VP of EverHome Mortgage, Clearly committing crimes, Schem to DeFraud,None of it is true. She swears under penalty of Perjury that she is VP of HSBC BANK USA, N.A in which she is NOT. That she is the VP of an entity that doesn’t even Legally exist(Evidence from Dept. of State records/SEC Edgar database). Posturing like the Plaintiff has Standing and they DO NOT, Incomplete Chain of Title, No Interest and No Ownership. This Fraudulent Foreclosure Complaint is being conducted by the Trustee of an entity that does not exist. HSBC gives Power of Attorney to EverHome Mortgage. Nowhere in this Affidavit does KELLIE ROHLING state that the Plaintiff is Entitled to Enforce the Note and Mortgage against the defendant. Nor does KELLIE ROHLING state the Plaintiff is Entitled a Judgment as a matter of Law because the defendant owes the Plaintiff money. Why? Because the Plaintiff doesn’t have the right to enforce the Note and Mortgage, they Do Not have physical possession of the Original Promissory Note(Debt Obligation), and The Plaintiff is NOT entitled to Judgment. The Pooling and Servicing agreement specifically statse that they CANNOT(Public Information). A complete failure, waste of court resources and attempt theft, ATTEMPTED. Predators putting their livelihood at risk when ALL the Evidence of their crimes is Public Information and the paper trail is there. Can this group of criminals get any dumber. KELLIE ROHLING is NOT even Licensed with a Regulatory Agency and the Criminal Attorneys passed an exam which made them members of a British Registry. KELLIE ROHLING’S Affidavit Was Not Based Upon KELLIE ROHLING’s Personal Knowledge. EverHome does NOT have the Note and this has already been proven. They never assigned the Note, Only the Mortgage. She commits perjury again saying they are Holder of Record. That would mean possession. They dont have possession. Bifurcation- the separation of the Note and Mortgage, has rendered the Mortgage contract a nullity. It is the Note that evidences the debt obligation. All evidence especially Title/Securitization/Loan Level Accounting reports of public information against the Plaintiff, Kellie Rohling, EverHome Mortgage, Plaintiffs Attorneys clearly showing their crimes such as Scheme to Defraud- NY Penal Law 190.65- e class Felony, Falsifying Business Documents- NY Penal Law 175.05- e class Felony, Extortion- 18 USC § 894(a) states: “Whoever knowingly participates in anyway, or conspires to do so, in the use of any extortionate means(1) to collect or attempt to collect any extension of credit, or(2) to punish any person for the non-repayment thereof, shall be fined under this title or imprisoned not more than 20years,or-both. KELLIE ROHLING averred to records which she did not submit nor could she testify for the authenticity of. KELLIE ROHLING has not attached any of these books, records or documents. This failure to do so is a clear violation of procedures. Here, the entire Affidavit is hearsay evidence as KELLIE ROHLING as an employee of Everhome Mortgage(a mere debt collector) and Predatory servicer, and Neither HSBC nor KELLIE ROHLING have knowledge of the underlying transaction between HO ME STAR MORTGAGE and the Defendant. Their scam is that ROHLING, EverHome and the Attorneys order their Fraudulent assignments of Mortgage from Lender Processing Services(Forges Fabricates Fraudulent documents) Bethany Hood works at LPS and is NOT a VP of MERS. Everhome shows a clear pattern of using LPS & Robo-Signer Bethany Hood, Ex.Everhome admitted in the koontz v everhome case that Bethany Hood's assignment was fraudulent after the officer of MERS stated Bethany Hood didnt work at MERS. EverHome Mortgage, Kelly Rohling,HSBC, FEIN SUCH & CRANE, LLP and attorneys monica G. Christie, Richard A. Gerbino & michael S. Hanusek are renegade rogue criminals committing Financial terrorism against "the people" of this Great country.
