In this month, audits of banks have to be completed. To me, target dates set by banks appear to be unreasonable. In his classical role, an auditor is required to express his opinion on whether the accounts show a true and fair view. In the case of bank audits with stringent deadlines, the time available to him to form such an opinion is extremely short. It is true that technology permits an auditor to access and analyse a large volume of data quickly, but I believe that forming an opinion on the basis of that data is a process that is inherently time consuming. Further, certain banks are in the process of overhauling their systems, or fine- tuning them. In certain cases the original documents of borrowers are maintained at a central location and are processed there. This results in the auditor having limited time for verification and this in turn puts his team under pressure. I think many of these problems can be solved if appointment of auditors is made early, maybe in the month of December. This will give enough time to the auditor to carry out the verification process prior to the close of the financial year. He may also be able to suggest rectification measures. The audit process can therefore be carried out in two stages. The cost for the auditee will obviously increase but will impart the much needed value addition. I am fully conscious of the fact that it is essential for auditees that the audit process is completed quickly. Users want information to be authentic, accurate and upto date. However I believe the quality of response is as important as its speed. At the Society, we try to bring to members best of both worlds. Some programmes enable them to upgrade their professional skills while others enrich and enhance the quality of human life. I invite members to take benefit of all such programmes. As members experience the heat of work this summer, I wish them all success in meeting the April deadlines. May the fruits of labour be sweet ! Dear Members,

The month of April has arrived and most of you must be sweating it out tomeet deadlines. In this month, audits of banks have to be completed. To me,target dates set by banks appear to be unreasonable.

In his classical role, an auditor is required to express his opinion on whetherthe accounts show a true and fair view. Study GroupsThe International Taxation Committee has been conducting two StudyGroups — ITF-1 & ITF-2 — for deliberations in the field ofInternational Taxation and Finance. The Groups run on a self-studybasis. Members of the Groups are expected to make presentationsbefore their respective Group and in the process enrich theirknowledge and share their experience with fellow members. Non-Groupmember speakers are invited only to introduce certain specialisedsubjects, which the Group members can then take up for further study.

Members of the Groups in past have immensely benefitted from thesedeliberations. In the larger interest of members of the Society, theCommittee has decided to invite new members to both the Groupsif they are willing to contribute and share their knowledge andexperience with fellow Group members. The profile of the respectiveGroups is as follows.

● ITF-1

ITF-1 was established about eighteen years ago. The deliberations inITF-1 are at an advanced level and members are expected to havebasic knowledge (including issues and case laws) and experience ofthe subject.

● ITF-2

The objective of ITF-2 is to introduce members to the field ofinternational taxation and enable them to acquire basic knowledge ofModel DTAAs through self-study and Group-study.

The Groups run on self-financing basis. Initial contribution of eachmember would be Rs.1,000.

Members desirous of joining either of the Groups may forward awritten application by way of a letter to the Assistant Event Managerat the BCAS office. The application should clearly state name,address, BCAS membership number, contact particulars (including e-mail ID) and the current practice/work profile. The member should alsomention if he/she would like to participate and assist in administrationof the Group. The application along with a cheque for Rs.1000 shouldreach BCAS office not later than 30th April 2008. Existing membersshould send their cheque for Rs.1000 with their name and membershipnumber written on its back to continue their membership.

The application of members desirous of joining ITF-1 should alsomention the topics on which he/she would like to make presentationsand share knowledge and experience with fellow Group members.

Charitable Trust Clinic

BCAS Foundation operates Right to Information (RTI) Clinic on aregular basis. RTI Clinic is operated by Mrs. Hema Sampat, aresearch scholar on the subject of RTI, Mr. A. K. Asher, Advocate& RTI activist and Mr. Narayan Varma, past President, BCAS.

The Clinic provides help and guidance to BCAS members as alsoto non-members, i.e., all citizens, for making applications under theRTI Act and also assists in resolving any related difficulties on thesubject of RTI.

The RTI Clinic operates on every 2nd, 3rd and 4th Saturday fromBCAS office — 11 a.m. to 1 p.m.

The next RTI Clinic days accordingly are 19th & 26th April2008 and 10th, 17th & 24th May 2008. Please call the Society’soffice (Mrs. Archana) to obtain a prior appointment.

Full-Day SeminarPost-Budget Controversies on Service TaxAs usual, Union Budget has proposed various changes in the arenaof Service Tax and CENVAT Credit. Some of the changes arefundamental and have far-reaching implications. After the initialreactions, a time has come to take stock, share experiences and findsome solutions. This in-depth seminar aims to achieve these goals.

The basic knowledge of Service Tax law and procedures is expected.The seminar aims at covering controversial issues in an interactivemanner. The faculty will draw from their experience and also suggestpractical tips.

In the pre-lunch session, CA S. S. Gupta will take the participantsthrough the amendments in CENVAT Credit Rules, 2004, with practicalillustrations and examples on applicability of Rule 6. He would alsoaddress participants’ queries and provide his expert comments.

The post-lunch session will witness a panel discussion on twoimportant services, namely, lease and information technology services.Both these services have significant elements of overlap with VATLaws. The panel therefore comprises of CA Rajat Talati who willdiscuss and elucidate the VAT principles pertaining to these servicesand CA Puloma Dalal who will throw light on the Service Taxprinciples. The session should end with some case studies highlightingthe overlap between the two laws and the solutions presented by thesubject experts to these overlaps.

Workshop on ‘Being alert and achieving’Do you wish to be well off and achieving ?

One way is to be well, psychologically well. For this, we will have to bealert. To be alert, we should have an idea about ourselves, of our outsideand our inside, especially the latter and also how to work around thatreality. Transactional analysis psychology helps us to do this in a practicalway. This workshop will give us a headstart in the journey.

Formation of Sub-committees for BCAS Foundation

BCAS Foundation is formed with the philanthropic objective of contributing tosociety in whatever manner possible. In the past, the Foundation hasundertaken various projects including Tsunami Relief work. It becameinstrumental in building a school at Pondicherry along with other NGOs/Trusts.It runs RTI Clinic and carries out other RTI-related activities on ongoing basis.It has assisted many individuals affected by Mumbai bomb blast and continuesto assist one brilliant articled student who became disabled by the bomb blast.

At the Foundation, we believe that it is our duty to repay our debt to societyby creating service centres of assistance. We need to expand our activities andmake an impact in other areas of social, moral and economic development.For this objective in mind, we need more participation of our members.

A.P. (DIR Series) Circular No. 31, dated March 11, 2008

Exim Bank’s Line of Credit of USD 45 million to the Governmentof the Socialist Republic of Vietnam

Exim Bank has, subject to certain terms and conditions, madeavailable a Line of Credit of US $ 45 million to the Government ofthe Socialist Republic of Vietnam for financing goods & servicesincluding consultancy services from India, eligible for export under theForeign Trade Policy of the Government of India and whose purchasemay be agreed to be financed by the Exim Bank, pertaining to NamChien Hydro Power Project (200 MW) being set up in Vietnam. Outof the total credit under this agreement, goods and services of thevalue of at least 85% of the contract price shall be supplied by sellersfrom India and the balance (other than consultancy services) may beprocured by sellers from outside India.

Exim Bank’s Line of Credit of USD 100 million to the Governmentof Nepal

Exim Bank has, subject to certain terms and conditions, madeavailable a Line of Credit of US $ 100 million to the Government ofNepal for financing goods & services, including consultancy servicesfrom India, eligible for export under the Foreign Trade Policy of theGovernment of India and whose purchase may be agreed to befinanced by the Exim Bank towards road projects, rural electrificationprojects, power transmission projects and hydro power projects inNepal. Out of the total credit under this agreement, the goods andservices of the value of at least (a) 85% of the contract price if theyare required for major repairs to Devighat hydro power project, (b) 70%of the contract price if they are to be used for interconnectivity/transmission lines project and (c) 50% of the contract price in caseof other projects shall be supplied by sellers from India and thebalance goods and associated services may be procured by sellersfrom outside India.

Overseas Investment by Mutual Funds — Liberalisation

Presently, Mutual funds registered with Securities & Exchange Boardof India are, subject to certain terms and conditions, permitted toinvest up to US $ 5 billion overseas.

This Circular has raised this limit to US $ 7 billion with immediateeffect. The existing facility to allow a limited number of Mutual Fundsto invest cumulatively up to US $ 1 billion in overseas ExchangeTraded Funds will continue.

Brief modalities of the scheme are as follows :

➠ Rs.2500 to be kept with the Society as an imprest cash in youraccount. Non-member will have to pay additional Rs.250 for accounthandling charges.

➠ The base level would be Rs.250 which needs to be reple-nished again to Rs.2500 by the person opting for the scheme.

➠ Publications, conference papers or CDs costing less thanRs.250 would be sent to you as soon as they are published/released. This would also include one set of English Editionof the Budget Publication (a set of 5 books).
