From the desk of the Administrative/Presiding Judge

As Presiding Judge of the Lima Municipal Court, I have served this court in that capacity since 2015. Judge David A. Rodabaugh will be the Presiding Judge during 2020. I know he will do an excellent job in guiding the Lima Municipal Court. This year was the beginning stage of the Lima Smart City Initiative for the Court, Prosecutors and the Lima Police Department. The Court normalized and converted our software data to SQL in order to research a new software system. One of the Court’s top priority is to implement electronic filing and hope to do so as soon as possible when technologically and economically feasible. The Lima Municipal Court hears misdemeanor criminal and traffic charges, which arise from violations of state code and municipal ordinances throughout Allen County, Ohio. It also hears civil cases arising throughout Allen County, Ohio. Those civil cases involve breaches of both oral and written contracts, tortious activity and forcible entry and detainer (evictions) actions. The Civil Division of the Court also has a Small Claims Division that hears contract and tort cases involving damages of no more than $6,000. The Court also hears appeals and petitions from actions of the Bureau of Motor Vehicles which arise in Allen County, Ohio. As you review the Court’s statistical figures, you will see that the charge of Operating Under the Influence (OVI) figures reflect a little differently. I would like to give you a quick overview of this particular charge. Operating Under the Influence (OVI) can be a multi-faceted case. Depending on the circumstances, there can be several types of OVI charges filed against a defendant for the same OVI case. However, by law, a defendant can be sentenced only for one charge of OVI per case since it is out of the same event. Therefore, when a prosecutor is handling any OVI case their goal is to have the defendant be held responsible for the highest level OVI charge available that would sustain a conviction, based on the evidence of the case. The “other” OVI charges will normally then not be prosecuted. It is also important to note that not only do these offenses put the public at risk but many of these charges carry with them mandatory jail sentences, as do driving under an OVI suspension, and account for a substantial portion of our jail population. The numerical figures, which follow, will tell the statistical story of the Lima Municipal Court for 2019. They do not express the dedication, which the employees of this court show daily in the performance of their duties. I hope this letter can adequately convey my admiration for them.

The Lima Municipal Treatment Court was established by Judge Tammie K. Hursh

when she held its inaugural status hearing on July 16, 2015. Initial certification of

this docket followed relatively quickly on September 15, 2015. And final

certification was granted by the Ohio Supreme Court on December 11, 2015.

Certification has been consistently maintained with the most recent recertification

being approved September 2019. From January 1, 2019 through December 31, 2019

Judge Hursh added twelve (12) new participants to the treatment court docket.

During this period she also approved the successful completion of seven (7)

participants while three (3) additional participants were unsuccessfully terminated

from the program.

On September 22, 2016 Judge David A. Rodabaugh expanded the treatment court

program at Lima Municipal Court when he held his initial status hearing. The Ohio

Supreme Court granted final certification for the additional docket on June 16,

2017. During the 2019 calendar year, Judge Rodabaugh added fifteen (15)

participants to the treatment court. Out of the twenty four (24) participants that

were involved in 2019 Judge Rodabaugh approved the successful completion of one

(1) and unsuccessfully terminated eight (8) participants.

Status hearings continue to follow treatment team meetings for their respective

dockets. At the treatment team meetings all members provide updates on the status

of participants, consider appropriate resources to meet challenges and barriers, as

well as address any issues of non-compliance or necessary areas of improvement.

In summary of both Treatment Court dockets for 2019: twenty-seven (27) new

participants began the program and 1,752 drug screens were conducted with fifty-

three (53) of those being positive. Judge Hursh ended 2019 with eighteen (18)

participants on the docket while Judge Rodabaugh maintained sixteen (16)

participants.

The Lima Municipal Court Probation Department conducts all written and oral,

post and pre-sentence investigation reports ordered by the court. Additionally the

Probation Department also completes all expungements & sealing of the record

reports for the Court’s review.

Probation releases are divided into two categories:

1. Successful completion of the Probation period.

a. If a defendant has completed all terms of supervision they may be eligible

to be released early

i. As long as they have completed at least half of their supervision

time ordered.

1. As long as they are not violent offenders, or a 3rd in 10 year

OVI offender.

2. Unsuccessful terminations

a. Failure to comply with terms of Probation.

b. Absconds from supervision.

c. Receives an extended jail or prison sentence from this or any other court.

d. Failure to complete tasks ordered by the Court during the Probation

period.

Defendant may be placed on non-reporting probation for any of the following

reasons:

1. Good conduct

2. Residing out of state

3. Receiving dual supervision from another Probation department

4. Ordered to non-reporting probation at sentencing

Since December of 1997, the Lima Municipal Court has contracted with the Allen

County Court of Common Pleas for Intensive Probation services. It should be noted

that this contract was re-signed by the seated Judges from both courts in November

of 2014. The program is designed to supervise defendants classified as moderate or

higher on the Ohio Risk Assessment System-Community Supervision Tool. The

intensive Probation Officer will carry a significantly smaller caseload, allowing

more contact with offenders.

The Lima Municipal Court currently has 28 defendants being supervised through

the Allen County Common Pleas Intensive Probation Department. If the defendant

successfully completes intensive probation, they may be referred back to the Lima

Municipal Court Probation Department for traditional supervision for the balance

of their Probation period. Upon successful completion of intensive probation

defendants may also be successfully completed from probation.

The Court initiated the Ignition Interlock Program in September of 1987. The

Probation Department continues to monitor the Ignition Interlock Program to date.

Since 2011, the Probation Department also assists in supervising Court ordered

Electronically Monitored House Arrest as well as alcohol monitoring via the In-

Hom Breathalyzer Unit. In 2019, the Probation Department was able to continue

utilizing the S.M.A.R.T. Mobile device through Smart Start Ohio. This device allows

Officers to set timeframes in which the offender must take a breath test. The Officer

can request the defendant to test up to ten (10) times a day. The S.M.A.R.T Mobile

Device is the primary source of alcohol monitoring in this Court.

The Lima Municipal Court Probation Department continues to provide community

service opportunities for those individuals ordered to complete community service.

Community service can be ordered for the following reasons.

1. In lieu of fines

2. In lieu of jail

3. For unspecified driving offenses

The Lima Municipal Court has several agencies in the area that can be utilized for

defendants to complete community service. However it should be noted that the

most notably used agencies are the Allen County Regional Transit Authority and

the West Ohio Food Bank. There were a total of 91 people ordered by the court to

complete community service in 2019.
