• In these circumstances, if any registeredmedical practitioner attends on a personwho is employed in an establishment andwho is believed by such medicalpractitioner to be, suffering from anydisease specified in the Second Schedule,

the medical practitioner shall, withoutdelay, send a report in writing to the ChiefInspector stating the name and a fullpostal address of the patient; the disease

from which he believes the patient to besuffering; and the name and address ofthe factory in which the patient is or waslast employed.

Power to Direct Enquiry Into

Cases of Accident or Disease•

Section 83 of the Act lays down that theGovernment may, if it considers it expedient so todo, appoint a competent person under intimation toall concerned to enquire into the causes of any

accident, any explosion, fire, forceful entrance ofwater or fumes as a result of accident occurring inan establishment, or into any case where a diseasespecified in the Second Schedule has been or is

suspected to have been contacted in anestablishment and may also appoint one or morepersons possessing legal or special knowledge toact as assessors in such enquiry.

• The person holding an enquiry under thissection shall make a report to the

Government stating the cause of theaccident or as the case may be, disease,and any attendant circumstances, andadding thereto any observations which he,or any of the assessors, may think fit tomake. The Government may, if it thinks fit,cause to be published any such report in

the manner and time as fixed by it.

Power to take Samples• Section 84(1) of the Bangladesh Labour Act

stipulates that an Inspector may take a sufficientsample of any substance used or intended to beused in the establishment at any time during thenormal working hours of an establishment, afterinforming the employer, such use being or likely tocause bodily injury to or injury to the health of,workers in the establishment. Where the Inspectortakes sample under sub-section (1), he shall inthe presence of the employer unless the employer

willfully absents himself, divide the sample intothree portions and effectively seal and suitablymark them, and shall permit the employer to addhis own seal and mark thereon.
