A. Sheet Numbering - Sheet numbers appear in the upper right comer of the page. Sheets arenumbered sequentially. However, new sheets are occasionally added to the tariff. When anew sheet is added between sheets already in effect, a decimal is added. For example, a newsheet added between sheets 14 and 15 would be 14.1.

B. Sheet Revision Numbers - Revision numbers also appear in the upper right comer of eachpage. These numbers are used to determine the most current sheet version on file with theNPSC. For example, the 4th revised Sheet 14 cancels the 3rd revised Sheet 14. Because ofvarious suspension periods, deferrals, etc. theNPSC follows in their tariffapproval process,the most current sheet number on file with the Commission is not always the tariffpages ineffect. Consult the check sheet for sheet currently in effect.

C. Paragraph Numbering Sequence -There are nine levels of paragraph coding. Each levelof coding is subservient to its next higher level:

All revisions made in a given filing are designated by anasterisk (). There will be no other symbols used on the check sheet if these are the onlychanges made to it (i.e., the format, etc. remains the same, just revised revision levels onsome pages). The tariff user should refer to the latest check sheet to find out if a particularsheet is the most current on file with the NPSC.

1.2 Technical Terms

Access Line - A dedicated arrangement from the local telephone company or common carrierwhich connects a Customer location to Carrier's location or switching center.

Ancillary Service Charge - Any charge Consumers may be assessed for the use of Inmate (N)Calling services that are not included in the per-minute charges assessed for individual calls. (N)

Authorization Code - A numerical code, one or more ofwhich may be assigned to a Customer,to enable the Carrier to identify use of service on the Customer's account and to bill the Customeraccordingly for such service. Multiple authorization codes may be assigned to a Customer toidentify individual users or groups of users on the account.

Calling Card - A billing convenience whereby the End User may bill the charges for a call to anapproved local exchange company-issue Calling Card. The terms and conditions of the localexchange company shall apply to payment arrangements.

Carrier - Whenever used in this tariff, "Carrier" refers to Legacy Long Distance International,Inc., unless otherwise specified or clearly indicated by the context.

Chargeable Time - For billing purposes calls are charged from the time the connection betweenthe calling party and the called party is established. The time at the beginning of each minute ofthe connection determines the applicable rate period. Chargeable time ends when the callingstation hangs up. If the called party hangs up but the calling party does not, billing stops whenthe connection is released by automatic timing equipment in the network.

Collect Billing - A billing arrangement whereby the originating caller may bill the charges for acall to the called party, provided the called party agrees to accept the charges.

Commission - Refers to the Nebraska Public Service Commission.

Company - Whenever used in this tariff, "Company" refers to Legacy Long DistanceInternational, Inc., unless otherwise specified or clearly indicated by the context.

Credit Card - This charge applies in addition to the per minute charges for calls billed to a (T)telephone company-issued Calling Card or commercial credit card when the customer dials all of Ithe digits required to route and bill the call. (T)

Customer - The person, company, firm, corporation, or other entity which orders or uses serviceand is responsible for the payment ofcharges and compliance with tariff regulations.

Customer Dialed Calling Card Call - A service whereby the End User dials all of the digitsnecessary to route and bill the call to a valid non-Premiere calling card or credit card.

Day Rate Period - After 8:00 am to, but not including, 5:00 pm Monday through Friday.

Evening Rate Period - After 5:00 pm to, but not including, 11 :00 pm Monday through Friday,and on Sunday.

Jail -A facility of a local, state or federal law enforcement agency that is used primarily to hold (N)individuals who are (1) awaiting adjudication of criminal charges; (2) post-conviction and Icommitted to confinement for sentences of one year or less; (3) post conviction and awaiting Itransfer to another facility. The term also includes city, county or regional facilities that have Icontracted with a private company to manage day-to-day operations; privately-owned and Ioperated facilities primarily engaged in housing city, county or regional inmates; and facilities Iused to detain individuals pursuant to a contract with U.S. Immigration and Customs (N)Enforcement.

LATA - Local Access and Transport Area

Legacy - Whenever used in this tariff, "Company" refers to Legacy Long Distance International,Inc., unless otherwise specified or clearly indicated by the context.

Night/Weekend Rate Period - After 11 :00 pm to, but not including, 8:00 am Monday throughFriday, all day Saturday, and Sunday to, but not including 5:00 pm.

Operator Dialed Surcharge - A charge applying to calls made when the user dials "00" only orany valid Company operator access code and requests that the operator dial the destinationnumber.

Operator Station Call - A service whereby the caller places a non-Person to Person call with theassistance ofan operator (live or automated).

Person to Person Call - A service whereby the person originating the call specifies a particularperson to be reached, or a particular station, room number, department or office to be reachedthrough a PBX attendant.

Personal Account Code - A pre-assigned numeric or alpha-numeric sequence which uniquelyidentifies a travel card account.

Point of Origination - The station from which the Customer initiates a call through the Carrier'sswitch or network.

Premises - The space designated by the Customer as his residence or place of business fortermination ofthe Carrier's service.

Prison - A facility operated by a territorial, state or federal agency that is used primarily to (N)confine individuals convicted of felonies and sentenced to terms in excess of one year. The term Ialso includes public and private facilities that provide outsource housing to other agencies such as Ithe State Departments of Correction and the Federal Bureau of Prisons; and facilities that would Iotherwise fall under the definition of a Jail but in which the majority of inmates are post- Iconviction or are committed to confinement for sentences longer than one year. (N)

Sponsor - A corporation or other legal entity that exclusively permits the use of its Marks to theCompany for use with telephone cards or other merchandise, and contracts with the Company forthe marketing of the services described herein.

Serving Wire Center - A specified geographic point from which the vertical and horizontalcoordinate is used in calculation ofairline mileage.

Special Access Origination/Termination - Where originating or terminating access between theCustomer and the interexchange carrier is provided on dedicated circuits. The cost of thesededicated circuits is billed by the access provider directly to the Customer.

Switched Access Origination/Termination - Where originating or terminating access betweenthe Customer and the interexchange carrier is provided on local exchange company FeatureGroup circuits. The cost of switched Feature Group access is billed to the interexchange carrier.

Third Party Billing - A billing arrangement by which the charges for a call may be billed to atelephone number that is different from the calling number and the called number.

2.1 Undertaking of Legacy

Legacy's services and facilities are furnished for communications originating at specifiedpoints within the state ofNebraska under terms of this tariff.

Legacy installs, operates, and maintains the communications services provided hereinunderin accordance with the terms and conditions set forth under this tariff. Legacy may act as theCustomer's agent for ordering access connection facilities provided by other carriers orentities, when authorized by the Customer, to allow connection of a Customer's location tothe Legacy network. The Customer shall be responsible for all charges due for such servicearrangement.

The Company's services and facilities are provided on a monthly basis unless otherwiseprovided, and are available twenty-four hours per day, seven days per week.

2.2 Applicability of Tariff

This tariff is applicable to telecommunications services provided by Legacy within the stateofNebraska.

2.3 Payment and Credit Regulations

2.3.1 Payment Arrangements

(A) The Customer is responsible for payment of all charges for services andequipment furnished to the Customer or to an Authorized User of theCustomer by Legacy. All charges due by the Customer are payable to theCompany or to the Company's authorized billing agent (such as a localexchange telephone company). This includes payment for calls or servicesoriginated at the Customer's numbers(s); incurred at the specific request ofthe Customer.

(B) All charges due by the Customer are payable upon receipt to the Companyor to any agency authorized to receive such payments.

(C) Customer bills for telephone service are due when they are rendered. ACustomer is in default unless payment is made on or before the due datespecified on the bill. If payment is not made within 23 days of the date of thebill, a late payment charge of one and one-halfpercent (1-1/2%) per monthlybilling period will be applied to all amounts previously billed under thisCompany's tariff(s), including arrears and unpaid late payment charges. Suchcollection fees are separate and distinct from attorney's fees and other costsincurred in collecting charges owed to the Company.

(D) Any objections to billed charges must be reported to the Company or itsbilling agent within six months after receipt of bill. Adjustments toCustomer's bills shall be made to the extent that circumstances exist whichreasonably indicate that such changes are appropriate.

(E) In the event that the Company incurs fees or expenses, including attorney'sfees, collecting, or attempting to collect, any charges owned to the Company,the Companymay charge the Customer all such fees and expenses reasonablyincurred, including a collection fee on the unpaid charges accruing at a rateof one-and-one half percent (1.5%) per month. Collection fees on unpaidcharges shall begin to accrue when the account is assigned to an outsidecollection agency.

(F) The Company reserves the right to assess a charge of $25.00 whenever acheck or draft presented for payment of service is not accepted by theinstitution on which it is written.

(G) The Customer shall be responsible for all calls placed by or throughCustomer's equipment by any person. In particular and without limitation tothe foregoing, the Customer is responsible for any calls placed by or throughthe Customer's equipment via any remote access features. The Customer isresponsible for all calls placed via their authorization code as a result of theCustomer's intentional or negligent disclosure of the authorization code.

2.3.2 Deposits

(A) Each applicant for service will be required to establish credit. Any applicantwhose credit has not been established to the sole and exclusive satisfactionof the Company may be required to make a deposit to be held as a guaranteeof payment of charges. An existing Customer may be required to make adeposit or increase a deposit presently held. The deposit may be held for aslong as the financial condition or credit worthiness of the Customer isconsidered to be unsatisfactory to the Company.

(B) The fact that a deposit has been made in no way relieves the Customer fromthe prompt payment of bills upon presentation.

(C) Interest on a cash deposit will be paid to a Customer for the period that thecash deposit is held by the Company. The interest rate used will be at the rateestablished by the appropriate legal authority in the statewhere the Customeris billed.

2.3.3 Advance Payments

The Company reserves the right to require an advance payment from a Customerinstead of, or in addition to, a deposit. The advance payment shall be in amount equalto or less than two months estimated billing.

Company reserves the right to bill any and all applicable truces in addition to normallong distance usage charges, including, but not limited to: Federal Excise True, StateSales True, Municipal Taxes, and Gross Receipts Tax. Such taxes will be itemizedseparately on Customer invoices.

2.4 Refunds or Credits for Service Outages or Deficiencies

2.4.1 Interruption of Service

Credit allowances for interruptions of service caused by service outages ordeficiencies are limited to the initial minimumperiod call charges for re-establishingthe interrupted call.

2.4.2 Inspection, Testing and Adjustment

Upon reasonable notice, the facilities provided by the Company shall be madeavailable to the Company for such tests and adjustments as may be deemed necessaryfor maintenance in a condition satisfactory to the Company. 2.5 Liability

2.5.1 The liability ofthe Carrier for its willful misconduct or gross negligence which is thesole legal cause of damage or injury is not limited by this tariff. With respect to anyother claim or suit, by a Subscriber or by any others, for damages associated withacts or omissions involving initiation, installation, provision, termination,maintenance, repair, interruption or restoration of any service or facilities offeredunder this tariff, the Carrier's liability, if any, is limited to the lesser of $500 or theactual damages or injury sustained, which in the event of any failure of service shallbe deemed to be 1/30 of the monthly charge for service affected for each 24-hourperiod during which such failure ofservice occurs and is reported to or knownby theCarrier. In addition, Subscriber credits for interrupted service will be issued, whereapplicable, in accordance with the provisions of Section 2.4.

2.5.2 In no event will Carrier be responsible for consequential damages or lost profitssuffered by Subscriber on account of interrupted or unsatisfactory service unlessCarrier is found to have been willfully negligent.

2.5.3 The Carrier is not liable for any act or omission ofany other company or companiesfurnishing a portion ofthe service. No agents or employees ofother carriers shall bedeemed to be agents or employees of the Carrier.

2.5.4 The Carrier shall be indemnified and held harmless by the Customer against:

(A) Claims for libel, slander, infringement of copyright or unauthorized use ofany trade mark, trade name or service mark arising out of the material, data,information, or other content transmitted by the Customer over the Carrier'sfacilities; and

(B) Claims for patent infringement arising from combining or connecting theCarrier's facilities with apparatus and systems of the Customer; and

(C) All other claims arising out of any act or omission of the Customer inconnection with any service provided by the Carrier.

2.5.5 The Carrier will make no refund of overpayments by a Subscriber unless the claimfor such overpayment togetherwith proper evidence be submittedwithin one ( 1) yearfrom the date of alleged overpayment unless billing records prepared by theCompany can be produced which would justify a credit beyond one year.

2.8 Refusal or Discontinuance by Company

Legacy may refuse or discontinue service under the following conditions provided that,unless otherwise stated, the Customer shall be given 15 days notice to comply with any ruleor remedy any deficiency:

2.8.1 For non-compliance with or violation of any State, municipal, or Federal law,ordinance or regulation pertaining to telephone service.

2.8.2 For use of telephone service for any purpose other than that described in theapplication.

2.8.3 For neglect or refusal to provide reasonable access to Legacy or its agents for thepurpose ofinspection and maintenance ofequipment owned by Legacy or its agents.

2.8.4 For noncompliancewith or violation ofCommission regulation or Legacy's rules andregulations on file with the Commission, provided five (5) working days' writtennotice is given before termination.

2.8.5 For nonpayment ofbills, provided that suspension or termination of service shall notbe made without five (5) days written notice to the Customer, except in extremecases. Such notice will be provided in a mailing separate from the Customer's bill.

2.8.6 Without notice in the event of Customer, Subscriber or Authorized User use ofequipment in such a manner as to adversely affect Legacy's equipment or service toothers.

Wheneverservice is discontinued for fraudulent use of service, Legacy may, before restoringservice, require the Customer to make, at his or her own expense, all changes infacilities or equipment necessary to eliminate illegal use and to pay an amountreasonably estimated as the loss in revenues resulting from such fraudulent use.

2.8.9 Without notice by reason of any order or decision of a court or other governmentauthority having jurisdiction which prohibits Company from furnishing suchservices.

2.9 Limitations of Service

2.9.1 Service will be furnished subject to the availability ofthe necessary facilities and/orequipment and subject to the provisions of this tariff.

2.9.2 Legacy reserves the right to discontinue furnishing service, upon written notice,when necessitated by conditions beyond its control, or when the Customer is usingthe service in violation of the provisions of this tariff, or in violation oflaw.

2.9.3 The Company does not undertake to transmit messages, but offers the use of itsfacilities when available, and will not be liable for errors in transmission or forfailure to establish connections.

2.9.4 Legacy reserves the right to discontinue the offering ofservice or deny an applicationfor service if a change in regulation materially and negatively impacts the financialviability of the service in the best business judgment of the Company.

2.10 Use of Service

Service may be used for any lawful purpose for which it is technically suited.

2.11 Terminal Equipment

Company's facilities and service may be used with or terminated in Customer-provided orSubscriber-provided terminal equipment or systems, such as PBXs, key systems,multiplexers, repeaters, signaling sets, teleprinters, handsets, or data sets. Such terminalequipment shall be furnished and maintained at the expense of the Customer or Subscriber,except as otherwise provided. Subscriber or Customer is responsible for all costs at his or herpremises, including personnel, wiring, electrical power, and the like, incurred in the use ofCompany's service.

2.12 Tests, Pilots, Promotional Campaigns and Contests

The Company may conduct special tests or pilot programs and promotions at its discretionto demonstrate the ease ofuse, quality ofservice and to promote the sale of its services. TheCompany may also waive a portion or all processing fees or installation fees for winner ofcontests and other occasional promotional events sponsored or endorsed by the Company.From time to time the Company may waive all processing fees for a Customer.

2.13 Other Rules

2.13.1 The Company reserves the right to refuse to process Credit Card or Calling Cardbilled calls when authorization for use is denied or cannot be validated.

2.13.2 The Company reserves the right to discontinue service, limit service, or to imposerequirements on Subscribers or Customers as required to meet changing regulations,rules or standards of the NPSC.

2.13.3 Telecommunications services provided to inmates of correctional or confinementinstitutions may be restricted or limited at the request of the institution.

2.13.4 Legacy may temporarily suspend service without notice to the Customer, by blockingtraffic to certain cities or NXX exchanges, or by blocking calls using certain PersonalAccount Codes when the Company deems it necessary to take such action to preventunlawful use of its service. Legacy will restore services as soon as service can beprovided without undue risk.

2.14 Toll-Free Numbers

2.14.1 The Company will make every effort to reserve "800/888" toll-free vanity numberson behalf of Customers, but makes no guarantee or warrantee that the requested"800/888" number(s) will be available or assigned to the Customer requesting thenumber.

2.14.2 If a Customer accumulates undisputed past-due charges, the Company reserves theright not to honor the Customer's request for a change in 800/888 service to anothercarrier (e.g., "porting" of the toll-free number), including a request for a ResponsibleOrganization (Resp Org) change, until such time as all charges are paid in full.

2.14.3 800/888 numbers shared by more than one Customer, whereby individual Customersare identified by a unique Personal Identification Number, may not be assigned ortransferred for use with service provided by another carrier. Subject to thelimitations provided in Section 2.14.2, the Company will only honor Customerrequests for change in Resp Org or 800/888 service provider for 800/888 numbersdedicated to the sole use of that single Customer.

SECTION 3.0 - SERVICE AND RATE DESCRIPTION

3.1 General

Calls are rated and billed according to one or more of the following variables: mileagebetween end points, time of day and day of week, type of access, term commitment, and/orvolume.

If a Customer or Subscriber purchases more than one Legacy service, the cumulativemonthly billing for all serviceswill be used to determine the rate for each service. Customerswith cumulative billing of less than $50.00 will be charged a $5.00 bill processing fee.

3.2 Timing of Calls

3.2.1 Long distance charges are based on the duration of each call.

3.2.2 The standard minimum call duration period for billing purposes and the incrementalbilling periods are specified in the descriptions for each service.

3.2.3 Unless otherwise specified in this tariff, usage after the initial period is measured androunded to the next higher full minute for billing purposes.

3.2.4 The Company will not bill for unanswered calls. When an End User indicates thathe/she was billed for an incomplete call, Legacy will reasonably issue credit for thecall.

3.2.5 When a call originates in one rate period and terminates in another rate period, theentire call will be billed at the rate in effect at the time of the call's origination.

Usage charges for mileage sensitive services vary based on the type of service subscribed toby the Customer. For services utilizing switched access, mileage measurements for rateschedules are based on the distance in airline miles between rate centers associated with theoriginating and terminating stations. For services utilizing dedicated access, mileagemeasurements for rate schedules are based on the distance in airline miles between theLegacy network access point associated with the station utilizing Dedicated AccessOrigination/Termination and the rate center associated with the called/calling station.

6.1 Institutional Operator Assisted Calling

6.1.1 General

Institutional operator assisted service allows Inmates to place Collect Calls through anautomated call processing system. The call processing system prompts the Inmate and thecalled party such that the call is completed without live operator assistance. Calls areplaced on a collect-only basis to the called party.

A number of special blocking and screening capabilities are available with institutionaloperator services provided by Legacy. These capabilities allow Institutions to controlInmate access to telecommunications services, reduce fraudulent use of the Company'sservices, and eliminate harassing calls to persons outside the Institution.

For services provided to Inmates of Institutions, the following special conditions apply:
