2.2.1.1 Derogation of EC Regulation 550/2004, article 7, paragraph 5

The Italian Air Force is authorised to provide ATS, CNS and MET Services to General Air Traffic (GAT) without certification. The Italian Air Force has adapted its organisational structure in order to generate functional separation between the high level body (USAM) accountable for services’ internal supervision and the units responsible for the provision of Air Navigation Services (Major Commands). Internal supervision activities and provision of Air Navigation Services to GAT are ensured by Italian Air Force in compliance with European Community laws and national regulation promulgated by the National Supervisory Authority, Ente Nazionale per l’Aviazione Civile (ENAC). As required by Italian law, ENAC carries on its supervision on air navigation services provided by Italian Air Force to GAT in accordance with a special agreement signed by the two organizations.

2.2.2 Designation The status of designation of ATS and MET Providers in Italy is presented below:

State authority responsible for Designation Air Navigation Services (ANS) are provided by ITAF or ENAV S.p.A. within the Air Space respectively assigned by National Law (DPR 484/81). In 2006 the new Code of Air Law confirmed ENAV position in article 691bis. This designation has been brought in full compliance with SES regulation by the ANSP Certificate. At the same time, in 2006, some AFIS Provider operating under ENAV SpA supervision applied for a separate certificate. These ANSPs are going to obtain a formal certificate of designation within 2009.

2.5 ATCO Licensing Transposition of SP-D-ATCO Y In 2006 ENAC has published a regulation which

introduced the technical elements of the EU Directive. A law has been issued (Dlg 118/2008) to support ENAC Regulation for mutual recognition of licence and establishment of sanctions.

2.7 FABs FAB initiative: BLUE MED project

Launched in: mid-2006

The Feasibility Study Phase (2006-2007), building on the findings of the preliminary study launched by ENAV and supported by MATS (MEDIFAB), addressed all the relevant issues related with the creation of FABs (Operational, Financial, Technological, Military, Environmental, Training, Human Resources, Legal,...).

Definition: Start: 2009 End: 2011 Progress:

This Phase will follow after the political engagement of the Partners States in pooling their airspace (or part of it) to build one or more FABs over the area. This phase will detail and plan all necessary actions, implementation and validation processes to be performed. In particular this phase will address the detailed design and validation of the new airspace structure, the definition and validation of the interoperability mechanisms, the identification of solutions for the legal-institutional and social issues identified in the previous phase and the execution of a full safety assessment. As final step, a Go/No Go decision based on the results of the Definition Phase will be taken, in order to verify the existence of all the prerequisite for the beginning of the implementation.

Implementation Phase

The Implementation Phase (2011/2012), is aimed at developing and implementing requirements and specific arrangements identified within the Definition Phase for Interoperability of ATM systems, also in accordance with SESAR indications. In both occasions Italian Operators have been over sought by ENAC surveyors in the framework of Air Operator Certificate. Private Aircraft are periodically checked for presence of the correct equipment Currently the check for presence of 8.33 Channel Spacing COM is an item of SAFA inspections. Non conformities have been identified in the past for non European aircraft, but presently they are close to zero.

2.9.2 Appeal/Review Procedure

Description of the review / appeal procedure for the decisions taken pursuant to the Charging Regulation

The appeal procedure may be pursued in the framework of general Italian administrative law, which establish the general rule for the appeal procedure towards any act of Italian State Administration. The appeal may be directed first to ENAC or Ministry of Transport, and then the litigation may be escalated to the Italian Regional Administrative Court and to the State Council which takes the ultimate decision.
