1. Executive Summary
The Law & Justice Commission of Pakistan (LJCP) devised a series of training programs on
appraisal of evidence & procedure of trials for Judges and Lawyers. It was funded by Access
to Justice Development Fund (AJDF). Khyber Pakhtunkhwa Judicial Academy (KPJA) was the
implementing partner, which conducted these training in the Province of Khyber
Pakhtunkhwa. The target districts were Peshawar, Swat, Chitral, Bannu, D.I Khan and
Abbottabad. The key areas were Professional ethics, Proceedings in Civil Cases, Evidence to
substantiate case, Adjournments, Sharia Nizam-e-Adl Regulation (Impact study), Summoning
of witnesses u/s 540 CrPc, significance of Forensic evidence, Pre trial proceedings and Trial
in criminal cases. The trainees were Civil Judges cum judicial Magistrates and lawyers
posted in their respective divisions. The ratio between Civil Judges cum Judicial Magistrates
and Lawyers was one to three. The District and Sessions Judges in consultation with the
Presidents of Bar Association nominated the lawyers for the trainings of their Districts.
The training activity for District Chitral was conducted on 9 & 10th at D.I. Khan, on 11 & 12th
at Bannu, on 13 & 14th, at Swat on 16 & 17th, at Abbottabad on 18 & 19th and at Peshawar
on 20th and 21st June 2014 respectively. It was attended by a considerable number of
participants.
The Resource Persons were mostly Judicial Officers except for Dr. Adnan Khan, Director
Research & Publication KPJA. The Resource Persons included Mr. Azim Khan Afridi, DSJ
Haripur, Mr. Sharif Ahmad Khan, DSJ, Swat, Mr. Adil Khan, DSJ Charrasadda, Mr. Shaber
Khan, DSJ Peshawar, Mr. Rauf Khan, DSJ D.I. Khan, Mr. Shahid Khan DSJ Abbottabad, Mr.
Inam Ullah Khan DSJ Tank, Syed Zamrod Shah, DSJ Bannu, DR. Khurshid Iqbal, Dean, Qazi
Ataullah, and Ms. javeria Sartaj, Director Instructions KPJA.
The course contents were of practical impart to the participants and the method of
instructions was interactive and participatory.

2. Dean's Note
This two-day training was a unique exercise for this Academy. It was conducted on
the advice of Law and Justice Commission of Pakistan, which had designed the
curriculum, selected the number, categories and ratio of the participants (total 100
with 2/3rd lawyers and 1/3rd judges) and the districts of their residences. Very little
was left to this Academy! The Academy is grateful to the LJCP for affording it this
opportunity. I can’t help appreciate the efforts of the LJCP for showing a concern for
training of judges and lawyers and advising this Academy to conduct this training.
For a purely academic purpose and with no malice at all, I take this opportunity to
highlight some key challenges that the Academy faced in organizing this training.
Moreover, a discussion on challenges may prove helpful in any future exercise of
similar nature for this Academy as well as the LJCP. Furthermore, we at this Academy
believe that we learn from our problems and shortcomings.
Two aspects appeared to be challenging. First, the proposed 100 participants for one
course appeared problematic. While the seating space was also a problem, what was
found much more difficult was an effective communication of a resource person
with such a large number of participants. The standard strength of a class we
maintain is 25 participants. This is also with a view to ensure sufficient interaction
between the resource person and the participants. In order to ensure effectiveness
of communication and sufficient interaction, the participants were divided into two
groups. The division helped, though in a limited way, to improve effectiveness of
communication, including interaction, particularly during a question-answer session.
It was not mere a logistical issue, but one that goes to the core of the concept of
training as a branch of adult education. One may appreciate that training is a kind of

adult education (Merrian and Ralph; 2007), seeking to bring about changes in
knowledge, attitudes, values or skills (Darkenwald and Merrian; 1982). Training of
professionals, like judges and lawyers, is a kind of adult education of collegial nature
(Oxner; 2003), relating to job description and requires ‘a separate body of
knowledge, inquiry, research and practice’ (Armytage; 1993). Emanating from
capacity building, judicial training has far reaching implications in wider perspectives,
such as, the rule of law, development and human rights (Armytage; 2003; Iqbal;
2014).
Second, the curriculum though was well designed, but the main points of some
topics seem to be wide and diverse. For example, the topic: “Trial in Criminal Cases”
was proposed to comprise of framing of charge, the when and how aspects of
evidence of prosecution and defence and recording of statement under section 342
Cr.P.C. Each of these sub-topics is so comprehensive that justice could not be done
to a single one in a two-hour lecture. Same could be said about other topics, for
instance, pretrial proceedings and evidence to substantiate case. On balance,
however, topics like importance of expert evidence and disposal of petty nature
criminal cases could be covered in given time.
Despite these two challenges, the Academy has made every effort to best to make
this training a successful exercise. We have a pre-and post-training evaluation
system that works online. A range of questions are asked from the participants on
the commencing day. Almost the same questions are again asked from the
participants on the concluding. This helps us explore the pre-training level and the
needs, including expectations of the participants. In this way, we are able to measure
the success of our course. Given the high number of participants, a good number of

pre-and post-evaluation forms were to be got filled by participants manually. This
manual exercise was difficult to be rigorously monitored. As a result, we could not
receive those forms filled each and every participant. Moreover, from lawyers, the
exact number of participants did not attend the training. Total number of
participants was 346 (252 lawyers and 112 judges). Due to high number of
participants, those registered themselves were 222; the record of 124 is not
available. The pre-and post-evaluation is 69 %. Hence, 69 % evaluation data could be
analyzed. The analyses indicate appreciable improvement in the knowledge and
expertise of the participants.

How to Address Adjournments and Stay Matters By

Introduction
Law relating to adjournment and Stay matter as embodied in Order XXXIX and XVII CPC is
considered purely a discretionary relief. Order XVII as originally enacted consisted of three
rules only.Two more rules were added by Ordinance XII of 1972. Rule 1 gives powers to
court to adjourn if sufficient cause is shown. Succeeding two rules apply to adjourned dates
of hearing in suit. To this extent there is similarity between Order IX and Order XVII .Order
IX provides for consequences of all or any party to suit on the day of hearing. Rule 2 states
that where on adjourned date of hearing court may proceed to dispose off the suit in any of
the modes provided under order IX. Rule 3 confers powers to decide forthwith if party to
suit fails to produce evidence inspite of having been given time. Decision may be the same
day or on any other day, but it should be on merits. Temporary injunctions is a form of
equitable relief and are to be issued in aid of equity and justice. Principle of grant or refusal
is regulated by provision of section 53, Specific Relief Act and Order XXXIX rule 1 and 2 of
CPC.

Main thrust of lecture was to make it more interactive and participatory by involving all the
participants. Relevant Provisions of Specific Relief Act also discussed with specific reference
to pragmatic approach of matter. Adjournment has become menace as this provision is
being misused rather abused for ulterior motives of parties having week case. It was
suggested by the participants that courts need to be more assertive and Bar to strictly

adhere to professional ethics and code of conduct. Similarly while dealing with stay matters
courts should avoid summary disposal of application. While issuing stay order vague and
general terminology should be avoided so as to avoid any interpretation other than
intended by the court.

The lecture encompasses the area of ‘Cognizable Criminal Litigation’ with the specific focus

and submission of ‘Final Report’ (Challan) for Trial of the case in Court, covering the
procedural law contained in S. 4 (f), Chapter V: S.46, Chapter XIV: S.154 to 173, Chapter
XXIV: S.344 and Chapter XXXIX: S.496-497 of Criminal Procedure Code, 1898, pertaining to
inception of cognizable criminal case, arrest of the accused, physical entrustment of custody

judicial confinement, time to time adjournments for completion of investigation and
submission of final report for commencement of court trial.
The fundamental objectives of the lecture, in this prospective, are:
Orientation of the Criminal Law relating to ‘Pre Trial Proceedings’.
Correct understanding of the Law on the subject vis-a-vis its aims of effective judicial
supervision over the investigation process.
Detection of causes of the acute problem of delays in investigation.
Sensitization of the dilemma of unnecessary delays amounting to denial of justice
and motivation for gripping the challenge to eliminate the distress within the existing
legal frame work.
Coordination of judicial Magistrates and Advocates in effective implementation of
relevant instructions of High Court and NJPMC (National Judicial Policy Making
Committee).
This lecture will be a training program for the Judicial Magistrates and Lawyers working at
District Judiciary level who directly concern with the ‘Pre Trial Proceedings’ of the Criminal
Cases.
Methodology:
The lecture starts with light motivating inception to comprehend the audience that their
vision and leadership qualities, augmented by strong will to work, would lead to explore
means and evolve better planning to successfully eradicate core and key issues in shortest
time. The lecture is descriptive, analytical and critical in the sense that it studies the relevant
law mentioned above, and analyzes it, besides its critical survey to discover the causes of
existing hardships and hurdles in its strict implementation. The lecture specifically has direct
micro focusing on the problem of non submission of final report for trial of the case within
14 days that the law codified in S. 173 Cr.P.C. zealously require. The lecture educates about
the practical strategy devised by the speaker with the name of “PTP-Plan” (Pre Trial Pursuit-
Plan) to combat the problem of unnecessary delay in submission of final reports (Challans)
when he was working as District and Session judge at Mardan, in the year 2006-2007. The
PTP-Plan was successfully utilized and the six months achievements report (from 1st January
to 30th June of year 2007) is attached and donated to “Khyber Pakhtunkhwa Judicial

the course and all others, interested. This tool of the lecture would sensitize the participants
that the delays in investigation of criminal cases are curable with attention and hot pursuit,
after establishment of articulate data base.

Summoning of Witnesses U/S 540 CrPC and Significance of Forensic Evidence

Introduction
At the first instance, the lecture discovers the justification of incorporating Section 540 in
the last chapter “Miscellaneous” of the Code of Criminal Procedure. As a second attempt, it
introduces Forensic Evidence with special focus on its evidentiary value.
For Section 540 is not a part of regular trial procedure, the lecture deals it in juxtaposition to
summoning of witnesses u/ss. 244 and 265(f) of the Code. It explores that the later sections
carries the principles of Common Law and as such provide equal opportunity of audience to
Prosecution and Defense. Section 540, on the other hand, has been laid down on the
principles of Equity that ensures the dispensation of justice on the basis of truth; a keynote
for arriving to the just conclusion of the case. Besides, the lecture digs out the philosophy of
seven time repetition of word “any” in a small provision of five lines.
Forensic Evidence is the second concern of the activity. The lecture draws a distinction
between its literal and technical meanings as it differentiates it from Forensic Science. It also
highlights the use of forensic evidence in various disciplines such as Astronomy, Biology,
Geology, Archaeology and the alike. The focus, nevertheless, remains on its use in criminal
causes. Traditionally, such evidence is taken as non-binding and is used for corroboration
only. The lecture explores that the utility of the prevailing practice should be revisited and
such evidence may be classified to conclusive and corroborative, on the basis of latest

modern research. Should our stance remain unchanged despite the discovery of “Genetic
Code” in mid 80’s?
Methodology
Analysis of the relevant provisions will remain the basic technique. Comparison shall also be
drawn between them. The participants shall provide their input, especially when tools of
interpretation are applied. All these peculiarities will render the lecture analytical on one
hand and participative and comparative on the other. As a whole, our approach shall remain
jurisprudential, free of journalistic descriptions.

INTRODUCTION
Since proceedings in civil cases are mainly regulated by the code of civil procedure,
therefore the lecture discusses the most relevant provisions of Code of civil procedure
“CPC”. CPC is a very exhaustive code which is primarily a procedural law but also contains
substantive provisions; and it may not be possible to encompass all provisions in the same
lecture. However an effort has been made to cover all those provisions which relate to
various stages of a civil suit it passes through. This lecture also describes the inter-se

helpful in understanding the very scheme of the Code in its practical application to the
litigation before the court.

Practical application of provisions of CPC to litigations.
Understanding of the powers of court in dealing with civil cases.

Methodology:
The lecture is descriptive as well as analytical. Descriptive in the sense, that it studies and
describes various provisions of CPC and analytical as it analysis the co-existence of the
Sections and Orders, and its applicability to cases before court.

5. Evaluation
6.1 Pre Evaluation & Post Evaluation (Closed Ended Questions)
G1
Analysis:
The graph G1 represents the combined pre and post evaluation result of 06 trainings. The
closed ended questions in the pre evaluation and post evaluation were marked and
compared. A scale of 1-10 has been standardized for the results. The overall score for the
pre evaluation was 6.6 and the post evaluation result was 9.2, which shows significant
improvement in the knowledge based skills of participants after the training. The G1 is
based from the result of different MCQs. Each MCQ has a minimum 03 field (options) for the
participants of the training to choose from. These close ended questions were in MCQs form
and 02 MCQs were taken from each topic taught during the course.

6.2 Over all training Evaluation
According to graph 1, 98% of the trainees opined that course content was quite relevant to
their judicial work. Only 2% opined that the training will bring a little improvement in their
work. This number is negligible. Graph 2 reveals that 100% of the trainees are of the
opinion that the training material was highly useful. About the skills of the trainer, 79% saw
it “very good” and 27% saw it excellent. It shows that there is, though little, room for
improvement. As far as command of the trainers over the subject is concerned, 70% opined
that it was excellent. The remaining graphs shows that the training environment in the
academy was excellent, however their opinions in respect of accommodation and food
quality therein are worthy consideration Note: For the reason that some questions are
similar [see consolidated resource person feedback graph] and the results in graphs are
more or less the same, we have therefore left them uncommented.

(orange) indicates pre – training intellectual level of the trainees at their arrival in the
academy.

Welcome Speech of the Director General
It is a great occasion for Khyber Pakhtunkhwa Judicial Academy that we are entering into a
new era. We are involving the lawyers in the training process. We have many plans and
programmes for the training of lawyers.
Judicial system in Pakistan hinges on two horns of a bull; one is the judges i.e. the district
judiciary as well as the High court and the second is the lawyers, commonly called
advocates. A single bar intervenes between the two; on one side there is judge and on the
other side of the bar there is advocate. Both of them have got similar responsibilities. Both
are answerable to Almighty Allah in the same way. One is to decide and the other is to
assist.
Assistance is sometimes more important than the decision, because decision is made on the
basis of assistance which is given. It is a sort of ladder that when you climb a building, you
use a ladder and if the ladder is strong you reach the roof safely and quickly and if the
ladder is weak there is always a chance that you may fell down and you may not reach the
roof. So to me the person standing on the other side of the bar is more important and more
responsible.
Ladies Gentlemen! You have selected a very tough job. You have selected a job which
imparts more responsibility, which imposes a larger duty of the nation upon you, because
you represent the justice seeker. It is a wrong conception that the plaintiff or the
complainant is the justice seeker and the defendant or accused is not the justice seeker.
Both the parties have come to the court for justice. And their mouths and their faces are
lawyers. This being the position, he is a very important segment of the society. When we
were lawyers we used to hear in the bar and we use to say that we are the cream of the
society. And I still believe that bar is the cream of the society. You are face of the nation. If
you are disciplined, the nation is disciplined. If you fight for justice, the nation gets justice.
Ladies and Gentlemen! This is your Academy. You are an important segment of the justice
system and it is our duty to transfer what we have to improve your capacities. I hope you
will enjoy the day here and your attitudes and behavior will be changed from tomorrow.

Class Representative Remarks (Consolidated)
On behalf of all my colleagues may I take the pride to pay our gratitude to Hon’able Chief
Justice for affording us the opportunity to take part in this one week’s training program. The
Academy is a marvelous achievement and an institution of its own kind. It is a dream come
true and no doubt KPK Judiciary took long strides in this direction. It was not possible
without the able leadership and patronage of the Hon Chief Justice. The way this Academy is
being managed and the efforts being put are excellent by all means. We can foresee that all
these efforts would transform this small Academy to a gigantic centre of excellence of
judicial and legal studies and the milestone is not that far.
Now coming to our training part, within this short span of time we really enjoyed the legal
and academic environment, presentation sessions, views of the resource persons and what
is more the heated debates over a number of issues of jurisprudential concepts and legal
practices. Though this short period of training could not satiate the intellectual thirst, it was
sufficient to make us learn, discuss and debate, share our respective angles of seeing a
thing, share our experiences and what is more we learnt to listen to the mind of each other.
It appears that when we came here we had only our own views and experiences, but while
leaving now we are carrying with us experiences of each other.
On academic part the resource persons, staff of the Academy as well the visiting faculty,
generated sufficient interest to involve us in discussions. We started with important topics
of framing of charge, public nuisance, oath by the parties and its evidentiary significance,
execution of decrees and bail. The lecture on anomalies and conflict between different laws
by Mr. Niaz Khan was most interesting and thought provoking. Specifically after that
particular presentation we felt how deficient we are and we really lack juristic approach for
interpretation of statutes.
We have also been asked to submit detail report as to the quality of training and point out
areas where further improvement can be made. The report shall be prepared and
submitted. This feedback shall help further making the training programs more meaningful
and effective. In that respect few of our suggestions are:
1. Reading material may be provided beforehand.

2. At the start of training, a session may be conducted to apprise the participants how
to participate, discuss things in an impersonal way and listen to other’s point of view with
patience.
3. Each participant must be given at least one topic well before the training to prepare
and present it during the session.
4. More hunting may be made for truly academic and research loving resource persons.
With these humble submissions I again thank you all specially the DG, the academic and
administrative wings for your valuable support and benevolent treatment.
