Auntie Aggie was a strong pillar of our community touching manythrough her advocacy in health care, education, Hawaiian homelands, kupuna care, culture, and many other areas. in Waianae were becoming sick and couldn’t afford to go to thehospital, said son Kamaki Kanahele. That prompted Cope to help found the Waianae CoastComprehensive Health Center more than 40 years ago. It now hassatellite clinics in Kapolei and Waipahu, Kanahele said.Cope died Nov. 16 at the Ka Punawai Ola rehabilitation center inKapolei. She was 91. Cope’s contributions to the community were many: becoming afounder of the Waianae Coast Culture and Arts Society as well as theCouncil of Elders, and having a traditional Native Hawaiian healingcenter named in her honor. “She was an extremely grounded person … always thought about thecommunity first,” said former U.S. Rep. Colleen Hanabusa, who grewup on the Waianae Coast.Hanabusa said many people who otherwise would have been unableto afford medical care have benefited from services at the WaianaeCoast Comprehensive Health Center. Kanahele said that what crystallized the need for a health centeroccurred in the 1950s when a large group of seniors in Hawaiiancommunities became sick. He said his mother, who assisted the group in seeking medicalattention, looked everywhere for affordable services but was unable tofind a hospital or clinic to help them. She decided that Waianaeneeded its own clinic and persuaded the Hawaiian HomesCommission to provide land for it, Kanahele said.She then proceeded to raise money for it, including donations frombake sales. “She had all kinds of fundraisers,” Kanahele said.Hanabusa said the Waianae Coast Culture and Arts Society helpedschoolteachers develop their arts programs. Cope was born on Oahu. She was a graduate of Farrington HighSchool, Honolulu Business College and the University of Hawaii.She taught at Waianae and Nanaikapono elementary schools. She alsowas a hula dancer for her grandmother, grand hula master LokaliaMontgomery, and a traditional Native healer.She worked with the late author John Dominis Holt to develop acollection of oral histories passed from one generation to the nextabout the Waianae Coast titled “Ka Poe Kahiko o Waianae: OralHistories of the Waianae Coast of Hawaii.” In 2009 she was awarded an honorary Doctor of Humane Lettersdegree by the University of Hawaii at Manoa. She was also named a“Living Treasure” by the Honpa Hongwanji Mission and honored bythe Office of Hawaiian Affairs for her role as a grand kumu hula andNative Hawaiian traditional healer. Gov. Neil Abercrombie proclaimed April 8, 2011, as AgnesKalaniho‘okaha Cope Day in the state. She is also survived by daughters Annie Kuuleilani Au Hoon andGeorgiana Kekuialono Kahele, and sons Danny Haawi Kanahele andDavid Kalani Kanahele. A celebration of her life will be held at 10:30 a.m. Dec. 16 atHawaiian Memorial Park. Burial to follow services. AHCC Adopts Resolution 15­L33, UrgesSupport of DOI Proposed RulesAt our Annual Convention last month, the House of Delegates votedoverwhelmingly to support Resolution 15­L33: "Urging support of theadministrative rules proposed by the United States Department ofthe Interior that facilitate the re­establishment of a formalgovernment­to­government relationship to more effectivelyimplement the special political and trust relationship between theUnited States and Native Hawaiians." There are just two weeks remaining before the December 30deadline for testimony and comments to the U.S. Department of theInterior (DOI). All members, clubs, and councils are encouraged tosubmit testimony in support prior to this deadline. The time to act is now! Nai Aupuni Update: ElectionTerminated, Aha to ProceedHONOLULU – Nai Aupuni announced today that it has terminatedthe Native Hawaiian election process but will go forward with a four­week­long ‘Aha in February. All 196 Hawaiians who ran as candidateswill be offered a seat as a delegate to the ‘Aha to learn about, discussand hopefully reach a consensus on a process to achieve self­governance. Nai Aupuni President Kuhio Asam said Nai Aupuni’s goal has alwaysbeen to create a path so Native Hawaiians can have a formal, long­overdue discussion on self­determination. “Our goal has always been to create a path so that Hawaiians cangather and have a serious and much­needed discussion about self­

governance,” Asam said. “We anticipated that the path would havetwists and turns and even some significant obstacles, but we arecommitted to getting to the ‘Aha where this long­overdue discussioncan take place.” He said due to the delays caused by the ongoing litigation – that couldcontinue for years – it was decided that the most effective route atthis point would be to offer to convene all of the remaining delegatecandidates and allow them to an opportunity to organize Hawaiiansand achieve self­governance. Nai Aupuni said Election­America has been informed to stop thereceipt of ballots, to seal ballots that have already been received, andto prevent anyone from counting the votes.Nai Aupuni attorney William Meheula said consistent with offering toseat all candidates, Nai Aupuni has decided that the election votes willnever be counted. “Thus, the Akina litigation, which seeks to stop thecounting of the votes, is moot, and Nai Aupuni will take steps todismiss the lawsuit,” he said.“To be clear, Nai Aupuni does not know and will never learn theelection results.” Asam said Nai Aupuni will manage the process of the Aha but not thesubstance of the discussions. “We have retained Peter Adler andLinda Colburn of The Mediation Center of the Pacific to serve asfacilitators to lead the instruction week and to thereafter assist inorganizing the delegates,” he said. “They will contact the candidateswho decide to participate in the Aha.” The confirmation deadline to participate in the Aha is Dec. 22, 2015.An email will request that the candidates confirm whether theyintend to accept the terms and attend the ‘Aha that runs the month ofFebruary 2016 and will be held at a meeting facility in Kailua, Oahu.On Dec. 23, 2015, Nai Aupuni will post the list of delegates on itswebsite. Asam said a key component of the Aha is the education andinformation the delegates will receive during the first week regardingconstitution building, federal Indian law, international law regardingde­occupation, decolonization, the rights of indigenous people, U.S.Constitution issues that relate to Native Hawaiian self­governance,the ceded lands claim, background on Hawaiian Home Lands,Kingdom Law and constitutions drafted by sovereignty groups.

This project was created to share the importance, createawareness and support the concept of “Malama Honua” in ourcommunity. Community Members collaborate to create aninspirational art piece, a wall hanging patchwork quilt. Patchwork is a form of needlework that involves sewingtogether pieces of fabric into a larger design. The clever use of colorsand patterns along with the creative efforts of the quilter usingshadow techniques highlight the uniqueness of each one of a kindimage. The finished quilt sewn together into a final and beautiful work ofart is a symbol of how we as individuals are connected to each other,in Families, Communities, Islands, Countries, and the World ourIsland Earth. Court Finds State Illegally Denied Fundsto DHHLAfter an eight (8) day trial which concluded in July, First CircuitCourt Judge Jeannette Castagnetti ruled on November 28, that theState violated its constitutional duty by its continuing failure toprovide adequate funding to the Department of Hawaiian HomeLands (DHHL). In a 40­page decision issued late Friday afternoon, the courtconcluded, “the legislature has failed to appropriate sufficient sums tothe Department of Hawaiian Home Lands for its administrative andoperating budget in violation of its constitutional duty to do so. Thisfailure includes every fiscal year since at least 1992.” In her rulingJudge Castagnetti noted that the “DHHL suffers from a lack offunding and staffing, which adversely affects beneficiaries of theHawaiian Home Lands Trust.” Moses Haia, the Executive Director of the Native Hawaiian LegalCorporation applauded the decision. “This has been a long timecoming. We are thankful that the Court has provided the State andthe DHHL with a roadmap for making good on the State’sconstitutional mandate and on both the State’s and the DHHL’s trustduties under the Hawaiian Homes Commission Act. We trust thisruling will ultimately result in a significant increase in the number of

beneficiaries living on Hawaiian Home Lands.” In fiscal year 2009, the legislature provided DHHL with less than$900,000 in general funds for its administrative and operatingbudget. For the next four fiscal years, the legislature appropriated nogeneral funds to DHHL. Funding was only restored after the Hawai`iSupreme Court ruled in 2012 that “the State has failed, by anyreasonable measure . . . to provide sufficient funds to DHHL.” For the last three years, the legislature has provided $9.6 million tothe department. Friday’s court’s ruling will require that thelegislature appropriate at least $28 million to the department for thiscoming fiscal year. In her ruling, Judge Castagnetti also left no doubt about whom theHawaiian Homes Commission and DHHL owe a duty of loyalty to.““Insofar as the years of underfunding by the State continued to placeDHHL in the intolerable position of having to use the Department’sown funds . . . . to pay for its administrative and operating expenses,it was beyond the bounds of reasonable judgment for the DHHLDefendants to not take action, to not file suit against the State and tooppose Plaintiffs in this case . . .” She concluded that the HawaiianHomes Commission has a “duty of loyalty to the beneficiaries of theHawaiian Home Lands Trust – not the governor or the Department ofBudget and Finance.” Six native Hawaiians: Richard Nelson III, Kelii Ioane, SherilynAdams, Kaliko Chun, James Akiona and Charles Aipia, filed thislawsuit in 2007. Akiona and Aipia have since died.According to Kaliko Chun, “This suit was filed on behalf of all nativeHawaiians; to make the State live up to its constitutional obligation;to get DHHL the money it needs; to get Hawaiians off the waitlist andback on the land; and to get DHHL to act like a trustee.” Mahalo Cedric Duarte for sharing this!
