(X) Upon motion of Supervisor Huber, seconded by Supervisor Parks, and duly carried, the Board hereby approves staff recommendations with the following modifications to Exhibit 10 - Proposed letter to the California State Office of Historical Preservation (OHP): page 3 paragraph 2 of letter modified to read;

The Board has stated that the public's health must be the first priority in the cleanup and remediation process. The Board also remains committed to preserving Native American historical and cultural resources to the extent doing so is consistent with protecting public health. Therefore, the Board expresses strong concern that listing the District in the National Register would expand the acreage and amount of contaminated soil to which DTSC's exception authority would apply. Potential human and ecologic exposures to any remaining contaminants onsite or as a result of contaminant migration to offsite areas would threaten public health, safety, and general welfare. Accordingly, the Board opposes any Nomination that conflicts with public health, safety, and general welfare to the extent the nomination impairs or impedes the legally mandated clean-up efforts at the District. OHP should reconsider the District boundary to acknowledge the areas requiring remediation so that the Nomination portion is not at odds with this critical necessity for public health. In addition, the Board recommends that OHP reject the Nomination because it is not technically and professionally correct and sufficient, nor is it adequately documented to support the entirety of the proposed 2,850 acres to be listed. As such, the Nomination is premature, and the Board recommends that OHP reject the Nomination at this time.
