ARTICLE I

ORGANIZATION OF BOARD OF EDUCATION

1. 1. The Board of Education of Union Free School District No. 21 (Rockville Centre Public Schools). New York. shall organize in accord with the New York State Education Law.

1. 2. Regular meetings of the Board of Education shall be held one evening each month. in the Board Room of the Administrative Offices. Shepherd Street. at such time and on such date as shall be fixed at the Organization Meeting of the Board. held the first Tuesday evening in July.

1. 3. Special meetings of the Board of Education shall be held at the call of the President, or of the Clerk. upon request of three members of the Board.

1. 4. Three members of the Board shall constitute a quorum.

1. 5. The order of business at regular meetings of the Board of Education shall be:

A. Roll Call B. Approval of minutes of previous meeting or meetings C. Schedule of bills to be paid D. Report of Finance Committee E. Presentation of communications F. Unfinished business G. New business

1. 6. The Organization ~leeting of the Board of Education shall be held the first Tuesday evening in July. in accordance with the State Education Law. At this meeting. the President shall name the chairman and the members of standing committees. each of which shall consist of three members. The standing committees shall be as follows:

A. Finance Committee B. Committee on School Buildings and Grounds

1. 7. The President shall be an ex-officio member of all committees.

1. 8. Two members of a committee shall constitute a quorum.

1. 9. Committees shall make recommendations to the Board of Educa­tion but no such recommendation shall be binding unless it is approved by a majority of the Board of Education.

1. 10. The Board of Education, at any meeting ,,,hen a quorum is present. may. at its discretion. convene as. or resolve itself into a Committee of the l:.Thole.

1. 11. The President may appoint special committees as the· need arises. and may appoint chairmen of such committees.

1. 12. One person shall serve as the secretary of the Board of Education and as Clerk of Union Free School District No. 21. and shall perform the duties \lThich are prescribed in the State Education Law.

1. 13. The President and Clerk of the Board of Education shall sign all warrants drawn on the accounts of Union Free School District No. 21.

1. 14. There shall be a Vice President of the Board of Education who shall act in the absence of the President. This shall include the signing of checks and other documents in the place of the President l!Then absent.

ARTICLE II

RULES AND REGULATIONS OF THE BeARD CF EDUCATION

2. 1. The Board of Education may make transfer from one budgetary classification to an~ther budgetary classification at their discretion. provided such transfer is in accordance with the State Education Law.

2. 2. The Board of Education shall authorize the Superintendent of Schools to add from time to time to the curriculum or course of study such outside of school activities as may seem best and in line with progressive trends and practices in education and to make such rules and regulations for the conduct of the same for adoption of the Board of Education. and when such activity or activities have been so added and approved. a teacher, after having obtained permission of a parent of each child in a class and the principal of the school, shall be privileged to arrange for trans­portation and conduct a ~lass of pupils on trips or excursions to a museum. fire house. telephone exchange, and to any place of bus­iness. to a manufacturing plant. to exhibitions. to a show or con-

. test during school hours or after school hours or on holidays or non-school days for the purpose of observation or obtaining infor­mation and for instruction, and a teacher so conducting a class shall be considered engaged and acting within the scope of his employment and under the direction of the Board of Education and such teacher shall be fully protected under Section 3023 of the State Education Law. '

2. 3. The Board of Education shall determine tuition fees for non­resident pupils atten~ing the Rockville Centre Public Schools~

2. 4. The Board of Education shall determine the requirements for graduation from Junior High School and frorn South Side High School in accordance llTith State Education Law and regulations of State Education Department.

2. 5. The Board of Education shall adopt a salary schedule and file same with the State Education Department.

2. 6. The Board of Education shall cause a perpetual inventory of all furniture and other equipment in all school buildings, to be main­tained under the direction of the Superintendent of Schools.

2. ;. The Board of Education, as a corporate body. may not sponsor activities to which an admission charge is made.

2. 8. All orders and contracts shall be executed by the office of the Superintendent of Schools. No order in excess of $100 may be consummated by the Superintendent of Schools except it be approved by the Board of Education.

ARTICLE III

TREASURER CF UNION FREE SCHeCL DISTRICT NO. 21

). 1. The Treasurer of Union Free School District No. 21 shall be appointed by the Board of Education at the Organization ~eeting of the Board for a period of one year.

). 2. The Treasurer shall also act as Treasurer of the Rockville Centre Public Library.

. ). 3. The Treasurer shall perform those duties demanded of him to

the New· York State Education LalIT. In addition, thereto. it shall be his duty to keep a complete record in a cash book of all moneys received and disbursed, shall issue receipts for all moneys received, and shall sign cheaks for all disbursements.

). 4. The Treasurer shall be bonded at the expense of the District in such amount as the Board of Education may determine.

ARTICLE IV

SUPERINTENDENT OF SCHOOLS

4. 1. The Superintendent of Schools shall perform the duties which are prescribed in the New York State Education Law and shall be the executive officer of the Board of Education.

4. 2. The Superintendent of Schools shall recommend candidates for all positions in the Rockville Centre Public Schools, to the Board of Education~

4. 3. The Superintendent of Schools shall prescribe courses of study and textbooks to be used in the scho.ol system. See "Rules and Regulations of Board of Education" - No.2.

4. 4. The Superintendent of Schools shall prepare the budget for the ensuing fiscal year and submit it to the Board of Education not less than thirty days before the annual meeting.

4. 5. The Superintendent of Schools shall recommend rules and regula­tions to promote the welfare of the school system.

4. 6. The Superintendent of Schools shall make assignments and trans~ fers of teachers and other employees as conditions require. He shall make no major changes in personnel or in policy without the approval of the Board of Education.

4. 7. The Superintendent of Schools shall assign and remove sub­stitute teachers and substitute employees at his discretion.

4. 8. The Superintendent of Schools, with the approval of the Board of Education, shall be authorized to fix the hours for the opening and the closing of the various schools; to modify the program of instruction within the limits set up by the New York State School Law and the Courses of Study adopted by the State; to organize and supervise the schools with the assistance of the principals and other teachers; to require such reports from principals and others as shall enable him to give to the Board of Education at any time definite information regarding any school activity; to make and enforce rules for the efficient operation of the schools, provided such rules do not conflict with the School Law or with the stated policy of the Board of Education.

4. 9. The Superintendent of Schools shall arrange for the use of school facilities at night, or at other times \\Then the schools are not in session, provided such use is not in conflict with the laws of the State Education Department. The Superintendent of Schools is authorized to arrange reservations for such use of the school facilities as are in keeping with the established policy of the Board of Education. Such requests as are not in keeping with the established policy shall be referred to the Board of Education for action.

4. 10. The Superintendent of Schools, at his discretion, may suspend or expel a pupil but his action must be referred to the Board of Education at tne next regular meeting for final disposition.

4. 11. The Superintendent of Schools is authorized to dispose of obsolete equipment at best price available. The proceeds of such sales are to be turned over to general funds.

4. 12. ~ihen the Superintendent of Schools is to be absent from his office for any reason, the Administrative Assistant shall act in his behalf. The Administrative Assistant shall be in general charge of the schools during the absence of the Superintendent of Schools, but all rulings and decisions made during his absence shall be ef­fective only during the absence of the Superintendent of Schools from his office.

4. 13. The Superintendent of Schools shall approve parents' requests for transportation for children -from our district to attend non­public schools in other districts under the following conditions and within the limits of the funds approved at the annual meeting:

a. the school meet State requirements b. the school be located not more than eight miles from the home

of the student ·c. the transporation be provided 6y public carrier if available

or by the most practical contract arrangement available.

13· d. application for transportation and other details of the admin-istration to be worked out by the office of the Superintendent of Schools.

14. The Superintendent of Schools shall arrange for transportation for physically and mentally handicapped children as required and within the limits of the funds approved at the annual meeting.

ARTICLE V

PRINCIPALS - -

5. 1. The principals shall carry out the provisions of the New York State Education Law and shall enforce the rules and regulations of the Superintendent of Schools

5. 2. The Principal shall be responsible for the general management and discipline of his or her school.

5. 3. The Principal shall be responsible for the text books. refer­ence library. supplies and equipment of any kind in his or her respective building and shall furnish the Superintendent of Schools with full and accurate reports when required.

5. 4. The Principal shall keep an itemized account of all money received for damaged or lost books or damage to the school property. This money collected shall be turned over to the Superintendent of Schools monthly. or as he shall direct; he. in turn, shall turn it over to the Treasurer of the school district.

5. 5. The Principal shall call fire drills in accordance with the provisions made by the Ne\v York State Education Law. and shall report dates of such drills on regular report forms. to the Super­intendent of Schools. at the end of each month.

5. 6. The Principal of a school may. for good and sufficient reason. modify the program of a pupil or may place a pupil in a lower or higher grade, provided the pupil has received a fair trial and provided the parent of said pupil and the Superintendent of Schools have been notified by means of form provided by the Superintendent of Schools. of the possibility of such action at least three days before the action is taken.

5. 7. No principal shall initiate any new procedure in the management of his or her school without first conferring with and receiving the approval of the Superintendent'of Schools.

5. 8. Principals shall notify office of Superintendent of Schools of all accident s, how'ever slight • resulting in personal injury to pupils on Form )1, provided for this purpose.

5. 9. No Principal may suspend or expel a pupil.

5. 10. Principals shall be responsible for evaluation of the effec­tiveness of a teacher's serviceS. Such evaluation shall be re­ported to the Superintendent on Form l50-A three times each year for first and second year teachers. tNice a year for third year teachers. and once a year for teachers on tenure. Additional reports may be required by Superintendent.

It is assumed that evaluation is part of the supervisory process. The principal shall be responsible for using the best possible procedures for assisting teachers to increase effectiveness. This assumes that the principal Nill use good supervisory techniques and good human relations practices \vhich encourage teachers to do their best possible work.

5. 11. A principal shall report immediately to the Superintendent of Schools in \vriting a teacher who. in his judgment, has been unduly absent, negligent. insubordinate, incompetent, or ineffi­cient in respect to instruction. discipline or supervision, guilty of conduct unbecoming a teacher or conduct prejudicial to the good order. efficiency or discipline of the service, or whose mental or physical condition is apparently such as to render him unfit for service.

5 •. 12. A principal shall report to the Superintendent of Schools, in writing. any person under his supervision or direction who shows evidence of disability or lvhose apparent physical or mental condi­tion interferes Nith the adequate performance of his regular or emergency duties.

5. 13. Principals shall make such regulations as are necessary to secure adequate and proper supervision of all pupils at all times that they are under the control of the school.

5. 14. Any principal who must be absent from his or her duties shall report to the Superintendent of Schools such absence not later than 8:00 A.~. of the day in question.

ARTICLE VI

SPECIAL TEACHERS

6. 1. The teachers of special subjects shall arrange schedules in conference with the principals of the several schools and shall submit same to the Superintendent of Schools for his approval.

6. 2. The teachers of special subjects shall prepare and submit to the Superintendent of Schools. requisitions for all supplies and equipment needed for their respective departments, and shall check orders for these supplies and equipment when received and report directly to the Superintendent of Schools.

ARTICLE VII

TEACHERS

7. 1. All candidates for teaching positions must meet the require­ments of the State Education Law of New York and must be holders of or be eligible for licenses as required by the State Education Department.

7. 2. The Superintendent of Schools shall recommend to the Board of Education at any meeting all appointees to teaching positions and shall, at the same time, recommend salaries for such appointees.

7. 3. Teachers shall perform duties which are prescribed by the New York State Education Law. the Board of Education, the Super­intendent of Schools, and their respective principals.

7. 4. Teachers shall report pregnancy to the Superintendent of Schools im~ediately upon knowledge. Failure to do so shall be deemed a neglect of duty and shall be sufficient ground for dis­missal. Teachers who have become pregnant and are on tenure shall receive a leave of absence for a period ending approximately tt-IO years from the date of conception. The period of such leave shall be recommended by the Superintendent but it shall terminate at the o:r:ening of school in September.

ARTICLE VIII

SCHoeL PHYSICIAN

8. 1. The school physician shall be appointed by the Board of Education upon the recommendation of the Superintendent of Schools.

8. 2. The school phys'ician shall make an annual physical examination of all pupils in school. keep a cumulative record of his findings and sign the record card at the time of the examination.

8. 3. The school physician shall notify in \\ITiting the parent or guardian of each child of any defects or physical disabilities that are found. A copy of th~s notification shall be kept in the files of the health department of the school.

8. 4. The school physician shall keep all health records confidential. Such records may be made available only to school authorities or to the parents of the pupil in question.

8. 5· The school physician shall examine all pupils desiring to com­pete in athletic contests at the beginning of each athletic season and as often thereafter as he believes necessary or as he is re­quested to do so by the coach, principal, or the Superintendent of Schools. He shall not approve of the participation of any pupil in any branch of athletic contests ,,,,hen, in his judgment. such participation is disadvantageous to the physical welfare of the pupil.

8. 6. After all physical examinations the school physician shall advise teachers and coaches of any defects found and how they may aid in their correction.

8. 7. The school physician shall make periodio inspection of the school buildings and grounds and report to the Superintendent of Schools any conditions that are inimical to the health. safety and comfort of pupils, teachers. and other employees.

8. 8. The school physician shall give pupils injured in recreational or instructional activities of the school first aid service only and he shall refer injured pupils to their family doctor.

8. 9. The school physician. if employed full-time in the school district, shall perform those duties prescribed by the New York State Commissioner of Education and those extra duties which may be assigned by the Superintendent of Schools or the Board of Education.

8. 10. The school physician shall make such examinations as are required for school employment certificates.

ARTICLE IX

G',lIJERAL RULES ..cU\TD REGULATIONS

9. 1. Teachers shall keep attendance registers in strict accordance with regulations printed in said registers. Registers must be completed daily, the attendance for a given day being indicated in the register before the teacher leaves the school for that day. Registers must be complete and accurate in every detail.

9. 2. Each teacher shall keep an accurate record of his own attend­ance in grade attendance register and shall report his OWO attend­ance at the end of each semester or at the termination of his em­ployment in school, on attendance report form provided by the Superintendent of Schools.

9. ). No teacher may take the attendance register from the school building except with the permission of his principal.

9. 4. Teachers shall keep daily plan books in accordance with directions of principals. These plan books shall indicate definitely the work to be presented each day rather than con­sti tute a chronicle of lvork already completed.

9. 5. Teachers shall be in their respective classrooms twenty minutes before the opening of school in the morning 'and shall be at their classroom doors, or other assigned stations. during the fifteen minutes preceding the opening of school.

9. 6. Teachers may be called',;c.lpon for service any school day up to four-thirty olclock.

9. 7. Principals and teachers shall not allow any agent or other person to exhibit in the schools any books or articles or apparatus; nor shall they allo\v the distribution of any advertis­ing matter whatsoever. nor any circulars or other printed matter, nor the taking of photographs in the building or about the premises; and they shall not allow any contribution for any purposes whatever to be taken in any school unless specific permission has been granted by the Superintendent of Schools.

9. 8. Principals or teachers shall not supply lists of the names of pupils for the sending out of advertisements or for any commercial purpose whatever, except such action has been approved by the Superintendent of Schools.

9. 9. Any teacher who must be absent from duty shall report such absence to his or her principal not later than 7:30 A.tl. of the day in question.

9. 10. '.1henever employees are compelled to be absent from school for cause other than their own personal sickness or death in the immediate family, permission for a leave of absence must be ob­tained from the Superintendent of Schools.

11. On return from any absence employees shall file in the office of the Superintendent of Schools a statement of cause of such absence - Form 35.

9. 12. Employees may be absent on account of personal illness ten days during the school year without deduction in salari. Days allowed for personal illness in anyone year which are not used, may be added to the unused days from other years to a maximum of 100 'vi thout deduction. Amount of cumulative sick leave shall be determined on basis of attendance record of employee for the nine years next preceding a protracted illness. All sick leave, \vhether annual or cumulative, shall be used for personal illness only. Employees who are absent more than five consecutive days on account of persona~ illness shall, on returning. present a physicia~'s certificate to the Superintendent of Schools. Any absence in excess of five consecutive days for which no physician's certificate is furnished, will result in a deduction at the daily rate of standard pay for substitute employee.

The salary of any employee, absent because of personal illness in excess of the time allowed above, shall be deducted at the daily rate of standard pay for substitute employee during the subsequent sixty working days of absence. In the event that said employee is absent in any school year more than sixty days in excess of the time allowed for personal illness without deduction in salary, the matter of payment of salary shall be determined by the Board of Education upon the basis of the length of service and upon the merit of the case.

Other Absences:

a. In the event of serious illness in the immediate family, a reasonable absence may be allowed without loss of pay. Or­dinarily such absence should not exceed five days in the school year unless the Superintendent makes an exception because of very unusual circumstances.

b. In the event of death in the immediate family. a reasonable absence will be allowed without" loss of pay. Ordinarily this will not exceed three calendar days (including Saturdays and Sundays) but a longer time may be allowed by the Superintendent in unusual circumstances.

c. Absences for urgent personal reasons may be excused if re­quested in writing. approved by the principal and the Super­intendent. Such absences shall not exceed three days in a school year without loss of pay.

d. Absences for re ligious holidays \17i thout deduction of pay will be limited to Rosh Hashanah and Yom Kippur only. If an employee is absent on any other religious holiday. salary deduction will be made at the daily rate of standard pay for substitute employee.

14. The daily pay for substitute teachers shall be 1/200 of minimum sllary on the four year training level schedule except in case of continued service in one position when it shall be determined by the Superintendent of Schools.

9· 15. All teachers shall meet either in general session or in grade meetings at such time as the Superintendent of Schools or the principal may direct.

9· 16. Teachers shall assume full responsibility for care of books and use of supplies. Books shall be checked up at least once a month by taking the roll and having pupi-ls respond by giving the number of their books. Teachers shall require all gymnasium suits and sneakers which are the property of pupils to be plain­ly and conspicuously marked.

9. 17. All teachers shall fully cooperate \"i th special teachers and at all times follow the work and directions given by special teachers. They - shall assist, w-hen requested, by giving a lesson, in maintaining discipline, or in any other way which the special teacher may indicate. The teacher shall give the entire lesson whenever requested by the special teacher.

9· 18. Teachers shall courteously but firmly refer to the~r prinCipals all persons making any complaint. request. inquiry, .or other matter '\Thich ,,,ould interrupt them in their classroom duties. No person, parent or others. shall be allowed to take teachers' time a,\Tay from class except by direct permission of the principal.

9. 19. Employees shall file their address and telephone number ,,,ith the office of the Superintendent of Schools and keep this information up-to-date.

9. 20. Teachers shall notify principals of any accident resulting in personal injury, however slight, which they may observe happening on school property to any person.

9. 21. Teachers shall not engage in other work which interferes with the proper discharge of their duties as teachers. Notifica­tion of the acceptance of any other employment shall be forwarded to the Superintendent of Schools.

9. 22. Frincipals and teachers may, under the direction of the Super­intendent of Schools, conduct and supervise groups of pupils or clQ~8es and give instruction in s\vimming, horseback riding, skat­ing, playday exercises, hikes, bicycle riding, athletic contests, exercises or practices, various other contests, service organiza­tions, clubs, bands, orchestras, glee clubs, and musical groups, and may organize, form and supervise student councils, student police, student safety patrols, student assistant corps, and may delegate authority to the same to use classroom visual aids and may instruct pupils in the use of same.

9. 23. Teachers shall requisition supplies and equipment from office of their respective principals. Principals shall submit these requisitions on Thursday of each week, on blanks provided for this purpose by the office of the Superintendent of Schools.

9. 24. No principal or teacher shall divulge any school record of any pupil to any person other than to regular school authorities or to the parent or guar~~An of said pupil.

9· 25. Teachers shall not tutor pupils regularly enrolled in the Rockville Centre Public Schools for pay without first receiving permission to do so from the Superintendent of Schools. Under no circumstances shall teachers tutor any pupil on school property for pay. Teachers in the music department of the Rockville Centre Public Schools may teach private pupils \vithout the consent of the Board of Education, provided the teaching is not done on school premises and is done at such times that it will in no way interfere with the regular assigned duties of said teachers.

9. 26. The Superintendent is empo\vered to authorize attendance of staff members at professional conferences at a distance not greater than 400 miles, with partial or total reimbursement of expenses, in accordance with his judgment and budgetary appropria­tions. The Board of Education may authorize such attendance at a distance greater than 400 miles.

9. 27. School equipment may not be permanently moved from one location to another except by the recommendation of the principal and approval of the Superintendent of Schools on duplicate blanks provided for this purpose. One of these Transfers of Equipment (Form #117) is to be handed to the custodian who is to make the transfer; the second copy is to be handed to the person who keeps the permanent inventory of school equipment.

9. 28. No school furniture or equipment is to b~" loaned to any person or organization for use outside of our school property except by formal permission of the Board of Education.

9. 29. Each employee shall retire from employment in this district at the end of the school year in which he reaches the age of 70 unless the Board of Education makes a specific exception. The school year is defined as July 1 to June 30 inclusive.

9. 30. All employees must observe all rules and regulations issued by the Superintendent of Schools in accordance with his proper authority under the public la,,, and the by-1aw"s of the Board of Education.

ARTICLE X

I ISCELLANEOUS

10. 1. No person may visit any part of the school building or any person employed in the school, ,,,ithout first getting permission from the principal of the school or his representative.

10. 2. Pupils will be admitted to the kindergarten if they will have attained their fifth birthday on or before December 1 in that school year. Children younger than this will not be admitted except that the principal of each school may in his discretion admit a child lITho reaches his fifth birthday during the month of December in that school year.

10. 3. Non-resident pupils shall not be accepted in our schools except:

a. Child~en who move from the community during the school year may be permitted to finish the school year.

b. In the senior high school when class enrollments permit.

c. In special classes for mentally handicapped when enrollments permit.

d. Children of school employees •

10. 4. Tuition charges for non-resident pupils shall be:

Kindergarten .$100 per yr.or ~;10 per month or portion thereof

Grades 1 through 6 · $200 per yr. or ~~20 per month or portion thereof

Grades 7 through 12 · $300 per yr. or $30 per month or portion thereof

Nentally handicapped . · $300 per yr. or $30 per month or portion thereof

Children of school employees shall not be charged tuition fees.

Tuition charges shall be due and payable semi-annually, ten days from date of bill. The Superintendent may exclude from school any non-resident pupil whose tuition is unpaid 30 days from date of bill.

10. 5. The Board of Education reserves the right to dismiss any non-resident pupil from any special class at any time when conditions warrant such action, and they shall so notify parents of such pupils in writing when pupils are accepted for enroll­ment.

10. 6. School facilities shall not be used by private teachers of music, the dance, and dramatics for private recitals, except by permi ssion of the Board of Education and lIThen the entire proceeds of such a program are contributed to a charitable purpose.

10. 7. The following regulations relative to awards shall be observed:

A. Presentation of prizes by organizations 'IThose aims are to advertise their activities shall be discouraged.

B. Aw"ards given by the student body are the mos t valuable.

" C. A'ITards shall only be made for excellence in some field of worthy endeavor.

D. A'ITard s shall be purely emblematic and of Ii tt Ie intrinsic value.

E. Competition for all prizes shall be fair, open to a large per cent of the student body, and be of such a nature as to secure a large number of contestants.

10. 8. All pupils who have attended South Side High School for two years or more, and have maintained a general average of at least 90% in all work s~udied in our school, shall be designated as honor pupils.

10. 9. ~hen, in the opinion of the Superintendent of Schools, it is desirable to invite a candidate to come from a considerable

distance to be interviewed for a teaching position, the Superintendent of Schools may pay such candidate reasonable traveling expenses from the funds of the district •

ARTICLE XI

SUPERINTENDEJ\TT C F BUILDINGS .AND GROUNDS

11. 1. The Superintendent of Buildings shall be appointed by the Board of Education. His salary shall be fixed regularly each year by the Board at the time of faculty appointments •

11. 2. The Superintendent of Buildings shall have charge of the operation and maintenance of buildings and grounds.

11. 3. The Superintendent of Buildings shall supervise the work of all janitors and mechanics.

11. 4. The Superintendent of Buildings shall report monthly, as directed by the office of the Superintendent of Schools or the Board of Education, all overtime service rendered by his staff.

ARTICLE XII

ASSISTANT SUTERINTENDENT OF BUILDINGS AND GROUNDS

12. 1. The Assistant Superintendent of Buildings and Grounds shall be appointed by the Board of Education. His sa~ary shall be

'fixed regularly each year by the Board at tho~ime of faculty appointment.

12. 2. He shall assume the duties of the Superintendent of Buildings and Grounds \~hen required and give assistance in the supervision of the janitorial staff.

ARTICLE XIII

AJIlENm~ENTS

13. 1. These By-Laws may be amended or added to by a majority vote at any regular Board meeting, provided that such amendment or addition has been proposed in writing not later than the next preceding Board meeting.
