which street lighting services shall be provided. Due to the time frame in which the intent is to be transmitted, Committee supports emergency legislation.

    RESOLUTION INCREASING THE AUTHORIZATION FOR THE NORTH MARKET STREET/PIQUA-TROY ROAD/ TROY-URBANA ROAD INTERSECTION REALIGNMENT PROJECT AND DECLARING AN EMERGENCY

    WHEREAS, Council previously approved Resolution No. R-27-2014, authorizing the North Market Street/Piqua-Troy Road/Troy-Urbana Road Intersection Realignment Project at a cost not to exceed Seven Hundred Eighty Thousand, Three Hundred Dollars ($780,300.00); and

    WHEREAS, during the course of the project construction there was less than favorable soil conditions that required the use of significantly higher quantities of fill materials than was indicated by the project design, which has resulted in the final cost of the project exceeding the authorization; and.

    WHEREAS, the project is complete and additional funds are now due the contractor.

    NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Troy, as follows:

    SECTION 1: That the authorization for the North Market Street/Piqua-Troy Road/Troy-Urbana Road Intersection Realignment Project is hereby increased by Twenty-six Thousand, One Hundred Twenty-two Dollars and 20/100 ($26,122.20) for a total authorization for such project not to exceed Eight Hundred Six Thousand, Four Hundred Twenty-two Dollars and 20/100 ($806,422.20).

    o Curbside Recycling Program for FY 2015-2017 was awarded to Rumpke of Ohio, Inc., the current vendor. With this new new contract, the containers will be changed from bins to 65 gallon containers (with lids) on wheels. Rumpke will be using new vehicles that allow the driver to use an automated system to manipulate the equipment to empty the container without exiting the vehicle. Rumpke has ordered new fuel efficient and environmentally friendly Compressed Natural Gas (CNG) vehicles to use in Troy. However, due to the availability of these vehicles, Rumpke has advised the City that the vehicles are currently not expected to be available prior to early October. In the meantime, the contractor and the City will be developing educational materials regarding the new curbside collection procedures. As previously commented, there are a number of alleys where the recycling collection will need to be changed to street collection to accommodate the new collection vehicles. The educational materials will include information related to this change, as well as addressing the new containers.

    o Commencing June 15, McKaig Avenue will be closed to through traffic from Monroe Street to Madison Street for the construction of the McKaig Road Improvement Project Phase II. This area will be closed until approximately November 11, 2015. Access for residents in the construction area will be maintained.

    As a reminder, the Downtown Troy Farmers Market will begin on June 13 and will be located on Cherry Street between Main Street and Franklin Street. This Farmers Market will be open Saturdays for business from 9:00 a.m. until noon and will run until September 19. The Downtown Farmers Market plans to have seasonal produce, home-made bakery goods, herbs, honey, jams and jellies, and artisan cheeses for sale.

    City Offices will be closed on Friday, July 3, in observance of the Independence Day Holiday. Residential trash and recycling will be picked up on July 3. The July 4 holiday will also include a morning parade at 9:00a.m. using the route of Staunton Road, South Market Street, Main Street to Monroe Street. In the evening at approximately 10:00 p.m. there will be a fantastic fireworks show.

    The Miami County Council recently recommended that Miami County communities observe Trick or Treat night on Thursday, October 29, 2015, from 6-8 pm. Troy has historically followed the recommendation of the Miami County Council.

    Operations Items of Interest June 12, 2015

    Street -Including Solid Waste- Jerry Mullins, Foreman Collected and transported 264 tons of residential trash since the last report of

    261 tons. Delivered recycling bins as requested. Sign shop worked on various sign projects. Asphalted 4 water services and 19 areas marked for repair. Dura-patched over 67 areas marked for repair. Made 26 asphalt repairs with our infrared machine. Completed the second round of our right-of-way mowing. We will be focusing on

    storm ditch mowing in the subdivisions starting the third week of June. Collected T-bags and brush. Several letters were sent out for non-compliant

    brush piles. We continue to remind citizens that brush must be bundled or placed in T-bags in order for it to be collected by the city. We also are reminding citizens that the Dye Mill Road Facility is open, and we offer that facility in lieu of placing brush at the curb. We are also experiencing a large number of yard waste bags that are not City of Troy bags. We are getting these bags as a onetime courtesy and leaving a door tag to let people know that we only collect City of Troy yard waste bags. A list of these addresses is being maintained to note repeat offenders. Non City of Troy bags placed out for the second time will not be collected.

    Cleaned the downtown area for upcoming events. Placed barricades, and performed other preparation work for the Strawberry

    Festival. Repaired the seam on west bound lanes on West Main Street.

    Electrical - Brian Ferree, Foreman Completed Ohio Utilities Protection Service requests as needed. Installed a new exhaust fan in the golf cart storage area at Miami Shores Golf Course. Installed several temporary electrical panels downtown for the Strawberry Festival. Turned off the school flashers for the season. Installed three new street lights and repaired a gazebo light at Brukner Park. Repaired a street light in Community Park and installed a new electric service drop to

    shelter 14. Installed new electrical drops in the temporary show panel at Prouty Plaza.

    Water Distribution/Sewer Maintenance- Tom Parsons, Foreman Marked numerous Ohio Utilities Protection Service tickets. Investigated numerous high consumption alerts. Completed a number of work orders for Billing and Collection. Shut-off non-payment customers and reconnected as payments were made.

  • Installed water lines at Treasure Island Park. Installed 11 taps for in the Nottingham Subdivision. Filled lines for Nottingham Sections 8 and 9. Installed 4" and 6" valves on McKaig and worked on other water valves for the

    McKaig rehab project. Shut water off at a residence on Mystic Lane due to a broken line inside the

    home. Installed and flushed all lines for Strawberry Festival. Cleaned the fountain on the Public Square and disassembled the water lines

    from fountain. Repaired a lawn on South Short Street after a repair to the water line was made. Repaired a 12" storm line on West Franklin Street. Investigated a sink hole at South Market Street and South Mulberry Street. Found sewer lateral location on Arrow Drive for Engineering. Vacuumed out the tanks for Wastewater Treatment Plant, the tanks from the

    Strawberry Festival, and also vacuumed on McKaig for the construction project. Checked out sanitary hot spots. Marked lines on Williams Street due to emergency gas leak.

    Water Treatment Plant - Jeff Monee For the month of May 2015, the WTP pumped a total of 111.364 million gallons

    (M G) to our distribution system and customers in West Milton and parts of Miami County (avg. 3.592 MG/day). Total precipitation recorded at the WTP for May was 2.64". Respective totals for May in previous years are:

    Nine bulk water account holders withdrew a total of 804,520 gallons from the WTP Bulk Water Station during the month of May; revenue total $6,504.60.

    A total of 9,428,329 gallons were pumped to the Extra High Service pressure zone in northwest Troy by the EHS Booster Station for May 1-31, for an average daily consumption in that zone of 0.3041 MG.

    A long-abandoned well on the Northwest comer of Prouty Plaza will be sealed in accordance with OEPA and Miami County requirements. This work will be done by a certified private well contractor, with assistance from Water Distribution and WTP staff.

    Contractor began removal of 3,600 dry tons of softening residuals from the West sludge storage lagoon on June 1. This process should be completed in approximately eight weeks.

    Our vendor has returned the motor for HS Pump 1 after correcting bearing defects causing high vibration levels.

    The 2015 Annual Water Quality report of all water testing between January 1-December 31, 20 14 has been completed. This document is available for viewing on the City of Troy website at http:/ jwww.troyohio.gov/Document Center/ View/ 825. Notifications of this web link have been printed in the Troy Daily News and on both mailings of June water bills. Printed copies are available at the City Building, Troy Public Library, Miami County Public Health and the WTP.

  • Wastewater Treatment Plant- Tim Snider Held interviews with two engineering firms that submitted RFP's to provide

    design and engineering services for the influent pump replacement project scheduled to take place in 2016.

    Cleaned grease and debris from in front of the equalization basin influent gate and from the old C&D building.

    Our vendor installed the upgraded radios for the lift stations. Our vendor installed the soft starts on aeration tank blowers #2, #3 and #4. Priority pollutant sampling took place on June 11. Staff completed the required preventive maintenance work orders. Our vendor was on site to make necessary repairs to cranes and hoists.

    Barnhart Road, Arthur Road, Oak Contract was awarded to Sturm Construction. Work and restoration is complete along Scott and Frank Streets.

    2013-11 Street, Scott Street & Frank Street Barnhart/SR-718 water main installation and testing is completed, and the water main is online. Restoration

    Waterlines including driveway culverts along Barnhart Road, Arthur Road (SR718) and Oak Street is progressing. Oak Street water main installation and testing is complete.

    2013-12 Finsbury, Governors, & Race Contract was awarded to Finfrock Construction. All water main is installed. The contractor is performing punchlist Waterlines items prior to final completion including record drawings.

    Contract has been awarded to Layne lnliners and Miller Pipeline. We have been notifying property owners as 2014-04 Southview & NE River Sewer Relining necessary for this project. Layne lnliners has completed the lining of the SW interceptor and a walk through for final 2014-05 SW Interceptor Relining site restioration was performed. Miller Pipeline has completed relining in Southview and NE of the river. Miller

    Pipeline is progressing with manhole lining in conjunction with the sanitary sewer relining.

    This phase of the project is between the Adams Street Bridge and Staunton Road. Project was awarded to LJ 2013-14 Adams Street Phase 2 DeWeese. Underground utility work is complete. Stone wall work & railing are complete. Contractor is working on bike path portion of the project. Hobart Arena sign and decorative poles are operational. MV Lighting has been

    contacted to remove the existing street lighting that was used during construction.

    Troy-Urbana intersection was completed on schedule and opened May 1. Final restoration and punchlist items are 2013-02 Piqua-Troy/Troy-Urbana Intersection being performed. Site distance issues to the north are being reviewed. At the June 15 Council Meeting, legislation

    will be considered to increase the authorization of this project.

    MIA- Troy East Main Street Downtown ODOT will fund a portion of this project. Council authorized the AEB's recommendation of modified assessments 2015-01 and authorized the bidding of the project. Council approved an increased authorization at the May 18 meeting. Streetscape (PID 93240) Contract has been awarded to the L J DeWeese Co., Inc. Work start date is pending.

    Hobart Arena Renovation and Council approved the recommendation to enter into an agreement with MSA Architects for the design of this work. 2014-16 Expansion Design development is progressing and bid alternates are being analyzed. Cost estimates are being reviewed with the architect.

    2014-17 Marina & Boathouse Renovation The contract was awarded to Bruns General Contracting. Work is completed on the internal portion of the tower, with the external tower cap work remaining. Canopy connection to the building is being reviewed.

    2014-18 Treasure Island Marina & Park Council authorized the project in an amount not to exceed $1,873,000. Contract has been awarded to Double Jay Improvements Construction. Contractor ha~star!ed_!ree removai__EDd Clty crews are installing water main. --

    I This phase includes work from Monroe Street to Madison Street (RR tracks). Design was coordinated with utility companies and CSX. CSX application for storm sewer has been submitted. Council authorized the project in the

    2014-07 McKaig Road Improvements Phase 2 amount not to exceed $1,142,000. The contract has been awarded to Finfrock Construction Company. A pre-construction meeting was held last week. The project will commence on June 15 with the closing of McKaig Avenue from Monroe Street to Madison Street for approximately 150 days.

    Council authorized an agreement for the design of a new Extra High Service Water Tower with the firm of EMH&T. The design kick-off meeting was held and potential sites determined. The City Engineer has contacted property

    2014-12 Extra High Service (EHS) Water Tower owners to discuss the available opportunities for water tower siting along Washington Road and West Stanfield Road. Positive feedback on potential sites has been received. Site analysis is proceeding forward by the design engineer.

    Council has authorized a contract with RA Consultants. Staff has submitted all requested information for

    2014-03 Water Regionalization Study evaluation, Workshop #2 was held, and the project will continue. Staff and the consultant met with West Milton to discuss details of their existing water system. A separate meeting with Miami County will be scheduled in the near future when RA is ready to proceed with a similar Sewer Regionalization meeting.

    2015-05 Sewer Regionalization Study Council has authorized a contract with RA Consultants, LLC. The City executed the signed agreements. Information is being gathered from Miami County.

    2015-03 Washington Road Waterline Staff entered into an agreement with Choice One Engineering Company for the design of a water loop along Washington Road from West Main Street to West Stanfield Road . Design will begin soon.

    2015-04 Nottingham Subdivision Sewer Gravity Access Engineering, LLC has been authorized to design a gravity sewer from the Nottingham Subdivision to Piqua-Troy Road at Troy-Urbana Road. Design is progressing.

    ANNUAL/OTHER PROJECTS

    Council authorized bidding for the Phase 8 sidewalks where the property owner did not take out a permit to do the 2014-21 Sidewalk Program 8 work. Project was awarded to I. F. Weber. Work has restarted with the remainder of the sidewalk marked for

    replacement. Once the contract is complete, assessments will be finalized.

    2015-14 Paving Program Council authorized a paving program in the amount of $1 ,068,000. That amount includes paving of City streets and other City properties. The contract was awarded to the only bidder, John R. Jurgensen Co. Staff is working with ODOT regarding the paving along SR 55 on the west side of town as well as the traffic circle.

    ODOT Paving (PID 91802) Council enacted the final ODOT Legislation. Milling started this week. Paving will occur during the night beween Sunday- Thursday nights. Affected tenants are being contacted with the help of downtown organizations. Project should be compelted by end of month.

    MV Lighting Street Light Contract - City's Mercury Vapor (MV) street lights to High Pressure Sodium (HPS) street lights as required by law. As a trial, Street Light Conversion LED street lights have been installed on Plum Street, Short Street, Adams Street, and along Shaftsbury Road at Adams Street. Street light additions and possible excess lighting are being monitored in conjunction with the Police

    Department.

    Staff has been working with an outside contractor to make the Engineering electronic files organized in such a way Engineering Electronic File that all staff can have access to most documents. This will improve efficiency with document filing and is expected

    Reorganization to reduce the volume of space necessary to keep the electronic files. Staff is re-implementing project numbers as well. Record drawings organization and personnel file clean-up continues.

    2003-35 Villages of Concord (formerly Oakmont) Section 5 is awaiting final punchlist and final course of asphalt. City is investigating the potential of completing the subdivision via special assessment process.

    2007-19 Pleasantview Estates Section 3 is awaiting final course of asphalt. Section 4 plat has been approved. Construction has not yet begun.

There were 41 permits issued during this time period.

    The second report contains the address, type of concern, and a summary of the current status of on-going issues. Both open and closed concerns are listed and are separated by each ward.

    As in the past, all costs associated with the removal of trash and elimination of noxious weeds will be invoiced to the property owner. If the property owner does not pay the invoice, the cost will be assessed to the property taxes.

I told him that in the City of Troy, we can be more restrictive than the State and we require that vehicles on private property be properly tagged. I suggested he put the car in the garage or move it outside the city limits. He said he was going to park it in front of 1131 Gettysburg and move it every 72 hours. He asked that if he had the 30 days from the state , that would be legal to do, right? I said I don't know I don't handle the street, that's the Police. I called the number of the person on the sign 818-723-7429. His name is Eddie Boyle. I asked about the space for rent sign he has on Michigan. I asked if it was for commercial space. He said it is if you do commercial selling online. I said I really don't do online selling. He asked what I did. I told him I do crafts and needed a small commercial space to sell my stuff. He said he does a lot of crafts, bottle art, and art and even though he doesn't advertise it, he has people come in and buy stuff from him. He just does word of mouth. I asked if I could have any outside sign, he said no. He said he works 3rd shift at Walmart and goes in at 10:00 pm. He said he is there most days from 10:00 am to 6 or 7:00 pm and all day on the weekends. He said I could stop by and look at a space anytime. I asked what his last name is and he said it is Boyle, Eddie Boyle. 6-2-15 sb From what I have seen and from what Charlie Davis told me, Michael has not been here using this property for about a year and a half. The commercial use is prohibited. It was to be used as a warehouse for the storage of books not sublet for other purposes. Therefore, it has lost it's non-conforming use. 6-4-15 sb Tel Michael Kowrach. Explained that Eddie is using the building for retail because he sells his stuff not only online but also to people who come to the building. Explained that this could affect his legal non-conforming status . I spoke with Grant Kerber. He said that before we would take this on as Michael losing his non-conforming status, Grant would want more evidence of the retail use. He said to let Michael know that in the future if the use is altered from a warehouse use, he runs the risk of having to conform to the R-5 zoning district.
