Is Housing Discrimination Against LGBT
persons illegal?
California bans sexual orientation housing
discrimination and bans gender identity housing
discrimination
The HUD “LGBT Rule” guarantees access to HUD
funded housing programs regardless of gender
identity and sexual orientation.
The federal Fair Housing Act does NOT include
gender identity and sexual orientation as
prohibited bases of discrimination. HUD considers
gender identity discrimination is a form of sex
discrimination under the Fair Housing Act.

Why is there a need for housing
welcoming to LGBT seniors?
Less likely to be married or partnered, more likely to
have social and financial insecurity.
Fewer children than other people and more likely to
be estranged from family members.
High risk of social isolation and depression.
Report harassment and bullying by staff and
residents in senior communities and facilities
Lack of access to caregiving resources because
social supports are not related by blood or marriage.

Housing? Creation of LGBT Leadership Advisory Team
Partnership with City Council member Steve Hansen
Continuing outreach to local LGBT community
Land Purchase with funding from national CDFI and
partial predevelopment funds from several banks.
(Bank of America, Wells Fargo, First Citizens Bank)
Challenged by neighborhood opposition to affordable
housing
Submission of initial designs and lot merger application.

Affirmative Marketing How does fair housing impact outreach
and marketing for LGBT-friend housing?
• NO asking about sexual orientation or gender
identity to screen for eligibility.
• Marketing brochures contain photos of LGBT couples and individuals & ethnic diversity.
• Promotion of LGBT-friendly concept and sensitively trained staff, appropriate and flexible services
