The answer should not come as a surprise: Corruption. In the sense that the same sex marriage laws were enacted after Davis was elected. Rather than have a provision in the law protecting the religious conscience of individuals such as Davis, the State simply enacted a law without regard for its consequences. This is where corruption fits in. This, in turn, makes the confrontation 100% avoidable. Now the SYSTEMhas a problem. Davis languished in jail for five days. The Legislature did nothing. The courts cannot do anything without the Legislature. So the second question was this: Is the same sex marriage law unconstitutional as applied to Davis and others similarly situated? Lets peel back one more layer. Rather than throw Davis in jail, the judge could have ruled the law unconstitutional, as applied to both Davis and the retroactivity of the law. This action by the Feds would have caused the State to fix the problem of requiring County Clerks in Davissituation to perform same sex marriages, or go to jail. Note here something very interesting: How could the judge rule that she perform this service or go to jail without a law enacted by the Legislature to this effect? Some will argue that the judge has inherent powerto control the administration of justice. Others will argue that the courts inherent powerwas against jail time, given the fact that the law at the time did not require Davis to perform same sex marriages. So I give you this to ponder: Imagine accepting a job in an eatery and your boss changes its policies to require that you now serve dogs and cats. You are against serving dogs and cats. Could a customer go to court and obtain an order requiring you to serve dogs & cats, or go to jail? Her name is Kim Davis, County Clerk for Rowan County Kentucky.
