INTRODUCTION

1. I am a S p e c i a l Agent w i t h t h e F e d e r a l Bureau o f

I n v e s t i g a t i o n ( " F B I " ) , and have been s o employed s i n c e September

1978 . For t h e p a s t t e n y e a r s , I have been a s s i g n e d t o t h e Eugene

R e s i d e n t Agency o f t h e "FBI" working numerous f e d e r a l v i o l a t i o n s

t o i n c l u d e d o m e s t i c t e r r o r i s m m a t t e r s , more s p e c i f i c a l l y a r s o n ,

and d e s t r u c t i o n of p r o p e r t y c l a i m e d by t h e Animal L i b e r a t i o n

F r o n t (ALF) and t h e E a r t h L i b e r a t i o n F r o n t (ELF) .

presented in the affidavit. Authority is being sought to search

the following premises: the residences of Stanislas Meyerhoff,

414 Four Seasons Drive, Charlottesville, Virginia; Kevin Tubbs,

520 South 71st Street, Springfield, Oregon; Daniel McGowan, 510

East 13th Street, Apartment 14, New York, New York; and the

residence and business of William C. Rodgers, 109 N-A ~c~ormick

Street, Prescott, Arizona. The items for which affiant and

others under his direction will be searching include: certain

evidence of association among co-conspirators, including address

and/or telephone books, personal diaries and photographs;

evidence of communication among co-conspirators, including

@ correspondence, voice mail, computer e-mail and web-site

messages; evidence of false identification used or possessed by

co-conspirat.ors, including identifications of Ronald Calloway,

Dylan Kay, and Jamie Moran; evidence of association of co-

conspirators with ALF/ELF, including publicat.ions or communiques

by or related t.o ALF/ELF, 1ist.s of potential victims, and manuals

on how to construct incendiary devices, both written and on

computers; evidence of financial and telephone records, including

credit. card statements, receipts, checks, bank statements, and

telephone bills; and two way radios, including hand-held radios

or walkie talkies, person to person communicators, scanners and

b. On t h e way t o Olympia, Washington, t h e CW, Tubbs and

Overaker s t o p p e d i n Tacoma, Washington t o s h o p l i f t

i t e m s f o r t h e i r p re -p lanned a r s o n . Overaker was

a r r e s t e d f o r s h o p l i f t i n g sponges and a mag l i g h t . a t

~ o h e Base, Tacoma, Washington. Because Overaker was

a r r e s t . e d , t .he CW and Tubbs dec ided t o c o n t a c t Dibee t o

c a l l o f f t h e two a r s o n s . The CW and Tubbs were unab le

t o c o n t a c t ~ i b e e . I n t h e meantime, t h e CW and Tubbs

were h a v i n g t r o u b l e w i t h t h e i r van, b u t w e r e a b l e t o

t e m p o r a r i l y f i x it and m e e t Rodgers. Overaker , who was

r e l e a s e d from j a i l , was w i t h Rodgers. They dec ided t o

commit t h e a r s o n of t h e APHIS F a c i l i t y s i n c e t h e y were

unab le t o c o n t a c t Dibee t o c a l l o f f t h e o t h e r p lanned

a r s o n . Overaker was t o l d t o f i n d a n a l i b i a s s h e was

n o t p e r m i t t e d t o p a r t i c i p a t e i n t h e a r s o n because of

h e r e a r l i e r a r r e s t .

c. Because t h e y were u n a b l e t o meet Dibee who was t o

supp ly t h e t i m e r s f o r t h e i n c e n d i a r y d e v i c e s , Rodgers

purchased l i g h t e r s t i c k s ( f i r e s t a r t e r s ) a t a s t o r e i n

Olympia, Washington t h a t were t o be used i n l i g h t i n g

t h e f u e l . With Tubbs d r i v i n g , t h e CW, Tubbs and

Rodgers t r a v e l e d t o Olympia, Washington i n Rodgers's

Tubbs t a l k e d a b o u t J o s e p h i n e S u n s h i n e Overaker b e i n g a r r e s t e d f o r

s h o p l i f t i n g j u s t p r i o r t o t h e a r s o n a t t h e A P H I S F a c i l i t y i n

Olympia, Washington.

7 . Independen t i n v e s t i g a t i o n d e t e r m i n e d t h a t Overake r was

a r r e s t e d on June 20, 1998, f o r s h o p l i f t i n g i n Tacoma, Washingt-on.

t h e CW t h a t Rodgers u s e d Duraflame F i r e s t a r t Barbeque l i g h t e r s t o

13. I n v e s t i g a t i o n r e v e a l e d tha t . on J a n u a r y 2, 2001, t h e

a r s o n a t t h e o f f i c e o f S u p e r i o r Lumber Company o c c u r r e d , and was

c la imed by t h e ELF. The CW p r o v i d e d d e t a i l s of t h e a r s o n s t o

i n c l u d e t h e i n c e n d i a r y d e v i c e s used , t h e p lacement of t h e

d e v i c e s , and t h e d e s c r i p t i o n of t h e t a r g e t e d a r e a , n e a r l y a l l of

which matched t h e f i r e c a u s e i n v e s t i g a t i o n conduc ted by ATF.

1 4 . On A p r i l 2 , 2005, I p l a c e d a body recorder . on t h e CW

who engaged i n a c o n v e r s a t i o n w i t h McGowan. McGowan t a l k e d about

t h e "Glendale t . h i n g n and t h a t "You were l o s i n g g a s i n Bet.ty ( t h e

van) and you had t o l i k e r u b s o a p o r something, or a p a n t y hose

o r something on t h e f u c k i n ' 0 r i n g . Do you remember tha t . ? Every

l i k e coup le m i l e s o r somet.hing r . i d i c u l o u s , You know what I ' m

a say ing?"

15. On J u l y 1 8 , 2005, I p l a c e d a body r e c o r d e r on t h e CW

who engaged i n a c o n v e r s a t i o n w i t h Meyerhoff. Meyerhoff s t a t e d ,

r e g a r d i n g Glenda le , "It was s u p e r smooth. I t wa-, it o p e r a t e d

w e l l . I t a l l went s u p e r smo0t.h e x c e p t f o r f u c k i n ' van

s t a r t i n g t o b r e a k down i n t h e midd le of t h e f u c k i n g d r i v e down."

16. I n a d e b r i e f i n g o f t h e CW duxing t h e p e r i o d September

2 1 through 2 3 , 2004, t h e CW p r o v i d e d t h e f o l l o w i n g i n f o r m a t i o n

r e g a r d i n g t h e a r s o n a t J e f f e r s o n P o p l a r Farm i n C l a t s k a n i e ,

Oregon on May 21 , 2001: Approximate ly s i x months p r i o r t.o t h e

a r s o n , t h e CW, who was l i v i n g i n P o r t l a n d , Oregon w i t h Overaker ,

0 was v i s i t e d by Tubbs, Meyerhoff, Chelsea Ger lach and McGowan.

They asked t h e CW t o accompany them f o r a d r y run o f a n unknown

l o c a t i o n . They d r o v e a c r o s s t h e S t a t e of Washington b o r d e r and

l a t e r c ro s sed back o v e r i n t o Oregon. The CW r e c a l l e d d r i v i n g

o v e r r a i l r o a d t r a c k s and t o a farm,

1 7 . On December 10, 2004, t h e CW was d r i v e n o u t t o

J e f f e r s o n Poplar Farms w i t h m e . Before we came t o any r a i l r o ' a d

t r a c k s , t h e CW s t a t e d t o m e t h a t t h e r e were r a i l r o a d t r a c k s

s h o r t l y ahead. A s h o r t d i s t a n c e l a t e r , w e were a b l e t o obse rv e

and drove over t h e r a i l r o a d t r a c k s . The CW r e c a l l e d t h e farm

a r e a .

1 8 . On June 2 8 , 2005, I p l a c e d a body r e c o r d i n g d e v i c e on

the CW. The CW met Meyerhoff and t h e y t a l k e d abou t t h e a r s o n a t

t h e J e f f e r s o n Pop l a r Farm. Meyerhoff s t a t e d "Towards t h e end,

you know, I ' d make t h e b u r g e r s ( t i m i n g d e v i c e s ) and it kep t

happening. You remember t h a t doub le , w e l l you were

t h e r e ... Double whammy? W e d i d two t h e same t i m e . Washington and

Oregon a t t h e same t i m e . " Meyerhoff c o n t i n u e s by s a y i n g "This i s

what ended up happening i s h a l f of it., h a l f o f it went ... l i k e

t r u c k s a l l went, you know? ... h a l f o f it went i n t h e s h e d and t h e

o f f i c e and r e l e v a n t s t u f f , l i k e t h e r e were two on t h e r e . "

19. I n v e s t i g a t i o n r e v e a l e d t h a t t h e r e were two a r s o n s on

May 2 1 , 2001 t ha t . were c la imed by ELF: one was a t t h e J e f f e r s o n

Poplar Farm i n C l a t s k a n i e , Oregon, and t h e o t h e r a t t h e

e University of Washington in Seattle, Washington. Investigation

also confirmed the details provided by Meyerhoff regarding the

setting of the incendiary devices at Jefferson Poplar Farms.

20. On April 2, 2005, I placed a body recording device on

the CW who engaged in a conversation with McGowan. McGowan said

"Well, yeah, Poplar, they basically, they got an intact one. This

uh, didn't work. It (timing device) was submerged though,

um . . . Yeah (in a bucket). It didn't work. Actually they probably

have two, two, two of them, from the same spot."

21. Investigation confirmed what McGowan was talking about.

regarding the setting of the incendiary devices at Jefferson

Poplar Farms and that timing devices did not ignite. Found at

the scene was a "fanny pack," submerged in a bucket of fuel. The

CW had earlier advised me that timing devices were typically

brought. to the scene of the arsons in backpacks or similar gear.

Intact incendiary devices were also recovered at Jefferson Poplar

Farms .

Association and Communication Arnonq Co-conspirators

22. On April 1, 2005, I placed a body recording device on

the person of the CW, who engaged in a conversat.ion with McGowan.

McGowan advised the CW that he keeps in touch with "India"

(Savoie), and that they write letters to each other. McGowan

also talked about meeting Lacy Phillabaum, girlfriend of

Meyerhoff, in the near future.

23. On April 2, 2005, I placed a body recording device on

the person of the CW, who engaged in a conversation with McGowan.

McGowan advised the CW that he tries to keep in touch with people

(cell members) to make sure everything is alright, and that they

did not find religion and/or money, which are the only ways

people will talk to law enforcement. McGowan also mentioned

tracking down the 'punk kids" (a couple who helped with the akson

at Jefferson Poplar) .

24. On August 15, 2005, I provided a body recording device

to CW, who engaged in a conversation with McGowan. McGowan

advised the CW that he talks to India (Savoie) every couple of

months.

25. On August 15, 2005, I placed a body recording device on

the person of the CW, who engaged in a conversation with McGowan.

McGowan advised the CW that. he researches on the internet for

updates on ALF/ELF arson investigations and information about

grand juries.

26. On November 18, 2005, I placed a body recording device

on the person of the CW, who engaged in a conversation with

T u b b s . T u b b s advised the CW that he is expecting an email from

"Kara" (Rebecca Rubin), who is a cell member and who participated

in at least one ALF/ELF claimed arson with Tubbs and Meyerhoff.

27. On January 8, 2005, I placed a bddy recording device on

the CW who engaged in a conversation with T u b b s regarding

discovering an ALF/ELF pamphlet in his house. T u b b s advised the

CW that the pamphlet was in his belongings for the past ten

years, and when he found it, he got rid of it..

28. On August 15, 2005, I provided a body recording device

to the CW who engaged in a conversation with M c G o w a n . M c G o w a n

talked about discovering a copy of the R o d g e r s ' manual llSett.ing

Fires with Electronic Timers," at an unknown storage unit for an

environmental office in New York City. M c G o w a n stated to the CW

that he made copies of the manual and was going to distribute

them to continue to educate extremists in how to build

destructive devices.

29. On November 25, 2005, I placed a body recording device

on the person of the CW who engaged in a conversation with

R o d g e r s . R o d g e r s advised the CW that he stopped working on his

manual ("Setting Fires with Electronic Timers") about a year and

a half ago and has not done anything with it since then. He

continued by stating that if he had completed the manual in 2001,

young people, who were committed to the destruction of property

on behalf of the ALF/ELF, would have avoided being arrested.

R o d g e r s also mentioned that he has all the "zines" (magazines and

other publications of the ALF/ELF) under his control.

Financial and Telephone Records

36. Based upon my training and experience, including

participation in other domestic terrorism investigations, and

extensive discussions with other experienced FBI agents and state

and local officers, I have probable cause to believe and do

believe that persons generally, including individuals involved in

domestic terrorism groups, and specifically M e y e r h o f f , Tubbs,

McGowan and Rodgers, typically maintain financial and telephone

records including credit card statements, receipts, checks, bank

statements and telephone bills as part of their personal records

for purposes of preparing personal tax returns, reconciling

checkbooks, and verification of purchases and/or payments. These

documents may be relevant to this investigation because they may

establish relationships, payments among co-conspirators,

locations and timing of where co-conspirators were in relation to

the destruction of property and/or arsons, and purchases of

components of incendiary devices and other necessary clothing and

tools used in the commission of the destruction of property

and/or arsons.

.instrumentalities of crime. This sorting process can

take weeks or months, depending on the volume of data

stored, and i t would be impractical and invasive to

attempt this kind of data search on-site.

b. Technical. requirements. searching computer systems for

criminal evidence is a highly technical process

requiring expert skill and a properly controlled

environment. The vast array of comput.er hardware and

software available requires even computer experts to

specialize in some systems and applications, so it is

difficult to know before a search which expert is

qualified to analyze the system and its data. In any

event, however, data search protocols are exacting

scientific procedures designed to protect the integrity

of the evidence and to recover even "hidden," erased,

compressed, password-protected, or encrypted files.

Because computer evidence is vulnerable to inadvertent

or intentional modification or destruction (both from

external sources or from destructive code imbedded in

the system as a "booby trap"), a controlled environment

may be necessary to complete an accurate analysis.

Further, such searches often require the seizure of

most or all of the computer system's input/output

peripheral devices, related software, documentation,
