1.0 Executive Summary
A Limited Phase II Environmental Site Assessment (ESA) was completed by Culpepper
and Associates, LLC during June and July 2016 at the site owned by L and M Land, LLC
in Hancock County, MS. As a result of the Macondo Canyon 252 (MC252) crude oil
spill event beginning in April 2010, contamination to the adjacent Gulf of Mexico, its
tributaries, and shorelines occurred. After multiple storm surge events in summer 2010,
some of the residual oil persisting on the shoreline near the subject site was carried inland
into the bayous, estuaries, and adjacent lands. Presence of MC252 contamination has
been established on the subject site1. Consequently, a Phase II ESA was requested by the
interest owner of the subject site, L and M Land, LLC. Limited sampling was conducted
in order to determine the present contamination condition of the soils impacted by crude
contaminated storm surge. Analytical results were screened for each chemical of concern
(COC) utilizing the lowest applicable Tier 1 Target Remediation Goal (TRG) identified
by Mississippi Department of Environmental Quality’s Risk Evaluation Procedures For
Voluntary Cleanup and Redevelopment of Brownfield Sites. The presence of
contamination below the applicable TRG was confirmed. The presence of contamination
above the applicable TRG’s was not identified by any of the samples collected. Based on
the results of this Limited Phase II ESA no further testing is recommended. The
remediation recommendations of Pardue should be completed if not already done so.
2.0 Introduction
Culpepper and Associates, LLC has completed a Limited Phase II Environmental Site
Assessment (ESA) at an approximate 6.1-acre vacant property located in Lakeshore,
Hancock County, MS on behalf of L and M Land, LLC.
The purpose of this Limited Phase II ESA was to evaluate the potential for Recognized
Environmental Conditions (RECs) that may exist as a result of the MC252 event for the
purpose of providing sufficient information regarding the nature and extent of any
potential contamination and to assist in making informed business decisions about the
property; and where applicable, providing the level of knowledge necessary to satisfy the
innocent purchaser defense under The Comprehensive Environmental Response,
Compensation, and Liability Act (CERCLA).
2.1 Background
The subject site is approximately 6.1 acres in size and is vacant property owned by Curtis
W. Murray per online tax assessor land records and is located adjacent to tidally affected
waterways in Lakeshore, Hancock County, MS. Beginning on April 20, 2010, The
Macondo Well Blowout, aka Deepwater Horizon Oil Spill, BP Oil Spill, etc. (MC252),
began releasing heavy crude as a result of control failure until control was regained in

July 2010 and declared sealed in late summer 2010. Moderate oil contamination of the
Lakeshore Beach was confirmed as indicated by Pardue. Concurrent with the MC252
event, two named tropical events occurred in June and July 2010, Hurricane Alex and
Hurricane Bonnie. Consequently, tidal surge inundated the tidal tributaries, marshes, and
adjacent private lands including the subject site located west of the seawall and Beach
Boulevard.
An investigation was conducted at the subject site in 2011 by John Pardue, PHD, PE.
The evaluation was conducted to “assess whether residual oil contamination remained on
these properties and it could be remediated”. Pardue summarized as a result of the
investigation that “Three locations were identified with potential crude oil
contamination.2
Due to the previous investigative results, the property owner requested that a limited
Phase II ESA be conducted to evaluate any potential contamination of the subject site
above Tier 1 TRG’s.
2.2 General Site Description
The subject site (Site) is comprised of approximately 6.1 acres located in Lakeshore,
Hancock County, MS. The site’s legal description is provided in the two Warranty Deeds
in Appendix A. The parcel numbers of the subject site provided by Hancock County
Assessor Geoportal is as follows, 164Q-0-20-017.000, 164Q-0-20-014.000, and 164Q-0-
20-002.000. The site also contains abandoned public rights-of-way.
The site is situated in the area of Lakeshore, MS and is a conglomeration of several
properties. The site is a part of Gulfview Subdivision which consists of numerous
undeveloped properties that appear to have been subdivided without consideration of
landscape constraints and on a strict grid pattern.
The landscape of the site includes tidally influenced waterways, estuarine marsh,
manmade upland, and natural chenier upland, and road and parking area adjacent to the
site on the east. A tidally influenced ditch was excavated many years ago and bisects the
site. Many spoil mounds are located adjacent to the manmade ditches. The site is inland
of a manmade seawall that was constructed along the waterfront to protect Beach Blvd.
from erosion. The seawall is located landward of a manmade beach. The tidal influence
is from Bayou Cadet to the south of the site approximately 0.5 miles. The site’s
elevations generally range from approximately +1’ (subject to mean high tide survey) to
+8’ MSL, and the site periodically experiences exposure to supratidal inundation from
storm generated surge events. Maps and aerial photographs are located in Appendix A.

2.3 Standard of Care
Culpepper and Associates’ services were performed in a manner consistent with
generally accepted practices of the profession undertaken in similar studies in the same
geographical area during the same period of time. Culpeper and Associates, LLC makes
no warranties, either express or implied, regarding the findings, conclusions or
recommendations.
Note that Culpepper and Associates does not warrant the work of laboratories, regulatory
agencies or other third parties supplying information used in the preparation of the report.
These Limited Phase II ESA services were performed in accordance with the Scope of
Work agreed with you, our client, as reflected in our proposal and were not restricted by
ASTM E1903-11.
2.4 Assumptions
Culpepper and Associates assumes the Property has been correctly and accurately
identified by the User.
Culpepper and Associates assumes that the User and any of its designated representatives
used good faith in answering questions about and in obtaining information for the
Property.
This report is not a comprehensive site characterization and should not be construed as
such. Conclusions reached regarding the conditions of the Property do not represent a
warranty that all areas within the Property are of a similar quality as may be inferred from
observable Property conditions and available Property history.
2.5 Reliance
This assessment was conducted on behalf of and for the exclusive use of L and M Land,
LLC. This report, and the findings contained herein, shall not, in whole or part, be
disseminated or conveyed to or used by any other party without the prior written consent
of Culpepper and Associates, LLC
2.6 Limiting Conditions and Methodologies Used
No ESA can eliminate all uncertainty. Furthermore, any sample, either surface or
subsurface, taken for chemical analysis may or may not be representative of a larger
population. Professional judgment and interpretation are inherent in the process and
uncertainty is inevitable. Additional assessment may be able to reduce the uncertainty.
Even when Phase II ESA work is executed with an appropriate site-specific standard of
care, certain conditions present especially difficult detection problems. Such conditions
may include, but are not limited to, complex geological settings, the fate and transport
characteristics of certain hazardous substances and petroleum products, the distribution of
existing contamination, physical limitations imposed by the location of utilities and other
man-made objects, and the limitations of assessment technologies.
Phase II ESAs do not generally require an exhaustive assessment of environmental
conditions on a property. There is a point at which the cost of information obtained and
the time required to obtain it outweigh the usefulness of the information and, in fact, may
be a material detriment to the orderly completion of transactions. If hazardous substance
or petroleum releases are confirmed on a parcel of property, the extent of further
assessment is related to the degree of uncertainty that is acceptable to the User with
respect to the real estate transaction.
Measurements and sampling data only represent the site conditions at the time of data
collection. Therefore, the usability of data collected as part of this Phase II ESA may
have a finite lifetime depending on the application and use being made of the data. An
Environmental Professional should evaluate whether the generated data are appropriate
for any subsequent use beyond the original purpose for which it was collected.
3.0 Field Activities and Methods
Culpepper and Associates, LLC conducted field activities June 22, 29, and July 5, 2016.
Initially, a site visit was conducted to evaluate the site for obvious signs of oil
contamination, to evaluate site characteristics, and to plan the sampling protocol. Upon
completion, the field approach for sample collection was developed. Accessibility was
limited in areas inundated by tidal waters located west of the ditch in the marsh, thus it
was not practicable to sample in much of this area. The remaining portion of the site was
sampled on transects and at 100-foot intervals along those transects where practicable. A
limited number of 27 sample locations were identified along these transects where access
allowed. In areas of restricted access, the sample was relocated to the closest accessible
area. During sampling activities, composite samples were acquired by hand auger at the
27 locations to a depth of 24”. Composite samples were placed in 27 clean glass
containers and subsequently labeled. The samples were given standard care during
possession prior to delivery to the laboratory. Sampling activities and product
descriptions were recorded, sampling sites were marked with pin flags and flagging tape,
and GPS coordinates were recorded at each site. Standard decontamination procedures
were conducted after each sample collection. There were no other sampling plan
deviations.
The 27 samples were delivered to Gulf Coast Analytical Laboratories, LLC of Baton
Rouge, LA for semi-volatiles mass spectrometry (EPA 8270C SIM) and semi-volatiles
gas chromatography (EPA 8015C DRO) analysis as described in the report and chain of
custody located in Appendix C. The laboratory analysis was conducted for diesel range
organic (DRO) compounds and polycyclic aromatic hydrocarbon (PAH) compounds
typically found in petroleum and crude based materials.
4.0 Results
4.1 Observations of Site and Soil Sample Characteristics
The 27 sample sites were located in estuarine wetland, and non-wetland areas. Most
sample sites were vegetated and were covered with various organic leaf litter and/or
detrital matter. An area near the east property boundary contained un-vegetated fill
material. The fill generally is clean fine sandy fill, however some broken asphalt was
observed on the surface in a small limited area. Soil sample locations can be found
presented as Appendix A. The soil lithology observed at the sample sites generally
consists of organics, sand, sand, sandy silt, sandy clay, silt, silty sand, silty clay, clayey
silt, clayey sand, and clay to 24” depth below land surface. The samples ranged from
saturated in wetland areas to dry in upland areas. A majority of the samples contained
some moisture but were not saturated. Redoximorphic features were prevalent in
samples collected from apparent wetland areas. No areas of obvious oiling or
contamination were identified in the field.
4.2 Soil Sample Analytical Results
Soil samples 1 through 27 that were collected as described above were evaluated at
GCAL utilizing semi-volatiles mass spectrometry (EPA 8270C SIM) and semi-volatiles
gas chromatography (EPA 8015C DRO) analysis to quantitatively determine the presence
of PAH and DRO in the samples.
The appropriate benchmark for screening analytical results is the lowest applicable Tier 1
unrestricted TRG’s. GCAL analysis of the soil samples collected at the subject site did
detect the presence of some COC constituents. GCAL analysis of the soil samples
collected at the subject site did not report concentrations of COC’s above TRG’s
published by MDEQ. The GCAL Laboratory Analytical Report is presented as Appendix
C. Summary tables of the GCAL analysis can be found presented as Appendix B.
5.0 Recommendations
This recommendation is based upon the results of the analysis conducted by GCAL of the
27 samples collected at the subject site and screening against MDEQ Tier 1 TRG’s for
unrestricted sites. Due to all samples being below respective TRG’s, no further testing is
recommended. The remediation plan recommended by Pardue should be completed if
not already done so.

SEMI-VOLATILES MASS SPECTROMETRY
In the EPA 8270C SIM analysis, the recoveries for the surrogates are below the lower control limit for sample 21607010315 (SB-15). The sample was re-extracted and re-analyzed with similar recoveries.
In the EPA 8270C SIM analysis, samples 21607010311 (SB-11), 21607010313 (SB-13), 21607010316 (SB-16), 21607010319 (SB-19), 21607010321 (SB-21) and 21607010308 (SB-8) had one surrogate recovery outside control limits in the base-neutral fraction.
