KANE BOROUGH COUNCIL MARCH 9, 2016 CALL TO ORDER The regular monthly meeting of Kane Borough Council was called to order at 6:30 p.m. by President Gary Schul. The regular monthly meeting of Kane Borough Council was called to order at 6:30 p.m. byPresident Gary Schul. The meeting was held at the Kane Borough Building, 112 Bayard Street,Kane, PA 16375. Members were notified ofthe meeting on March 7, 2016.

APPROVAL OF MINUTES

A motion was made by Ms. Snyder, seconded by Mr. Kase, to approve the minutes oftheFebruary 10,2016 regular monthly meeting, as presented. Motion carried.

UNFINISHED BUSINESS

Keyholder Alarm Ordinance

Mr. Gentilman stated that he had not spoken with the Pennsylvania State Police on this proposedordinance.

A motion was made by Mr. Gentilman, seconded by Mr. Drost, to look into proposing anordinance for all commercial businesses to require that their keyholders show up when an alarm

Motion carried on a 7 - 0 vote.

Mr. Alfieri stated that he will first look into state law and the penalties to see if there is a need forsuch an ordinance.

PIB Loan Documents

Mr. Payne discussed the loan payback schedule with Council members.

A motion was made by Mr. Kase, seconded by Mr. Johnston to approve Ordinance #A-l 030increasing the indebtedness of the Borough of Kane by the issue of a general obligation note inthe amount of $500,000. A roll call vote was taken with the results as follows:

Motion carried on a 7 - 0 vote.

Amotion was made by Mr. Kase, seconded by Mr. Drost, to authorize the Council President andBorough Manager to sign the necessary documents for the PIB loan. Motion carried.

CORRESPONDENCE

1) Tax Claim Reduction Request - Mr. Payne explained that this request was for theexoneration of2014 real estate taxes at penalty for property located at 512 Biddle Street.Mr. Payne stated that his recommendation was to not grant the exoneration request. Mr.Payne passed out copies of the county assessment and notes of the inspector on thisproperty from the county tax assessment office.

A motion was made by Ms. Snyder, seconded by Mr. Johnston, to deny the exoneration requestof Mr. Clifford Frampton, for the 2014 real estate taxes at penalty for 512 Biddle Street. Motioncarried.

MONTHLY REPORTS

Budget - Report submittedTax Collector - Balance on duplicate - $692,472.12

A motion was made by Mr. Drost, seconded by Mr. Johnston, to approve the Budget and TaxCollector reports, as presented. Motion carried.

BILLS FOR PAYMENT

Check detail in the amount of$34,013.92 was presented to Council for approval. Amotion wasmade by Ms. Snyder, seconded by Mr. Walker, to approve the bills for payment and any otheroutstanding utility billings or bills due for discount. Motion carried.

STAFF REPORTS

Office - Mr. Payne reported:

1) Monthly report submitted.2) Solution for the traffic problem at Schoolhouse Drive was to construct a sidewalk from

the main parking lot on Chestnut Street to the side door. Mr. Payne stated that thissidewalk will cost approximately $7,000 and that donations will be accepted to defray thecost.

3) Signage for West Hemlock Avenue will be ordered soon.4) Talked with residents regarding violations for garbage and parking.5) He noted that the tree removal and trimming has not been done as stated in his report.6) Attended the county Planning Commission meeting.7) Spoke with Nagle Athletics regarding the repair of the cracks on the tennis/basketball

courts.8) Noted that "weather permitting" the courts will be open. They will beopen all of the

time starting April 15th•9) Talked about the possibility of turning the court lights on early.10) Thanked Mr. Lingenfelter for the tour of the wastewater treatment plant recently.11) Noted that the plan for the former Anderson's Bar property is to have some handicap

accessible parking available.12) Working on a possible first time home buyers program to sell 12 Chestnut Street.

Grantwriter - Mrs. Cecchetti reported:

1) Met with a representative of the USDA on March 15th along with Mr. Payne. Noted thatshe will get the final preparation of the grant for the boilers at the Fire Hall soon.

2) Noted that grants were found for people to purchase property.

3) To give a presentation at the Parks Commission Meeting this month.

Solicitor - Mr. Alfieri had no report.

Police - Chief Boyer reported:

1) Monthly report submitted to Council.2) Noted that there were 116 calls for service in February with 16 arrests.

WWTP - Mr. Lingenfelter reported:

1) Monthly report submitted to Council.2) Noted that Councilmembers are urged to contact Mr. Payne to set up another tour of the

WWTPs.

Street Department Manager

Mr. Couch's monthly report was submitted to Council. Mr. Payne noted that the sweeper hasbeen running. There were several issues brought to the table by Council Members includingsnow removal hours, cleaning of storm drains, catch basin located behind the Elks Club, potholepatching by the department and truck radios.

Fire Chief - Mr. Holt reported:

1) 10 dispatched alarms in February.2) Railroad Emergency Response class held on February 14th. It was well attended.3) To sell Engine 58.4) Oil and filter changes done on equipment.5) Preparing for wildfire season ..6) Held a Coffee & Conversation with State Representative Martin Causer recently at the

Fire Hall.7) Annual Banquet was held on March 5th. Awards were given out. US Representative

Glenn Thompson was in attendance. He is to meet with Fire Chiefs in the district todiscuss current issues.

8) Tri-County Fire School to start in April.9) Meetings scheduled with the Elk County and McKean County Fire Chiefs.10) Reminded everyone of the extremely dry conditions and to use extra caution when

burning outdoors.

Building PermitsHealth Board Reports submitted

It was noted that the former Arlington Hotel building is scheduled for demolition on March 14th.

COMMITTEE REPORTS

Public Works - Mr. Drost had no report but stated that his committee will meet later this monthand that several stop signs were overlaid recently.

Borough Properties - Mr. Drost reported:

1) Noted that he is unable to make this month's Park Commission meeting but that Mr.Gentilman and Ms. Snyder will attend.

2) To go through the parks with committee members to get a list of priorities.3) Mr. Walker will be reinstated to this committee.

Personnel- Mr. Kase had no report.

Finance - Mr. Kase had no report.

Cable/Technology - Mr. Gentilman had no report.

IT - Mr. Kase & Mr. Schul had no report but noted that the police car cameras are being workedon.

Public Safety - Mr. Schul had no report.

NEW BUSINESS

Erik Smith - Buckhorn Hotel

Mr. Smith asked Council to consider petitioning the PLCB regarding the noise regulations. Heasked that the Borough be responsible for enforcing the Borough's noise ordinance instead ofhaving the PLCB enforce the noise regulations. Mr. Smith stated that he has been unable to haveany type of music for the last couple of months and that it is hurting his business considerably.

A motion was made by Mr. Johnston, seconded by Mr. Walker, to authorize Mr. Schul, Mr.Alfieri and Mr. Payne to research this issue and to keep Mr. Smith informed. Motion carried.

Alleys

Mr. Payne noted that the information on the alleys in the Borough is an issue that will bediscussed at a Work Session.

OLD BUSINESS

Bike / Skate Park Survey

Junior Council Member Nic Grube stated that he took a survey of the high schools students tosee which type of park they would prefer. 83% prefer a bike park ad 27% prefer a skate park.

Mr. Grube will meet with Mr. Petruney and Mrs. Cecchetti to forward the written results of thesurvey for grant purposes.

MAYOR'S REPORT

Mr. Osmer had no report.

STATEMENT OF CITIZENS

Mr. Dan Spangler - 108 Clay Street, Kane, PA

Mr. Spangler voiced his concerns regarding some neighboring properties that have garbage andthe grass has not been mowed. He was also concerned about the number of cars parked on thestreet (alternate parking) because of an apartment building at the corner of Clay & LincolnStreets that now has renters. Mr. Payne stated that he will contact the owner of the apartmentbuilding.

Jean Swanson - Kearney Street, Kane, PA

Mrs. Swanson asked if the street sweeper could come down the middle of Kearney Street asthere are a lot of stones there. She stated that she liked seeing the new faces on Council andasked them to save where they can and not to raise taxes. Mrs. Swanson stated her concernsabout a local business (Buckhorn Hotel) losing money because of one person complaining aboutnoise. She also hoped that the Borough saved a lot on anti-skid with the mild winter. She alsoasked why there was no alternate parking on the block of-Clay Street between Biddle Street andHighpoint Drive. She was told that there are some blocks in the Borough that do not havealternate parking.

Mr. Dave Carlson & Mr. Joe Carley -, Greeves Street, Kane, PA

Mr. Carlson and Mr. Carley voiced their concerns regarding their neighbor encroaching on thealley bordering their property. They were told that this matter is a civil matter and for them totake this issue up with their attorney.
