CHAPTERI

Definitions.� “appellateauthority”meansanauthoritynotifiedundersub-section(3)ofsection14orsub-section(1)ofsection53ordesignatedundersub-section(1)ofsection59,asthecasemaybe.� appropriateGovernment”means,— (i)inrelationtotheCentralGovernmentoranyestablishmentwhollyorsubstantiallyfinancedbythatGovernment,oraCantonmentBoardconstituted under the Cantonments Act, 2006, the CentralGovernment; (ii) in relation to a State Government or anyestablishment,whollyorsubstantiallyfinancedbythatGovernment,orany local authority, other than a Cantonment Board, the StateGovernment.


�  “barrier’’ means any factor includingcommunicational,cultural,economic,environmental,institutional,political,social,attitudinalorstructuralfactors which hampers the full and effectiveparticipationofpersonswithdisabilitiesinsociety

�  “care-giver”meansanypersonincludingparentsandotherfamilyMemberswhowithorwithoutpaymentprovidescare,supportorassistancetoapersonwithdisability;

�  “care-giver”meansanypersonincludingparentsandotherfamilyMemberswhowithorwithoutpaymentprovidescare,supportorassistancetoapersonwithdisability.


�  “certifyingauthority”meansanauthoritydesignatedundersub-section(1)ofsection57.

�  “communication” includes means and formats ofcommunication, languages, display of text, Braille,tactile communication, signs, large print, accessiblemultimedia,written,audio,video,visualdisplays,signlanguage, plain-language, human-reader,augmentative and alternative modes and accessibleinformationandcommunicationtechnology;

�  “competentauthority”meansanauthorityappointedundersection49;


�  “discrimination” in relation to disability, means anydistinction, exclusion, restriction on the basis ofdisabilitywhich is thepurposeoreffectof impairingor nullifying the recognition, enjoyment or exerciseonanequalbasiswithothersofallhumanrightsandfundamental freedoms in the political, economic,social,cultural,civiloranyotherfieldandincludesallforms of discrimination and denial of reasonableaccommodation.

�  “establishment”includesaGovernmentestablishmentandprivateestablishment.

�  “Fund”meanstheNationalFundconstitutedundersection86.


�  “Government establishment” means a corporationestablished by or under a Central Act or StateAct or anauthority or a body owned or controlled or aided by theGovernment or a local authority or a Governmentcompany as defined in section 2 of the Companies Act,2013andincludesaDepartmentoftheGovernment.

�  “high support” means an intensive support, physical,psychologicalandotherwise,whichmayberequiredbyaperson with benchmark disability for daily activities, totakeindependentandinformeddecisiontoaccessfacilitiesand participating in all areas of life including education,employment, family and community life and treatmentandtherapy.


�  “inclusive education” means a system of educationwherein students with and without disability learntogether and the system of teaching and learning issuitably adapted to meet the learning needs ofdifferenttypesofstudentswithdisabilities.

�  “information and communication technology”includes all services and innovations relating toinformation and communication, including telecomservices, web based services, electronic and printservices,digitalandvirtualservices;

�  “institution”meansaninstitutionforthereception,care,protection,education,training,rehabilitationandanyotheractivitiesforpersonswithdisabilities;


�  “localauthority”meansaMunicipalityoraPanchayat,asdefinedinclause(e)andclause(f)ofarticle243PoftheConstitution;aCantonmentBoardconstitutedundertheCantonmentsAct,2006;andanyotherauthorityestablishedunderanActofParliamentoraStateLegislaturetoadministerthecivicaffairs.

�  “notification” means a notification published in theOfficial Gazette and the expression “notify” or notified”shallbeconstruedaccordingly.

�  “personwith benchmark disability”means a personwithnotlessthanfortypercent.ofaspecifieddisabilitywherespecified disability has not been defined in measurableterms and includes a person with disability wherespecifieddisabilityhasbeendefinedinmeasurableterms,ascertifiedbythecertifyingauthority;


�  “person with disability” means a person with long termphysical, mental, Intellectual or sensory impairmentwhich, in interaction with barriers, hinders his full andeffectiveparticipationinsocietyequallywithothers.

�  “personwithdisabilityhavinghighsupportneeds”meansapersonwithbenchmarkdisabilitycertifiedunderclause(a)ofsub-section(2)ofsection58whoneedshighsupport;

�  “prescribed”meansprescribedbyrulesmadeunderthisAct;

�  “private establishment” means a company, firm,cooperative or other society, associations, trust, agency,institution, organization, union, factory or such otherestablishment as the appropriate Government may, bynotification,specify;


�  “publicbuilding”meansaGovernmentorprivatebuilding,used or accessed by the public at large, including abuilding used for educational or vocational purposes,workplace,commercialactivities,publicutilities,religious,cultural, leisure or recreational activities, medical orhealth services, law enforcement agencies, reformatoriesor judicial foras, railway stations or platforms, roadwaysbusstandsorterminus,airportsorwaterways;

�  “publicfacilitiesandservices”includesallformsofdeliveryofservicestothepublicatlarge,includinghousing,educationalandvocationaltrainings,employmentandcareeradvancement,shoppingormarketing,religious,cultural,leisureorrecreational,medical,healthandrehabilitation,banking,financeandinsurance,communication,postalandinformation,accesstojustice,publicutilities,transportation;


�  “reasonable accommodation” means necessary andappropriate modification and adjustments, withoutimposing a disproportionate or undue burden in aparticular case, toensure topersonswithdisabilitiesthe enjoyment or exercise of rights equally withothers;

�  “registered organization” means an association ofpersons with disabilities or a disabled personorganization, associationofparentsofpersonswithdisabilities, association of persons with disabilitiesand family members, or a voluntary or non-governmental or charitable organization or trust,society, or non-profit company working for thewelfare of the persons with disabilities, dulyregistered under an Act of Parliament or a StateLegislature;


�  rehabilitation” refers to a process aimed at enablingpersons with disabilities to attain and maintainoptimal, physical, sensory, intellectual, psychologicalenvironmentalorsocialfunctionlevels;

�  “Special Employment Exchange”means any office orplaceestablishedandmaintainedbytheGovernmentfor the collection and furnishing of information,either by keeping (i) persons who seek to engageemployeesfromamongstthepersonswithdisabilities;(ii) persons with benchmark disability who seekemployment; (iii) vacancies to which persons withbenchmark disabilities seeking employment may beappointed;

�  “specified disability” means the disabilities asspecifiedintheSchedule.CBRNETWORK,Bangalore

�  “transportationsystems”includesroadtransport,railtransport,airtransport,watertransport,paratransitsystemsforthelastmileconnectivity,roadandstreetinfrastructure,etc.

�  “universal design” means the design of products,environments,programmesandservicestobeusablebyallpeople to thegreatestextentpossible,withoutthe need for adaptation or specialized design andshall apply to assistive devices including advancedtechnologies for particular group of persons withdisabilities.


CHAPTERIIRIGHTSANDENTITLEMENTS

PROTECTIONANDSAFETY.�  (1)Thepersonswithdisabilitiesshallhaveequalprotectionandsafetyinsituationsofrisk,armedconflict,humanitarianemergenciesandnaturaldisasters.

�  (2) TheNationalDisasterManagementAuthority and theState Disaster Management Authority shall takeappropriatemeasurestoensure inclusionofpersonswithdisabilitiesinitsdisastermanagementactivitiesasdefinedunder clause (e)of section 2of theDisasterManagementAct, 2005 for the safety and protection of persons withdisabilities.


�  (3) The District Disaster Management Authorityconstituted under section 25 of the DisasterManagement Act, 2005 shall maintain record ofdetailsofpersonswithdisabilities in thedistrictandtakesuitablemeasurestoinformsuchpersonsofanysituations of risk so as to enhance disasterpreparedness.

�  (4)Theauthoritiesengagedinreconstructionactivitiessubsequenttoanysituationofrisk,armedconflictornaturaldisastersshallundertakesuchactivities,inconsultationwiththeconcernedStateCommissioner,inaccordancewiththeaccessibilityrequirementsofpersonswithdisabilities.


HOMEANDFAMILY.�  (1)Nochildwithdisabilityshallbeseparatedfromhisorherparentsonthegroundofdisabilityexceptonanorderofcompetentcourt,ifrequired,inthebestinterestofthechild.

�  (2)Wheretheparentsareunabletotakecareofachildwith disability, the competent court shall place suchchildwith his or her near relations, and failing thatwithin the community in a family setting or inexceptional cases in shelter home run by theappropriate Government or non-governmentalorganization,asmayberequired.


REPRODUCTIVERIGHTS.�  (1) The appropriate Government shall ensure thatpersons with disabilities have access to appropriateinformation regarding reproductive and familyplanning.

�  (2) No person with disability shall be subject to anymedical procedure which leads to infertility withouthisorherfreeandinformedconsent.


ACCESSIBILITYINVOTING.� The Election Commission of India and the StateElection Commissions shall ensure that all pollingstationsareaccessibletopersonswithdisabilitiesandallmaterialsrelatedtotheelectoralprocessareeasilyunderstandablebyandaccessibletothem.

ACCESSTOJUSTICE.�  (1) The appropriate Government shall ensure thatpersonswithdisabilitiesareable toexercise the rightto access any court, tribunal, authority, commissionoranyotherbodyhaving judicialorquasi-judicialorinvestigative powers without discrimination on thebasisofdisability.


�  (2)TheappropriateGovernmentshalltakestepstoputin place suitable supportmeasures for persons withdisabilities specially those living outside family andthose disabled requiring high support for exercisinglegalrights.

�  (3)TheNationalLegalServicesAuthorityandtheStateLegalServicesAuthoritiesconstitutedundertheLegalServices Authorities Act, 1987 shall make provisionsincluding reasonable accommodation to ensure thatpersons with disabilities have access to any scheme,programme,facilityorserviceofferedbythemequallywithothers.


�  (4)The appropriateGovernment shall take steps to—(a) ensure that all their public documents are inaccessible formats; (b) ensure that the filingdepartments,registryoranyotherofficeofrecordsaresupplied with necessary equipment to enable filing,storingandreferringto thedocumentsandevidencein accessible formats; and (c) make available allnecessary facilities and equipment to facilitaterecordingoftestimonies,argumentsoropiniongivenby persons with disabilities in their preferredlanguageandmeansofcommunication.


� DESIGNATIONOFAUTHORITIESTOSUPPORT.(1) The appropriate Government shall designate one ormore authorities to mobilize the community andcreate social awareness to support persons withdisabilitiesinexerciseoftheirlegalcapacity.

(2)The authority designated under sub-section (1) shalltake measures for setting up suitable supportarrangements to exercise legal capacity by personswith disabilities living in institutions and thosewithhighsupportneedsandanyothermeasuresasmayberequired


CHAPTERIIIEDUCATION

DUTYOFEDUCATIONALINSTITUTIONS.�  The appropriate Government and the local authoritiesshallEndeavourthatalleducationalinstitutionsfundedorrecognized by them provide inclusive education to thechildrenwithdisabilitiesandtowardsthatendshall.

�  (i) admit them without discrimination and provideeducation and opportunities for sports and recreationactivitiesequallywithothers;

�  (ii) make building, campus and various facilitiesaccessible; (iii) provide reasonable accommodationaccordingtotheindividual’srequirements.


�  (iv)providenecessarysupportindividualizedorotherwisein environments that maximize academic and socialdevelopmentconsistentwiththegoaloffullinclusion;

�  (v)ensurethattheeducationtopersonswhoareblindordeaforbothisimpartedinthemostappropriatelanguagesandmodesandmeansofcommunication;

�  (vi) detect specific learningdisabilities in children at theearliestandtakesuitablepedagogicalandothermeasurestoovercomethem;

�  (vii) monitor participation, progress in terms ofattainment levelsandcompletionofeducation in respectofeverystudentwithdisability;

�  (viii)providetransportationfacilitiestothechildrenwithdisabilities and also the attendant of the children withdisabilitieshavinghighsupportneeds.


SPECIFICMEASURESTOPROMOTEANDFACILITATEINCLUSIVEEDUCATION.

� TheappropriateGovernmentandthelocalauthoritiesshalltakethefollowingmeasuresforthepurposeofsection16,namely.

�  (a)toconductsurveyofschoolgoingchildrenineveryfiveyearsforidentifyingchildrenwithdisabilities,ascertainingtheirspecialneedsandtheextenttowhichthesearebeingmet:

� ProvidedthatthefirstsurveyshallbeconductedwithinaperiodoftwoyearsfromthedateofcommencementofthisAct;


�  (b)toestablishadequatenumberofteachertraininginstitutions;�  (c)totrainandemployteachers,includingteacherswith

disabilitywhoarequalifiedinsignlanguageandBrailleandalsoteacherswhoaretrainedinteachingchildrenwithintellectualdisability;

�  (d)totrainprofessionalsandstafftosupportinclusiveeducationatalllevelsofschooleducation;

�  (e)toestablishadequatenumberofresourcecentrestosupporteducationalinstitutionsatalllevelsofschooleducation;

�  (f)topromotetheuseofappropriateaugmentativeandalternativemodesincludingmeansandformatsofcommunication,Brailleandsignlanguagetosupplementtheuseofone’sownspeechtofulfillthedailycommunicationneedsofpersonswithspeech,communicationorlanguagedisabilitiesandenablesthemtoparticipateandcontributetotheircommunityandsociety;


�  (g)toprovidebooks,otherlearningmaterialsandappropriateassistivedevicestostudentswithbenchmarkdisabilitiesfreeofcostuptotheageofeighteenyears;

�  (h)toprovidescholarshipsinappropriatecasestostudentswithbenchmarkdisability;

�  (i)tomakesuitablemodificationsinthecurriculumandexaminationsystemtomeettheneedsofstudentswithdisabilitiessuchasextratimeforcompletionofexaminationpaper,facilityofscribeoramanuensis,exemptionfromsecondandthirdlanguagecourses;

�  (j)topromoteresearchtoimprovelearning;and�  (k)anyothermeasures,asmayberequired.


ADULTEDUCATION� TheappropriateGovernmentandthelocalauthoritiesshalltakemeasurestopromote,protectandensureparticipationofpersonswithdisabilitiesinadulteducationandcontinuingeducationprogrammesequallywithothers.


CHAPTERIVSKILLDEVELOPMENTANDEMPLOYMENT

EQUALOPPORTUNITYPOLICY.�  (1) Every establishment shall notify equal opportunitypolicydetailingmeasuresproposedtobetakenbyitinpursuance of the provisions of this Chapter in themanner as may be prescribed by the CentralGovernment.

�  (2)Everyestablishmentshallregisteracopyofthesaidpolicy with the Chief Commissioner or the StateCommissioner,asthecasemaybe.


MAINTENANCEOFRECORDS.�  (1) Every establishment shall maintain records of thepersons with disabilities in relation to the matter ofemployment, facilities provided and other necessaryinformationincompliancewiththeprovisionsofthisChapter in such form and manner as may beprescribedbytheCentralGovernment.

�  (2)Everyemploymentexchangeshallmaintainrecordsofpersonswithdisabilitiesseekingemployment.

�  (3)Therecordsmaintainedundersub-section(1)shallbeopento inspectionatallreasonablehoursbysuchpersons asmay be authorized in their behalf by theappropriateGovernment.


APPOINTMENTOFGRIEVANCEREDRESSALOFFICER.

�  (1) Every Government establishment shall appoint aGrievanceRedressalOfficerforthepurposeofsection19and shall inform the Chief Commissioner or the StateCommissioner, as the case may be, about theappointmentofsuchofficer.

�  (2)Anypersonaggrievedwiththenon-complianceoftheprovisions of section 20,may file a complaint with theGrievanceRedressalOfficer,whoshallinvestigateitandshall take up the matter with the establishment forcorrectiveaction.


�  (3) The Grievance Redressal Officer shall maintain aregister of complaints in the manner as may beprescribed by the Central Government, and everycomplaint shall be inquired within two weeks of itsregistration.

�  (4) If the aggrieved person is not satisfied with theaction taken on his or her complaint,he or shemayapproachtheDistrict-LevelCommitteeondisability.


CHAPTERVSOCIALSECURITY,HEALTH,REHABILITATIONAND

RECREATIONSOCIALSECURITY.�  (1) The appropriateGovernment shallwithin the limitof its economic capacity and development formulatenecessaryschemesandprogrammestosafeguardandpromote the right of persons with disabilities foradequate standard of living to enable them to liveindependentlyorinthecommunity:

Providedthatthequantumofassistancetothepersonswithdisabilitiesundersuchschemesandprogrammesshallbeatleasttwenty-fivepercent.higherthanthesimilarschemesapplicabletoothers.


�  (2) The appropriate Government while devising theseschemesandprogrammesshallgivedueconsiderationto the diversity of disability, gender, age, and socio-economicstatus.

�  (3)Theschemesundersub-section(1)shallprovidefor,—

(a) community centres with good living conditions intermsofsafety,sanitation,healthcareandcounseling;

(b) facilities for persons including children withdisabilities who have no family or have beenabandoned,orarewithoutshelterorlivelihood;

(c)supportduringnaturalorman-madedisastersandinareasofconflict;


�  (d)supporttowomenwithdisabilityforlivelihoodandforupbringingoftheirchildren;

�  (e)accesstosafedrinkingwaterandappropriateandaccessiblesanitationfacilitiesespeciallyinurbanslumsandruralareas;

�  (f)provisionsofaidsandappliances,medicineanddiagnosticservicesandcorrectivesurgeryfreeofcosttopersonswithdisabilitieswithsuchincomeceilingasmaybenotified;

�  (g)disabilitypensiontopersonswithdisabilitiessubjecttosuchincomeceilingasmaybenotified;

�  (h)unemploymentallowancetopersonswithdisabilitiesregisteredwithSpecialEmploymentExchangeformorethantwoyearsandwhocouldnotbeplacedinanygainfuloccupation;


�  (i)care-giverallowancetopersonswithdisabilitieswithhighsupportneeds;

�  (j)comprehensiveinsuranceschemeforpersonswithdisability,notcoveredundertheEmployeesStateInsuranceSchemes,oranyotherstatutoryorGovernmentsponsoredinsuranceschemes;

�  (k)anyothermatterwhichtheappropriateGovernmentmaythinkfit.


RESEARCHANDDEVELOPMENT.� TheappropriateGovernmentshallinitiateorcausetobe initiated research and development throughindividuals and institutions on issues which shallenhance habilitation and rehabilitation and on suchother issues which are necessary for theempowermentofpersonswithdisabilities.

CULTUREANDRECREATION.� TheappropriateGovernmentandthelocalauthoritiesshalltakemeasurestopromoteandprotecttherightsofallpersonswithdisabilitiestohaveaculturallifeandtoparticipateinrecreationalactivitiesequallywithotherswhichinclude,—


�  (a) facilities, support and sponsorships to artists andwriters with disability to pursue their interests andtalents;

�  (b)establishmentofadisabilityhistorymuseumwhichchroniclesand interpretsthehistoricalexperiencesofpersonswithdisabilities;

�  (c)makingartaccessibletopersonswithdisabilities;�  (d) promoting recreation centres, and otherassociational

�  (e)facilitatingparticipationinscouting,dancing,artclasses,outdoorcampsandadventureactivities;

�  (f)redesigningcoursesinculturalandartssubjectstoenableparticipationandaccessforpersonswithdisabilities;


�  (g)developingtechnology,assistivedevicesandequipmentsto facilitate access and inclusion for persons withdisabilitiesinrecreationalactivities;and

�  (h) ensuring that persons with hearing impairment canhave access to televisionprogrammeswith sign languageinterpretationorsub-titles.

SPORTINGACTIVITIES.�  (1)TheappropriateGovernmentshalltakemeasurestoensureeffectiveparticipationinsportingactivitiesofthepersonswithdisabilities.

�  (2)Thesportsauthoritiesshallaccordduerecognitiontotherightofpersonswithdisabilitiestoparticipateinsportsandshallmakedueprovisionsfortheinclusionofpersonswithdisabilitiesintheirschemesandprogrammesforthepromotionanddevelopmentofsportingtalents.


�  (3)Withoutprejudicetotheprovisionscontainedinsub-sections(1)and(2),theappropriateGovernmentandthesportsauthoritiesshalltakemeasuresto,—

�  (a)restructurecoursesandprogrammestoensureaccess,inclusionandparticipationofpersonswithdisabilitiesinallsportingactivities;

�  (b)redesignandsupportinfrastructurefacilitiesofallsportingactivitiesforpersonswithdisabilities;

�  (c)developtechnologytoenhancepotential,talent,capacityandabilityinsportingactivitiesofallpersonswithdisabilities;

�  (d)providemulti-sensoryessentialsandfeaturesinallsportingactivitiestoensureeffectiveparticipationofallpersonswithdisabilities;


�  (e)allocatefundsfordevelopmentofstateofartsportfacilitiesfortrainingofpersonswithdisabilities;

�  (f)promoteandorganizedisabilityspecificsportingeventsforpersonswithdisabilitiesandalsofacilitateawardstothewinnersandotherparticipantsofsuchsportingevents.


CHAPTERVISPECIALPROVISIONSFORPERSONSWITH

BENCHMARKDISABIILITESINCENTIVESTOEMPLOYERSINPRIVATESECTOR.

� TheappropriateGovernmentandthelocalauthoritiesshall,withinthelimitoftheireconomiccapacityanddevelopment, provide incentives to employer inprivatesector toensure thatat leastfivepercent.oftheir work force is composed of persons withbenchmarkdisability.


SPECIALEMPLOYMENTEXCHANGE.

� The appropriate Government may, by notification,require that from such date, the employer in everyestablishment shall furnish such information orreturn as may be prescribed by the CentralGovernment in relation to vacancies appointed forpersonswithbenchmarkdisabilitythathaveoccurredor are about to occur in that establishment to suchspecial employment exchange asmay be notified bytheCentralGovernment and the establishment shallthereuponcomplywithsuchrequisition.
