ldquoAlmost EVERYTHING is blocked at school Staff has been told NOT to have any

contactfriends with any students on social mediardquo

I am in a high school library and most social media sites are blocked from our patrons Additionally our school board policy regarding any internet use is very outdated and prohibitive

My elementary school library does not have access to most they are blocked by our corporation

Not open by my school

As a school we are not encouraged to use these and these sites are actually blocked on our school network

Our campus President dislikes social media and we have not been able to convince her that we (the Library along with several other Academic and Student-related departments) need to use these resources for outreach and other legitimate school-related activities

In analyzing the availability of the immunity offered by this provision courts generally apply a three-prong test A defendant must satisfy each of the three prongs to gain the benefit of the immunity

1) The defendant must be a provider or user of an interactive computer serviceldquo

2) The cause of action asserted by the plaintiff must treat the defendant as the publisher or speaker of the harmful information at issue

3) The information must be provided by another information content provider ie

the defendant must not be the information content provider of the harmful information at issue

3) The information must be provided by another information content provider ie

the defendant must not be the information content provider of the harmful information at issue

ldquoAlmost EVERYTHING is blocked at school Staff has been told NOT to have any

contactfriends with any students on social mediardquo

3) The information must be provided by another information content provider ie

the defendant must not be the information content provider of the harmful information at issue

ldquoAlmost EVERYTHING is blocked at school Staff has been told NOT to have any

contactfriends with any students on social mediardquo

Thanks for the Legal Tip KLFLegal ILFannual12 SRC

In analyzing the availability of the immunity offered by this provision courts generally apply a three-prong test A defendant must satisfy each of the three prongs to gain the benefit of the immunity

1) The defendant must be a provider or user of an interactive computer serviceldquo

2) The cause of action asserted by the plaintiff must treat the defendant as the publisher or speaker of the harmful information at issue

3) The information must be provided by another information content provider ie

the defendant must not be the information content provider of the harmful information at issue
