Gordon Sommerville Since the Family Law (Scotland) Act 2006 the days

of an unmarried couple setting up home together

with no legal rights or obligations came to an end.

There has not been a huge amount of publicity

about the new rights for cohabiting couples

although it is known that over 150,000 couples are

cohabiting in Scotland.

The Act defines a

“cohabitant” as a person

who is or was living with

another person as if they

were husband and wife, or 2 persons of the same

sex who are or were living together as if they were

civil partners. However, the Courts when

determining whether a person is a cohabitant of

someone else take regard of (a) the length of the

period during which they live together, (b) the

nature of the relationship during that period and

(c) the nature and extent of any financial

arrangement subsisting or which subsisted during

that period.

The legislation allows a cohabitant to apply for

financial provision following the separation. The

applicant can apply to the Court for an order for

payment of a capital sum for their own benefit

and/or a further sum to reflect the burden of

having to care for a child who is either a child of

both of the parties or a child who has been

accepted as a child of the

family.

However, one of the main

changes relates to when one

cohabitant dies intestate

(i.e. without making a Will). If the deceased

cohabitant has made a Will the law remains

unchanged. However, if the position is one of

intestacy the survivor may apply for a financial

provision out of the deceased’s estate which can

take the form of a capital sum or a property

transfer out of the deceased’s net intestate

estate. A lump sum or instalments are both

competent.

The Court will consider the

size and nature of the estate,

any benefit received or to be

received by the survivor, any

other claims on the estate

such as those of the

deceased’s children and any other matters which

the Court considers to be appropriate. The Court

also cannot make an award awarding the survivor

a higher amount that they would have had right to

had the parties been married (or in a Civil

Partnership). Any order for payment of a capital

sum or transfer of property must be made from

the deceased’s net estate after payment of any

inheritance tax, debts and satisfaction of any

prior or legal right claims of the surviving

spouse/civil partner.

The new provisions probably strengthen the

argument that everybody should make a Will.

It is also important to note that any application to

the Court must be brought within six months of

the date of death.

It will be interesting to see how the Courts deals

with interpreting this legislation over the coming

years.

Hairy Bikers: Larger Than Live

It’s now been over two years since we did our last

stage tour, a complete sell-out and one of the best

times of our lives. It’s for those reasons that we can’t

wait to do it all over again; only this time it’s going to

be bigger, bolder, funnier, and packed with more

food and laughs than ever before. We like to do things

just giving you a show, we’re giving you a real night

One Man, Two Guvnors

13th - 17th November

Actor, stand-up comedian and presenter Rufus Hound

will lead the cast in Nicholas Hytner’s five star

award-winning production of One Man, Two Guvnors

when the National Theatre's West End and now

Broadway hit comes to Glasgow. Rufus will play the

lead role of Francis Henshall.

Richard Bean’s award-winning play is a glorious

celebration of British comedy: a unique,

laugh-out-loud mix of satire, songs, slapstick and

glittering one-liners.

Fired from his skiffle band, Francis Henshall becomes

minder to Roscoe Crabbe but Roscoe is really Rachel,

posing as her own dead brother who’s been killed by

her boyfriend Stanley Stubbers. Francis spots the

chance of an extra meal ticket and takes a job with

one Stanley Stubbers. To prevent discovery Francis

must keep his two guvnors apart. Simple.

Eddi Reader

within a year. Another means of introduction can be via spore

transferrence from clothing, pets, shoes etc.

More modern houses, with treated timbers, are far more

resistant to attack than older untreated properies, but, as I've

personally witnessed, it can still happen. And, a word of

warning...many people are under the impression that their

buildings insurance will cover them. It won't. Unless you have a

speciallist policy specifying dry rot cover (and a detailed survey

of your home would be required before the policy would be

accepted) you will have to cover the cost yourself. Could

this possibly get any worse? Well,

unfortunately, yes. If your home is a

�at, mid/end terrace etc, you could

be liable to pay for any damage

caused to adjoining property if it

can be demonstrated that the

source came from you.

I don't mean to be a scare-monger,

really I don't. I'd just rather that if you

have any suspicions whatsoever, do something about it sooner

rather than later. Give me a call and I might be able to save you

thousands by nipping it in the bud. If you've got rot, I'll tell you. If

you don't, I'll tell you. All my dry rot remedial work is

chemically treated and guaranteed.

And, feel free to call me with any other joinery work you need

done, regardless of how small a job it is.

Hello to you all!

As some of you may be unlucky enough to recall, I used to

regularly write in these pages.

It's been a few years since, and I thought it was high time I

subjected you to some more drivel. I still do all of the things I

used to (from tiny jobs to kitchens, windows, extensions,

etc). But what better way to start than with the cheery topic of

dry rot.

When I was around 20, I worked with a company that dealt

solely in the treatment of woodworm, dampness, wet rot and

dry rot. I stayed with that company

forabout 4 years and saw countless

instances of the devastation these

topics can cause if left untreated. In

my experience though, by far the

worst o�ender is dry rot.

Allow me to brie�y explain what dry

rot actually is: it's a living plant-like

thing, like a fungal cancer, and like

most living things it needs air and moisture to survive. It initially

attacks a small area and develops a fruited body, from which

vein like strands grow in any direction. These strands go in

search of moisture, and timber, with it's natural healthy moisture

content, is an ideal source of nourishment. The strands suck all

the moisture out of the healthy timber (hence 'dry' rot) leaving it

cuboid and brittle. Brick walls o�er no protection either...the

strands will seek out tiny gaps and work their way through.

In order for it to attack any property, it has to be somehow

'introduced' in the �rst place. Think on it like dandelion seeds

randomly blowing in the wind. Some seeds will land in areas

unsuitable for growth, others will land in areas with ideal growth

conditions (darkness, moisture supply and low air �ow). It's a

scary thought, but given these ideal conditions undetected

(and it likes to hide), it can destroy a perfectly healthy home
