REPORT OF THE COMMISSION OF INQUIRY INTO ETHN!C VIOLENCEIN KIBUYE

Introduction

From the 18 to 25 August 1992, ethnic violence broke out in Gishyita and Rwamatamucommunes in Kibuye préfecture.

The Council of Ministers, in its meeting on 25 August 1992, decided to set up aCommission of Inquiry to investigate these acts of violence.

I° Composition of the Commission

Pursuant to the Prime Minister’s letter no. 512/02.4 of 27 August 1992 on the saiddecision, the Commission of Inquiry shall comprise the following:

Representatives of the Prime Minister’s office: Juvenal Habimana, Headof the Political and Administrative Affairs Service, Chairman, andAugustin Iyamuremye, Head of the Intelligence Service.

A representative of the Ministry of the Interior and communaldevelopment: Mr. Vénuste NyombayirE, Director of TerritorialAdministration.

2. Mandate of the Commission

In accordance with the terms of the above-mentioned letter, the mandate of theCommission was as follows:

Establish the chronology of events;

Compile a list of victims and an inventory of material and human loss;

Assess the interventions of administrative, judicial and militaryauthorities;

Identify the real instigators and propose appropriate sanctions;

Propose concrete measures to halt the violence and check its propagationto other communes and préfectures;

Submit a report within one week.

3. Methodology

Preparatory meetings were held on 3 and 4 September 1992 and members of theCommission were sub-divided into three groups as follows:

Sub-group A went to Rwamatamu on 7 and 8 September 1992, while sub-groups B and Cwent to Gishyita on 7 and 8 September 1992.

Ail the sub groups carried out their duties in Giteni on 9 and 10 September 1992, meetingvarious civilian authorities (Prosecutor’s office, préfecture) and met the accused personsheld in the Kibuye prison who hail from the various communes visited.

CHRONOLOGY OF THE EVENTS

1.1 In Gishyita commune

The night of 18 to 19 August 1992:

In Rwaramba commune, Gishyita sector at about 8 p.m., Samson Ngirabatware’s (Tutsi)residence was attacked. In the course of that attack:

Mr. Ngirabatware and his son Sahabo sustained serious injury and werehospitalized at Mugonoro.

His three houses were bumt down, his looted was plundered, his coffeeand banana plantations were destroyed and his carie stolen.

In his statement, Mr. Ngirabatware claims to have recognized one Nyamutazi as one ofthe attackers. He further states that there had been a running conflict between them for along time.

19 August 1992

At about 9 p.m. in the evening, Mr. Jean Buhanga (Tutsi) of Karenge cellule, Ngomasecteur and Mr. Francois Mayira (Tutsi) residing in Kigarama secteur, Ngoma communewere also attaeked. During that attack, two (2) of Mr. Buhanga’s cows were slaughteredand two (2) thatch roof kitchens belonging to the victims were burnt down.

20 August 1992

The communal authorities arrested one Nyamutazi (Hutu) and his accomplices,suspeeting them of having attacked Mr. Samson Ngirabatware, and threw them in jail. Inthe evening, Nyamutezi’s acolytes from Gishyita secteur attempted to free them by force

but failed thanks to the vigilance and vigorous intervention of the communal police andthe support of the population.

On that day, some Tutsi were escaping to Mugonero hospital. At about 6.30 p.m., a groupof Tutsi from the same secteur attacked Ntakirutimana, Samson Sekahe, Rwandebo andSefiaku, ail Hutu, from Ngoma secteur. The attacked group to which Gakwerere (Tutsi)belonged called for help the same night.

Nyamutezi’s group which had been chased out and was withdrawing from the CommunalOffice answered the call for help. They retaliated by burning down houses belonging tosome Tutsi in Kigarama commune, particularly the houses of Dan Kayibanda, ThareiseeSegashi, Emmanuel Gasherebuka, Nyakaswa and Mukakimanuka.

Six homes were burnt down in Mpombo secteur.

Towards midnight, two houses belonging to Katarugat and Mutuyeyezu were set ablazein Gisizi cellule Mara secteur, by a group made up of Umwanzavugaye, Ntabareshya andRyamukuru.

21 August 1992

The Tutsi population was panic stricken during that day and began to move towardsMubuga parish, leaving their property and seeking refuge with friendly Hutu families.

In the evening, two groups were spontaneously formed, one Tutsi and the other Hutu.They were set to fight each other. They hurled malicious insults at each other.

1.2 In Rwamatamu commune

20 August 1992

Coffee plantations belonging to farmers’ cooperatives whose members included Tutsi andHutu alike, in Nyaruzima islet, Nyagahinga secteur, Doga cellule were set ablaze byRwayitare and his father Gasarasi (Tutsi) from the same commune.

A house belonging to Kanywabahizi (Hutu) was bumt down by Élie Rugwiza andEshuwa Kanamugire. They were sponsored by Mrs. Marthe Mukamibungo (Tutsi) whopaid them two hundred (200 RFW) Rwandan Francs.

A group of Hutu retaliated by setting tire to houses and coffee plantations belonging toTutsi of Nyagahinga secteur in Doga cellule.

21 August 1992

A group of persons bumt down houses in Rusuzumiro cellule in Butimbo-Rwabisindusecteur.

An atmosphere of tension was observed in Buhambwe and Gihombo cellules ofNyagahinga secteur where Tutis families had gathered, purportedly to protect themselvesfrom possible Hum attacks.

22 August 1992

Fires sparked by Hutus with the support of some Tutsi ravaged Rushoka and Buhambwecellules in Nyagahinga secteur as well as Rwamatamu and Busoro cellules in Gihombasecteur.

23 August 1992

Violence flared up in Butare cellule in Nyagahinga secteur.

24 August 1992

Gihombo secteur is up in flames.

The Tutsi group which had fallen back to Gasagara (Gitwa) in Nyagahinga secteurmoved right down to the Gihombo-Nyagahinga border to provoke Hutu in Gihombosecteur.

25 August 1992

The road in Mugozi cellule, Nyagahinga secteur was closed and 15 offenders werearrested by the forces of law and order.

Violence ignited in Muhoror cellule, Butimbo secteur and houses, coffee plantations andforests were set ablaze.

An attack was launched by Hutus, particularly against Pastor Metusela Musoni’s familyon the grounds of his ethnocentrism and provocative behaviour. The attacks then spreadto the entire Gasagara secteur and to some cellules in Nyagahinga secteur.

II. MATERI~ AND HUMAN LOSS

1. Human Loss

Following the violence that rocked the two communes, seven persons died, namely:Bitwayiki, Makango, Rupfunda and Munyarurembo in Rwamatamu commune, andMuakakimanuka, Nzamwita and BucyihindukA in Gishyita commune.

About twenty people were wounded in Rwamatamu commune. In Gishyita commune, thefollowing were also wounded:

2. Material LossDamage was caused mainly through the torching of residential buildings, coffeeplantations and the destruction of banana plantations.

Furthermore, a great number of carie, cows, goats, rabbits, chicken and other propertywere looted or ruthlessly set on tire inside the houses.

In Gishyita commune, the roofs, doors and windows of 11 tin-roofed houses, 80 thatched-roof houses were severely damaged. Moreover, outbuildings in residential homes sueh askitchens, cowsheds for cattle and goats, and henhouses were mot spared.

Indeed, 14 tin kitchens and 88 thatched-roof kitchens were either partially or completelydestroyed.

In Rwamatamu commune, 135 main buildings in tin and 72 thatched houses were alsodestroyed along with their 20 tin and 126 thatch outhouses.

As concems livestock, the information available to the Commission does mot shedsufiïcient light on the scope of the damage. However, it is estimated at some fifteencows, forty goats, fifteen ehickens and ten rabbits either were stolen or perished in therires.

For lack of time, it was mot possible to gather specific information on the scope of thedamage done to coffee and banana plantations either by buming or destruction.

The annexed tables however provide a picture of the damage done in the affectedcommunes.

III. INTERVENTION OF ADMINISTRATWE, JUDICIAL AND MILITARYAUTRHORITIES

1. ADMINISTRATIVE AUTHORITIES

1.1 Authorities at the commune and secteur levels

On the whole, a generalized failure on the part of the basic administrative structures inthe communes and secteurs was observed.

In fact, a cloud of insecurity hung over the region, but cellule committee officiais andsecteur conseillers failed to organize meeting to sensitize and inform the population inorder to pre-empt the impending danger.

This irresponsible behaviour apparently stems from generalized laxity within thesestructures and the advent of multi-party politics. The foundation of authority was thusweakened by:

The language used by political party leaders who had no consideration foradministrative authorities;

The greater attention and esteem being given by party members to theirparty officiais;

The "KUBOHOZA" activities undertaken by members of some politicalparties;

The freeze on allowances to members of cellule committees.

1.2 The bourzmestre

Following the outbreak of the events in Rwamatamu commune, the bourgmestrepromptly organized field trips and sensitization and pacification meetings.

As soon as he was notified by the Prosecutor and the préfet, the bourgmestre of Gishyitagot involved in the Samson Ngirabatware case. He however subsequently did not takethe necessary measures to bring under control this situation which was likely to eruptinto violence and spread to other secteurs of the commune.

This inertia continued even afler the hosfilities had ceased. Let me underscore the factthat on 24 August 1992, the bourgmestre went to Mara and Murangara secteurs, toreceive and/or participate in a meeting with the population chaired by the PrimeMinister when he was in that part of the commune. The lone pacification meeting in thatpart of the commune held in Mara secteur and was presided over by the Conseiller ofthe said secteur on 31 August 1992, several days airer the events had taken place.

1.3 The préfet

As soon as the préfet received information on the violence of 20/08/1992, he requestedthe rapid intervention of the services of the Armed Forces, the Prosecutor’s office, theintelligence services of the prefectoral of~ce and ORINFOR, each in their variouscapacity. He then informed the central administration and charities accordingly.

1.4 The Govemment

Following a decision by the Council of Ministers, the Prime Minister traveled on 24 and26 August 1992, while the Minister of the Interior and Communal Development and theMinister of Defense travelled on 22, 24 and 26 August 1992.

They conveyed a message of pacification to the people they met on their way, andinformed them of the measures that had been taken to strengthen security.

2. JUDICIAL AUTHORITIES

The intervention of the Kibuye Prosecutor’s office came late. Though it had been warnedby the préfet since 19 August 1992, it only intervened on the 23 August 1992.

Similarly, the Gishyita and Rwamatamu IPJ [Criminal Investigation Officers] did noteffectively bring the situation under control.

3. MILITARY AUTHORITIES

The rapid intervention of the Armed Forces and the Gendarmerie on 19/8/1992 inRwamatamu and on 21/8/1992 in Gishyita was good for the population.

Having leamt that the population was about to destroy the Kirimbi and Mugonero bridgesduring the night of 19/8/1992, the Kibuye military camp dispatched a patrol to the area.On 21/8/1992 at about 4 in the moming, the Kibuye Camp in Ngoma secteur furtherdispatched a section of soldiers to Gishyita where there had been reports of ethnicviolence.

On the same day, the Minister of Defense ordered the Gendarmerie Chief of Staff toprepare two platoons for intervention and pacification in Mabanza and Gashyitacommunes.

In the evening of that very same day, the Gendarmerie General Staff accordinglyinstructed the 6th Battalion to prepare a platoon that would be ready to leave on themoming of 22/08/1992 at 8 a.m.

On 22/08/1992, the Area Commander for Kibuye went to Gishyita in person.

On 25/08/1992, the Minister of Defense ordered the Gendarmerie General Staff topromptly dispateh two back-up platoons to Kibuye following reports of ethnic confliets inRwamatamu commune.

On the same day, the Gendarmerie General Staff ordered the 6th Battalion to immediatelydispatch two platoons under the orders of a company commander.

On 29/08/1992, the Gendarmerie General Staff ordered Commander HAGUMA to takecommand of the Kibuye Law Enforcement detachment till further notice.

On 31/08/1992, the Chief of the Gendarmerie General Staff himself went to Rwamatamucommune in person.

Concluding on this chapter, may I underscore the fact that the population was veryappreciative of the timely intervention of the forces of law and order which contributed tohalting the violence and sourcing assistance for the victims, even though there areenormous needs yet to be met.

However, the shortcomings in the intervention of local administrative authorities and thejudicial bodies of Kibuye préfecture must be criticized.

IV. POSSIBLE INSTIGATORS AND PEPERTRATORS OF THE VIOLENCE

The investigations so far conducted within the population by the administrative, judicialand military authorities have not yet lead to the identification of the real insfigators of theviolence that rocked Gishyita and Rwamatamu communes.

It is yet premature to make any statement on the existence of instigators and on theidentity of the perpetrators. Judicial enquiries are still underway and it is only upon theconclusion of the judicial proceedings that the truth on this matter shall be known. It istherefore only proper at this juncture to wait until the findings of the judicial investigationare released.

Most of the suspects have been arrested and are available to appear before the KibuyeProsecutor’s office. However, the real instigators of the violence have not yet beenidentified.

Rumours alleging that the troublemakers had come from Lake Kivu have neither beenconfirmed by resource persons from amongst the population nor by the local authorities.

However, some contacts have indicated that shortly before the violence erupted, a groupof bandits, on board an engine boat, had stolen a cow and a goat in Mpembe secteur inGishyita commune and had fled toward Idjwui island. That group has not been identifiedto date. Local authorities however assert that such activities had tended to occur evenprior to the violence.

Regarding the rumours about the presence of boats on the Lake Kivu during the period ofthe violence, the Commission found out that the barges belonged to fishermen operatingunder the framework of the Fishing Project and going from Cyangugu to Gisenyi throughKibuye.

Although the instigators are not yet known, the office of the Prosecutor has alreadyarrested some suspects whose motives and identity have been recorded.

The possible causes of the violence in¢lude:

Stars form the October war which had undermined national unity andwhipped up ethnic hatred form the past.

The movement of Tutsi youth who had lcft their collines for unknowndestinations. They were bclievcd by the population to have gone to jointhe ranks of the Inkotanyi, and this recmitment exercisc therefore createdsuspicion and distrust between the ethnic groups.

In fact, it is in Nyagahinga, Butimbo and Gihombo secteurs inRwamatamu commune that the highest numbers of departures wererecorded (17, 16 and 12 respectively) and it is these very communes thatsuffered the most violence.

An announcement on Radio Muhabura (RPF) in July 1992 thankingRwamatama commune for releasing its youth to join the RPF furtherstrengthened the mistrust between ethnic groups.

Confrontations between the MRD and MRND parties in June and July1992 did not foster congeniality.

Ethnic tension between Hutu and Tutsi groups fanned by the behaviour ofthe Tutsi group comprising Nathanaël Rugema, Lazare Kaguriro, SethNdoli, Pastor Metusela Musoni and Nathan Hadizi from Nyagahinga,which was purportedly set up to provide protection for themselves andtheir cattle. This group had developed the habit of taking their cattle toGasagara hill at night and retuming it at dawn.

From the information gathered, it emerges that Pastor Metusela Musonicould be heard saying ail over that "BAHUTU MWE MWITONDE,ABANA BA CU BA GIYE KUGAR UKA, TUGABANE IB YO MWIRA TANA".Ail these factors put together caused the Hutu to pool together with a viewto defending themselves. The same sources of information incriminateRugema and Kaguriro for leading an attack at the borders of the Gihomboand Nyagahinga secteurs on the way from Gitwa, claiming that theirvillage had just been bumt down by Hum from Nyagahinga.

Mr. Elidadi Nsanganira (Hum) alerted the villagers and the alarm sounded was echoed by Mr. Jean NZITONDA who then mobilized theGihombo secteur to tome to the rescue of Hutu in Nyagahinga.

Clandestine meetings held by some Tutsi of Kigarama cellule in Ngoma-Gishyita secteur and chaired by the responsable of the cellule, NathanGAPFIZI (Tutsi) raised suspicion in the minds of the Hutu of the area.

Tutsi seen escaping with th¢ir property prior to the onset of the violenceraised many questions in th¢ minds of the people who then had to be onguard.

A longstanding misunderstanding between the Nyamutezi (Hum) andNgirabatware (Tutsi) families of Rwaramba cellule, Gishyita secteur inGishyita commune.

Ngirabatware claims that the attack against his family stemmed from thatmisunderstanding.

May we indicate here that Ngirabatware was hated by his Hutu neighboursbecause of his arrogance and ethnocentrism.

Antagonism between the Semahe (Hum) and Dan Kayibanda (Tutsi)families of Kigarama cellule in Ngoma secteur of Gishyita commune. Twogroups were bore out of this antagonism and they proceeded to destroyeach other’s property during the violence.

A land dispute between the Rwayitare (Tutsi) family and members of theFarmer’s Cooperative in Nyaruzima islet in Doga cellule, Nyagahingasecteur of Rwamatamu commune. Previously, the islet had been illegallyfarmed by Tutsi but had later been recuperated by din of the law andhanded over to the cooperative societies by the commune.

The cooperatives ejected Mr. Rwayitare from the land for reasons bestknown to them. He decided to get revenge by setting ablaze threethousand coffee trees belonging to the cooperatives. He was supported inthis by the Semutwa family which authorized their sons, ineludingUwambayinkindi to excavate the land of the islet for the specific purposeo f "KUB OHOZA".

The buming down of the house of Kanywabahizi (Hum) by ÉliézerRugwiza and Josué Kanamugire (both Tutsi) upon the instigation of Mrs.Marthe Mukamibungo (Tutsi widow) in Gasagare cellule of Nyagahingasecteur.

This woman paid the above mentioned arsonists 200 RWF to carry out thisheinous act.

The deleterious effects of the measures taken by the President to grantamnesty and pardon.

General Remarks

Some specific issues need to be brought to the attention of the competent authoritiesconceming these two communes and even the préfecture:

Regarding Gishyita and Rwamatamu communes:

A former conseiller known as Nicodème Karasanyi from Butimbo secteur had warnedguests at a wedding to go back home early. This hightened tensions between the ethniegroups and people felt either hemmed in or betrayed.

On 22 August 1992, the military patrol dispatched to Rwabisindu secteur (Rwamatamu)arrested a number of offenders including 2 persons in military gear. They weresubsequently identified as retired soldier Nelson Bakunzibake, dismissed from the armyon 26/7/1992 and Thassion Ntihemuka, a soldier on permission. Both men hailed fromRwabisindu secteur.

Bandits operating in secteurs along the shores of Lake Kivu and who hide out on the lakewhenever they are being hunted down have created an atmosphere of insecurity andtension, which persists to this day.

Regarding the préfecture:

The Commission observed that the atmosphere of insecurity and irresponsibility has notyet been cheeked. It still prevails and may even worsen given that bourgmestres arethreatening to resign. According to the préfet, 5 of the 9 bourgmestres of Kibuyepréfecture are likely or threatening to resign in view of the prevailing insecurity andinsubordination.

As regards the mmours that had been spread:

It should be recalled that on 16 August 1992, Éliézer Niyitegeka made a speeeh at a rallyin Mugonero which was has been referred to by some as inflammatory.

Some dignitaries hailing from Kibuye préfecture also passed by or spent time in thepréfecture, particularly Karemera (Member of Parliament) and his wife who were Rwamatamu commune on 26 August 1992, as well as Cyprien Munyampundu (Memberof Parliament) who visited on 23 Augsut 1992. Mr. Jean Damaseène Ndindabo, Presidentof the Parti Social Démocrate in Kibuye also visited Rwamatamu and Gishyita on24 August 1992, while Doctor Madeleine Bagwaneza, Adviser at the Ministry of Labourand Social Affairs cum President of the Parti Libéral in Kibuye préfecture also visitedthe same communes on 24 August 1992. Mr. Juvénal Mbonyizina, President of the Para"Democratique Chrétien in Kibuye as well as Mr. Thomas Kabera, Adviser at the Ministry

of the Environment and Tourism, both visited the two communes on 28 August 1992.Needless to mention the working visit of the Director of the Social Fund of Rwanda toKibuye on 23 August 1992.

Contrary to the information that was available to some circles, the Commission did notfind cause to establish a link between the events that bereaved the Gishyita andRwamatamu communes and the movements and behaviour of political party officiais.

All persons contacted indicated that the presence of these officiais did not have anyimpact on the events.

Regarding the nature of the violence, the Commission could not establish that the unrestwas really an ethnic conflict although the opposing groups were of Hutu and Tutsiethnicity.

However, based on the information available toit, the Commission was satisfied that theviolence was not political in nature, in so far as it did not pit political parties dulyregistered in Rwanda against each other.

V° CONCRETE MEASURES

Increase the number of joint politico-administrative meetings to fostersensitization and pacification;

2. Arrest ail identified offenders;

3. Mete out exemplary punishment in accordance with the law to ail guiltypersons;

4° Revamp organizational structures at ail levels to ensure that ail and sundrytake full measure of theîr responsibility in matters of security;

Pay the allowances due to members of cellule committees;

6° Engage the relevant technical services to facilitate and create conduciveconditions for the resettlement of displaced persons;

Educate the population on a regular basis on understanding, tolerance,mutual respect and peaceful cohabitation.

This message should be the leitmotif of all administrative meetings andpolitical rallies across the country;

Organise emergency assistance particularly for families of victims, payingparticular attention to those who voluntarily retum to their bornes. Priority

must be givcn to the reconstruction and refurbishing of 454 houses thatwere destroyed in the two communes;

Provide a vehicle to Rwamatamu commune and rehabilitate the telephoneline to Gishyita commune, in order to enable the communal authorities tobetter discharge their duties;

Ensure that political and administrative authorities are in touch with thepeople in order to pre-empt danger and take the required measurespromptly whenever need be;

Cleaning up the Kibuye Prosecutor’s office is highly recommended.Security services should also heighten their level of vigilance in order tosecure information that may help to avoid such events.

Local authorities should eliminate niches and hideouts for bandits andintroduce more stringent control measures over Lake Kivu.
