When starting a federal taxation research project a good place to start is with the Internal Revenue Code
![Page 8: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/8.jpg)
Be sure to consult a current version of the code

Tax Research
Tax research, an example …
![Page 10: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/10.jpg)
Have you ever needed to know …
![Page 11: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/11.jpg)
What it means to allocate income and deductions among taxpayers?
![Page 12: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/12.jpg)
Start by consulting the Code, section 482.
![Page 13: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/13.jpg)
IRC § 482, Allocation of income and deductions among taxpayers.
In any case of two or more organizations, trades, or businesses (whether or not incorporated, whether or not organized in the United States, and whether or not affiliated) owned or controlled directly or indirectly by the same interests, the Secretary may distribute, apportion, or allocate gross income, deductions, credits, or allowances between or among such organizations, trades, or businesses, if he determines that such distribution, apportionment, or allocation is necessary in order to prevent evasion of taxes or clearly to reflect the income of any of such organizations, trades, or businesses. In the case of any transfer (or license) of intangible property (within the meaning of section 936(h)(3)(B)), the income with respect to such transfer or license shall be commensurate with the income attributable to the intangible.
![Page 14: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/14.jpg)
Section 482 seems straight forward. Only two sentences.
![Page 15: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/15.jpg)
Is tax law really this easy, just two simple sentences explaining how to allocate income and deductions?
![Page 16: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/16.jpg)
H-E-Double Hockey Stick No!!!
![Page 17: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/17.jpg)
If it were that easy politicians would stop complaining about it, and students would stop studying it!
![Page 18: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/18.jpg)
To ensure you are getting the information your professor or client needs …
![Page 19: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/19.jpg)
Always consult the Regulations!
![Page 20: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/20.jpg)
All taxation students must get in the habit of consulting the Regulations while in school!
![Page 21: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/21.jpg)
Failure to do so while practicing can be professional misconduct!
![Page 22: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/22.jpg)
Internal Revenue Code Section 482 is explained in the Treasury Regulations sections 1.482-0 through 1.482-9T.
![Page 23: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/23.jpg)
You may be asking yourself …
![Page 24: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/24.jpg)
How much new information can the Regulations add regarding the 2-sentence long section 482?
![Page 25: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/25.jpg)
Well, I’m glad you asked …
![Page 26: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/26.jpg)
Regulation section 1.482-0 contains an 18 page table of contents for Section 482’s regulations.
![Page 27: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/27.jpg)
Yes! You read that correctly, 18 pages that consist only of a table of contents!
![Page 28: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/28.jpg)
Regulation section 1.482-0T contains a similar table of contents for the temporary regulations explaining section 482!
![Page 29: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/29.jpg)
Yes! There are temporary regulations that alter the permanent regulations that expand upon section 482!
![Page 30: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/30.jpg)
The regulations that explain Code section 482 are roughly 200 pages in length, all to explain the 2 sentence long Code section 482.
![Page 31: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/31.jpg)
All 200 pages will contain itty bitty print and long sentences
![Page 32: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/32.jpg)
Consulting the Code of Federal Regulations is important in other areas of the law as well.
![Page 33: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/33.jpg)
As an example …
![Page 34: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/34.jpg)
The importation of items into the United States is governed by Title 19 of the United States Code, Customs Duties
![Page 35: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/35.jpg)
Title 19 of the United States Code, Customs Duties, is explained by its very own set of regulations …
![Page 36: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/36.jpg)
Title 19 of the Code of Federal Regulations, the Customs Regulations
![Page 37: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/37.jpg)
An example of Customs research …
![Page 38: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/38.jpg)
If you ever need to know where to import antiques, where do you look?
![Page 39: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/39.jpg)
Could all the information be found in section 10.53, which is captioned as “Antiques?”
![Page 40: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/40.jpg)
Of course not! That would be too easy.
![Page 41: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/41.jpg)
Our lawyers and Customs Brokers need jobs after all
![Page 42: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/42.jpg)
So, where do we look then?
![Page 43: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/43.jpg)
Look to section 12.26, captioned as …
![Page 44: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/44.jpg)
Importations of wild animals, fish, amphibians, reptiles, mollusks, and crustaceans; prohibited and endangered and threatened species; designated ports of entry; permits required.
![Page 45: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/45.jpg)
What does the import of antiquities have to do with the import of wildlife?
![Page 46: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/46.jpg)
Certain antique items might be made from the pelts, bones or ivory of endangered species.
![Page 47: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/47.jpg)
Subsection (g)(2) of section 12.26 answers our question
![Page 48: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/48.jpg)
19 C.F.R. § 12.26(g)(2)Any antique article imported under Sec.
10.53(g) of this chapter shall be entered at one of the following ports:
Boston, Massachusetts; New York, New York; Baltimore, Maryland; Philadelphia, Pennsylvania; Miami, Florida; San Juan, Puerto Rico; New Orleans, Louisiana; Houston, Texas; Los Angeles, California; San Francisco, California; Anchorage, Alaska; Honolulu, Hawaii; O'Hare International Airport, Chicago, Illinois
![Page 49: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/49.jpg)
One more thing to be aware of …
![Page 50: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/50.jpg)
The name of a code or regulation section is called a caption
![Page 51: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/51.jpg)
In a perfect world a caption would accurately reflect two things…
![Page 52: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/52.jpg)
What type of law is contained in the section,
![Page 53: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/53.jpg)
And,
![Page 54: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/54.jpg)
Who the law affects, and in what circumstances
![Page 55: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/55.jpg)
However,
![Page 56: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/56.jpg)
Intel Corporation v. Advanced Micro Devices, Inc. 542 U.S. 241
“A statute's caption, however, cannot undo or limit its text's plain meaning.”
![Page 57: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/57.jpg)
Therefore, when conducting federal taxation research, tax students must be aware of the information contained in the Code or Regulations, rather than what a section’s caption alludes to
![Page 58: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/58.jpg)
Remember,
![Page 59: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/59.jpg)
The Code often used by students is contained in a single book
![Page 60: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/60.jpg)
The Regulations used by students, however
![Page 61: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/61.jpg)
Are often contained in 8 books
![Page 62: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/62.jpg)
All students of taxation or any other area of the law need to be aware of the different Titles in the Code of Federal Regulations,
![Page 63: LI 819 Presentation, Instructional](https://reader033.vdocument.in/reader033/viewer/2022061222/54c30af24a7959933f8b45c7/html5/thumbnails/63.jpg)
And must get in the habit of regularly consulting them while they are in school.
