socio@economic5 .olitical and .ersonal rights and freedoms of citiAens5 as well as the rights

and legal interests of merchants5 institutions and organisations5 the s.ecified management

.rocedures5 State and .ublic order5 to strengthen legality5 to .revent right violations5 toeducate citiAens in a s.irit of .recise and strict observance of laws5 to inculcate a full of

res.ect attitude in them towards the rights of other citiAens5 honour and self@esteem towards

4n s.ecial cases .rovided for in this Code and binding regulations issued by local

government councils (.arish councils) legal .ersons shall be sub1ect to liability for

administrative violations8 =ersons .erforming commercial activity5 but which are not legal

.ersons5 shall be sub1ect to liability for administrative violations as legal .ersons8

! soldier shall be held liable according to the general .rocedure for an administrative

violation committed outside the fulfilment of duties of active service5 but for an

administrative violation committed by a soldier during .erformance of the duties of active

service5 he or she shall be sub1ect to disci.linary liability8

The referred to .ersons5 who have committed administrative violations5 may be

sub1ect to administrative detention5 but administrative arrest may not be a..lied to them8

+ther .ersons to whom disci.linary regulations or s.ecial by@laws regarding disci.line

&oreign nationals and stateless .ersons5 in the territory of Latvia5 shall be sub1ect to

administrative liability on the basis of the same regulations as citiAens of the

damage to the endangering .erson5 but without violation of the limits of self@defence8

Section $'. 4asic Administrative Sanctions and Additional Sanctions

The confiscation of an ob1ect and instrument of commitment5 the forfeiture of s.ecial

rights5 as well as the forfeiture of rights to hold .articular offices or the forfeiture of rights to

s.ecified or all forms of commercial activities may be a..lied both as a basic sanction or an

additional sanction8 =rohibition for a certain .eriod of time to obtain a driving licence to drive

a means of trans.ort or a recreational craft may be a..lied only as an additional sanction8

The maximum fine5 which shall be im.osed for administrative violations on a natural

.erson (exce.t for the administrative violations s.ecified in Sections /"5 /25 #25 #28"5 #2825

.ersons (exce.t for the administrative violation .rovided for in Section "",82

of finance shall be determined as a .ercentage of the value of the financial transaction

(amount)5 not ta7ing into account the condition s.ecified in =aragra.h one of this Section

Section $2. Con"iscation o" an Administrative Violation O)9ect or an Instr(ment o"

Commitment

The confiscation of an administrative violation ob1ect or an instrument used in its

commitment shall mean the forcible transfer thereof without com.ensation to the ownershi.

of the State8 +nly ob1ects in the .ersonal ownershi. of the violator may be confiscated5 but in

matters regarding violations in trade5 commercial activity5 in the field of customs or regarding

the violations in connection with goods5 which are sub1ect to excise duty E also ob1ects owned

by other .ersons8

The .rocedures for a..lication of confiscation and the list of ob1ects not to be

confiscated shall be determined by this Code and other regulatory enactments8

Section $6. 3or"eit(re o" Special Licences Assi#ned to a Person

S.ecial licences (a licence to drive a means of trans.ort5 a licence to drive a

recreational craft5 hunting licence5 fishing licence5 a licence to ac6uire5 .ossess and carry

firearms or high energy .neumatic wea.ons) granted to a .erson may be ta7en away for a

.eriod of u. to $ years regarding gross or systematic violation of .rocedures for use of theselicences8

The .eriod of time of forfeiture of such licences may not be less than "$ days5 if it is

not otherwise s.ecified in regulatory enactments8

&or a .erson for driving a means of trans.ort or a recreational craft under the influence

of alcohol or under the influence of narcotics or other intoxicating substance for the time

.eriod of the sanction for the committed violation both the licence to drive a means of

trans.ort and the licence to drive a recreational craft shall be ta7en away8

exce.t for a bicycle5 irres.ective of the category of the means of trans.ort with which the

violation has been committed8

The time .eriod of .rohibition to obtain a licence to drive a means of trans.ort shall be

determined in accordance with the time .eriod for forfeiture of the licence to drive a means of

trans.ort s.ecified in the violation sanction8

! .rohibition to obtain a licence to drive a recreational craft for a certain .eriod of

time shall be a..lied to drivers of recreational craft who do not have such a licence and who

have committed a violation regarding which the forfeiture of the licence to drive a

recreational craft is .rovided for8

The .rohibition shall a..ly to all ty.es of recreational craft irres.ective of the ty.e of

recreational craft with which the violation has been committed8

The time .eriod of the .rohibition to obtain a licence to drive a recreational craft shall

be determined in conformity with the time .eriod for the forfeiture of the licence to drive a

recreational craft s.ecified in the violation sanction8

!n administrative arrest shall be determined and a..lied only in exce.tional casesregarding certain ty.es of administrative violations and for a .eriod of from 2, hours u. to "$

days and nights8 !n administrative arrest shall be a..lied by a district (city) court (1udge)8

!n administrative arrest may not be a..lied to a .erson who has not reached "# years

of age5 to a disabled .erson of the first and second grou.5 a .regnant woman5 as well as to a

.erson who is the only guardian of a child5 who has not reached "2 years of age8

by the regulatory enactment which s.ecifies liability for the committed violation5 strictly

according to this Code and other enactments regarding administrative violations8

4n im.osing a sanction the nature of the committed violation5 the .ersonality of a

violator5 the degree of his or her cul.ability5 the liability mitigating and aggravating

circumstances shall be ta7en into account8

!uthorities and officials5 which are authorised to im.ose administrative sanctions5 arenot entitled to re6uest from a .erson5 who has committed a violation5 that he or she shall .ay

directly or indirectly via an intermediary for .ayable services not s.ecified in laws in force5

should ma7e donations or other .ayments not .rovided for in the law8

Section %%. Circ(mstances iti#atin# Lia)ilit+ "or an Administrative Violation

The following circumstances shall mitigate the liability for an administrative violation:

") if the .erson at fault has fran7ly regretted what he or she has done%

2) if the .erson at fault has eliminated the harmful conse6uences of the violation5

voluntarily com.ensated the loss or eliminated the damage committed%') if the violation was committed under the influence of strong mental agitation or due

to serious .ersonal or family circumstances%

,) if the violation was committed by a minor%

$) if the violation was committed by a woman who is .regnant or a woman who has a

child aged u. to " year% and

/) if a .erson at fault has voluntarily a..lied .rior to disclosing of the committed

violation8

Circumstances which reduce the .ossible threat to traffic safety of a certain violation E

the time .eriod of the day and night5 road and weather conditions5 traffic intensity at the .lace

where the violation has been committed and other similar conditions5 as well as .ersonal or

family conditions shall mitigate liability for an administrative violation in road traffic8

!n institution (official) who decides regarding the case of an administrative violation

may recognise as mitigating circumstances also those circumstances5 which have not been

referred to in the Law8

Section %'. Circ(mstances A##ravatin# Lia)ilit+ "or an Administrative Violation

The following circumstances shall aggravate the liability for an administrative

violation:") if the unlawful action is continued5 regardless of an authorised .ersonsG re6uest to

cease it%

2) if a similar violation5 regarding which a .erson had been already .unished5 has been

committed re.eatedly within a year% if the administrative violation has been committed by a

.erson who has .reviously committed an offence%

') if a minor has been involved in the committing of a violation%

,) if the violation has been committed by a grou. of .ersons%

$) if the violation has been committed during a natural disaster or other emergency

circumstances%

/) if the violation has been committed under the influence of alcoholic beverages5

narcotic or other intoxicating substances8 0e.ending on the nature of the violation5 theinstitution (official)5 which im.oses administrative sanction5 may decide not to consider

circumstance as being liability aggravating8

Section %*. Imposin# o" Administrative Sanction< i" Several Administrative Violationshave )een Committed

4f one .erson has committed two or more administrative violations5 an administrative

sanction shall be im.osed for each violation se.arately8

4f a .erson has committed administrative violations5 which have been determined

simultaneously5 and they are examined by one and the same institution (official)5

administrative sanction shall be im.osed within the framewor7 of that sanction which is

.rovided for the more serious violation8 4n such a case a basic sanction may be su..lemented

by any of the additional sanctions5 which are .rovided for in the Sections5 which determine

liability for any of the violations committed8

Section %. Calc(lation o" Periods o" ime "or Administrative Sanction

The .eriod of time for an administrative arrest shall be calculated in days and nights5

but the .eriod of time for which s.ecial rights are de.rived of5 the right to hold certain offices

and .erform s.ecified or all forms of commercial activities E in years and months8

Section %/. Periods o" ime "or Imposin# o" Administrative Sanction

!dministrative sanction may be im.osed not later than within , months after the day

of commitment of a violation5 but5 if the violation is continuous E within , months from the

day of disclosure thereof8

4f a refusal toinitiate criminal .roceedings has been received or criminal .roceedings

have been terminated5 but the behaviour of the violator has the features of an administrative

violation5 the administrative sanction may be im.osed not later than within one month from

the day when the decision regarding refusal to initiate the criminal .roceedings or regarding

the termination thereof has been ta7en8

The time .eriods referred to in this Section shall not a..ly to the cases when

confiscation is a..lied in the matters regarding the violation of customs regulations8

!dministrative sanction regarding the administrative violations s.ecified in Sections,*5 ,#5 $" E $'5 $'82E /#5 *" and *2 E *,8"% Section *$5 =aragra.h one% Sections *$8"E ##8"5

be im.osed not later than within four months from the day of disclosure of the violation5 but

not later than within a year from the day of commitment of the violation8

Section %6. O)li#ation to Compensate "or Losses Ca(sed

4f5 as a result of an administrative violation5 financial losses have been caused to a

natural or legal .erson5 then when examining the 6uestion regarding the im.osition of an

administrative sanction5 the administrative commission has the right to examine at the same

time the 6uestion regarding the obligation of the .erson at fault to com.ensate the financiallosses u. to LVL $5 but the district (city) court 1udges E u. to LVL 28

4n other cases the 6uestion regarding the com.ensation of financial losses or moral

harm caused as a result of an administrative violation shall be examined according to the

.rocedures of civil 1udicial .roceedings8

0hich an Administrative Sanction is Imposed
