5 SIMTA has previously approached both Defencc and the Department of Finance and Deregulation (DOFD) seeking Land Owners Consent as required under NSW planning legislation to lodge plans for the construction of rail infrastructure on Defence land adjoining the SIMTA site with the relevant NSW authorities [n close consultation with DOFD and other interested arties (such as

the Department of Infrastructure and Transport) Defence has detennined thaL given the uncertainties surrounding the Moorebank precinct with respect to both our Logistics project and the broader IMT project we are not in a position to provide consent at this time Defence is unable to assess the impact of the SIMT A proposal until there is certainty about the proposal for Defence to relocate from Steele Barracks DOFD has also advised of its inability to provide Owners Consent to the Steele Barracks site until after Government consider the lntermodal Terminal proposal being developed by the (DOFD) Moorebank Project Office In my conversation with SIMTA I noted that if the SME remained at Moorebank we would need to ensure that any development in close proximity to the site did not disrupt the training conducted - or impose unreasonable loss of amenity on the staff - at SME

Purpose To update you of the status of the Defence leased facilities at Moorebank NSW

2 Two key meetings have occurred since that time which have been attended by Defence officials and representatives of the Sydney Inter-modal Terminal Alliance (SIMTA) The first was a meeting on 15 Mar 12 that was jointly chaired by the Chainnan ofInfrastructure Australia Sir Rod Eddington and the Chairman of Infrastructure NSW the Hon Nick Griener At the meeting a presentation was made by Maurice James Managing Director or Qube Logistics His presentation included assertion that Defence had agreed to vacate 10 Ha of the 83 Ha leased site on which the DNSDC is located Mr Simon Lewis (COO Defence) refuted the assertion

3 An outcome of that meeting was that Defence and SIMTA meet to further discuss the detail of the SIMT A proposal The follow-up meeting occurred on 22 Mar 12

4 I chaired the follow-up meeting and the outcomes (attached) including agreement that Defence has not agreed to vacate part of the DNSDC site and that SIMT A needed to lodge a fOlmal submission addressing a specified list of issues it was also made very clear during the meeting that any revised leasing agreement that Defence may enter into shall not be interpreted as agreement to the construction of an intermodal freight hub on the excised land or as owner consent to the planning or construction of a railway to service the site on Defence owned lUld Mr Simon Smith from the NSW Premiers and Department also attended the meeting The outcomes of the meeting are attached at Attachment 2

5 On 27 Mar 12 Defence received a very brief Jbrmal proposal from SIMTA that does not appear to address all the issues specified The proposal has been circulated to Defence stakeholders for analysis
