About the LEVY COURT

About the ROW OFFICES

Levy Court is your County government. Kent County Levy Court is comprised of seven elected Commissioners: six are elected from the districts in which they reside, and the seventh elect-ed at-large to represent the entire county. The Commissioners serve at the will of the electorate and answer solely to their con-stituents. Since the Commissioners are elected officials, it is cus-tomary to refer to them with the designation of Honorable.

Levy Court responsibilities include: enacting planning and land use ordinances; providing parks and recreation facilities; estab-lishing fees; providing emergency medical services; 911 commu-

nications; emergency management; approving sewer system construction; establishing the yearly tax rate; appointing de-partment heads and overseeing the county departments that support the mission of Levy Court. The Commissioners appoint a County Administrator who is responsible for managing the day-to-day operations of county government.

Levy Court offices are located at 555 Bay Road. Residents may call 744-2300 to reach a County Office.

Kent County has four Row Officers: each of which is an elected official. Row Officers serve four year terms and each is empow-ered to manage their office. Each row office performs a distinct function within the County Government.

Kent County FIRE POLICE OF THE YEARLevy Court Commissioners are pleased to share the news that Main-tenance Mechanic Michael Berry, was named 2019 Kent County Fire Police of the Year. The announcement was made at the Annual Delaware State Fire Police Conference Dinner on September 11th. Michael Berry works at the Kent County Regional Resource Recovery Facility in Milford, and plans to retire before the end of this year after more than 17 years of service to Kent County.

Mr. Berry volunteers for the Frederica Volunteer Fire Company #49, where he has served for 35 years. When not working at the County, he proudly works hand-in-hand with other emergency management agencies re-routing traffic when needed. Mr. Berry says, on average his fire company responds to 150-200 alarms per year; and given that he currently has a full-time job, he says on average he has responded to about half. Sworn-in by Kent County Sheriff Carl Wright over thirty years ago, Mr. Berry has served as a Fire Police for 32 years. He is also President of the Kent County Fire Police Association.

Speaking of Sheriffs, Kent County Sheriff, Brian E. Lewis and Deputy Sheriff Chris White were also in attendance at the affair. Delaware Code allows county sheriffs and deputies to administer oaths giving Fire Police Officers some law enforcement powers, which are done frequent-

ly. Sheriff Lewis, who has been Kent County Sheriff since 2018, enthusiastically noted that he recently swore-in an 80 year old gentleman returning to the Fire Police.

Community Development BLOCK GRANTEach year the Kent County Department of Planning Ser-vices Housing and Community Development section re-ceives grants from the Delaware State Housing Authority to be used to improve the quality of life of low-to-mod-erate income persons through the administration of various housing and community development pro-grams. The area served by the programs includes Kent County and the 19 municipalities, excluding the City of Dover.

Housing assistance is provided in the form of grants for repairs and renovations of owner-occupied houses and manufactured housing that will bring a home up to hous-ing code standards and correct safety issues. Examples of some of the types of work done are: electrical, plumb-ing, roofing, heating, structural renovations and handi-capped ramps.

To qualify, the residence being considered for a grant must be owner-occupied. The total annual income of the occupants cannot exceed the income limits set for Kent County, Delaware.

By total household size*: 1 Person - $37,450; 2 Person - $42,800; 3 Person - $48,150; 4 Person - $53,500; 5 Person - $57,800; 6 Person - $62,100; 7 Person - $66,350; 8 Person - $70,650* (Income includes all sources of income from everyone living in the home)

There must be adequate hazard insurance on the prop-erty being considered for assistance prior to the start of work. All City and County taxes, sewer fees and proper-ty assessments must be paid. Manufactured housing on rented land must be current in the rental payments.

Homeowners interested in participating in the program must fill out an application for assistance provided by the County. Certain information requiring verification will be mailed to employers, Division of Revenue, etc. A Hous-ing and Community Development Specialist will inspect the home and prepare a list of repairs to be completed. The work order describing the repairs needed is given to County approved licensed contractors and the job is awarded to the lowest bidding responsive contractor. The selected contractor completes the work and pres-ents a bill to the County. The County Housing Specialist inspects the work with the homeowner and, if satisfacto-ry, the County pays the contractor. To avoid abuse of the Program, a lien (in the form of a mortgage) is placed on the property repaired.

This lien has a 0% interest rate, and no monthly payments are due during the term of the lien, which ranges from 5 to 15 years, depending on the amount of funds spent. At the end of the lien term, the mortgage is considered satisfied and cancelled.

At its August 18 Business meeting, Levy Court Commis-sioners approved the establishment of the Kent County EDGE Grant Matching Program. Modeled after the State of Delaware’s, Division of Small Business EDGE Grant launched in May 2019, the Commissioners endorsed funding through the Kent County Strategic Development Fund with an initial allocation of $100,000. Grants will be awarded on a one-to-one matching basis for every dollar of State EDGE Grant awarded to a Kent County Based business up to a maximum of $10,000 for Science Tech-nology, Engineering and or Math (STEM) based Business-es - and a maximum of $5,000 for Entrepreneur Class (non-STEM) Businesses in accordance with the Matching Grant Program Guidelines as presented.

The EDGE Grant was set up to help small, early stage businesses (businesses for less than five years) with product development, capital costs, and promotional expenses. Other criteria for the grant includes: busi-nesses with no more than ten employees; 51% of em-ployees must reside in Delaware; the business must have net assets totaling less than $500,000; and the business could not have received a previous Delaware Strategic Fund Grant. Once the County Administrator is notified and confirmation received by the Delaware Division of Small Business that an award has been granted, a dis-bursement will be processed in accordance with the regular Kent County schedule for accounts payable processing.

On Sunday, July 7, 2019, Mr. Lawrence Normile was re-moving trees and brush in Smyrna, DE along with the assistance of 16 year-old Jason Rogers and Mr. Normile’s son, Issac. Having created a pile of debris and water-ing the perimeter, an accelerant was used to ignite the stumps and yard waste. During the ignition phase, the fire back flashed on Jason creating areas of 1st, 2nd, and 3rd degree burns. Mr. Normile attempted to get Jason to stop drop and roll, but this proved ineffective as the fire reignited, and as such, Mr. Normile smothered Jason with his own body rolling him as fast as possible to extinguish the fire. Mr. Normile also received burns on his arm, shoul-der and face trying to extinguish the fire from Jason. Mr. Normile’s son Issac used a garden hose to extinguish the remaining fire.

Mr. Normile quickly put Jason into a shower in an attempt to relieve the pain from the burns and then transported him to Bayhealth’s Emergency Department in Smyrna. Mr. Normile was treated and released while Jason Rogers was transferred to Crozer Chester Burn Center where he has since been released.

“Clearly, without Mr. Normile’s quick reaction this unfor-tunate event could have been catastrophic for Jason,” said Chief Colin Faulkner, Director of Kent County De-partment of Public Safety. “Mr. Normile responded ap-propriately by extinguishing the fire with obvious risk to self, took remedial actions to cool the burns and quickly transported Jason to the Emergency Department. Mis-management could have resulted in inhalation burns, as well as, a worsened outcome for Jason. The seriousness of this event is evident in the transfer of Jason to a burn center.”

Employees of the Month

Kent County Department Heads have selected MICHAEL A. FESTI from the Department of Planning Services as the July 2019 Employee of the Month.

Michael started with Kent County in March 2017 and serves as a Permit Technician I in the Inspections & En-forcement Office.

He is primarily responsible for explain-ing zoning and related ordinances to the general public and building con-tractors; applying related ordinances to the process of obtaining a building

or other permit for contractors and the general public; reviewing building permit applications for complete-

ness and approval; and conducting research of property ownership records, zoning violations, and demographic trends.

A new co-worker recently praised Michael for his helpful instructive nature and willingness to respond to numer-ous questions about permitting procedures and process-es. His positive demeanor and work ethic is greatly ad-mired by customers and staff.

According to Planning Services Director Sarah Keifer, Michael is “exceptionally helpful to internal and external customers. He has worked closely with new inspectors to help them understand the County’s permitting pro-cess. During his relatively short tenure, he has already achieved an unexpected level of expertise.”

Kent County Department Heads have selected KENNETH A. ANDERSON Sr. from the Office of the Kent County Sheriff as the August 2019 Employee of the Month.

Ken started with the Sheriff’s Office in June 2017 and his primary duties include service of court-ordered sub-poenas, maintaining records of ser-vice, conducting property inventory for scheduled sales, and assisting in the sale of property by the Sheriff.

Ken is a former Delaware State Police officer and previously worked as a uniform patrol offi-cer at Troop 3, Auto Theft Detective for Kent and Sussex

Counties, and Property Crimes Detective at Troop 3 until retiring in 2016 after 27 years

He is highly regarded for his professionalism and de-meanor. His prior experience as a DSP Field Training Of-ficer has proven especially helpful with the training and orientation of a new deputy sheriff in the Office.

According to Sheriff Lewis, “Ken is well organized and well suited for this new training assignment. He is always willing to share new ideas and is a big part of the daily office operations. It is a pleasure to have Ken as a part of the TEAM working in the Kent County Sheriff’s Office. “He is well deserving of the this high honor and I am hon-ored to have nominated him”

Kent County Department Heads have selected VANESSA A. MARTIN from the Office of the Kent County Record-er of Deeds as the September 2019 Employee of the Month.

Vanessa started with Kent County in September 2013 as a Permit Tech-nician and later transferred to the Deeds Office in January 2017 were she currently serves as a Deed Clerk II. Her primary duties include verifying documents as to their accuracy prior to recording, cash receipting, assist-ing customers with research ques-

tions, and imaging recorded documents.

Her experience in the building permits office has prov-en to be very helpful to the office, and she has willing-ly shared her knowledge with co-workers. Supervisors praise Vanessa for her positive attitude and motivation to learn all about the history and importance of the re-cording process. She has excellent customer service skills and is always looking for the next challenge.

According to Kent County Recorder of Deeds Betty Lou McKenna, “Vanessa always exhibits enthusiasm with a positive attitude. She is courteous, friendly and extreme-ly helpful when constituents come to the deeds office for information as well as for recording documents. Vanessa is very dedicated to her job as well as Kent County in general. She is an exemplary employee.”

Charles Dickens is one of the most well-loved authors in the world and the greatest novelist of the Victorian era.  He created some of the most iconic literary characters of all time and enjoyed unprecedented success during his own lifetime.  Dickens’ own life was a rags-to-rich-es story that represented the strong themes of social reform and philanthropy that run through his novels. In December, Kent County Public Library will have de-cor throughout the building, celebrating Dickens’ most widely acclaimed novel, A Christmas Carol, as well as the region’s Victorian heritage on Dec. 7 and Dec. 13, 2019. But that’s not all; there will also be two other Christmas events at the library; On Dec. 13, an gathering at the li-brary is scheduled to take a look at how Christmas is cel-ebrated globally, and the other event, on Dec. 19, will be a Storytime, with arts and crafts to follow.

High Time for Afternoon Tea — Saturday, Dec. 7 at 2 pmTickets for the Dickens Literary Tea, the annual fundraiser hosted by the Friends of Kent County Public Library, have been on sale since October and sell-out quickly ($30 per adult).  Guests are cordially invited to a telling of Charles Dickens’ immortal holiday classic, A Christmas Carol, as told by Ebeneezer Scrooge’s sister Nan, portrayed in cos-tume by historical storyteller Alisa Dupuy.  Tickets can be purchased exclusively at Kent County Public Library. 

A Christmas Carol — Friday, Dec. 13 at 11 pmA Christmas Carol charts the rise of Christmas as a holi-day during the Victorian era, and introduces new Christ-mas traditions such as the Christmas tree and family gatherings, now taken for granted.  It also is an inspiring ghost story, in the Victorian tradition of sharing tales of the supernatural over the holidays. 

Kent County Public Library’s Friday the 13th Book Club will be meeting at House of Coffi (Loockerman St., Do-ver) from 11 pm-midnight to discuss the still-popular nov-el. The Friday the 13th book club, meeting at The House of Coffi (Loockerman Street, Dover) is free.  There is no pre-registration, but participants are asked to read “A Christ-mas Carol” (Dickens) prior to the event.

LIONS CLUBS Present Bench To The CountyJohn Burris and Sheila Schieferstein presented Kent County Levy Court with a Trex bench at its August 20, Combined Business and Committee meetings. Made pos-sible through the collection of over 792 pounds of sheet plastic collected within six months, the Club’s main goal was keeping the plastic out of the landfill. It takes 100 bags to make a pound.

Placing the bench within the community was an added bonus and the Kent County Levy Court Complex was the ideal place, since several Kent County Lions Clubs partic-ipated in the project: Clayton, Capitol City, Dover, Smyrna and Dover Lioness. Helping the environment is one of the five global causes of Lions Clubs International, the other four are vision, childhood cancer, diabetes and hunger.

Levy Court Commissioners expressed their appreciation for the bench and admiration to the Club for their dedi-cation to the causes they champion.

“When we agreed to accept the bench, I had no idea what it would look like”, said Terry Pepper, Levy Court Vice President. The bench surpassed everyone’s expec-

tation and sits proudly in the entrance area of the Kent County Administrative Complex where all visitors can admire it.

Kudos to Kent County Department of Public Safety on PROTECTING THE HEART

In light of Sudden Cardiac Arrest Awareness month, the County’s Emergency Medical Services Division deserves many thanks from those of us who know the impor-tance of knowing Cardiopulmonary Resuscitation (CPR). Armed with the knowledge that “every second counts” when it comes to cardiac arrest the Department of Public Safety has used every opportunity to train young and old on how to perform CPR and save a life in efforts including the use of cell phone apps.

According to the American Heart Association’s 2015 Guidelines Update, CPR training helps people learn the skills and develop the confidence to provide CPR when encountering a cardiac arrest victim. And while AEDs can be used by the public regardless of whether the respond-er has been trained, even minimal training improves per-formance, timeliness, and efficacy.

Since August, Medics have participated in five hands only CPR events. Hands only CPR allows a citizen to get in-volved in saving a life rather than do nothing.

In October and November our medics trained at two health care provider CPR events. And, to date CPR Co-ordinator, Richard J. Schlauch, Jr. has held 10 CPR classes in the hopes of improving the survival rates of cardiac arrests in Kent County and throughout the State of Del-aware.

Other measures include: On Sept. 9, 2015, Kent County an-nounced the launch of Smart911 — an emergency response service

which allows you to create a safety profile that can be seen by emergency responders when you call 911.

Smart911, is a free, private, and secure service, allows cit-izens to create a Safety Profile at Smart911.com for their household that includes any information you want 9-1-1 and response teams to have in the event of an emergency. By having information ahead of time, when a citizen makes an emergency call, their Safety Profile is automatically dis-played to the 9-1-1 call taker, allowing them to send the right response teams to the right location with the right information.

In September of 2018, Kent Coun-ty announced the rollout of Pulse-Point Respond®, a high-tech tool

designed to alert smartphone owners of cardiac arrest calls near their location, allowing them to respond and ad-minister CPR immediately until first responders arrive.

GPS-enabled cell phones can be alerted, based on their location, to a CPR medical call and the closest automated external defibrillator (AED) in that area.

The product is free and intended for anyone with a smart-phone who is trained in providing cpr. It works only for cardiac events in public venues, such as businesses, not in private residential settings.

Early application of bystander CPR and rapid defibrilla-tion from an AED have proven to be crucial in improving a person’s chance of surviving sudden cardiac arrest (SCA). PulsePoint® is not limited to emergency responders or those with official CPR certification. It can be used by any-one who has been trained in CPR.

Kent County Paramedics literally bring the emergency de-partment to the streets. Paramedics in Kent County and Del-aware, also have the distinction of being among the best in the nation. They are advanced life support practitioners who bring life-saving skills and techniques to wherever a patient may be. Paramedics in Kent County typically have an associ-ate’s degree though many have a bachelor’s degree as well. Professionally, paramedics are on par with nurses, police of-ficers, and fire fighters. It is for this and other reasons that Kent County promotes its paramedics as a profession.

Colin Faulkner, Chief of the Kent County Department of Pub-lic Safety encourages qualified individuals to explore oppor-tunities with the Department. Paramedics especially, are at a premium in Delaware. Delaware is an extremely progressive and rigorous state for paramedics to practice in and as such, not all are successful. The job is physically demanding and stressful with a high level of academic prowess required.

Additionally, you see people at their absolute worst and in situations that are literally un-speakable. It is not for everyone.

Our paramedics work in environ-ments that consist of extreme cold and extreme heat and everything in between and under any variety of adverse weather conditions. Chief Colin Faulkner recalls many times performing fine motor skills on the streets in extreme cold/heat and the challenges that these skills present in a field setting. Consid-erable danger is an everyday real-ity for our medics as they are de-ployed to any type of emergency that filters through our 911 Center. Paramedics in Delaware are licensed by the Divi-sion of Professional Regulation and work under a physician’s license. This creates a best case scenario for assuring the highest level of care possible.

Many of our citizens may notice that Kent County paramed-ics do not have any ambulances in its fleet. Chief Faulkner in-dicates that we only deploy personnel and equipment. This is based on a tiered approach to delivering advanced life support care whereupon a paramedic’s responses are lim-ited to medical or traumatic life threats. If a paramedic was on an ambulance with a minor injury and a higher level of emergency presented with time being critical, the success of patient care would be challenged because of extended response times.

We literally have the best system of care available anywhere. Our statistics shows it and we have a lot of statistics. Chief Faulkner readily states that he would put his faith and trust for his family in the care of the Public Safety Department’s Paramedics and its Dispatchers. They are all amazing to watch.

Because the Department’s 911 Center is a Nationally Accred-ited Emergency Medical Dispatch Agency, professional care for EMS patients begins immediately when someone dials 911.

Our 911 Dispatchers expertly triage all calls and determine what level of response is required. The Dispatchers provide pre-arrival instruction to the patient and often times will coach callers in performing CPR and other lifesaving skills.

Minor EMS events will warrant an ambulance response only while serious events such as allergic reactions, cardiac prob-lems, stroke, traumatic events, etc., will warrant an ambu-lance and a team of paramedics. Chief Faulkner points out that while the EMT’s from various fire services and private ambulance services provide care for many calls that the paramedics do not respond to; they become a valuable part of the advanced life support team when they are deployed with the paramedics. We could not do it by ourselves.

All of our EMT’s are nationally registered and perform out-standing care under the same conditions and challenges as do our paramedics. Both are great professions. Our De-partment of Public Safety also sponsors a Special Opera-tions Support Section which supports other than typical re-

sponses. SWAT (Special Weapons and Tactics) support local law en-forcement and the high angle and confined space supports the Kent County Team.

Additionally, we have an All-Ter-rain Medical Response Team, Bike Team, Hazmat Support Team and a NASCAR Team. All of these spe-cialized groups require consid-erable and rigorous training and members must be in top physical condition.

Additionally and a post 911 reality is that our medics are well versed in CBERNE (Chemical/Biological/Radiological/Nuclear/Explosive) and areas of re-sponse and mitigation.

Chief Faulkner points out that all of his first responders are equipped with the highest quality Kevlar vests and helmets and are equipped with the skills to manage organized mass gatherings such as NASCAR and Fire Fly while possessing the skills to provide front line management of more onerous terrorist type activities, whether foreign or domestic.

Becoming a paramedic is an excellent profession first and fore-most for individuals who are inclined and can be dedicated to public service. If you are adventurous, in excellent mental and physical condition, and have the academic skills for success, this can be one of the most rewarding careers to enter.

Chief Faulkner encourages nationally registered paramedics to explore opportunities with the Department. He also en-courages interested individuals to contact DTCC (Delaware Technical and Community College) for information about its Paramedic Technology Program. DTCC is the only degree awarding institution in Delaware to offer opportunities to become Nationally Registered Paramedics with an Associ-ate’s Degree upon completion. Many of our current para-medics are DTCC graduates. Chief Faulkner encourages all but cautions all that this is not for everyone.

WHAT IS THE DECENNIAL CENSUS?Every 10 years, the federal government conducts a population count of everyone in the United States. Data from the census provide the basis for distributing more than $675 billion in federal funds annually to communities across the country to support vital programs—impacting housing, education, transportation, employment, health care, and public policy. They also are used to redraw the boundaries of congressional and state legislative districts and accurately determine the number of congressional seats each state has in the U.S. House of Representatives.

WHY IS IT IMPORTANT TO ME?Responding to the census is not only your civic duty; it also affects the amount of funding your community receives, how your community plans for the future, and your representation in government. Specifically, data from the 2020 Census are used to:

• Ensure public services and funding for schools, hospitals, and fire departments.

• Plan new homes and businesses and improve neighborhoods.

• Determine how many seats your state is allocated in the House of Representatives.

WHEN WILL I COMPLETE THE CENSUS?The next census will take place in 2020. Beginning in mid-March, people will receive a notice in the mail to complete the 2020 Census. Once you receive it, you can respond online. In May, the U.S. Census Bureau will begin following up in person with households that haven’t responded to the census.

HOW CAN I RESPOND?In 2020, for the first time ever, the U.S. Census Bureau will accept responses online, but you can still respond by phone or mail if you prefer. Responding should take less time than it takes to finish your morning coffee.

WHAT INFORMATION WILL BE REQUESTED?The decennial census will collect basic information about the people living in your household. When completing the census, you should count everyone who is living in your household on April 1, 2020.

WHAT INFORMATION WILL NOT BE REQUESTED?The Census Bureau will never ask for:

• Social Security numbers.

• Bank or credit card account numbers.

• Money or donations.

• Anything on behalf of a political party.

WILL MY INFORMATION BE KEPT CONFIDENTIAL?Strict federal law protects your census responses. It is against the law for any Census Bureau employee to disclose or publish any census information that identifies an individual. Census Bureau employees take a lifelong pledge of confidentiality to handle data responsibly and keep respondents’ information private. The penalty for wrongful disclosure is a fine of up to $250,000 or imprisonment for up to 5 years, or both. No law enforcement agency (not the DHS, ICE, FBI, or CIA) can access or use your personal information at any time. Data collected can only be used for statistical purposes that help inform important decisions, including how much federal funding your community receives.

The Census Bureau has a robust cybersecurity program that incorporates industry best practices and federal security standards for encrypting data.

At the end of the class you will take home your soap in its own reusable mold to sit for at least 24 hours before being sliced and allowed to cure for 4-6 weeks. Originally a grana-ry for the working mill, this historic and rural building has been transformed into a Center for historical and environmental education. Make-A-Difference Day 2019Parks and Recreation Thanks Local Volunteers

On Saturday, October 26th, 93 local volunteers put on their work gloves and boots to lend a helping hand to park staff for the annual Make-A-Difference Day (MADD) at the Hunn Nature Park.

MADD is the annual day of community service and volunteerism that began back in 1992 thanks to an initiative by USA Weekend — the second largest national newspaper at the time.

Kent County Parks and Recreation has been using this volunteer effort to help revitalize the Hunn Nature Park by planting trees, tending to trails, and general clean-up of the former landfill property.

This year, special thanks go out to the Airman

Leadership Squad from the Dover Air Force Base, who used their teamwork to haul multiple 55-foot long fiberglass beams from their storage spot to the future pedestrian bridge location on the Racetrack Pond loop trail. This bridge will allow park patrons to fully enjoy the half-mile loop trail that has water vistas on both side of the trail.

A future ribbon cutting and grand opening ceremony will be scheduled in the near future for this amazing addition to the Park.

In order to receive the text message notifications, you must submit your mobile carrier name when signing up for an account, or let us know by answering the question during registration check out. If you have any questions regarding this helpful program, please call our office.

GENERAL INFORMATION• Classes, activities, and trips are subject to cancellation for any

reasonable cause. • For weather and last minute cancellation information, please

view our website at co.kent.de.us and facebook.com/Kent-CountyParksandRec. Timely program cancellation notifica-tions will be done by phone or email from Staff.

• Please make sure that the instructor is present before drop-ping your child off at a program

• Arrive to pick up your child at least five minutes before the program’s scheduled closing. Failure to pick up your child on time may result in expulsion from the program.

• A child may be expelled from a program with no refund after notifying parent of disciplinary problems.

• The Department may photograph programs and participants for publicity purposes, such as the brochure, facebook, twit-ter, etc.

• The Department has the right to adjust any of the program details in the brochure including fees, locations, instructors, times, days and starting dates.

WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT

I hereby acknowledge that in using the facilities, programs and equipment of Kent County Parks and Recreation, I do so en-tirely at my own risk and I assume the risk of any injury and/or damage while engaging in any physical exercise or activity or use of any facility on the premises. This assumption of the risk includes, without limitation, my use of the gymnasium, athletic courts, lobby, hallways, athletic fields, parks, sidewalk, parking lot, seating, or any equipment in the facility/park. I further agree to assume the risk in participating in any activity, class, program, instruction, or any event sponsored by Kent County Parks and Recreation (Kent County Levy Court).

By executing this Agreement, I HEREBY WAIVE, RELEASE AND FOREVER DISCHARGE, Kent County Levy Court and its  past, present and future administrators, partners, employees, in-sureds, assigns, agents, and representatives in their personal and professional capacities (collectively “Kent County Parks and Recreation “), from all claims, demands, injuries, damages, actions or causes of action, and from all acts of active or passive negligence on the part of such entity, its servants, agents, or employees of any nature whatsoever, including attorneys’ fees and costs arising out of or connection with the aforementioned activities. I further agree to indemnify and hold harmless Kent County Levy Court from any claims, demands, injuries, damages, actions or causes of action, loss, liability, damage or cost which Kent County Levy Court may incur due to my presence at or use of the facility. I further agree that the foregoing warranty, waiver and indemnity agreement is intended to be as broad and inclusive as permitted by the law of the State of Delaware and that if any portion is deemed to be invalid, it is expressly agreed that the remaining terms shall remain in full legal force and effect.

REGISTRATION PROCEDURES

CREDIT CARD USE POLICYKent County Parks and Recreation cares about the safety of your credit card information. We will no longer accept mailed or phoned in credit card payments. Credit card payments (Visa, MasterCard, Discover) can be made in person at our main office or via our online registration catalog (CivicRec). Kent County Parks and Recreation can only accept credit card payment by authorized account holder as displayed on the card. Please note: All credit/debit transactions will show Kent County Levy Court.

REFUND POLICYRegistration fees for recreation programs/activities must be paid in advance and shall be refunded in full to the payer of record if the County cancels the program/activity. If a par-ticipant cancels his/her participation in a program at least five (5) days prior to the first scheduled day, a full refund shall be paid less a $5 processing fee pursuant to County ordinance. Refunds will not be given for any other reason.
