Level 3 Enforcement

Company Enforcement HearingThe directors of the company are instructed to attenda hearing in the relevant court. At the hearing the Director/s need to supply a list of all assets held bythe company and the details of any bank accounts.

Enforcement WarrantIf the Directors of the debtor Company fail to attend the above hearing, warrants for Their arrest are issuedby the court.

459E Wind-Up NoticeIf it is determined at theEnforcement Hearing that the company holds enough assets to cover the debt, notice is given to the directors that unless fullpayment is made within 21 days the Company will be wound up.

Wind-Up PetitionThe Federal court is petitioned to wind-up the company.

Re-direction of Debt

If it is determined at theEnforcement Hearing that the debtor has a regular source of income, an order is sought through the courts for the funds to be re-directed from the debtors bankaccount to yours.

Bankruptcy Notice

If an order for re-direction of debt is unable to be sought,a Bankruptcy petition is filed with the Insolvency Trustee Service of Australia (ITSA) and served on the debtor.

Bankruptcy Petition

The Federal court is petitioned to bankrupt the debtor.

Act Early

The reality is that if your debtors are having trouble paying you then the chances are that they have other creditors they are having trouble paying as well, but while they are dragging their heels, if you are making early advances you are the first one they’ll pay.
