CIGARETTES AND TOBACCO PRODUCTS REMOVED FROM THE DIRECTORY

40 Day Sell-Off Period for Distributors and Wholesalers

Pursuant to Revenue and Taxation Code section 30165.1, subdivision (c)(3)(B), distributors and wholesalers many not purchase, possess, stamp, or sell any cigarette or tobacco product removed from the Directory for more than forty (40) days. (Rev. & Tax. Code, § 30165.1, subd. (c)(3)(B).) Forty (40) days after a brand family is removed from the Directory, the brand family: is contraband; may not be sold, possessed, or purchased; and is subject to seizure, destruction, and other applicable penalties. Furthermore, distributors and wholesalers must provide the Notice of Directory Removal (“Notice”) to each of their existing customers within seven (7) days of receiving any Notice, and distributors and wholesalers cannot sell any cigarettes or tobacco products removed from the Directory to a California retailer unless the retailer has received a copy of the applicable Notice. Pursuant to Revenue and Taxation Code section 30165.1, subdivision (c)(3)(D), retailers cannot possess, transport, or sell any cigarette or tobacco product removed from the Directory for more than sixty (60) days. (Rev. & Tax. Code, § 30165.1, subd. (c)(3)(D).) Sixty (60) days after a brand family is removed from the Directory, the brand family: is contraband; may not be sold, possessed, or purchased; and is subject to seizure, destruction, and other applicable penalties. The list includes the dates each cigarette or tobacco product brand family was removed from the Directory. Using the list below or the applicable Directory Notice also posted on this website, distributors, wholesalers, and retailers can determine whether a brand family is still within the statutory sell-off periods described above.
