Dear Mr. Davis:

I am w riting o n behalf of my client Steve Jones in respon se to you r email

ad dr es sed to hi m earlier toda y. Your letter falsely claims that Mr. Jones, in front of

you and a number of other people, s tated that he had, in fact sexually assaulted a

female fan after she had pass ed ou t in his ho m e, and in the wo rd y ou claim he

used, com mit ted a rape .

As you well kno w , Mr. Jones never said that he had, in fact, eng aged in

such act. As w as typical duri ng pro du ction m eetings of BrandX, participan ts ,

inclu ding M r. Jones, we re enco urag ed to come u p wit h fictit ious story l ines. In

that context, Mr. Jones sugg ested the rap e story as the basis for a fictional

episod e of BrandX. At no time d id M r. Jones state or imply, directly or indirectly,

that suc h an event ha d eve r, in fact occurred . It wa s very clear to all present,

including you, that Mr. Jones was making up a ficti t ious story, not recounting

any thing tha t had ever taken place.

Mr. Jones is shocked tha t you w ou ld threaten to p ublish an article as if i t

w ere a n adm ission by M r. Jones of the comm ission of the crime of rap e described

in his obviously fictional s tory. He does not understand what your motivation

wo uld be , or wh y you w ou ld w ant to cause ir reparable har m to his reputa t ion.

And, he cannotfathomh ow y ou wo uld h ave the gal l to do so kno win g tha t there

w as a roo m full of witne sses w ho w ill testify th at Mr. Jones never s tated or imp lied

that, in fact, he ha d ever sexually assaulted or raped an yon e. W hatev er y ou

m otiva tion m ight be, be advise d tha t Mr. Jones purs ue all legal rem edies if you go

forward with the threat to provide an articleforSalon (or anyo ne else) wh ich

falsely p ortra ys Mr. Jones as hav ing com mitte d th e crime of rape.

wri t ingand/or publishing the story that you have threatened to deliver to Salon.

Should Salon or anyone else pub lish the story, or should you dissem inate i t in any

medium, including on the internet, Mr. Jones will immediately pursue all available

legal remedies against all involved, including you, Salon and any other participant

you , includin g suin g you and Salon for l ibel , wh ich will subject yo u to a

subs tantia l awar d of damag es inc luding puni t ive d amag es .
