This is an application for a new premises licence which currently operates as a University. The premises are intending on hosting small events for their students and staff.

Premises licence history:

The premises has been divided into separate areas in relation to the licensable areas and therefore the premises have had the benefit of three premises licences. The premises have a licence for each of the following areas:

1. Ground Floor, Mezzanine, Third Floor, Fourth Floor, Fifth Floor Sixth Floor

2. Library 3. Basement, Ground Floor, Level 2, Level 6, Level 12.

A copy of all three premises licences can be found at Appendix 3.

Summary of Application There are three existing licences for the London School of Economics that permit licensable activities within the premises buildings. It appears that the purpose of this application is to authorise licensable activities that will be carried out at various “small” events within the external area of the London School of Economics campus for students and guests. The majority of activities will cease by the latest 23.00 on Monday to Saturday and 22.30 on Sundays. The applicant has also sought permission for one major event which will take place during May or June each year which is described as the summer ball. The exact date has not been specified in the application as it will vary from one year to the next but the application does seek an extension of hours until 02.00 on the day following the event for all licensable activities.

I refer to the application for a new Premises Licence for the above premises. This representation is based on the Operating Schedule and the submitted plans, for the area, drawing number P11720-00-002-LSE-100 and dated 07.01.20. The applicant is seeking the following in the area:

1. To allow the Supply of Alcohol ‘on’ the premises Monday to Saturday 10:00-23:00 hours and Sunday 10:00-22:30 hours. To also allow one event until 02:00 hours.

2. To allow Late Night Refreshment for the one event until 02:00 hours.

3. To allow the provision of regulated entertainment both ‘indoors and ‘outdoors’ including films, plays, live music recorded music, performance of dance and anything similar Monday to Saturday 10:00-23:00 hours and Sunday 10:00-22:30 hours.

I wish to make the following representation in relation to the above application:

1. The provision of the Supply of Alcohol may cause an increase in Public Nuisance in the area, it may also impact on Public Safety.

2. The provision of Late Night Refreshment may cause an increase in Public Nuisance in the area.

3. The provision of regulated entertainment may cause an increase in Public Nuisance in

area, it may also impact on Public Safety. Advice has been followed that was provided in the pre-application advice report. The granting of the new Premises Licence as presented would have the likely effect of causing an increase in Public Nuisance in the area and may impact on Public Safety.

This Representation is made on behalf of is concerned about 3 aspects of the proposed application. We believe that unless these

are modified the grant of a Licence will harm the Licensing Objective of the Prevention of Public Nuisance. Noise The application is clear that music noise should not be audible within noise sensitive premises with the window open. However large scale events can generate noise even without music being played. We are concerned about this risk and ask that the condition be amended to refer to noise in general rather than music noise in particular Dispersal There is a requirement that the Management Plan includes dispersal (9 xiv) but there is no stated requirement that dispersal will be managed in such a way so as not to cause a nuisance. Condition 14 includes this requirement for queuing, and we believe something similar is required during dispersal. Condition 11 We are concerned that Condition 11 introduces a "get out clause" card which means that the Event Management Plan does not need to be realistic. All the applicant needs to claim is that it was not "reasonably practicable" to comply with the plan that they had themselves developed. We believe that this clause should be removed. There may be unforeseen situations where it is not possible to comply with the agreed plan but we think that the current wording of this condition gives too much scope to the applicant.

The following policies within the City Of Westminster Statement of Licensing Policy apply:

Policy HRS1 applies (i) Applications for hours within the core hours set out below in this policy will generally be granted, subject to not being contrary to other policies in the Statement of Licensing Policy.

4. Equality Implications

The Council in its capacity as Licensing Authority has a duty to have regard to its public sector equality duty under section 149 of the Equality Act 2010. In summary, section 149 provides that a Public Authority must, in the exercise of its functions, have due regard to the need to:

(a) eliminate discrimination harassment, victimisation and any other conduct that is prohibited by or under this Act; (b) advance equality of opportunity between persons who share a relevant protected characteristic and persons who do not share it; and (c) foster good relations between persons who share a relevant protected characteristics and persons who do not share it.

Section 149 (7) of the Equality Act 2010 defines the relevant protected characteristics as age, disability, gender reassignment, Marriages and Civil Partnerships, pregnancy and maternity, race, religion or belief, sex, and sexual orientation.

Proposal

The proposal is to host events on LSE land and WCC land.

The events will be limited to 23:00 hours save for ‘major events’. Major events would be those that would trigger stricter requirements after certain criteria is met, such as a higher capacity or later hour.

The proposed activities are as follows:

• Regulated Entertainment (Films, Live Music, Recorded Music, Performance of Dance, Anything similar) – Monday -Saturday 10:00-23:00 and Sunday 10:00-22:30.

• Late Night Refreshment – for events that go past 23:00 hours

• Alcohol ‘on’ the premises - Monday -Saturday 10:00-23:00 and Sunday 10:00-22:30.

The land that is to be used is a mix of ownership between Westminster City Council and LSE. Therefore, the majority of events will not be closed to the public.

Westminster’s Statement of Licensing Policy

Environmental Health bases any recommendations on achieving compliance with Westminster’s Statement of Licensing Policy as well as being consistent with promoting the Licensing Objectives.

The advice in this report should therefore be read in conjunction with the policy which can be found on the Council’s website at the following link:

In addition this link gives access to the list of Model Conditions (MC) which should be used as the basis for any conditions that may be proposed in an operating schedule.

The principal policy consideration is policy PVC1: Theatres, cinemas, other performance venues, and qualifying clubs outside the Cumulative Impact Areas - which states that ‘applications will generally be granted subject to relevant criteria in policies CD1, PS1, PN1 and CH1’ as the premises are not in a Cumulative Impact Area (CIA) and if the proposal also has the following main elements:

• supply of alcohol is ancillary to an event

• operational hours within core hour policy HRS1

Core Hours

The core hours are as follows for the supply of alcohol for consumption on the premises:

1. Monday to Thursday: 10:00 to 23:30 2. Friday and Saturday: 10:00 to midnight

Type of Events

The majority of events will be less than 500 people and will take place either in daytime hours into evening but not beyond 23:00 hours. The main event where longer hours are requested is for the Summer Ball. It was discussed at the meeting that certain events will incur stricter requirements and would be classed as a major event.

De-regulated entertainment

For the events that have a smaller capacity (under 500) and will not operate after 23:00 hours it may be that some of the regulated entertainment is deregulated.

In the meeting it was discussed the majority of events would be finished by this hour except for the Summer Ball.

Structure and Capacity

The majority of events will operate under 500 people. However, the proposed capacity over the whole space for major events is a maximum of 1000 people. Further advice is given in the report regarding the capacity from Alan Lynagh, district surveyor.

Any calculations on the safe capacity shall be made with reference to ‘The Technical Standards for Places of Entertainment – District Surveyor’s Association’ and any guidance provided by the Fire Brigade.

Westminster Building Control should be contacted if temporary structures are to be provided for an event to ascertain if temporary structures licences are required. In that situation full structural design details and calculations of all temporary structures must be submitted to Building Control and approval obtained prior to the event starting.

WC Provisions

With regard to the WCs the Event Safety Guide should be referenced.

For the events under 500 people existing facilities in the university buildings will be made accessible. These should be referenced on the layout plan. For major events further temporary facilities will be provided which will be detailed in the Event Management Plan.

Event Management Plan

A risk assessment will be expected to be undertaken for all events as well producing an Event Management Plan and a Noise Management Plan for all events. For those events that trigger the major event criteria a condition is proposed that this shall be submitted a minimum of 28 days before the event. However, the more detail added to the application may help potential objectors understand the impact of the activity. Such a plan should contain appropriate details on relevant aspects (see below under list of recommended conditions).

Food Offering

The provision of food was discussed during the meeting. The proposal for some events is a mix of mobile units/street food. Consideration should be given to the location of food units in terms of means of escape and potential fumes/odours that may cause a nuisance.

Further guidance has been attached regarding mobile food units and follows in the report.

Temporary Power Supply generators for events:

Use of temporary diesel generators of 37KW and 560KW used to provide power for an event are advised to also comply with the same emission standards under the Non Road Mobile Machinery (NRMM) Regulations (which currently apply to building sites):

• ie emission standards Stage IIIA or Stage IIIB of EU Directive 97/68/EC

Smoking Area

The area for smokers was not discussed, however any area would need to comply with the Health Act 2006.

Street Trading

For any stalls placed on public highway street trading licences will be need be applied for.

For events that use or impact the public highway permission will need to be sought from The City Promotions and Events Team [email protected]

Noise

If power is going to be taken from generators the plant will need to comply with the usual standards of permanent plant.

During the build-up and break down of the site, any activities that might cause noise to be audible outside the site will be limited to 08:00 - 18:00 Monday –Saturday and 08:00 - 13:00 Sunday.

Regulated entertainment

Sound from entertainment will need to be controlled at all times of the day.

The main issue that causes concern due to the late night use is any noise nuisance that may be caused from the activity of regulated entertainment.

It is unlikely that the noise from the entertainment for the majority of events will be at a volume to be audible beyond the boundary of the site. However further details are required on how the sound will be controlled which can be detailed in the noise management plan. As there is no control on the number of these events then regulated entertainment and/or amplified should not be audible at the nearest noise sensitive premises.

For major events a noise management plan will need to be submitted. Up until 23:00 hours the following condition should be met:

‘At a ‘major event’ the Music Noise Level shall not at 1 metre from the façade of any noise sensitive premises exceed the background noise level by more than 15dB(A)over a 15 minute period throughout the duration of the event.’

The proposal for the Summer Ball is to operate beyond 23:00 hours until 02:00 hours. There are serious concerns that regulated entertainment at this hour will cause a public nuisance. Referring to the Pop Code (Control of Practice on Environmental Noise Control at Concerts) the following condition should be met:

‘For any event that operates beyond 23:00 hours there shall be no music noise audible within noise sensitive premises with windows open in a typical manner for ventilation.’

In order to uphold the Prevention of Public Nuisance objective I would advise there should be no external regulated entertainment beyond 23:00 hours.

Appendix 11 of the Licensing Policy should be referenced.

Alcohol Management

The following was discussed and is detailed in the conditions further in the document.

• The use of the bars shall only be ancillary to an event.

• It would be good practice to have a personal licence holder on site at all times.

• A challenge policy should adopted, such as Challenge 21 or Challenge 25.

• The alcohol offering was discussed and it was agreed this would not be limited to a certain number of drinks.

• The number of bars will be limited by those indicated in the event management plan and fixed bars would never be provided.

• Site boundary – this will need to be determined that alcohol does not come out of the event space. I imagine this will often be smaller than the overall licensed space and this space will need to be detailed in the individual Event Management Plan.

Crime and Disorder

Security provisions should be discussed with the Police, with regard to searching, numbers of staff, etc. Please contact [email protected] It is strongly advised that the use of glass in the outside areas is prohibited. Once again discussion should take place with the Police to confirm if they are content with this approach.

Type of licence

A new licence application will be required.

The capacity of the whole site will be under 1000 so this will not incur higher licensing fees.

Items not discussed in the meeting

Can the following also be addressed in the Event Management Plan:

• Will there be any special effects?

• How will drinking water be provided?

• How will you power the site? i.e. with generators?

Proposed Conditions

The following conditions should be considered to reduce the impact on the licensing objectives.

1. Substantial food and non-intoxicating beverages, including drinking water, shall be available in all parts of the premises where alcohol is sold or supplied for consumption on the premises.

2. There shall be no permanent fixed bar/s in licensed space. 3. Alcohol shall be ancillary to the main use as an event space used by the London School of

Economics. 4. In the licensed space there shall be a maximum of 12 'major events' in any 12-month

period. A 'major event' is triggered when any of the following takes place:

• A capacity of over 500 persons

• Persons are in attendance beyond 23:00 hours

• Temporary structures are present which require Building Control approval

• The music level is audible at the site boundary

• Events that use WCC land

A record of these events shall be kept on site for a minimum of one year and be made available for inspection by an authorised officer.

5. Save for the 'major events' no amplified music shall be audible at the site boundary. 6. At a ‘major event’ the Music Noise Level shall not at 1 metre from the façade of any noise

sensitive premises exceed the background noise level by more than 15dB(A)over a 15 minute period throughout the duration of the event.

7. For any event that operates beyond 23:00 hours there shall be no music noise audible within noise sensitive premises with windows open in a typical manner for ventilation.

8. For a ‘major event’ unless otherwise agreed, no later than 28 days prior to the event, the Premises Licence holder must ensure an Event Management Plan is presented to the Environmental Health Consultation Team, The Westminster Licensing Police and The City Promotions Events and Filming Team for their comments. The Event Management Plan shall include, as a minimum:

i) Emergency and evacuation procedures ii) Crowd management and stewarding arrangements iv) A detailed site plan showing all permanent and temporary structures and all access and egress points v) Capacity at any one time vi) Certificates from competent persons on Structures, Electrical Power Supply and Gas equipment (including LPG)

vii) First Aid and Lost Children arrangements viii) Noise Management Plan including details of resident engagement ix) Risk Assessments x) A waste management plan xi) Sanitary accommodation xiii) The setup and break down arrangements for the event xiv) The dispersal of customers at the end of the event. For all other event an Event Management Plan detailing the points above shall be written and kept for at least one year and made available to authorised officers if requested.

9. So far as is reasonably practicable the Premises Licence Holder shall ensure that the event is run in accordance with the Event Management Plan.

10. In the licensed space the maximum number of persons accommodated at any one time shall not exceed 1000 persons (as agreed with the District Surveyor).

11. For a 'major event' the Event Manager or his authorised representative shall be responsible for liaising with local residents and organisations to notify them at least 14 days in advance and providing them with a complaints `hotline' telephone number, for any licensable activity taking place in the licensed space.

12. The licence holder shall ensure that any queue to enter the licensed space which forms outside the premises is orderly and supervised by door staff so as to ensure that there is no public nuisance or obstruction to the public highway.

13. When temporary seating is provided within the licensed space the following arrangements shall be complied with:

o Where the number of seats exceed 50, seats should be secured together in lengths of not less than 4.

o Where the number of seats exceed 250, seats should be secured together in rows and fix the ends of the rows to the floor or to each other by using chamfered bars.

o Where the number of seats exceed 600, fix all seats individually to the floor.

14. At a 'major event', a minimum of 1 SIA licensed door supervisor per 100 customers shall be on duty at the premises at all times for the duration of the event.

15. There shall be no striptease or nudity, and all persons shall be decently attired at all times, except when the premises are operating under the authority of a Sexual Entertainment Venue licence.

16. During the hours of operation of the premises, the licence holder shall ensure sufficient measures are in place to remove and prevent litter or waste arising or accumulating from customers in the area immediately outside the premises, and that this area shall be swept and or washed, and litter and sweepings collected and stored in accordance with the approved refuse storage arrangements by close of business.

17. A direct telephone number for the manager at the premises shall be publicly available at all times the premises is open. This telephone number is to be made available to residents and businesses in the vicinity.

18. Flashing or particularly bright lights on or outside the premises shall not cause a nuisance to nearby premises.

19. In the absence of daylight there will be sufficient lighting installed whilst the premises are open to the public.

20. The edge of the treads of steps and stairways shall be maintained so as to be conspicuous.

21. There shall be at least one personal licence holder on site during operational hours. Details of the personal licence holder (including name and contact number) shall be displayed in a prominent position on site.

22. No alcohol shall be taken outside of the boundary of the licensable area.

23. No hot food or hot drinks shall be taken off site beyond 23:00 hours. 24. All staff engaged outside the entrance to the premises, or supervising or controlling

queues, shall wear high visibility jackets or vests. 25. No drinks shall be served in glass containers at any time. 26. Notices shall be prominently displayed at all exits requesting patrons to respect the needs

of local residents and businesses and leave the area quietly. 27. A Challenge 25 proof of age scheme shall be operated at the premises where the only

acceptable forms of identification are recognised photographic identification cards, such as a driving licence, passport or proof of age card with the PASS Hologram.

28. A record shall be kept detailing all refused sales of alcohol. The record should include the date and time of the refused sale and the name of the member of staff who refused the sale. The record shall be available for inspection at the premises by the police or an authorised officer of the City Council at all times whilst the premises is open.

29. An incident log shall be kept at the premises, and made available on request to an authorised officer of the City Council or the Police. It must be completed within 24 hours of the incident and will record the following:

i. all crimes reported to the venue ii. all ejections of patrons iii. any complaints received concerning crime and disorder iv. any incidents of disorder v. all seizures of drugs or offensive weapons vi. any refusal of the sale of alcohol vii. any formal visit by a relevant authority or emergency service.

30. Any special effects or mechanical installations shall be arranged, operated and stored so as to minimise any risk to the safety of those using the premises. The following special effects will only be used on 10 days prior notice being given to the licensing authority where consent has not previously been given.

• dry ice and cryogenic fog

• smoke machines and fog generators

• pyrotechnics including fireworks

• firearms

• lasers

• explosives and highly flammable substances.

• real flame.

• strobe lighting.

31. No person shall give at the premises any exhibition, demonstration or performance of hypnotism, mesmerism or any similar act or process which produces or is intended to produce in any other person any form of induced sleep or trance in which susceptibility of the mind of that person to suggestion or direction is increased or intended to be increased. NOTE: (1) This rule does not apply to exhibitions given under the provisions of Section 2(1A) and 5 of the Hypnotism Act 1952.

32. The approved arrangements at the premises, including means of escape provisions, emergency warning equipment, the electrical installation and mechanical equipment, shall at all material times be maintained in good condition and full working order.

33. The means of escape provided for the premises shall be maintained unobstructed, free of trip hazards, be immediately available and clearly identified in accordance with the plans provided.

34. Emergency exits and entrances to the event area must be kept clear at all times and must be provided with clearly visible signage.

35. All parts of the licensed area intended to be used in the absence of adequate daylight and all essential safety signage shall be suitably illuminable. Details of the locations and level of illumination must be detailed in the Event Management Plan.

36. The edges of the treads of steps and stairways shall be maintained so as to be conspicuous.

37. Curtains and hangings shall be arranged so as not to obstruct emergency safety signs or emergency equipment.

38. All fabrics, curtains, drapes and similar features including materials used in finishing and furnishing shall be either non-combustible or be durably or inherently flame-retarded fabric. Any fabrics used in escape routes, entertainment areas, shall be non- combustible.

39. All fabric, including curtains and drapes used on stage for tents and marquees, or plastic and weather sheeting, shall be inherently or durably flame retardant to the relevant British Standards. Certificates of compliance must be available upon request by an authorised officer of Westminster City Council, The London Fire Brigade.

40. Any moving flown equipment must contain a device or method whereby failure in the lifting system would not allow the load to fall. All hung scenery and equipment must be provided with a minimum of two securely fixed independent suspensions such that in the event of failure of one suspension the load shall be safely sustained.

41. The certificates listed below shall be submitted to the licensing authority upon written request:

• Any permanent or temporary emergency lighting battery or system

• Any permanent or temporary electrical installation

• Any permanent or temporary emergency warning system

42. No waste or recyclable materials, including bottles, shall be moved, removed from or placed in outside areas between 23.00 hours and 07.00 hours on the following day.

43. No deliveries to the premises shall take place between 23.00 and 07.00 on the following day.

44. No fumes, steam or odours shall be emitted from the licensed area so as to cause a nuisance to any persons living or carrying on business in the area where the premises are situated.

45. A sufficient number of easily identifiable, readily accessible receptacles for refuse must be provided, including provisions for concessions. Arrangements must be made for regular collection. Public areas must be kept clear of refuse and other combustible waste prior to, and so far as is reasonably practicable, during the licensed event.

46. There shall be no noise audible at the nearest noise sensitive premises from any construction or similar works in association with the set up and dismantling of the site, outside the hours of:

08:00 - 18:00 Monday -Saturday

08:00 - 13:00 Sunday

47. Any generators, refrigerators or other machinery running overnight will be silenced, screened or sited so as not to be audible outside the boundary of the Gardens.

48. Electrical generators, where used, must be:

• Suitably located clear of buildings, marquees and structures, and free from flammable materials;

• Enclosed to prevent unauthorised access;

• Able to provide power for the duration of the event;

• Backed up electrical generators are to be provided to power essential communications, lighting and safety systems in the event of primary generator failure.

49. Details of all marquees, tented structures and temporary structures should be provided including emergency exits and signage, fire warning and fire fighting equipment.

50. Full structural design details and calculations of all and any structures to be erected within the licensed area must be submitted to the Westminster City Council Building Control. A

certificate from a competent person or engineer that a completed structure has been erected in accordance with the structural drawings and design specification must be available for inspection prior to a relevant structure being used during the licensed event.

51. The Premises Licence Holder must ensure that competent persons are employed to assess the electrical requirements at the event and the compatibility of the electricity supply with the equipment to be used. Appropriate safety devices (such as 30mA Residual Current Devices at Source) must be used for electrical apparatus, particularly for any electrical equipment exposed to adverse conditions or electrical equipment to be used in association with hand held devices (e.g. microphones). The competent person must make a certificate of inspection of the electrical installation available for inspection.

52. All spare fuel, including LPG, must be kept and stored safely in accordance with relevant Health and Safety legislation and suitable safety signage and fire fighting equipment provided.

To discuss with the police

53. The premises shall install and maintain a comprehensive CCTV system as per the minimum requirements of the Westminster Police Licensing Team. All entry will be covered enabling frontal identification of every person entering in any light condition. The CCTV system shall continually record whilst the premises is open for licensable activities and during all times when customers remain on the premises. All recordings shall be stored for a minimum period of 31 days with date and time stamping. Viewing of recordings shall be made available immediately upon the request of Police or authorised officer throughout the entire 31 day period.

54. A staff member from the premises who is conversant with the operation of the CCTV system shall be on the premises at all times when the premises is open. This staff member must be able to provide a Police or authorised council officer copies of recent CCTV images or data with the absolute minimum of delay when requested.

55. At least (TBC) SIA licensed door supervisor shall be on duty at each entrance of the premises at all times when it is open for business.

56. Adequate stewarding within the licensed area must be provided at all times during the licensed event.

Please be aware that as part of the application process other responsible authorities will also need to assess the proposals and may wish to make additional comments.

District Surveyor considerations General Legislative Background Building Regulations It is not clear if the scope of the proposals would trigger a building control application. This looks unlikely from the discussions to date but be advised that this should be considered. Generally any material change to the building by way of construction (installation of sanitary facilities, changes to load bearing construction, changes to means of escape routes etc) would require a building control application. Any temporary structures used for events may need a Section 30 temporary structure notice and this will need to be applied for as required. Health and Safety at Work Act 1974 Ensuring the health and safety of employees, contractors and others who resort to the premises is a key statutory requirement at all times. In addition once the premises are operating under a premises licence consideration should be given to any increased risks this creates and this should be suitably assessed by way of risk assessments for the activities proposed. For events where there is the potential for public to be involved also further consideration should be given to assessing any wider risks and as required the premises existing health and safety policy and supporting documentation should eb updated appropriately.

Licensing Act The operator will need to show that the application is supporting the 4 licensing objectives of:

• Public Safety

• Prevention of Public Nuisance

• Prevention of Crime and Disorder

• Prevention of Children from Harm

The operator should look to ensure that anything they do not impact negatively on any of these licensing objectives so the guidance contained within this report should be followed where possible and is given for guidance purposes in assisting the operator plan for the premises use under any licence that is granted. Public Safety Layout and Planning Detailed plans showing any proposed seating layout(s), standing area, exit routes and widths etc, should be prepared in order to determine the number of people who can safely be accommodated. These are required under the Licensing Act 2003 and will allow the council to assess and determine maximum numbers per floor and the appropriate details as discussed at the site meeting should be detailed on the plans. Temporary Seating Arrangements The licence will give the operator flexibility in how the space is used and this is likely to mean that on certain occasions temporary seating will be used. When temporary seating is used within the event space the arrangements detailed in table 1 below are recommended to ensure the seats remain suitably stable and secure and do not negatively impact on public safety. Given the external nature of the space it may not be viable to fix seats to the floor as detailed but an alternative approach would need to be put inplace to provided the same level of stability and rigidity to any seating proposed. 2. Where it is impractical to fix seats to floor plates, for example on polished dance floors, chamfered floor bars may be used. This is not a recommended solution for a “lively” audience, for example at a pop concert

Overcrowding Consideration needs to be given to how the maximum occupancies prescribed are monitored within the premises, this may include:

• Appropriate ticketing strategy

• Manual systems for counting within the event space

• Monitoring systems throughout events

Doors In relation to any tented structures introduced wherever possible all doors should open in

direction of escape and where 60 or more people may need to escape the door should always

open in the direction of escape.

To clarify the width of a doorway is the clear width measured between the leaves (or, if a single

door, the leaf and the frame or doorstop) of the doors when open at right angles to the frame.

Door hardware may be ignored if the door opens more than 90 degrees to the frame.

Doorways should be not less than 2060mm high. Curtains or drapes should never be hung

across doors or escape routes within any of the licensable areas as this could impede any

evacuation.

Thresholds No door should open immediately over or onto a step. A single step on the line of a doorway is not acceptable. A landing at least as wide as the door and at least as long as the width of the door plus 400mm, should be provided between the door and the first step of any stair. There should be no upstand or threshold bar across any doorway or escape route, other than a chamfered weather bar or threshold seal for sound insulation protruding a maximum of 6mm and arranged so as not to cause a trip hazard. Door fastenings All exit doors should be free from fastenings when public, entertainers or staff are present or have fastenings that may be readily opened in emergency without using both hands or a key to open the door. Note 1:This does not preclude the use of a key to open the door from the outside. Note 2:Any removable devices, such as locks, bolts, chains or padlocks, used to improve security must be removed before the premises are occupied. A door alarm system is preferable to removable security devices where possible. Where there may be more than 60 people, any fastenings on doors should be panic bolts or panic latches operated by push bars complying with BS EN 1125. If a room holds less than 60 people, push pads or lever handles complying with BS EN 179 are acceptable. The use of latches operated by lever handles should be avoided in public areas. Round knobs should not be used as they could be difficult to operate. Any door furniture should be fitted between 800mm and 1200mm above floor level and should provide visual contrast with the surface of the doors. To avoid confusion push plates should usually be fitted for pushing doors and handles to pull doors. Guarding and Barriers Any platforms, temporary or otherwise over 380mm high to which the public have access should be provided with suitable guarding. Any staircases should be provided with suitable handrails 800mm above pitch line of stairs. Temporary electrical installations All temporary electrical wiring and distribution systems for any installations used within the premises should comply with the recommendations of BS 7671 or where applicable BS 7909. Where they have not been installed by a competent person, temporary electrical wiring and

distribution systems should be inspected and certified by a competent person before they are

put to use.

Electrical sockets located in performance areas should be protected by residual current devices (RCDs) of 30 milliamps/30 milliseconds sensitivity complying with BS 4293.

Lighting

The event space should have an adequate supply of both normal and emergency lighting and each system should be sufficient to enable the public, performers and staff to see their way to move around the premises safely and to escape from the premises. Particular attention is drawn to the existing staircases and changes of level. If the normal mains/street lighting to the external areas were to fail we need to ensure there is an adequate back up supply that provides the required level of luminence. Adequate emergency lighting in addition to sufficient normal lighting should be provided so that all parts of the premises including toilets and any internal and external exit routes leading to the street are illuminated. Both supplies of lighting should be independently capable of providing the recommended minimum illuminance. However, whilst both normal and emergency supplies are functioning properly, either or both supplies may operate at a reduced level so long as the minimum recommended illuminance is provided. In the event of the failure of either supply the remaining supply should be automatically restored to full illuminance. People with Impaired Mobility A suitable and sufficient method statement should be prepared detailing the physical and management provisions in place to ensure that people who have impaired mobility can escape in the event of a hazard. Reliance on the fire brigade to assist in the evacuation of disabled patrons is not satisfactory and considerable thought should be given to this subject to ensure compliance with the Equalities Act. Communication Adequate communication is needed throughout the proposed site. Where noise levels are loud thought should be given to the most appropriate communications systems to be used. Consideration should be given to the type and style of operation proposed and the type of entertainment available as this will help inform any decisions made regarding communication systems. In some circumstances a duty manager, equipped with two-way communication and a means to initiate an evacuation incorporating designated members of staff may be sufficient. We would request a full evacuation plan is provided for further assessment and comment. Special Effects

Special effects such as dry ice, smoke, pyrotechnics, lasers, strobe lighting and real flame

effects require specialists for both installation and operation. If the premises intend to use or

allow third parties to use such effects on the premises site specific risk assessments should be

carried out by the operator and the third party and we would suggest a suitable condition that

seeks our approval should be attached to the licence.

Exit Signage All exit routes should be suitably signed or detail regarding how an evacuation would be staffed should be provided for further consideration. Use of LPG for Catering

• All gas appliances should be confirmed as appropriate for use with an LPG supply.

• All gas appliances used should have been serviced by a competent gas safe registered engineer within the last twelve months.

• All gas appliances should be secured on a stable heat proof table.

• All gas appliances should be located away from any materials that could easily catch fire and should be at least 300mm from the wall of any stall structure.

• Traders should have a system in place to ensure that the gas supply is cut off in the event of the flame going out to prevent a leak of LPG. This system should be that all gas appliances are fitted with a flame failure or flame supervision device.

• Any fryers should be fitted with an automatic high temperature limiting device that limits the temperature of the fat or oil used to 250 degrees or lower.

• All LPG hoses must be in good condition and comply with BS 3212 or BSEN 1763.

• All LPG hoses should not be excessively long and should be less than 2 metres in length from the cylinder.

• All connections should be checked for leaks prior to cooking and this should be done via the use of leak detection fluid.

• All fastenings to connect hoses t appliances, cylinders etc. should be crimp fastenings (i.e. Double Ear 0 Ring clips).

• All cylinders should be turned off when not in use.

• All cylinders should be fitted with the correct pressure regulator for the gas type (i.e. propane or butane) and should comply with BS 3016 or BSEN 12864.

• All cylinders should be well ventilated.

• All cylinders should be stored upright and away from any ignition sources or flames.

• All cylinders should be located 2 metres away from any drain or gulley.

• Where cylinders are 13kg or larger they should be appropriately secured to prevent them falling over.

• All cylinders should be fitted with an automatic cut off valve. Fire Extinguishers on Catering Units All stalls should have fire extinguishers of a minimum 4 Kg or equivalent, of a suitable type for the activities carried out on the stall for example:

▪ Stall carrying out food activities including cooking – 2kg CO2 and 2kg Foam ▪ Stall carrying out food activities with no cooking – 2kg CO2 and 2kg Water. ▪ All stalls cooking food should have a suitable fire blanket. ▪ Unless new, all fire extinguishers used should have been serviced within the last 12

months.

Use of Generators

• Generators should not be overloaded and any generators used should be capable of safely supplying the electrical load placed upon it.

• Generators should be protected from adverse weather.

• Generators should have adequate ventilation at all times.

• All external plugs and sockets connected to a generator should be suitable for outdoor use.

• All generators should be located in suitable areas that will not cause hazards to nearby premises/properties/stalls, and should not be exhausted to an outside area (not into stalls).

• Where necessary generators should be suitably guarded to prevent access by unauthorised persons.

• Generators should be switched off while refuelling.

• Generators should be sited away from the general public and/or in a protective cage on firm ground.

• Generators should be diesel as this is less flammable than other fuel types.

• Electrical connections from generators should be fitted with RCD protection to 30 milliamps sensitivity.

Use of Fabrics/Coverings

• Appropriate fire retardant certification for all furnishings, curtains, fabrics and drapes used on site should be provided and in line with the relevant British Standard (generally BS EN 1101/2). These should be appropriately stored for inspection by enforcing authorities if required.

• Records and or certification of any proprietary treatment should be kept also and made available for inspection as required.

Conclusions The above list is not exhaustive but details some of the key considerations for the proposed use of the space. It is also advised that a final clearance inspection should take place prior to any major use under the licence and this should include a full walk through of the performance content so that any risks can be assessed.

Annex 1 – Mandatory conditions

1. No supply of alcohol may be made at a time when there is no designated premises

supervisor in respect of this licence.

2. No supply of alcohol may be made at a time when the designated premises supervisor

does not hold a personal licence or the personal licence is suspended.

3. Every supply of alcohol under this licence must be made or authorised by a person who

holds a personal licence.

4. (1) The responsible person must ensure that staff on relevant premises do not carry

out, arrange or participate in any irresponsible promotions in relation to the

premises.

(2) In this paragraph, an irresponsible promotion means any one or more of the

following activities, or substantially similar activities, carried on for the purpose of

encouraging the sale or supply of alcohol for consumption on the premises—

(a) games or other activities which require or encourage, or are designed to require

or encourage, individuals to;

(i) drink a quantity of alcohol within a time limit (other than to drink alcohol

sold or supplied on the premises before the cessation of the period in

which the responsible person is authorised to sell or supply alcohol), or

(ii) drink as much alcohol as possible (whether within a time limit or

otherwise);

(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or

discounted fee to the public or to a group defined by a particular characteristic in

a manner which carries a significant risk of undermining a licensing objective;

(c) provision of free or discounted alcohol or any other thing as a prize to encourage

or reward the purchase and consumption of alcohol over a period of 24 hours or

less in a manner which carries a significant risk of undermining a licensing

objective;

(d) selling or supplying alcohol in association with promotional posters or flyers on,

or in the vicinity of, the premises which can reasonably be considered to

condone, encourage or glamorise anti-social behaviour or to refer to the effects

of drunkenness in any favourable manner;

(e) dispensing alcohol directly by one person into the mouth of another (other than

where that other person is unable to drink without assistance by reason of a

disability).

5. The responsible person must ensure that free potable water is provided on request to

customers where it is reasonably available.

6. (1) The premises licence holder or club premises certificate holder must ensure that

an age verification policy is adopted in respect of the premises in relation to the

sale or supply of alcohol.

(2) The designated premises supervisor in relation to the premises licence must

ensure that the supply of alcohol at the premises is carried on in accordance with

the age verification policy.

(3) The policy must require individuals who appear to the responsible person to be

under 18 years of age (or such older age as may be specified in the policy) to

produce on request, before being served alcohol, identification bearing their

photograph, date of birth and either—

(a) a holographic mark, or

(b) an ultraviolet feature.

7. The responsible person must ensure that—

(a) where any of the following alcoholic drinks is sold or supplied for consumption on

the premises (other than alcoholic drinks sold or supplied having been made up

in advance ready for sale or supply in a securely closed container) it is available

to customers in the following measures—

(i) beer or cider: ½ pint;

(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

(iii) still wine in a glass: 125 ml;

(b) these measures are displayed in a menu, price list or other printed material

which is available to customers on the premises; and

(c) where a customer does not in relation to a sale of alcohol specify the quantity of

alcohol to be sold, the customer is made aware that these measures are

available.

A responsible person in relation to a licensed premises means the holder of the premise licence

in respect of the premises, the designated premises supervisor (if any) or any individual aged

18 or over who is authorised by either the licence holder or designated premises supervisor.

For premises with a club premises certificate, any member or officer of the club present on the

premises in a capacity that which enables him to prevent the supply of alcohol.

8(i) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or

off the premises for a price which is less than the permitted price.

8(ii) For the purposes of the condition set out in paragraph 8(i) above -

(a) "duty" is to be construed in accordance with the Alcoholic Liquor Duties Act

1979;

(b) "permitted price" is the price found by applying the formula -

Where -

(i) P is the permitted price,

(ii) D is the amount of duty chargeable in relation to the alcohol as if the duty

were charged on the date of the sale or supply of the alcohol, and

(iii) V is the rate of value added tax chargeable in relation to the alcohol as if

the value added tax were charged on the date of the sale or supply of the

alcohol;

(c) "relevant person" means, in relation to premises in respect of which there is in

force a premises licence -

(i) the holder of the premises licence,

(ii) the designated premises supervisor (if any) in respect of such a licence,

or

(iii) the personal licence holder who makes or authorises a supply of

alcohol under such a licence;

(d) "relevant person" means, in relation to premises in respect of which there is in

force a club premises certificate, any member or officer of the club present on the

premises in a capacity which enables the member or officer to prevent the supply

in question; and

(e) "value added tax" means value added tax charged in accordance with the Value

Added Tax Act 1994.

8(iii). Where the permitted price given by Paragraph 8(ii)(b) above would (apart from this

paragraph) not be a whole number of pennies, the price given by that sub-paragraph

shall be taken to be the price actually given by that sub-paragraph rounded up to the

nearest penny.

8(iv). (1) Sub-paragraph 8(iv)(2) below applies where the permitted price given by

Paragraph 8(ii)(b) above on a day ("the first day") would be different from the

permitted price on the next day ("the second day") as a result of a change to the

rate of duty or value added tax.

(2) The permitted price which would apply on the first day applies to sales or

supplies of alcohol which take place before the expiry of the period of 14 days

beginning on the second day.

Annex 2 – Conditions consistent with the operating Schedule 9. The Licence Holder shall ensure that the details of all complaints are recorded in an

occurrence book and such book shall be available for police inspection 10. Clearly legible notices shall be displayed at all exits from the premises requesting

patrons to respect the needs of local residents and to leave the premises and area quietly.

11. A dedicated telephone number for the Designated Premises Supervisor or the duty

manager shall be maintained for use by any person who may wish to make a complaint. 12. A documented staff training programme shall be provided to key members of staff at the

premises in respect of the :-

• Age verification policy

• The licensing objectives

• Opening times for the venue 13. Food and non-intoxicating beverages, including drinking water, shall be available in all

parts of the premises where alcohol is sold or supplied for consumption on the premises. 14. No noise generated on the premises, or by its associated plant or equipment, shall

emanate from the premises nor vibration be transmitted through the structure of the premises which gives rise to a nuisance.

15. There shall be no sales of hot food or hot drink for consumption off the premises 16. There shall be no striptease or nudity, and all persons shall be decently attired at all

times, except when the premises are operating under the authority of a Sexual Entertainment Venue licence.

17. The approved arrangements at the premises, including means of escape provisions,

emergency warning equipment, the electrical installation and mechanical equipment, shall at all material times be maintained in good condition and full working order.

18. The means of escape provided for the premises shall be maintained unobstructed, free

of trip hazards, be immediately available and clearly identified in accordance with the plans provided

19. All emergency exit doors shall be available at all material times without the use of a key,

code, card or similar means. 20. All emergency doors shall be maintained effectively self closing and not held open other

than by an approved device. 21. The edges of the treads of steps and stairways shall be maintained so as to be

conspicuous. 22. The premises shall install and maintain a comprehensive CCTV system as per the

minimum requirements of the Westminster Police Licensing Team. All entry and exit points will be covered enabling frontal identification of every person entering in any light condition. The CCTV system shall continually record whilst the premises is open for licensable activities and during all times when customers remain on the premises. All recordings shall be stored for a minimum period of 21 days with date and time stamping. Viewing of recordings shall be made available immediately upon the request of Police or authorised officer throughout the entire 21 day period.

23. A staff member from the premises who is conversant with the operation of the CCTV

system shall be on the premises at all times when the premises are open for licensable activities. This staff member must be able to provide a Police or authorised council officer copies of recent CCTV images or data with the absolute minimum of delay when requested.

24. Notices shall be prominently displayed at all exits requesting patrons to respect the

needs of local residents and businesses and leave the area quietly. 25. Notices shall be prominently displayed at any area used for smoking requesting patrons

to respect the needs of local residents and use the area quietly. 26. Admission to the Licensed areas shall be through the premises lobby area only 27. Challenge 21 proof of age scheme shall be operated at the premises where the only

acceptable forms of identification are recognised photographic identification cards, such as a driving licence, passport or proof of age card with the PASS Hologram.

28. A record shall be kept detailing all refused sales of alcohol. The record should include

the date and time of the refused sale and the name of the member of staff who refused the sale. The record shall be available for inspection at the premises by the police or an authorised officer of the City Council at all times whilst the premises are open.

29. An incident log shall be kept at the premises, and made available on request to an

authorised officer of the City Council or the Police. It must be completed on the day of the incident and will record the following: (a) all crimes reported to the venue (b) all ejections of patrons (c) any complaints received concerning crime and disorder (d) any incidents of disorder (e) all seizures of drugs or offensive weapons (f) any faults in the CCTV system. (g) any refusal of the sale of alcohol (h) any visit by a relevant authority or emergency service

30. Patrons permitted to temporarily leave and then re-enter the premises, e.g. to smoke,

shall not be permitted to take drinks or glass containers with them. 31. In the event that a serious assault is committed on the premises (or appears to have

been committed) the management will immediately ensure that:

(a) The police (and, where appropriate, the London Ambulance Service) are called without delay;

(b) All measures that are reasonably practicable are taken to apprehend any suspects pending the arrival of the police;

(c) The crime scene is preserved so as to enable a full forensic investigation to be carried out by the police; and

(d) Such other measures are taken (as appropriate) to fully protect the safety of all persons present on the premises

32. Alcohol shall only be sold for consumption by persons attending a pre-booked and bona

fide private function or event to which members of the public are not admitted. A register of persons attending the event shall be kept at the premises and made available for immediate inspection by police or an authorised officer of the Council.

(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

9. Admission of children to the premises must be restricted in accordance with the film

classification recommended by the British Board of Film Classification or recommended by this licensing authority as appropriate.

Annex 2 – Conditions consistent with the operating Schedule 10. The Licence Holder shall ensure that the details of all complaints are recorded in an

occurrence book and such book shall be available for police inspection 11. Clearly legible notices shall be displayed at all exits from the premises requesting

patrons to respect the needs of local residents and to leave the premises and area quietly.

12. A dedicated telephone number for the Designated Premises Supervisor or the duty

manager shall be maintained for use by any person who may wish to make a complaint. 13. A documented staff training programme shall be provided to key members of staff at the

premises in respect of the :- a) Age verification policy b) The licensing objectives c) Opening times for the venue

14. Food and non-intoxicating beverages, including drinking water, shall be available in all parts of the premises where alcohol is sold or supplied for consumption on the premises.

15. No noise generated on the premises, or by its associated plant or equipment, shall

emanate from the premises nor vibration be transmitted through the structure of the premises which gives rise to a nuisance.

16. There shall be no striptease or nudity, and all persons shall be decently attired at all

times, except when the premises are operating under the authority of a Sexual Entertainment Venue licence.

17. The approved arrangements at the premises, including means of escape provisions,

emergency warning equipment, the electrical installation and mechanical equipment, shall at all material times be maintained in good condition and full working order.

18. The means of escape provided for the premises shall be maintained unobstructed, free

of trip hazards, be immediately available and clearly identified in accordance with the plans provided

19. All emergency exit doors shall be available at all material times without the use of a key,

code, card or similar means. 20. All emergency doors shall be maintained effectively self-closing and not held open other

than by an approved device. 21. The edges of the treads of steps and stairways shall be maintained so as to be

conspicuous. 22. The premises shall install and maintain a comprehensive CCTV system as per the

minimum requirements of the Westminster Police Licensing Team. All entry and exit points will be covered enabling frontal identification of every person entering in any light condition. The CCTV system shall continually record whilst the premises is open for licensable activities and during all times when customers remain on the premises. All recordings shall be stored for a minimum period of 31 days with date and time stamping. Viewing of recordings shall be made available immediately upon the request of Police or authorised officer throughout the entire 31 day period.

23. A staff member from the premises who is conversant with the operation of the CCTV

system shall be on the premises at all times when the premises are open for licensable

activities. This staff member must be able to provide a Police or authorised council officer copies of recent CCTV images or data with the absolute minimum of delay when requested.

24. Notices shall be prominently displayed at all exits requesting patrons to respect the

needs of local residents and businesses and leave the area quietly. 25. Notices shall be prominently displayed at any area used for smoking requesting patrons

to respect the needs of local residents and use the area quietly. 26. Admission to the Licensed areas shall be via a security desk 27. Challenge 25 proof of age scheme shall be operated at the premises where the only

acceptable forms of identification are recognised photographic identification cards, such as a driving licence, passport or proof of age card with the PASS Hologram.

28. A record shall be kept detailing all refused sales of alcohol. The record should include

the date and time of the refused sale and the name of the member of staff who refused the sale. The record shall be available for inspection at the premises by the police or an authorised officer of the City Council at all times whilst the premises are open.

29. An incident log shall be kept at the premises and made available on request to an

authorised officer of the City Council or the Police. It must be completed on the day of the incident and will record the following:

a) all crimes reported to the venue b) all ejections of patrons c) any complaints received concerning crime and disorder d) any incidents of disorder e) all seizures of drugs or offensive weapons f) any faults in the CCTV system. g) any refusal of the sale of alcohol h) any visit by a relevant authority or emergency service

30. Patrons permitted to temporarily leave and then re-enter the premises, e.g. to smoke, shall not be permitted to take drinks or glass containers with them, other than in the designated external area on the ground floor.

31. In the event that a serious assault is committed on the premises (or appears to have

been committed) the management will immediately ensure that:

a) The police (and, where appropriate, the London Ambulance Service) are called without delay; b) All measures that are reasonably practicable are taken to apprehend any suspects pending the arrival of the police; c) The crime scene is preserved so as to enable a full forensic investigation to be carried out by the police; and d) Such other measures are taken (as appropriate) to fully protect the safety of all persons present on the premises

32. Alcohol shall only be sold for consumption by persons attending a pre-booked and bona

fide private function or event to which members of the public are not admitted. A register of persons attending the event shall be kept at the premises and made available for immediate inspection by police or an authorised officer of the Council.

33. The licensable activities authorised by this licence and provided at the premises shall be

ancillary to the main function of the premises as an educational institution.

34. There shall be no events involving licensable activities organised by an external promoter at the premises.

Appendix 4 CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE AND CONDITIONS PROPOSED BY A PARTY TO THE HEARING When determining an application for a new premises licence under the provisions of the Licensing Act 2003, the licensing authority must, unless it decides to reject the application, grant the licence subject to the conditions which are indicated as mandatory in this schedule. At a hearing the licensing authority may, in addition, and having regard to any representations received, grant the licence subject to such conditions which are consistent with the operating schedule submitted by the applicant as part of their application, or alter or omit these conditions, or add any new condition to such extent as the licensing authority considers necessary for the promotion of the licensing objectives. This schedule lists those conditions which are consistent with the operating schedule, or proposed as necessary for the promotion of the licensing objectives by a responsible authority or an interested party as indicated. These conditions have not been submitted by the licensing service but reflect the positions of the applicant, responsible authority or interested party and have not necessarily been agreed Mandatory Conditions 1. No supply of alcohol may be made at a time when there is no designated premises

supervisor in respect of this licence. 2. No supply of alcohol may be made at a time when the designated premises supervisor

does not hold a personal licence or the personal licence is suspended. 3. Every supply of alcohol under this licence must be made or authorised by a person who

holds a personal licence. 4. (1) The responsible person must ensure that staff on relevant premises do not carry

out, arrange or participate in any irresponsible promotions in relation to the premises.

(2) In this paragraph, an irresponsible promotion means any one or more of the

following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises—

(a) games or other activities which require or encourage, or are designed to require

or encourage, individuals to;

(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

(ii) drink as much alcohol as possible (whether within a time limit or otherwise);

(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or

discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

(c) provision of free or discounted alcohol or any other thing as a prize to encourage

or reward the purchase and consumption of alcohol over a period of 24 hours or

less in a manner which carries a significant risk of undermining a licensing objective;

(d) selling or supplying alcohol in association with promotional posters or flyers on,

or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

(e) dispensing alcohol directly by one person into the mouth of another (other than

where that other person is unable to drink without assistance by reason of a disability).

5. The responsible person must ensure that free potable water is provided on request to

customers where it is reasonably available. 6. (1) The premises licence holder or club premises certificate holder must ensure that

an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

(2) The designated premises supervisor in relation to the premises licence must

ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

(3) The policy must require individuals who appear to the responsible person to be

under 18 years of age (or such older age as may be specified in the policy) to

produce on request, before being served alcohol, identification bearing their

photograph, date of birth and either—

(a) a holographic mark, or

(b) an ultraviolet feature.

7. The responsible person must ensure that—

(a) where any of the following alcoholic drinks is sold or supplied for consumption on

the premises (other than alcoholic drinks sold or supplied having been made up

in advance ready for sale or supply in a securely closed container) it is available

to customers in the following measures—

(i) beer or cider: ½ pint;

(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

(iii) still wine in a glass: 125 ml;

(b) these measures are displayed in a menu, price list or other printed material

which is available to customers on the premises; and (c) where a customer does not in relation to a sale of alcohol specify the quantity of

alcohol to be sold, the customer is made aware that these measures are available.

A responsible person in relation to a licensed premises means the holder of the premise licence in respect of the premises, the designated premises supervisor (if any) or any individual aged 18 or over who is authorised by either the licence holder or designated premises supervisor. For premises with a club premises certificate, any member or officer of the club present on the premises in a capacity that which enables him to prevent the supply of alcohol.

8(i) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or

off the premises for a price which is less than the permitted price. 8(ii) For the purposes of the condition set out in paragraph 8(i) above -

(a) "duty" is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

(b) "permitted price" is the price found by applying the formula -

P = D+(DxV)

Where -

(i) P is the permitted price, (ii) D is the amount of duty chargeable in relation to the alcohol as if the duty

were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if

the value added tax were charged on the date of the sale or supply of the alcohol;

(c) "relevant person" means, in relation to premises in respect of which there is in

force a premises licence -

(i) the holder of the premises licence, (ii) the designated premises supervisor (if any) in respect of such a licence,

or (iii) the personal licence holder who makes or authorises a supply of

alcohol under such a licence;

(d) "relevant person" means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

(e) "value added tax" means value added tax charged in accordance with the Value

Added Tax Act 1994. 8(iii). Where the permitted price given by Paragraph 8(ii)(b) above would (apart from this

paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

8(iv). (1) Sub-paragraph 8(iv)(2) below applies where the permitted price given by

Paragraph 8(ii)(b) above on a day ("the first day") would be different from the permitted price on the next day ("the second day") as a result of a change to the rate of duty or value added tax.

(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

Conditions consistent with the operating schedule 9. Substantial food and non-intoxicating beverages, including drinking water, shall be

available in all parts of the premises where alcohol is sold or supplied for consumption on the premises.

10. There shall be no permanent fixed bar/s in licensed space. 11. Alcohol shall be ancillary to the main use as an event space used by the London School

of Economics. 12. In the licensed space there shall be a maximum of 12 'major events' in any 12-month

period. A 'major event' is triggered when any of the following takes place:

▪ A capacity of over 500 persons

▪ Persons are in attendance beyond 23:00 hours

▪ Temporary structures are present which require Building Control approval

▪ The music level is audible at the site boundary

▪ Events that use WCC land

13. A record of these events shall be kept on site for a minimum of one year and be made

available for inspection by an authorised officer. 14. Save for the 'major events' no amplified music shall be audible at the site boundary. 15. At a ‘major event’ the Music Noise Level shall not at 1 metre from the façade of any

noise sensitive premises exceed the background noise level by more than 15dB(A)over a 15 minute period throughout the duration of the event.

16. For any event that operates beyond 23:00 hours (with the exception of the Summer Ball

where this condition shall apply where the event operates beyond midnight) there shall be no music noise audible within noise sensitive premises with windows open in a typical manner for ventilation.

In relation to condition 16 Environmental Health proposes to amend the condition to the following:

There shall be no music noise audible within noise sensitive premises with windows open in a typical manner for ventilation for any event that operates beyond 23:00 hours (save for the Summer Ball where this condition shall apply from midnight). In relation to condition 16 proposes to amend the condition to the following which is agreed by the applicant: For all major events no music noise shall be audible within noise sensitive premises with windows open in a typical manner for ventilation after 23:00 (save for the Summer Ball where this will apply after 00:00).

17. For a ‘major event’ unless otherwise agreed, no later than 28 days prior to the event, the

Premises Licence holder must ensure an Event Management Plan is presented to the Environmental Health Consultation Team, The Westminster Licensing Police and The City Promotions Events and Filming Team for their comments. The Event Management Plan shall include, as a minimum:

i) Emergency and evacuation procedures ii) Crowd management and stewarding arrangements iv) A detailed site plan showing all permanent and temporary structures and all

access and egress points v) Capacity at any one time vi) Certificates from competent persons on Structures, Electrical Power Supply

and Gas equipment (including LPG)

vii) First Aid and Lost Children arrangements viii)Noise Management Plan including details of resident engagement ix) Risk Assessments x) A waste management plan

xi) Sanitary accommodation

xiii) The setup and break down arrangements for the event xiv) The dispersal of customers at the end of the event.

18. For all other event an Event Management Plan detailing the points above shall be written and kept for at least one year and made available to authorised officers if requested.

19. So far as is reasonably practicable the Premises Licence Holder shall ensure that the event is run in accordance with the Event Management Plan.

20. In the licensed space the maximum number of persons accommodated at any one time

shall not exceed 1000 persons (as agreed with the District Surveyor). 21. For a 'major event' the Event Manager or his authorised representative shall be

responsible for liaising with local residents and organisations to notify them at least 14 days in advance and providing them with a complaints `hotline' telephone number, for any licensable activity taking place in the licensed space.

22. The licence holder shall ensure that any queue to enter the licensed space which forms

outside the premises is orderly and supervised by door staff so as to ensure that there is no public nuisance or obstruction to the public highway.

23. When temporary seating is provided within the licensed space the following

arrangements shall be complied with:

• Where the number of seats exceed 50, seats should be secured together in

lengths of not less than 4.

• Where the number of seats exceed 250, seats should be secured together in

rows and fix the ends of the rows to the floor or to each other by using chamfered

bars.

• Where the number of seats exceed 600, fix all seats individually to the floor.

24. There shall be no striptease or nudity, and all persons shall be decently attired at all

times, except when the premises are operating under the authority of a Sexual Entertainment Venue licence.

25. During the hours of operation of the premises, the licence holder shall ensure sufficient

measures are in place to remove and prevent litter or waste arising or accumulating from customers in the area immediately outside the premises, and that this area shall be swept and or washed, and litter and sweepings collected and stored in accordance with the approved refuse storage arrangements by close of business.

26. A direct telephone number for the manager at the premises shall be publicly available at

all times the premises is open. This telephone number is to be made available to residents and businesses in the vicinity.

27. Flashing or particularly bright lights on or outside the premises shall not cause a

nuisance to nearby premises. 28. In the absence of daylight there will be sufficient lighting installed whilst the premises are

open to the public.

29. The edge of the treads of steps and stairways shall be maintained so as to be

Details of the personal licence holder (including name and contact number) shall be displayed in a prominent position on site.

31. No alcohol shall be taken outside of the boundary of the licensable area. 32. No hot food or hot drinks shall be taken off site beyond 23:00 hours. 33. Notices shall be prominently displayed at all exits requesting patrons to respect the

needs of local residents and businesses and leave the area quietly. 34. A Challenge 25 proof of age scheme shall be operated at the premises where the only

acceptable forms of identification are recognised photographic identification cards, such as a driving licence, passport or proof of age card with the PASS Hologram.

35. A record shall be kept detailing all refused sales of alcohol. The record should include

the date and time of the refused sale and the name of the member of staff who refused the sale. The record shall be available for inspection at the premises by the police or an authorised officer of the City Council at all times whilst the premises is open.

36. An incident log shall be kept at the premises, and made available on request to an

authorised officer of the City Council or the Police. It must be completed within 24 hours of the incident and will record the following:

i. all crimes reported to the venue ii. all ejections of patrons iii. any complaints received concerning crime and disorder iv. any incidents of disorder v. all seizures of drugs or offensive weapons vi. any refusal of the sale of alcohol vii. any formal visit by a relevant authority or emergency service.

37. Any special effects or mechanical installations shall be arranged, operated and stored so

as to minimise any risk to the safety of those using the premises. The following special effects will only be used on 10 days prior notice being given to the licensing authority where consent has not previously been given.

• dry ice and cryogenic fog

• smoke machines and fog generators

• pyrotechnics including fireworks

• firearms

• lasers

• explosives and highly flammable substances.

• real flame.

• strobe lighting.

38. No person shall give at the premises any exhibition, demonstration or performance of

hypnotism, mesmerism or any similar act or process which produces or is intended to produce in any other person any form of induced sleep or trance in which susceptibility of the mind of that person to suggestion or direction is increased or intended to be increased. NOTE: (1) This rule does not apply to exhibitions given under the provisions of Section 2(1A) and 5 of the Hypnotism Act 1952.

39. The approved arrangements at the premises, including means of escape provisions, emergency warning equipment, the electrical installation and mechanical equipment, shall at all material times be maintained in good condition and full working order.

40. The means of escape provided for the premises shall be maintained unobstructed, free

of trip hazards, be immediately available and clearly identified in accordance with the plans provided.

41. Emergency exits and entrances to the event area must be kept clear at all times and

must be provided with clearly visible signage. 42. All parts of the licensed area intended to be used in the absence of adequate daylight

and all essential safety signage shall be suitably illuminable. Details of the locations and level of illumination must be detailed in the Event Management Plan.

43. The edges of the treads of steps and stairways shall be maintained so as to be conspicuous.

44. Curtains and hangings shall be arranged so as not to obstruct emergency safety signs

or emergency equipment. 45. All fabrics, curtains, drapes and similar features including materials used in finishing and

furnishing shall be either non-combustible or be durably or inherently flameretarded fabric. Any fabrics used in escape routes, entertainment areas, shall be non- combustible.

46. All fabric, including curtains and drapes used on stage for tents and marquees, or plastic

and weather sheeting, shall be inherently or durably flame retardant to the relevant British Standards. Certificates of compliance must be available upon request by an authorised officer of Westminster City Council, The London Fire Brigade.

47. Any moving flown equipment must contain a device or method whereby failure in the

lifting system would not allow the load to fall. All hung scenery and equipment must be provided with a minimum of two securely fixed independent suspensions such that in the event of failure of one suspension the load shall be safely sustained.

48. The certificates listed below shall be submitted to the licensing authority upon written

request:

• Any permanent or temporary emergency lighting battery or system

• Any permanent or temporary electrical installation

• Any permanent or temporary emergency warning system

49. No waste or recyclable materials, including bottles, shall be moved, removed from or

placed in outside areas between 23.00 hours and 07.00 hours on the following day. 50. No deliveries to the premises shall take place between 23.00 and 07.00 on the following

day. 51. No fumes, steam or odours shall be emitted from the licensed area so as to cause a

nuisance to any persons living or carrying on business in the area where the premises are situated.

52. A sufficient number of easily identifiable, readily accessible receptacles for refuse must

be provided, including provisions for concessions. Arrangements must be made for regular collection. Public areas must be kept clear of refuse and other combustible waste prior to, and so far as is reasonably practicable, during the licensed event.

53. There shall be no noise audible at the nearest noise sensitive premises from any construction or similar works in association with the set up and dismantling of the site, outside the hours of:

08:00 - 18:00 Monday -Saturday 08:00 - 13:00 Sunday

54. Any generators, refrigerators or other machinery running overnight will be silenced,

screened or sited so as not to be audible outside the boundary of the Gardens. 55. Electrical generators, where used, must be:

• Suitably located clear of buildings, marquees and structures, and free from

flammable materials;

• Enclosed to prevent unauthorised access;

• Able to provide power for the duration of the event;

• Backed up electrical generators are to be provided to power essential

communications, lighting and safety systems in the event of primary

generator failure.

56. Details of all marquees, tented structures and temporary structures should be provided

including emergency exits and signage, fire warning and fire fighting equipment. 57. Full structural design details and calculations of all and any structures to be erected

within the licensed area must be submitted to the Westminster City Council Building Control. A certificate from a competent person or engineer that a completed structure has been erected in accordance with the structural drawings and design specification must be available for inspection prior to a relevant structure being used during the licensed event.

58. The Premises Licence Holder must ensure that competent persons are employed to

assess the electrical requirements at the event and the compatibility of the electricity supply with the equipment to be used. Appropriate safety devices (such as 30mA Residual Current Devices at Source) must be used for electrical apparatus, particularly for any electrical equipment exposed to adverse conditions or electrical equipment to be used in association with hand held devices (e.g. microphones). The competent person must make a certificate of inspection of the electrical installation available for inspection.

59. All spare fuel, including LPG, must be kept and stored safely in accordance with relevant

Health and Safety legislation and suitable safety signage and fire fighting equipment provided.

60. The premises shall install and maintain a comprehensive CCTV system as per the

minimum requirements of the Westminster Police Licensing Team. All entry will be covered enabling frontal identification of every person entering in any light condition. The CCTV system shall continually record whilst the premises is open for licensable activities and during all times when customers remain on the premises. All recordings shall be stored for a minimum period of 31 days with date and time stamping. Viewing of recordings shall be made available immediately upon the request of Police or authorised officer throughout the entire 31 day period.

61. A staff member from the premises who is conversant with the operation of the CCTV

system shall be on the premises at all times when the premises is open. This staff member must be able to provide a Police or authorised council officer copies of recent CCTV images or data with the absolute minimum of delay when requested.

City Promotions, Events & Filming team has being sought and confirmed. Conditions proposed by the Police and agreed with the applicant so as to form part of the operating schedule

63. For major events

a) All drinking vessels used in the venue shall be polycarbonate. All drinks in glass

bottles are to be decanted into polycarbonate containers or polycarbonate

carafes prior to being served, with the exception of champagne or bottles of

spirits with a minimum size of 70cl supplied by waiter/waitress service to tables.

Staff shall clear all empty champagne and spirit bottles promptly from the tables.

Customers shall not be permitted to leave their table carrying any such glass

bottles or drink directly from the bottle.

b) Notwithstanding a) above, with the written agreement of the Westminster

Licensing Police, a copy of which will be held at the premises reception, glass

drinking vessels may be used for private or pre-booked events within the

(specified area).

64. Tickets for major events will only be issued to students, staff, alumni and their guests

(limited to one guest per student, member of staff or alumni) and a record will be kept of

all persons purchasing tickets for at least 30 days after an event.

65. All persons entering or re-entering the premises who are attending the Summer Ball

event, shall have their bags searched by a SIA licensed member of staff

66. At a 'major event', a minimum of 2 SIA licensed door supervisors for the first 100

customers and on a ratio of 1:100 thereafter, shall be on duty at the premises at all times

for the duration of the event. At least two SIA licensed door supervisors shall be on duty

at each entrance of the premises at all times when it is open for licensable activities and

adequate stewarding within the licensed area must be provided at all times. Staff shall

be clearly identifiable as security staff and with their SIA ID being displayed.
