KILDARE COUNTY COUNCIL COMHAIRLE CONTAE CHILL DARA ____ NOTICE OF THE MAKING OF A COMPULSORY PURCHASE ORDER UNDER SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT (NO. 2) ACT, 1960 TO BE PUBLISHED IN ACCORDANCE WITH ARTICLE 4(a) OF THE THIRD SCHEDULE TO HOUSING ACT, 1966 AS AMENDED BY THE PLANNING AND DEVELOPMENT ACTS 2000 TO 2016 AND UNDER SECTION 213 OF THE PLANNING AND DEVELOPMENT ACT, 2000 TO 201647. ___ KILDARE COUNTY COUNCIL (ATHY DISTRIBUTOR ROAD) COMPULSORY PURCHASE ORDER 2017 __ Kildare County Council (hereinafter referred to as “the local authority”) in exercise of the powers conferred upon them by Section 76 of the Housing Act, 1966, and the Third Schedule thereto, as extended by Section 10 of the Local Government (No. 2) Act, 1960 as substituted by Section 86 of the Housing Act, 1966 as amended by Section 6 and the Second Schedule to the Roads Act, 1993 and as amended by the Planning and Development Acts, 2000 to 2016, and the powers conferred upon them by Section 213 of the Planning and Development Acts 2000 to 2016 have made an order entitled as above which is about to be submitted to An Bord Pleanála (hereafter “the Board”) for confirmation. If confirmed, the order will authorise the local authority to acquire compulsorily the land and rights described in Part I , Part II and Part III-Part B of the Schedule thereto for the purposes of constructing a road development, namely the Athy Distributor Road from the townland of Bennetsbridge to the townland of Gallowshill, incorporating a bridge crossing of the River Barrow, refurbishment of an existing disused railway bridge crossing of the River Barrow and the provision of a new bridge crossing of the Dublin – Waterford Railway, in the townlands of Bennetsbridge, Blackparks, Ardrew, Bleach, Athy Urban, Coneyburrow, Chanterlands, Townparks and Gallowshill in the County of Kildare together with link roads, side roads and all ancillary and consequential works associated therewith and for the provision of infrastructure facilitating public transport. Owners, lessees and occupiers of the land and rights described in Part I, Part II and Part III Part B of the Schedule will receive individual written notice and any objections by them to the compulsory acquisition of the land or rights described in the Schedule, Part I, Part II and Part III Part B should be made in writing to An Bord Pleanála (Strategic Infrastructure Division) 64 Marlborough Street, Dublin , D01 V902, from Tuesday the 25th April to Friday 9th June 2017. The order will also authorise the local authority to extinguish the public rights of way described in the Schedule, Part III-Part A thereto, by order made by them after they have acquired the land, where the said public rights of way are over the land so acquired or any part thereof, or over land adjacent to or associated with the land so acquired or any part thereof. Any objections to the extinguishing of the said public rights of way should be made in writing to An Bord Pleanála (Strategic Infrastructure Division) 64 Marlborough Street, Dublin 1 D01 V902, from Tuesday the 25th April to Friday 9th June 2017. The Board may, at its absolute discretion, decide not to confirm — a) a compulsory purchase order in respect of the land if an objection is made in respect of the acquisition by an owner, lessee or occupier of the land and not withdrawn, b) an order which authorises the extinguishment of a public right of way if there is an objection to the extinguishment, which is not withdrawn, until it has considered the objection. An Bord Pleanála has an absolute discretion under Section 218 of the Planning and Development Acts 2000 to 2016 to hold an oral hearing. Before making its decision on an application to confirm the Compulsory Purchase Order, namely the Athy Distributor Road-Compulsory Purchaser Order 2017, the Board must consider any objection made and not withdrawn, any additional submissions or observations made pursuant to a request by the Board under Section 217A of the Planning and Development Act, 2000 to 2016, any report of the person who held the oral hearing if such an oral hearing takes place. An Environmental Impact Statement and a Natura Impact Statement, for which separate public notice has been given, have been prepared in respect of the development which it is proposed to carry out on the land to which the compulsory order relates. Evidence in relation to the likely effects on the environment of the proposed road development; the implications of the proposed road development for proper planning and sustainable development in the area in which it is proposed to situate the proposed road development, and the likely significant effects of the proposed road development on European sites may also be heard at any oral hearing, that may be held. Kildare KILDARE COUNTY COUNCIL Comhairle Contae Chill Dara www.kildare.ie Kildare County Council (“the road authority”) has applied under section 51 (2) of the Roads Acts, 1993-2015 (as amended by section 9 (1)(e)(i) of the Roads Act 2007) to An Bord Pleanála (“the Board”) for approval in relation to a proposed road development consisting of: The provision of a new Distributor Road between the townlands of Bennetsbridge and Gallowshill and passing through the townlands of Blackparks, Ardrew, Bleach, Athy Urban, Coneyburrow, Chanterlands and Townparks all in the County of Kildare, comprising inter alia:- • 3.4 Kilometres of Single Carriageway Road forming the Athy Distributor Road; • 4 Kilometres of Single Carriageway Road realignment of the N78 National Secondary Road; • 0.7 kilometres of local/ regional road improvements/ realignments/ tie-ins; • 2 all movements at grade signalised junctions; • 2 new roundabout junctions and connection to 1 existing roundabout; • Provision of 3.4km of segregated shared cyclist and pedestrian facilities and an additional 0.7km of segregated shared pedestrian and cycle links to existing infrastructure; • Structures; o including an 80m single span bridge crossing of the River Barrow; o a two span bridge crossing of the Dublin – Waterford Railway crossing; o a new culvert crossing of the Bennetsbridge Stream; o the repair and refurbishment of the existing disused railway bridge crossing of the River Barrow, a protected structure; • Roads associated earthworks - including the excavation of unacceptable material, importation of material, provision of material deposit areas; • Provision of road pavement, signing, lining and ancillary works; • Provision of fencing and safety fencing works, drainage works, landscaping works, environmental measures; • diversion of utilities and services including the diversion of a 110kV overhead powerline at the N78, including the provision of associated poles and support towers; • construction of accommodation works, including the provision of a replacement 280m long railway siding, agricultural access tracks and ancillary accommodation works; • all other ancillary works The location of the proposed road development is illustrated in the map below. Kildare County Council has submitted to an Bord Pleanála the Environmental Impact Statement prepared in accordance with section 50 of the Roads Acts, 1993-2015 (as amended by section 9 (1)(d) of the Roads Act 2007) in respect of the proposed road development. Kildare County Council has prepared a Natura Impact Statement in respect of the proposed road development which has also been submitted to An Bord Pleanála.
