LOCATIONThe Property is located in the heart of the Kaanapali Beach Resort and in the middle of two major development projects – the proposed revitalization of the Kaanapali Golf Courses and Kaanapali 2020.

The Property represents a tremendous development opportunity given the quality of the location, surrounding uses and view planes from the site. The Property is bounded by Hoonoapiilani Highway to the east, the Fairway Shops retail center to the north, Kaanapali Golf course to the west and the Kaanapali Royal condominiums to the south. The site’s elevation provides dramatic views across the golf course to the island of Molokai.

The 305 acre golf course is owned by the State of Hawaii Employees’ Retirement System (ERS) and they are currently in the EIS (Environmental Impact Statement) process in an effort to redevelop portions of their property.

CONDITIONS OF TRANSFER, PERMITTED USES AND APPROVALSAs required by the Declaration for Kaanapali Beach Resort, the transfer of ownership to the Property will be subject to approval by the Kaanapali Operations Association, Inc. (“KOA”). This approval will be a condition to closing a sale and the buyer will be required to present financial and development plans to KOA to obtain this approval. The Property is zoned BR, Resort Commercial, which allows for retail and office uses in addition to others within the Primary Use category (see Maui County Zoning Ordinance); dwelling units are permitted as an Accessory Use above Primary Uses (ie condominiums over retail/office). Seller’s title contains other use restrictions; however, KOA has indicated that they are open to reviewing a project with uses as permitted under BR zoning, subject to design review as outlined in the Kaanapali Beach Resort Design Guidelines. All property transfers, project design and proposed uses are subject to KOA review and approval as outlined in the Declaration and Guidelines.
